Harmony, as one of the widespread terms of ancient Greek mythology and one of the key notions, as well as the basic methodological principle of ancient Greek Philosophy is analyzed. The mosaicity of philosophical ideas as for the harmony phenomenon was concentrated around two conceptual approaches proposed by Pifagor and Heraclite. Though, these ideas have much in common in methodological sense, Pifagor’s and Heraclite’s conceptions are qualitatively different and even contrary in the explanation of harmony essence and (...) its role and place in the integral world functioning. Pifagor considers harmony as the initial fundamental quality of the world directed on merging, combination, coordination, as well as conciliation of contraries with its different traits. Heraclite considered the origin of the world, as a single phenomenon, not in the harmony but in eternal struggle, hostility of contraries which resulted in harmony. The hypothesis about the importance of mentioned conceptions for the development of Western European model of harmony is proposed. (shrink)

As a contemporary form of aesthetics of nature, Eco-aesthetics is dedicated to an aesthetic revision of the split between humans and nature in the process of modernization. Starting from the criticism that the current eco-aesthetic research is usually limited to a taste evaluation of natural beauty and that many studies pay little attention to practically reconstructing a new harmony between humans and nature under contemporary conditions, the article focuses on the following issue: a) To what extent can the approach (...) of Eco-aesthetics be theoretically re-formulated so that the perspective of traditional aesthetics of judgment, predominantly fixed on the experience and reflection of natural beauty, can be avoided? b) How can this reformulation contribute to recultivating and renaturing an environment in a widely urbanized world? Here the concept of ‘atmosphere’ which has been primarily developed by contemporary German philosophers emphasizes the interaction between bodily perception and the qualities of the surrounding environment is of particular significance for solving these issues. It is demonstrated that in atmospheric experiences the body embeds man, together with his multifarious ways of perception and sense experiences, into nature so that man and nature are interrelated with each other and merged into a unified whole. The eco-aesthetic meaning here transcends the framework of the beauty of nature and is characterized by an infinite range of perceptual possibilities towards the integration of the human situation and the environmental conditions. At the same time, the investigation of the conditions and forms of atmospheric creation will contribute to further extending the eco-aesthetic vision to the practical area. This study aimed to explore the role of two models of well-being in the prediction of psychological distress during the COVID-19 pandemic, namely PERMA and mature happiness. According to PERMA, well-being is mainly composed of five elements: positive emotions, engagement, relationships, meaning in life, and achievement. Instead, mature happiness is understood as a positive mental state characterized by inner harmony, calmness, acceptance, contentment, and satisfaction with life. Rooted in existential positive psychology, this harmony-based happiness represents the result of (...) living in balance between positive and negative aspects of one's life. We hypothesized that mature happiness would be a more prominent protective factor during the present pandemic than the PERMA composite. A total of 12,203 participants from 30 countries responded to an online survey including the Depression Anxiety Stress Scale (DASS-21), the PERMA-Profiler, and the Mature Happiness Scale-Revised (MHS-R). Confirmatory factor analyses indicated that PERMA and mature happiness were highly correlated, but nonetheless, they represented two separate factors. After controlling for demographic factors and country-level variables, both PERMA Well-being and MHS-R were negative predictors of psychological distress. Mature happiness was a better predictor of stress, anxiety, and general distress, while PERMA showed a higher prediction of depression. Mature happiness moderated the relation between the perceived noxious effects of the pandemic and all markers of distress (depression, anxiety, stress, and total DASS-21). Instead, PERMA acted as a moderator in the case of depression and stress. These findings indicate that inner harmony, according to the mature happiness theory, is an essential facet of well-being to be taken into consideration. The results of this study can also orient policies aimed to alleviate the negative effects of the pandemic on mental health through the promotion of well-being. (shrink)

