The purpose of this research review is to examine the usefulness of reconstructing problematic interpersonal conflict behavior as violations of rules for critical discussions. Dialectical reconstruction of interpersonal conflict behavior sheds light on the ways in which dialectical fallacies influence not only the course of a critical discussion, but also the personal and relationship outcomes experienced by arguers. Conflict sequences such as cross complaining and demand/withdraw are shown to be problematic, in part, because they prevent parties from resolving (...) their difference through rational dialogue. This contribution discusses some problems of Pragma-Dialectics and explains them by its consensualistic view of the function of argumentation and by its philosophical underpinnings. It is suggested that these problems can be overcome by relying on a better epistemology and on an epistemological theory of argumentation. On the one hand Pragma-Dialectics takes unqualified consensus as the aim of argumentation, which is problematic, (Sect. 2) on the other it includes strong epistemological and rationalistic elements (Sect. 3). The problematic (...) philosophical underpinnings of Pragma-Dialectics, specifically Critical Rationalism as well as Logical Constructivism and Dialogic Logic of the Erlangen School, are among the sources of this incoherence (Sect. 4). The epistemologists Biro and Siegel have raised two objections against the pragma-dialectical approach to argumentation. According to the first objection the pragma-dialectical theory is not genuinely normative. According to the second objection the rejection of justificationism by pragma-dialecticians is unwarranted: they reject justificationism prematurely and they are not consistent in accepting some arguments (‘justifications’) as sound. The first objection is based on what we regard as the misconception that the goal of resolving differences of (...) opinion cannot provide a normative approach. Pragma-dialectics is dynamic, context-sensitive, and multi-agent; it promises theories of fallacy and argumentative structure. But pragma-dialectic theory and practice are not yet fully in harmony. Key definitions of the theory fall short of explicating the analyses that pragma-dialecticians actually do. Many discussions involve more than two participants with different and mutually incompatible standpoints. Success in such a discussion may be more than success against each opponent. Pragma-dialectics does well at analyzing arguments advanced by one (...) party, directed at another party; it does much less well at analyzing arguments directed at several opponents at once or at convincing an audience. I suggest a strategy of construing fallacies as defeasible arguments relying on reasonable default principles but applying them in circumstances in which they are undercut or overridden. (shrink)

This article explains the design and development of the pragma-dialectical approach to fallacies. In this approach fallacies are viewed as violations of the standards for critical discussion that are expressed in a code of conduct for reasonable argumentative discourse. After the problem-solving validity in resolving differences of opinion of the rules of this code has been discussed, their conventional validity for real-life arguers is demonstrated. Starting from the extended version of the theory in which the strategic maneuvering (...) taking place in argumentative discourse is included, the article explains that the violations of the rules that are committed in the fallacies involve derailments of strategic maneuvering. This culminates in a discussion of the exploitation of hidden fallaciousness as an unreasonable way of increasing the effectiveness of argumentative discourse – a vital topic of research in present-day pragma-dialectics. Analytic philosophers have, since the pioneering work of B.K. Matilal, emphasized the contributions of Nyāya philosophers to what contemporary philosophy considers epistemology. More recently, scholarly work demonstrates the relevance of their ideas to argumentation theory, an interdisciplinary area of study drawing on epistemology as well as logic, rhetoric, and linguistics. This paper shows how early Nyāya theorizing about argumentation, from