The human relation to things in the world is at stake in the so-called post-humanist era where the distinction between human and non-human is blurred, as indicated in a term like ‘the nano-self’. How should we understand the nature of our relation to things in this era? Or how can we describe an educationally meaningful relation we as human agents can make in relation to things, artificial and natural, in the face of this technologically hybrid and ever-dehumanizing tendency of society? Well-known for his actor-network theory, Bruno Latour, an influential materialist and philosopher of technology, says that ‘objects’ have agency as much as humans; so we need to be able to translate the language of things into the language of men or vice versa as a way of co-shaping the world we live in. What does this mean and how can we do so? In carefully examining his theory, the essay attempts to explore and reformulate his account of the mediating role of human agency to see if it can provide us with an educationally plausible post-humanist concept of human agency, which can lead us into an ecologically ethical and politically responsible approach to education in general, and science education in particular. Even though the relevance of business actors in peace processes is increasingly acknowledged, analysis of their particular roles and contributions remain sparse in peace mediation literature. This is despite the fact that such knowledge would be highly relevant for supporting mediation processes such as those ongoing in Colombia or the Philippines. This article looks at the involvement of business actors in mediation processes by tracing analysis along the entry points for involvement, the different roles that business actors can play and (...) the limitations they face. The empirical data shows that business actors mainly play a role during the pre‐ and mediation phase and therein often as a support‐giver to the mediation process. Furthermore, most of the involvement does not take place at track‐1 level but rather at track‐2 mediation processes, where mainly local business play an important role. In contrary to what is postulated by some of the literature, the relevance of utilitaristic motives is not problematic; rather a monetary motivation can also foster the credibility in a political process where a lot is at stake. Performance Generating Systems (PGS) are rule- and task-based approaches to improvisation on stage in theatre, dance, and music. These systems require performers to draw on predefined source materials (texts, scores, memories) while working on complex tasks within limiting rules. An interdisciplinary research team at a large Western Canadian university hypothesized that learning to sustain this praxis over the duration of a performance places high demands on executive functions; demands that may improve the performers’ executive abilities. These performers need to continuously (...) shift attention while remaining responsive to embodied and environmental stimuli in the present, they are required to inhibit automated responses and impulses using the rules of the system, and they strive towards addressing multitasking challenges with fluidity and flexibility. This study set out to test the mentioned hypothesis deductively and identify mediating processes inductively, using mixed empirical methods. In a small sample experiment with a control group (28 participants; 15 in intervention group, 13 in control group), standardized quantitative tests of executive functions (D-KEFS) were administered before and after an eight-week intervention. Participant-reported qualitative observations from the praxis were also collected throughout the intervention for grounded analysis. Within the limitations of small sample data, we found both statistically significant and trending effects on inhibition, problem-solving initiation, fluidity, and cognitive flexibility. Examining the mediating process, we found that participants experienced significant challenges sustaining the practice halfway through the intervention. The participant-reported solutions to these challenges, which emerged as the strongest behavioural patterns when coding the qualitative data to saturation, were strategies of problem-solving and of re-directing attention. These strategies support and advance our understanding of the effects measured in the standardized tests. In terms of application, our results identify characteristics of PGS that could potentially maintain and strengthen executive functions over and above less demanding performing arts interventions. The results also deliver new insight into how PGS works, which may contribute to the development and teaching of this artistic practice. (shrink)

In a recent, currently unpublished, research project that sought to examine the meaning and enactment of ethical nursing practice across a variety of clinical settings, the significance of moral identity was highlighted. This article describes the findings and illuminates how the moral identities of the nurse participants arose and evolved as they navigated their way through the contextual and systemic forces that shaped the moral situations of their practice. Despite accumulated evidence from previous studies that green creativity is highly emphasized in various industries, limited research has been conducted in the context of public sectors. Drawing on the dynamic componential model of creativity and innovation in organizations, this paper aims to propose and sequentially test the relationship between green training and employees’ green creativity through green values and green intrinsic motivation. Based on the data collected in Chinese public sectors at two different time points, the results indicate that green (...) training is positively related to green