This article explores how `social harmony' as cultural performance, is conducted by Chinese in their conversation at the surface level, with turbulence and manipulation concealed beneath superficial politeness. Although their more collective cultural orientation may lead them to greater cooperation and less confrontation, Chinese also develop artfully crafted messages to communicate competition and frustration. Selected discourse samples collected in Taiwan were analyzed in depth to show how social harmony may become a matter of external display, constructed, enacted and (...) negotiated through participants' verbal exchanges in their moment-to-moment interaction. It is concluded that superficial harmony allows the extensive web of interpersonal connections and hierarchical positioning to be maintained with minimal discord, while at the same time concealing underlying aggressiveness and ulterior motives. Purpose. The paper aims at examining the phenomenon of the rebirth of the Goddess in the contemporary world. The author has used the hermeneutic approach and cultural-historical method, as well as the anthropological integrative approach. Theoretical basis. The study is based on the ideas of Carol Christ, Margot Adler, Miriam Simos, and Jean Shinoda Bolen. Originality. The rebirth of the Goddess is not a deconstruction of the God. The face of the Goddess is one side of the binary opposition "Goddess (...) – God". Life on the earthly plane presupposes masculine and feminine dualism. However, these polarities are not mutually exclusive and mutually suppressive, but complementary to each other. The return of the Goddess to the throne and a profound appreciation of Femininity is a necessary step forward in establishing true equality and restoring lost harmony. As humanity returns to the Absolute that transcends duality, as divinity is revealed in feminine and masculine forms, and, finally, as humans get in touch with their true self, the two faces, feminine and masculine, will inevitably merge. Conclusions. Identifying herself with the images of the Goddesses, a woman develops self-awareness and self-acceptance that contribute greatly to her reintegration with a wider spiritual reality. The cult of the Goddess finds practical application in women’s lives. These are magical rituals, work with the archetypes, life-changing tours. Recognizing her right to the fullness of being, a woman overcomes rigid gender roles and stereotypes, ceases to be an object of manipulation and becomes the supreme arbiter of her own life. (shrink)

In the present paper we discuss a recent suggestion of Schroeder-Heister concerning the possibility of defining an intensional notion of harmony using isomorphism in second-order propositional logic. The latter is not an absolute notion, but its definition is relative to the choice of criteria for identity of proofs. In the paper, it is argued that in order to attain a satisfactory account of harmony, one has to consider a notion of identity stronger than the usual one (based on (...) β- and η-conversions) that the authors have investigated in recent work. Yat-hung Leung debates Chenyang Li’s view of harmony and benevolence in Confucian teachings: Which is the more fundamental and important value, and ultimate ideal? In The Confucian Philosophy of Harmony, Li delineates a distinctively Confucian conception of “deep harmony” as the basic ideal of Chinese culture and especially Confucianism. Leung questions that depiction of things, arguing that benevolence does and should hold that place of honor. Leung focuses his arguments against two claims: firstly, that harmony should (...) be understood as the supreme value in Confucian thought, and secondly, that the ideal of harmony is of greater value to us today than that of benevolence. Leung points out that in the influential texts and traditions of Confucian philosophy, benevolence is of higher value than harmony. He disputes both the representative nature of the texts Li relies on as well as Li’s portrayals of some of those texts. We more properly understand Confucian harmony and benevolence in the inverse relation, with harmony as the product of benevolence, and thereby come to see that the substantive action-guiding content of benevolence in fact has the greater value to contemporary life. The representation of a complex but stable, self-regulated and, finally, harmonious nature penetrates the whole history of Ecology, thus contradicting the core of the Darwinian evolution. Originated in the pre-Darwinian Natural History, this representation defined theoretically the various schools of early ecology and, in the context of the cybernetic synthesis of the 1950s, it assumed a typical mathematical form on account of α positive correlation between species diversity and community stability. After 1960, these two aforementioned concepts and their positive correlation (...) were proposed as environmental management tools, in the face of the ecological crisis arising at the time. In the early 1970s, and particularly after May’s evolutionary arguments, the consensus around this positive correlation collapsed for a while, only to be promptly restored for the purpose of attaching an ecological value on biodiversity. In this paper, we explore the history of the diversity–stability hypothesis and we review the successive terms that have been used to express community stability. We argue that this hypothesis has been motivated by the nodal ideological presuppositions of order and harmony and that the scientific developments in this field largely correspond to external social pressures. We conclude that the conflict about the diversity–stability relationship is in fact an ideological debate, referring mostly to the way we see nature and society rather than to an autonomous scientific question. From this point of view, we may understand why Ecology’s concepts and perceptions may decline and return again and again, forming a pluralistic scientific history. (shrink)