Vātsyāyana to Jayanta Bhaṭṭa, can fruitfully be juxtaposed with the pragma-dialectic approach to argumentation pioneered by Frans van Eemeren. In this article the author develops a framework for a pragma-dialectical reconstruction of teleological argumentation in a legal context. Ideas taken from legal theory are integrated in a pragma-dialectical model for analyzing and evaluating argumentation, thus providing a more systematic and elaborate framework for assessing the quality of teleological arguments in a legal context. Teleological argumentation in a legal context is approached as a specific form of pragmatic argumentation. The legal criteria that are relevant for (...) the evaluation of teleological argumentation are discussed and translated in terms of critical questions that are relevant for the evaluation of the various forms of teleological argumentation. This paper concerns the character of argumentation in inner dialogue, i.e. dialogue that an individual keeps to herself in her own mind. The problem of inner dialogue research is the methodological difficulty connected with its externalization. In the text, the activity of crisis diary-writing is suggested as a way of naturally externalizing inner decision-making. By adopting a pragma-dialectic approach to argumentation, the text attempts to characterize crisis diary-writing as an argumentative activity type. The argumentative characterization of crisis diary-writing involves (...) identifying the institutional point and implemented genre as well as distinguishing the empirical counterparts of the four stages of critical discussion. For illustration, the paper draws its examples from Anne Frank’s Diary. As a result of the characterization achieved in the paper, it is concluded that crisis diary-writing is a conventionalized deliberative activity type preconditioned by implicit norms governing the conduct of argumentation. Each one of the five books authored or co-authored by Frans van Eemeren which have so far been translated into Spanish clearly fulfills a different role. Following the chronological order, we first have Speech Acts in Argumentative Discussions (van Eemeren and Grootendorst 1984; Spanish translation 2013), a book that contains the theoretical spadework in the field of pragmatics on which the whole edifice of pragma-dialectics is erected. Then follows Argumentation, Communication, and Fallacies (van Eemeren and Grootendorst 1992; Spanish translation (...) 2002, 22007), which is the first full presentation of the Standard Theory of Pragma-Dialectics complete with its explanation of fallacies as violations of the rules of critical discussion. In the third place comes my favourite book—Argumentation: Analysis, Evaluation, Presentation (van Eemeren, Grootendorst, and Snoeck Henkemans 2002; Spanish translation, 2006)—a rare combination of sophisticated theory (again, the Standard Theory) tersely an. This paper describes the development of pragma-dialectics as a theory of argumentative discourse. First the development of the pragma-dialectical model of a critical discussion is explained, with the rules that are to be complied with in order to avoid fallacies from occurring. Then the integration is discussed of rhetorical insight in the dialectical framework. In this endeavour, the concept of strategic manoeuvring is explained that allows for a more refined and more profoundly justified analysis of (...) argumentative discourse and a better identification of fallacies. This paper answers the question how pragmatic argumentation which occurs in a legal context, can be analyzed and evaluated adequately. First, the author surveys various ideas taken from argumentation theory and legal theory on the analysis and evaluation of pragmatic argumentation. Then, on the basis of these ideas, she develops a pragma-dialectical instrument for analyzing and evaluating pragmatic argumentation in a legal context. The present paper elaborates a deductivist account of natural language argu-ment in the context of pragma-dialectics. It reviews earlier debates, criticizes some standard misconceptions in the literature, and argues that the identification and analysis of deductive argument schemes can be the basis of a compelling theory of argumentative discourse.