creativity. Moreover, this relationship is sequentially mediated by green values and green intrinsic motivation. The results in our study advance the emergent literature on green human resource management in the public sector for the practical applications of training and creativity in terms of green management. Mediator is a coregulatory complex that plays essential roles in multiple processes of transcription regulation. One of the human Mediator subunits, MED26, has a role in recruitment of the super elongation complex (SEC) to polyadenylated genes and little elongation complex (LEC) to non‐polyadenylated genes, including small nuclear RNAs (snRNAs) and replication‐dependent histone (RDH) genes. MED26‐containing Mediator plays a role in 3′ Pol II pausing at the proximal region of transcript end sites in RDH genes through recruitment of Cajal bodies (CBs) (...) to histone locus bodies (HLBs). This finding suggests that Mediator is involved in the association of CBs with HLBs to facilitate 3′ Pol II pausing and subsequent 3′‐end processing by supplying 3′‐end processing factors from CBs. The underlying mechanisms of the effectiveness of mindfulness-based interventions for emotional well-being remain poorly understood. Here, we examined the potential mediating effects of cognitive reactivity and self-compassion on symptoms of depression, anxiety and stress using data from an earlier randomised controlled school trial. A moderated time-lagged mediation model based on multilevel modelling was used to analyse the data. The findings showed that post-treatment changes in cognitive reactivity and self-coldness, an aspect of self-compassion, mediated subsequent changes in symptoms of depression, (...) anxiety and stress. These results suggest that cognitive reactivity and self-coldness may be considered as transdiagnostic mechanisms of change of a mindfulness-based intervention programme for youth. (shrink)

Burnout was recently declared by WHO as an “occupational phenomenon” in the International Classification of Diseases 11th revision, recognizing burnout as a serious health issue. Earlier studies have shown that feelings of guilt appear to be involved in the burnout process. However, the exact nature of the relationships among burnout, guilt and psychosomatic disorders remains unclear. The purpose of this study was to investigate the mediator role of feelings of guilt in the relationship between burnout and psychosomatic disorders, and (...) perform a cross-cultural validation of the multi-dimensional model by Gil-Monte in two samples of teachers. The study sample was composed of 1,266 teachers, 1,062 from Spain, and 204 from Portugal. Burnout was measured by the Spanish Burnout Inventory. Hypotheses were tested together in a path model. The results obtained provide empirical evidence for the mediator role of guilt in the relationship between the Burnout syndrome and psychosomatic disorders in the sample of teachers from Spain and Portugal, and they contribute to the empirical validation of the model by Gil-Monte. The results indicate that guilt should be incorporated as a symptom of burnout in order to identify individuals affected by burnout and profiles or types of burnout to differentiate it from other pathologies like depression. In the contemporary world, frugal innovation is the most discussed area to enhance corporate sustainable performance in manufacturing firms. The knowledge management process is also a key determinant of FI. Existing literature is limited to knowledge management and its impact on CSP. This study aims to determine the effect of the KMP on sustainable corporate performance with the association of FI. The survey method was used to collect data from 356 small and medium enterprises in China. Structure equation modeling (...) was applied to obtain the results of collected data. Results show that all three dimensions of KM have a significant impact on CSP. Furthermore, FI also has a significant and positive impact on CSP. Results further show that FI partially mediates the relationship of the knowledge dissemination, knowledge application and sustainable corporate performance but no mediation role FI was found between knowledge acquisition and CSP. The findings of this study will provide useful insights for experts and manufacturers. It will help to understand the role of KM in their organizational behavior by being an economical manufacturing process. This study underscored the importance of the KMP to policymakers. In countries such as China that have global orders, KM is an essential determinant of FI. KM is a tool used to achieve CSP goals inside and outside of an enterprise, thus the development firms need to focus on KM. (shrink)

The study of ethical leadership has emerged as an important topic for understanding the effects of leadership in organizations. In a study with 845 working adults across multiple organizations, the relationships between ethical leadership with positive employee outcomes were examined. Results suggest that ethical leadership is related to both psychological well-being and job satisfaction in employees, but the processes are different. Employee voice mediated the relationship between ethical leadership and psychological well-being. Feelings of psychological ownership mediated the relationship between ethical (...) leadership and job satisfaction. A discussion of theoretical and practical implications concludes the article. An alternative to Aggleton & Brown's interpretation is presented suggesting that the perirhinal cortex and hippocampus mediate different attribute information, but use the same processes, supporting the idea of parallel processing based on attribute (visual object and spatial location) rather than process characteristics (item recognition and familiarity).