This short paper argues that interreligious and intra-religious harmony is a necessary condition for social harmony, peace and progress. It is an attempt to develop arguments in favour of the above thesis with special reference to the teachings of Buddha and Vivekananda. Buddha taught human beings to be rational, analytical and moral in way of life. Buddha, therefore, taught openness, interdependence and middle path. Vivekananda also argues for universal religion which is based on scientific, rational and compassionate human (...) relations. He considers that the service of human beings is the service of God. It seems to be a direct impact of the compassionate teachings of Buddha upon Vivekananda. Both of them have indirectly contributed to what is called today the philosophical doctrine of Religious Pluralism which rests on the principle of ‘live and let live’. Both of them were against all kinds of ‘dogmatism, fanaticism and bigotry’. The aims of this research were twofold: first, to compare the levels of organisational harmony between family and non-family firms and, second, to study the influence of organisational harmony on family firms’ performance (profitability, longevity and group cohesion). Starting from a definition of organisational harmony as a value and considering the importance of the management of organisational values, we use the main topics indicated by the general literature (organisational climate, trust and participation) to analyse organisational harmony, (...) as well as three other topics for performance (profitability, survival and group cohesion). Results indicate that family firms have higher levels of these three qualities than non-family firms, and that the levels of trust, participation and organisational climate have a positive and significant influence on the performance of family firms. These results can be understood as a consequence of the influence of family social capital on organisational social capital and so on the performance of family businesses. From the perspective of institutionalism, the higher levels of harmony existing in family businesses are a reflection of the pressures that the owning family as an institution exercises on the organisational social capital in its companies. Ancient philosophy has been a source of inspiration for contemporary philosophy in recent decades. An outstanding example is the renaissance of hylomorphism in the field of philosophy of biology. For the philosophy of mind, hylomorphism has been little discussed so far. Therefore, ancient models in the philosophy of mind are still of interest. This article argues that Plato’s Phaedo can act as a source for contemporary debates. As a starting point, Simmias’s objections to the immortality of the soul are analyzed. (...) Plato does not simply reject these objections, but introduces conditions for a hylomorphistic understanding of the soul in Socrates’ reply. These conditions are the following: (A) the mind supervenes on the body; (B) this supervenience must allow the strong emergence of the mind; (C) the mind comprises causal powers; (D) teleological explanations are a necessary ingredient of a suitable model for the mind-body problem. With these conditions, Plato already introduces central components that are present in contemporary philosophical debates, but have not yet been unified into a hylomorphistic concept in the philosophy of mind. The paper begins with the assumption that in order to explain the efficacy of harmony as an organizing force in human and natural affairs we must pay attention to the dynamic features characteristic of the growth and maintenance of harmonious forms. Two dynamic features are highlighted for their especial significance: revitalization, and self-surpassing. It is then argued that the two are substantively connected through the agency of creativity which, when given free reign, tends to preserve and fortify harmony (...) by surpassing existing harmonious configurations. It follows that the impetus towards self-transcendence is a vital aspect of the growth, the sustenance, and the flourishing of harmony. I then argue that this urge towards self-transcendence can be broadly identified with Plato's notion of Eros. Nevertheless, I also argue that this affinity does not commit us to a rigid Platonic scheme of the sort criticized by Chenyang Li (2014) as harmony by conformity. (shrink)