The introduction of the concept of strategic maneuvering into the pragma-dialectical theory makes it possible to formulate testable hypotheses regarding the persuasiveness of argumentative moves that are made in argumentative discourse. It transpires that approaches focusing on dialectical reasonableness are, next to pragma-dialectics, formal dialectics and informal logic; approaches focusing on rhetorical effectiveness are, next to pragma-dialectics, rhetoric and pragmalinguistics, and the informal logician Tindale. When it comes to the relationship between dialectical reasonableness and rhetorical effectiveness, some interest in it is shown in rhetoric and pragmalinguistics, but only in pragma-dialectics and in Tindale’s work is it a real focus. The main difference between Tindale’s view and the pragma-dialectical view is that in pragma-dialectics the decisive role in deciding about reasonableness is assigned to a code of conduct for reasonable argumentative discourse and in Tindale’s approach this role is assigned to Tindale’s interpretation of the Perelmanian universal audience. The introduction of the concept of strategic maneuvering into the pragma-dialectical theory makes it possible to formulate testable hypotheses regarding the persuasiveness of argumentative moves that are made in argumentative discourse. After summarizing the standard pragma-dialectical approach to argumentation, van Eemeren, Garssen, and Meuffels explain what the extension of the pragma-dialectical approach with strategic maneuvering involves and discuss the fallacies in terms of the extended pragma-dialectical approach as derailments of strategic maneuvering. This paper serves as an introduction to the special issue on argumentative patterns in discourse, more in particular on argumentative patterns with pragmatic argumentation as a main argument that are prototypical of argumentative discourse in certain communicative activity types in the political, the legal, the medical, and the academic domain. It situates the studies of argumentative patterns reported in these papers in the pragma-dialectical research program. In order to be able to do so, it is first explained in (...) which consecutive stages the pragma-dialectical theorizing has developed, what the study of argumentative patterns involves, and why the identification of argumentative patterns represents a vital stage in the development of pragma-dialectics. The description of the theoretical innovations that are introduced and the exposition of their relationship with the standard and extended pragma-dialectical theory create a conceptual and terminological framework for understanding the background and the rationale of the current research projects. The overall goal of this paper is to show that computational modelling of argumentation theories is a useful tool to deepen them. Specifically, it provides a basic computational formalization of part of Pragma-dialectics’ model of a critical discussion, which serves as a basis for analyzing this influential theory of argumentation. Such analysis reveals some weaknesses and leaves some questions opened for Pragma-dialectics. Particularly, it shows that the model of a critical discussion is not independent of the model (...) of reasoning/inference chosen, because, while it performs differently with different models of reasoning, it does not work well with some of them. This paper investigates the tentative compatibility of two pragmatic approaches, Pragma-Dialectics and Relevance Theory. The development of pragmatics historically led to conceptions of communication that supplied answers formal logic approaches had trouble capturing. Within argumentation studies, PD took this pragmatic turn while at the same time pursuing a normative agenda. This gives evidence of an external approach to language excluding, though not closing the door to cognitive insights. The purpose of this paper is to discuss the extent to (...) which PD can operate from an internal cognitive perspective — i.e., with explicit ambitions of dealing with cognitive mechanisms of meaning construction and belief fixation. In ‘The Making of Pragma-Dialectics: A Synopsis’ the authors give an overview of the pragma-dialectical argumentation theory. First they characterize the five components of the research program: critical rationalistic philosophy, pragma-dialectical theory, qualitative and quantitative empirical research, resolution-oriented reconstructive analysis, reflection-minded practical intervention. Then they explain the four metatheoretical principles underlying the pragma-dialectical research: functionalization, socialization, externalization, and dialectification. Next the various phases in the systematic development of pragma-dialectics in the (...) past 50 years are described: (1) conceptualization of the theoretical framework, (2) validation of the theoretical proposals, (3) empiricalization of the research efforts, (4) instrumentalization of the reconstructive analysis, (5) extension of the standard theory, (6) contextualization of the extended theory. What does it mean to convince? In the pragma-dialectical theory of argumentation, convincing is done by arguments. The perlocutionary act of convincing is fundamentally related to the illocutionary act of arguing. I propose a critical reassessment of this relationship. The arguing-convincing pair presents conceptual difficulties, I argue, both in the pragmatic description based on felicity conditions and in the dialectical one based on intersubjective procedures. To tackle these problems, I develop a proposal that takes the speakers’ (...) non-verbal interaction with evidence, as opposed to their verbal interaction with one another, as the basis for understanding the resolution of differences of opinion. The proposal is compatible with the pragma-dialectical theory, provided some methodological adjustments are conceded. (shrink)