In many disciplines, mediating processes are usually investigated with randomized experiments and linear regression to determine if the treatment affects the outcome through a mediator. However, randomizing the treatment will not yield accurate causal direct and indirect estimates unless certain assumptions are satisfied since the mediator status is not randomized. This study describes methods to estimate causal direct and indirect effects and reports the results of a large Monte Carlo simulation study on the performance of the ordinary regression and (...) modern causal mediation analysis methods, including a previously untested doubly robust sequential g-estimation method, when there are confounders of the mediator-to-outcome relation. Results show that failing to measure and incorporate potential post-treatment confounders in a mediation model leads to biased estimates, regardless of the analysis method used. The article investigates the mechanisms shaping a new quality of social development in contemporary Russia amidst growing societal challenges. Four key mechanisms are explored: mediation, social dialogue, polysubjectivity, and convergence. These are analyzed for their role in fostering novel forms of social integration and development. The mechanisms serve as tools for studying and shaping the current interplay between tradition and innovation, cultural stasis and social dynamics across various sociocultural contexts and transitional processes. Notable contributions include V.A. Lektorsky’s concept of “the supra-individual as social universality,” which advances our understanding of socio-individual meaning formation and transcends the individual-society dichotomy. A.A. Auzan’s analysis of the dual-core structure of Russian culture aptly captures the unique challenges of social development in Russia. O.V. Aksenova’s examination of the contradictory nature of social action subjects in an increasingly technologized society illuminates the complexities of balancing freedom with necessity, and uniformity with diversity in social action. V.M. Rozin’s approach is considered for its potential to facilitate mediational social dialogue in Russian society. The author argues that neither the individualistic nor the collectivist cores of Russian culture can independently drive effective modernization. Instead, the concept of convergence is proposed as a means to transcend the extremes of ego-individualism and totalitarian collectivism. Three primary directions for implementing convergent strategies are identified: synthesizing individual and social aspects in social action and dialogue, optimizing center-periphery interactions in governance, and developing public-private partnership models as a form of economic convergence. The study emphasizes the need for new forms of social integration and concludes that Russia’s sustainable social development requires an integrative socio-individual model, combining elements of individual freedom and collective solidarity. The significance of mediatization in countryside settings is an under-researched topic in media studies. In this paper, based on qualitative fieldwork carried out in two rural areas in Sweden, we study how mediatization integrates the prospects of cosmopolitan social change. The current phase of the mediatization process, which imposes a more dynamic register of networked communication, nourishes a new type of cosmopolitan identity in the countryside. As shown in the study, this development is constituted by complex configurations of different (...) forms of mobility and connectivity. We argue that these spatial processes are socially structured, meaning that certain social groups are better equipped, through the appropriation of network capital, for turning cosmopolitan dispositions into a transformative resource, a ‘cosmopolitan politics of place’. Many studies showed that comprehenders monitor changes in protagonists’ emotions and actions. This article reports two experiments that explored how focusing comprehenders’ attention on a particular property of the protagonist dimension affects the accessibility of information about target objects mentioned in the sentence. Furthermore, the present research examined whether participants’ attitudes toward the issues described in the sentence can modulate comprehension processes. To this end, we asked participants to read sentences about environmental issues that focused comprehenders’ attention on different mental (...) and physical attributes of the same entities and then self-report their own thoughts on the topic of environment by responding to the items assessing their environmental awareness. Importantly, we manipulated the task requirements across two experiments by administering a self-report task, which required the participants to rate the seriousness and the frequency of the problem mentioned in a sentence; and administering a sentence-picture verification paradigm, which required the participants to merely indicate if the object depicted in the picture was mentioned in the preceding sentence. The results of these experiments suggest that the focus of a sentence on the environmental problem enhances the accessibility of information about environmental issues ; that the comprehender’s level of environmental awareness influences one’s attention during sentence processing; and that comprehender characteristics significantly modulate comprehension processes only when the measures tap into explicit processes. As a part of job resources, work time control is essential for innovation. We examine how work time control impacts knowledge employees’ innovation in the workplace. A two-stage study was conducted to verify the mediating and moderating processes. In Study 1, adopting the job demands–resources model as a theoretical framework, we conducted a laboratory test to find the relation between work time control, job engagement, job burnout, and innovation, and verified the path between work time control and innovation. Study 2, drawing on the job demands–resources model verified by Study 1 and self-regulation theory, it is proposed that during the psychological process in the workplace, job engagement plays a mediating role, and the vocational delay of gratification plays a moderating role between work time control and innovation. A total of 254 knowledge employees from diverse organizations participated in the survey study. After taking demographic variables, job demands, and neuroticism as control variables, the results showed that job engagement would mediate the relationship between work time control and innovation. A higher level of delay of gratification buffered the effect of a higher level of work time control on innovation. All these findings verified and expanded knowledge on work time control and innovation literature, showing that work time control is important for innovation. Based on Chinese cultural background, managers should offer employees the opportunity to conduct self-control training and encourage them with great freedom to foster employee innovation. (shrink)