ABSTRACTChildren are often perceived to be less credible testifiers than adults. Their inexperience and affinity for play can provide reason to question their credibility and sincerity as truth tellers. The discrediting of children's testimonial claims can, however, result in an injustice when it stems from an uncritical age-related identity prejudice. This injustice can lead to several consequences varying in severity, with the worst cases leading to their deaths. More commonly, and especially when this injustice is considered in combination with other (...) intersectional identities, it has the potential to render these children invisible. In this paper, we discuss common domains within which children can face epistemic injustice when testifying about their experiences. The heart of the paper explores the most severe instances of epistemic injustices by reviewing three cases where children with intersectional identities died after their testimony was not believed. The paper concludes by emphasizing some of the important considerations that a recognition of intersectionality brings to the current discussion. (shrink)

The article examines the evolution of the views of the German poet and playwright Friedrich Schiller on the concept of a "beautiful soul" as a harmonious combination of mind (form) and sensuality (matter). The idea of this evolution is formed on the basis of the poet's artistic works. The main objects of research are six of Schiller's dramas ("The Robbers", "The Fiesco Conspiracy in Genoa", "Don Carlos, Infante of Spain", "Mary Stuart", "The Maid of Orleans" and "William Tell"), which most (...) vividly depict the poet's attempts to resolve the conflict between form and matter. A number of Schiller's theoretical works are considered as additional sources: on physiology, history and aesthetics. In turn, additional sources allow us to form an idea of the socio-political significance that Schiller attached to his vision of a "beautiful soul." The research is based on the following methods: descriptive, comparative and biographical methods of analyzing works of art. The author of the article proceeds from the premise that the poet, who began under the strong influence of the literary movement "Storm and Onslaught", quickly became disillusioned with Sturmer's individualist hero, whose goal was to maximize his own potential, albeit to the detriment of society. At the same time, it is noted that Schiller did not have confidence in the state and its laws, which seek to simplify the diversity of life by subordinating it to ideal forms. It is concluded that the existence of a "beautiful soul" acting at will and not limited by the law is possible only in a society in which the state has disappeared as an independent institution, merging with the people; in which there is no class stratification and a gap between ordinary citizens and rulers. The contribution of the author of the article is to develop the idea of Schiller as a kind of "ideologue" of a stateless society. Article is devoted to research of the views of the Algerian philosopher and Muslim intellectual Mālik Bin Nabī (1905-1973) and reviews his sociological, cultural, historical and philosophical ideas. In his works Mālik Bin Nabī was writing about human society, paying special attention to the reasons for the decline of Muslim civilization and raised the issue of the degree of necessity, ways and forms of perception of its achievements. The author points to the complex approach of the thinker to the problems (...) of the civilizational revival of the Muslim world in the context of the phenomenon of nahda ( al-Nahda ), the main problem of which was and remains the problem of relationship with Western civilization. According to M. Bin Nabī, both in political and social aspects, Nahda is conceptually connected with the Muslims’ search for their own identity and a way out of the crisis generated by long centuries of colonization. In its broad socio-cultural context al-Nahda implies an authentic way for Arabs to meet modernity and constitutes one of the main concepts aimed at achieving a way out of the crisis and a genuine revival of the Muslim world. He sees the ways of solving this problem through the expression of the social values of Islam, arising from the moral and ethical foundations of the Islamic religion, which, in his opinion, affect the restoration of Muslim identity in all realms of existence of the global universe. The thinker proposes a way for the productive revival of the Muslim world based on a harmonious synthesis in line with the merging of the achievements of Western philosophical rationalism and the Islamic religious heritage. In addition, in order to unite the efforts of the Afro-Asian peoples in the face of colonialism, the cultural and economic expansion of the West and the true revival, ultimately, of all the peoples of the East, M. Bin Nabī developed the concept of Afro-Asianism, in which he puts forward the tasks of a globalist scale, pursuing again revival goals. According to the ontological differentiation of M. Bin Nabī, present in the ratio of man, time, space, it has an Islamic basis. This aspect can play an important role in both positive and negative reorganization of the world by man. This situation is directly related to the issue of what meaning people give to the world, as well as the level of their responsibility for that. (shrink)