The paper reacts against the strict separation between dialectical and rhetorical approaches to argumentation and argues that argumentative discourse can be analyzed and evaluated more adequately if the two are systematically combined. Such an integrated approach makes it possible to show how the opportunities available in each of the dialectical stages of a critical discussion have been used strategically to further the rhetorical aims of the speaker or writer. A major virtue of the Pragma-Dialectical theory of argumentation is its commitment to reasonableness and rationality as central criteria of argumentative quality. However, the account of these key notions offered by the originators of this theory, Frans van Eemeren and Rob Grootendorst, seems to us problematic in several respects. In what follows we criticize that account and suggest an alternative, offered elsewhere, that seems to us to be both independently preferable and more in keeping with the (...) epistemic approach to arguments and argumentation we favor. In this book two of the leading figures in argumentation theory present a view of argumentation as a means of resolving differences of opinion by testing the acceptability of the disputed positions. Their model of a 'critical discussion' serves as a theoretical tool for analysing, evaluating and producing argumentative discourse. They develop a method for the reconstruction of argumentative discourse that takes into account all aspects that are relevant to a critical assessment. They also propose a practical code of (...) behaviour for discussants who want to resolve their differences in a reasonable way. This is a major contribution to the study of argumentation and will be of particular value to professionals and graduate students in speech communication, informal logic, rhetoric, critical thinking, linguistics, and philosophy. I argue that the logical perspective—the study of arguments as products—is not well integrated into pragma-dialectics. I show that the Validity Rule and the Argumentation Scheme Rule, despite being procedural rules, are, in a certain sense, “logical” rules. Subsequently, I distinguish and review three successive periods in the development of the logical dimension of pragma-dialectics: conventionalist, inferentialist and dualist, to reveal that none of them is completely satisfactory. I contend that, given the assumptions and conceptual apparatus of (...) class='Hi'>pragma-dialectics, the integration of the logical perspective, and especially of a suitable account of counterargumentation, requires the adoption of a conception of logic as a theory of reasons, as opposed to the traditional conception of logic as a theory of inferences. Understanding logic as a theory of the dialogical construction of reasons enables us to approach the study of the relationships between arguments and the weighing of opposing arguments. (shrink)

This paper adopts a pragma-dialectic approach to explore inclusion in real-world argumentation. Having outlined theories of deliberative democracy—focussing on Habermas’s discourse model—and pragma-dialectic methods for analysing argumentative exchanges in the real world, we then relate them. From this we identify the potential for using the enhanced detail of pragma-dialectic analysis to constructively understand dynamics of inclusion in the political decision processes of central concern to deliberative democratic theories.In the remainder of the article we illustrate this potential with (...) our own pragma-dialectic analysis of an instance of real-world argumentation in a political policymaking process—a deliberative forum in the contentious field of mental health. The detail afforded by the pragma-dialectic method allows us to more clearly identify the complex layers and dynamics of argument involved in these policy deliberations, allowing insights into mechanisms for inclusion in deliberations, relative to the parties to such deliberations, their roles and competing interests and perspectives.By relating the two fields of deliberative democratic theory and pragma-dialectics this article aims to develop their complementary potential—in particular by suggesting, and briefly illustrating—how pragma-dialectic methods might enhance analysis of the dynamics of argumentation in political policymaking processes, in particular as an aid to constructive reflection on those processes by theorists and participants together. Virtue argumentation theory focuses on the arguers’ character, whereas pragma-dialectics focuses on argumentation as a procedure. In this paper I attempt to explain that both theories are not opposite approaches to argumentation. I argue that, with the help of some non-fundamental changes in pragma-dialectics and some restrictions in virtue argumentation theory, it is possible to regard these theories as complementary approaches to the argumentative practice.

This article reviews Frans H. van Eemeren’s Argumentation Theory: A Pragma-Dialectical Perspective.

In this paper, the author develops an instrument for the rational reconstruction of argumentation in which a judicial decision is justified by referring to the consequences in relation to the purpose of the rule. The instrument is developed by integrating insights from legal theory and legal philosophy about the function and use of arguments from consequences in relation to the purpose of a rule into a pragma-dialectical framework. Then, by applying the instrument to the analysis of examples (...) from legal practice, it is demonstrated that the instrument can offer a heuristic and critical tool for the analysis and evaluation of legal argumentation that can ‘bridge’ the gap between more abstract discussions of forms of legal argumentation on the one hand, and legal arguments as they occur in actual legal practice on the other hand.