Loneliness has been described as endemic among young people. Such feelings of social isolation ‘even in a crowd’ are likely linked to adverse early life experiences that serve to diminish perceptions of social support and intensify negative social interactions. It was suggested in the present series of survey studies that childhood abuse, which compromises a child’s sense of safety in relationships, may affect social processes that contribute to loneliness in young adulthood. Study 1 assessed different adverse childhood and adult experiences (...) in relation to loneliness among young adults. Linear regression analyses indicated that childhood abuse was uniquely associated with greater loneliness, and this relationship was partially mediated by the perceived availability of social support. Study 2 assessed different forms of childhood abuse and demonstrated that early life emotional abuse was a unique predictor of loneliness, and this relationship was fully mediated by lower perceived support or value in social connections and more frequent unsupportive interactions with friends. Study 3 evaluated the implications of the age of occurrence of abuse. Both emotional and sexual abuse predicted young adult loneliness regardless of age; abuse that was recalled to have occurred at very early ages was not predictive of loneliness over and above consideration of events that happened in older childhood. These relationships were at least partially mediated by perceived social support, social connectedness, and in the case of emotional abuse, unsupportive interactions with friends. Our results add to mounting evidence pointing to the prevalence of loneliness among young adults and the links to adverse early life experiences that may serve to shape appraisals of safety, value, and personal worth in social relationships. With the rising influence of digitalization and its immense penetration intoeven everyday life, the last decade of the 20th Century addressed to a critical threshold in the successive transformation process of the spatiality in its long-term run. The advanced digital technologies of ubiquitous computing and generative design, as well as the invention of smart materials in late 90’s have all provoked the fluid characteristics of spatiality, and strengthen the transformative capacities of the architectural space through the emergence of computer-augmented (...) territories. Additionally, while they are becoming as the body extensions, the advent of novel apparatuses and gadgets further enhanced the inte- gration of the corporal and incorporal bodies with the spatio-temporal multiplicities, where the hyperdimensionality of the space has been triggered to its outmost range, in relation to the “soft and smart technologically augmented immanent millieu”, in Spuybroek terms. Thus, like Spuybroek points out as the “haptonomist” presence of the body merges itself with these diverse bodily extensions on one hand; and on the other hand, as the rising influence of nomadic view of the world further stimulates the unboundedness and endless fluidity of space, so that the spatiality becomes a landscape of successive transformations, a topology of emergence or a plane of becoming, which is merely defined by lines of forces, and occures as an alive territory rather than a limited space of predefined boarders. Therefore, this evolvable territory which is affectable and being affected by the lines of forces –inner and outer forces–, emerges as an animated existence, an interactive organism. So, by interacting with the Deleuzian Philosophy and their notions like lines of forces, folding, becoming, smooth space, territory, spatium, this article aims to reveal the relevance of these notions in architectural discourse, as well as the emergence of the smooth space in the contemporary architectural practice, by magnifiying one of the very initial examples of its kind; in terms of unfolding the Fresh Water Pavilion of NOX Architecture by Lars Spuybroek into question to reveal the essences of thecontemporary transformable-evolvable architectural spatiality. Second language listening is a common challenge for language learners. It remains largely unknown how bilinguals process L2 listening. The literature has suggested an interactive model of L2 listening processing. However, few studies have examined the model from an experimental approach. The current study tried to provide empirical evidence for the interactive model of L2 listening processing in bilinguals by exploring the relationships among English spoken word segmentation, cognitive inhibition, cognitive flexibility, and L2 listening proficiency. The results showed positive (...) associations among SWS, cognitive inhibition, cognitive flexibility, and L2 listening proficiency. Mediation analysis suggested that SWS might have a positive influence on L2 listening proficiency both directly and indirectly through cognitive inhibition and cognitive flexibility, respectively. These results imply that both bottom-up and top-down processes are engaged in bilinguals’ L2 listening processing. (shrink)

The aim of this article is to contribute to the discussion surrounding mediatization by presenting some arguments on how we could include questions of media specificity in an appropriate way. The core argument is that we have to do this by integrating `media specificity' into a theory of communicative practice or action. In doing so, we can grasp media in their institutional and technological sense as `molding force' of communicative action and research them empirically as part of mediatization processes.

