The Study on Penal Legislation for Environment under the Background of Development of Western Regions in China

Abstract

Natural conditions, economic structure and other factors, a large number of breeding of environmental crime, a serious impact on China's western development process. In view of the current legislation there is a lack of environmental criminal law, people should build a combination of parochialism and natural Benweizhuyi legislative concept related crime constitutes a change in the proper application of the penalty at the same time actively exploring a wide range of criminal penalties, to strengthen the western region criminal law protection of the environment. Environmental crimes seriously influence the process of the Development of western regions of China, which are multiplied by many factors, such as natural condition and economic structure. Because of the deficiency of existing criminal law about environment, we must construct ideas of legislation that combine human -oriented doctrine with nature-oriented doctrine, and amend relevant structures of crime. While applying penalty properly, we should seek multiple means of penalty in order to strengthen environmental protection of criminal law in the western regions of China