The paper covers the last phase of Jan Mukařovský’s career between 1945 and 1964 during which his scholarly outlook underwent several steep flections. It treats his conversion from structuralism to Marxism as a story with a distinctive composition, generic characteristics, and buildup. It articulates it into three stages and argues that each accommodates the relationship between these two scholarly paradigms in a different manner. If the initial one strove toward a harmonious merge of structuralism with Marxism, the second one triggered (...) a sharp renunciation of the former and the total acceptance of the latter, while the last one brought about a rather diffident return to some initial premises of structuralism. The COVID-19 pandemic has foregrounded the significance of time to everyday life, as the routines, pace, and speed of social relations were widely reconfigured. This article uses rhythm as an object and tool of inquiry to make sense of spatio-temporal change. We analyse the Mass Observation (MO) directive we co-commissioned on ‘COVID-19 and Time’, where volunteer writers reflect on whether and how time was made, experienced, and imagined differently during the early stages of the pandemic in the UK. We draw (...) on Henri Lefebvre and Catherine Régulier's ‘rhythmanalysis’, taking up their theorisation of rhythm as linear and cyclical and their concepts of arrhythmia (discordant rhythms) and eurhythmia (harmonious rhythms). Our analysis highlights how MO writers articulate (a) the ruptures to their everyday rhythms across time and space, (b) their experience of ‘blurred’ or ‘merged’ time as everyday rhythms are dissolved and the pace of time is intensified or slowed, and (c) the remaking of rhythms through new practices or devices and attunements to nature. We show how rhythm enables a consideration of the spatio-temporal textures of everyday life, including their unevenness, variation, and difference. This chapter examines the way in which the author of the Wuxing establishes “Sagacity” as a key psychological marker of moral realization—associated with the divine Way of Heaven. I show how Sagacity (...) epitomizes the ideal of harmony among the Five Conducts by merging human, mundane realms of moral thought and feeling with divine apprehension of moral perfection. Through an analysis of musical metaphors that reveal the nature of the human–Heaven relationship in the human body, I demonstrate how some early Chinese Ruist thinkers grounded their ethics in a highly spiritual attitude towards the human psyche. Recent years have witnessed the proliferation of “Christian” companies in the U.S. These firms declare their belief in, and active pursuit of, the successful merging of biblical principles with business activities. Economic success, hard work, and biblical values are seen as capable of existing together in harmony. While the number of such businesses appears to be growing, there has been a dearth of any scientific study of these companies. No empirical research has been conducted to determine whether (...) these religious values and behaviors have any significant impact on a company’s performance. The present study is designed to partially fill this gap. Specifically, it seeks to determine whether there are differences in long-term performance between self-proclaimed “Christian-based” businesses and their secular counterparts. Data were collected from 312 companies. A multivariate analysis of variance (MANOVA), followed by univariate ANOVAs, found significant differences between these two groups of firms on three of the four performance variables that were analyzed. This article traces the roots of transhumanism's soteriology and eschatology and then examines the underlying anthropological problems that drive the hoped-for salvation through digital immortality. Unfortunately, the admirable desire to extend life sacrifices an appreciation (...) for the integral harmony of the human person's animal and spiritual dimensions. Since human actions manifest the person's intrinsic corporeality, attempts to detach the human personality from the body through digitalization would produce replicas of the dead without achieving true immortality. The surprising quasi-religious thrust of contemporary transhumanism's secular eschatology presents an opportunity to rediscover the Catholic patrimony's reflection on authentic divinization through the transhumanizing effects of divine grace. The article thus concludes with a Thomistic theosis-centered reorientation of secular transhumanism's eschatological aspirations for immanent immortality toward true human flourishing. [End Page 841]The Secular Eschatology of Contemporary TranshumanismThe leading transhumanist philosopher, Oxford University professor Nick Bostrom, thinks that his movement will provide real solutions to the perennial problems of humanity that traditional religions have tried and failed to address:While not