Luthra, Peraza-Santiago, Beeson, Saltzman, Crinnion, and Magnuson (2021) present data from the lexically mediated compensation for coarticulation paradigm that they claim provides conclusive evidence in favor of top-down processing in speech perception. We argue here that this evidence does not support that conclusion. The findings are open to alternative explanations, and we give data in support of one of them (that there is an acoustic confound in the materials). Lexically mediated compensation for coarticulation thus remains elusive, while prior data from (...) the paradigm instead challenge the idea that there is top-down processing in online speech recognition. In his article In Between Us, Yoni van den Eede expands existing theories of mediation into the realm of the social and the political, focusing on the notions of opacity and transparency. His approach is rich and promising, but two pitfalls should be avoided. First, his concept of ‘in-between’ runs the risk to conceptualize mediation as a process ‘between’ pre-given entities. On the basis of current work in postphenomenology and actor-network theory, though, mediation should rather be seen as the (...) origin of entities, not as an intermediary between them. Second, Van den Eede’s separate discussion of transparency and opacity in ‘use’ and in ‘context’ runs the risk to make invisible the complementarity of the two dimensions. While transparency of use embodies an experiential form of the distinction between transparency and opacity, transparency of context embodies a more cognitive dimension of the distinction. Only by linking the two it becomes possible to take responsibility for the impact that technological mediations can have. Users and designers need a ‘double vision’ to simultaneously see the transparency of both use and context. (shrink)

In man-machine communication, there is a relationship between what may be described as tacit (human) and explicit (machine) knowledge. The tacit lies in practice and the explicit in the formulation of the processes and content of this practice. However, when a human communicates with another human face to face, we may describe them as communicating aspects of the tacit and explicit dimension of their knowledge, i.e. the expression and its background of meaning for the particular situation. When this is unsuccessful (...) in being communicated, some mediator (not necessarily a third person) is needed to provide the bridge for the particular discrepant aspects of the tacit and explicit dimensions to meet. This is achieved by making the tacit nature of the discrepancy in the communication explicit to both participants such that they both understand the background to their discrepancy. This research examines the impact of blockchain intelligent contracts on the arbitration rate and the mediator's function of settling disputes in supply and logistics contracts. The quantitative approach for the study and the involvement of 202 legal professionals acquainted with blockchain, the investigation explores the relationships of using smart contracts, trust, and speed of the arbitration process. The research results show that using smart contracts based on blockchain technology significantly improves the arbitration process's speed, efficiency, and transparency and (...) strengthens the parties' trust. The cognitive model for social anxiety disorder highlights the role of safety behaviors and post-event processing. We identify the serial mediating effect of state and trait PEP between three types of safety behaviors and social anxiety. Given that the associations between the three subtypes of safety behaviors and two perspectives of PEP have not yet been examined, we aimed to investigate these relationships according to the level of social anxiety. A total of 487 participants participated in an online survey. (...) Participants were classified into two groups, high and low, based on their social anxiety scores. We used Social Behavior Questionnaire to distinguish three types of safety behaviors and the State and Trait versions of the Post-Event Processing Inventory to identify two perspectives of PEP. We used descriptive statistics and an independent t-test to compare the high and low social anxiety groups. Mediation effects were examined using mediation analysis and bootstrapping with 5,000 replications. The results showed that the three safety behaviors had different effects on social anxiety via PEP. In the high social anxiety group, avoidance behavior and anxiety-symptom control predicted social anxiety positively, whereas impression management did not. However, with state PEP and trait PEP as mediators, impression management and avoidance behavior positively predicted social anxiety but not anxiety-symptom control. In the low social anxiety group, only avoidance behavior was significantly related to social anxiety, but when the state and trait PEP were mediated, the effect disappeared. These results indicated that impression management could affect social anxiety only when mediated by PEP in people with high social anxiety. A better understanding of the content and processes underpinning safety behavior and PEPs might have important implications for the prevention and treatment of social anxiety disorder. (shrink)

