Beyond Modern International Human Rights

Abstract

Contemporary international protection of Human Rights is characterized by a domination logic which is a legacy of a Modernity - unity via marginalization, denial or annihilation. This domination can be understood as a civilizational domination dynamic, as it is expressed according to three civilizational domination axes. I argue that traditional Brazilian legal scholarship is reified because it lacks the capability to perceive those civilizational domination patterns in pure and practical reasonings of International Human Rights.