Semiotics of mediation is based on comparative analysis of mediation processes, on typology of forms of mediation and on the subsequent complementary analysis of culture. Not only does cultural analysis that is based on semiotics of mediation proceed from communication processes, it also searches for possibilities of correlation between concepts of describability, analysability, translatability. Depending on the strategy of mediation semiotics it is possible to create an overview of the main parameters of cultural analysis and to specify the boundaries of (...) semiotic analysis of culture. The main types of mediation are simultaneously parameters of cultural analysis. The main types include autocommunicative mediation, metalingual mediation, intertextual mediation, interdiscursive mediation, and inter- or transmedial mediation. Typology of mediation types facilitates the understanding of the autocommunicative aspect of culture and creates the basis for analysing communication processes not on the level of the immediate sender and receiver but as part of the culture’s communication with itself. Semiotics of mediation starts from semiotic mediation and ends with a culture of mediation in which one and the same cultural language or text operates as a means of dialogue with itself, as a means of communication with others, as part of some textual system or discourse, or as a transmedial phenomenon. Semiotics of mediation is a means of studying the correlation between implicit semiotic mediation and forms of explicit semiotic mediation, thus complementing cultural semiotic study of culture. We develop a framework for understanding how lack of clarity in business press coverage of corporate social responsibility functions as a mediated and emergent form of strategic ambiguity. Many stakeholders expect CSR to exhibit clarity, consistency, and discursive closure. But stakeholders also expect CSR to conform to varying degrees of both formal and substantive rationality. These diverse expectations conflict with each other and change over time. A content analysis of press coverage in Denmark suggests that the business media reflect and (...) amplify the ambiguity generated by these shifting demands. We propose that this very public lack of discursive closure provides strategic advantages to CSR stakeholders by rendering the concept of CSR adaptable, resilient, and meaningful to diverse interests. From this perspective, strategic ambiguity emerges from a relational and mediated process, not from the direct intentions of individual stakeholders. Our framework suggests that CSR is best understood not as a clear or consistent agenda, but rather as a forum for sensemaking, diversity of opinion, and debate over the conflicting social norms and expectations attached to corporate activity. A central question in online human sentence comprehension is, “How are linguistic relations established between different parts of a sentence?” Previous work has shown that this dependency resolution process can be computationally expensive, but the underlying reasons for this are still unclear. This article argues that dependency resolution is mediated by cue‐based retrieval, constrained by independently motivated working memory principles defined in a cognitive architecture. To demonstrate this, this article investigates an unusual instance of dependency resolution, the processing of (...) negative and positive polarity items, and confirms a surprising prediction of the cue‐based retrieval model: Partial‐cue matches—which constitute a kind of similarity‐based interference—can give rise to the intrusion of ungrammatical retrieval candidates, leading to both processing slow‐downs and even errors of judgment that take the form of illusions of grammaticality in patently ungrammatical structures. A notable achievement is that good quantitative fits are achieved without adjusting the key model parameters. (shrink)

Cells utilize diverse organelles to maintain homeostasis and to respond to extracellular stimuli. Recently, multifaceted aspects of organelle stress caused by various factors have been emerging. The endosome is an essential organelle, functioning as the central hub for membrane trafficking in cooperation with the ubiquitin system. However, knowledge regarding endosomal stress, which refers to organelle stress of the endosome, is currently limited. We recently revealed ubiquitin‐mediated endosomal stress of early endosomes (EEs) and its responsive signaling pathways. These findings shed light (...) on the relevance of ubiquitin‐mediated endosomal stress to physiological and pathological processes. Here, we present a hypothesis that ubiquitin‐mediated endosomal stress may have significant roles in biological contexts and that ubiquitin‐specific protease 8 is a key regulator of ubiquitin clearance from EEs. Mediation in a legal sense is a means of alternative dispute resolution (ADR). Having evolved in the USA in the last half of 20th century the procedure is growing in popularity and proliferation all over the world. Many countries enacted particular legislation, and others included relevant articles into Civil and/or Criminal Procedure Codes. Howbeit, lawyers are to be aware of mediation and roles they may play within the process. Law school curriculum drafters face the challenge of including a new (...) up-to-date course in mediation into busy and very full academic programmes. Analysis of existing instructing practice showed that in Anglo-American law schools mediation teaching is a part of clinical legal education. As for European countries, there is a broad range of scenarios and no established experience. Recognition of communicative skills as key skills for mediators prompts the use of a CLIL approach in structuring such a course. Listening, reframing, summarising, questioning are skills to be mastered by law-students both in a foreign language and their mother tongue. Language teachers are in charge of this part of the course while law teachers can work out text contents built on the branches of law mediators deal with more often (family law, employment law, contracts, etc.). Moreover, some texts may cover mediation law in a home country and abroad. Another important factor to take into account is a career path chosen by a law-student – if s/he is going to become a mediator or a lawyer securing clients in mediation. Role plays and scenarios are an integral part of the course. Moreover, the course developed can serve as an introduction to internship in a law clinic. (shrink)

Mediation is an alternative dispute resolution process that is becoming more and more popular particularly in English-speaking countries. In contrast to traditional litigation it has not benefited from technological advances and little research has been carried out to make this increasingly widespread practice more efficient. The study of argumentation in dispute mediation hitherto has largely been concerned with theoretical insights. The development of argumentation theories linked to computational applications opens promising new horizons since computational tools could support mediators, making (...) sessions quicker and more efficient. For this, we need tools for close analysis of mediation discourse in order to explore the argumentative activity in depth, and ultimately get an accurate image of how dialogues unfold in this particular context. This paper therefore aims at laying the foundations of a theory of close analysis for discourse in dispute mediation. Theories provided by the literature serve as a basis for argumentative analyses of transcripts of mediation sessions in order to deliver a clear image of the argumentative structure. Analyses of the argumentative strategies in mediation discourse will allow for the development of a dialogue protocol that can be used to develop operational models which can be embodied in software to help make the mediation process easier and more effective. Using matched four-stage data from 477 team members and their 132 team leaders in Chinese companies, we examined a cross-level model in which group- and individual-focused transformational leadership and their influence on team and member performance from the perspective of multilevel model of motivation in teams. The results indicated that group-focused TFL exerts positive effects through sequential mediation of team efficacy and team process whereas individual-focused TFL has a positive effect on team members' performance through sequential mediation of followers' (...) self-efficacy and individual regulation process. In addition, we also find significant cross-level mediation effects demonstrating that group-focused TFL was positively related to self-efficacy through the mediator of team efficacy, team efficacy was positively related to the individual regulation process through the mediator of the team process, team process was positively related to individual performance through the mediator of the individual regulation process. This paper presents an empirical account of mediatization from a Bourdieuian perspective, based on the development of a number of new concepts, such as cross-field effects and the rescaling of such effects as linked to processes of globalization. Built on an Australian empirical case relating to educational policy and the knowledge based economy, this paper argues that mediatization can be understood in relation to the cross-field effects of different fields of journalism on subsequent fields, which have their genesis in forms (...) of practice that cross different social fields. Specifically, the case analysis details interactions between the field of print journalism and the field of policy over the course of an Australian science capability review, chaired by the then chief scientist, Dr Robin Batterham, which led to Australia adopting a national version of the knowledge economy. The empirical case also leads us to consider the impact of both global and national fields of journalism on fields of educational policy in relation to mediatization. (shrink)