a religion, transhumanism might serve a few of the same functions that people have traditionally sought in religion. It offers a sense of direction and purpose and suggests a vision that humans can achieve something greater than our present condition. Unlike most religious believers, however, transhumanists seek to make their dreams come true in this world, by relying not on supernatural powers or divine intervention but on rational thinking and empiricism, through continued scientific, technological, economic, and human development.1Yet, for all its protests against antiquated creeds, secular transhumanism frequently tends toward quasi-religious expressions. For instance, Meghan O'Gieblyn finds striking parallels between the evangelical and transhumanist worldviews she has embraced and abandoned during her life.2 Her writing explores her harrowing transition from Christian fundamentalism to trans-humanism and her eventual disillusionment with the techno-movement. Bible school had taught her about the various epochs of salvation history and her position within the "dispensation of grace" that marked the final preparation for the longed-for "millennial kingdom." As an adult, she spurned the false promises of organized religion and sought a more rational organization for her life. Later, a book recommendation plunged her into the thought of Google guru Ray Kurzweil and his narrative of evolutionary eras pointing toward an imminent "singularity" in which intelligent machines would emerge from an informational explosion. Such advanced robots would bring digital immortality through mind uploads and a nanotech new earth [End Page 842] that would put Eden to shame. Through his projects, Kurzweil purports to continue the Enlightenment tradition of empirical science and rational rigor. Similarly, many transhumanists tend to follow their Enlightenment predecessors in chiding traditional religion for obscurantist opposition to scientific progress. Nonetheless, O'Gieblyn discovered that the very movement that pretends to supplant the superstitions of the old-time religion is itself "a secular outgrowth of Christian eschatology."3The Christian-trained author could not help but detect familiar religious themes in the technocentric movement. Before it spread through the offices of Silicon Valley, the term "transhuman" first appeared in Henry Francis Carey's 1814 version of Dante's Paradiso, where the poet pilgrim recognizes that not even his own genius can describe the joy of risen life when he writes, "words may not tell of that transhuman change."4 Recent efforts to substitute supernatural resurrection with technological advancement find antecedents in the thirteenth-century friar Roger Bacon's quest for an elixir of life. Later, the nineteenth-century Russian Orthodox philosopher Nikolai Fedorov claims humans should use technology to control Darwin's unguided evolutionary process. Similarly, the twentieth-century Jesuit paleontologist Pierre Teilhard de Chardin predicted a global machine network that would merge consciousnesses worldwide and prompt the Omega Point of transphysical union with the divine.The Eugenicist Julian Huxley strips such notions of their religious trappings to present a secular transhumanist project that will "overcome limitations…to arrive at... The production of knowledge should be premised on the inclusion of all epistemologies to provide possibilities to build a more just world. However, knowledge production, as we have it today, is premised on Western epistemology which is used to distil other knowledges before they could be accepted as legitimate. This approach stifles possibilities to find different ways of knowing that could contribute to imagining the world anew. There is a need, therefore, to unthink the West such that we find other (...) ways to understand the world. The article helps in unthinking the West to allow an authentic understanding of the indigenous people of South Africa. I argue that the ontology of AmaZulu – one of the indigenous groups in South Africa – is an ethic-orientated ontology that is expressed through the concept of ukukhonza – a process where one surrenders their identity in order to belong to the group (this can also refer to worship). In ukukhonza, the surrendering of one’s identity is to ensure harmonious living centred on a common identity that is unified by the principles of ubuntu. Drawing on the nuances of ukukhonza, this article argues that the ontology of AmaZulu is centred on respecting life in its different forms because it is believed that everything is interconnected. This understanding of life provides a different conceptualisation of God which anchors the religion that is practised everyday such that doing good is inescapable. This is an ethic-oriented ontology which when brought forth in its authentic form can address the many ills of modern society.Contribution: This is the conceptual article that contributes to rethinking religion from an African perspective to provide a possibility of an ethic-centred society that can inform the new ways of being in the world. Andean philosophy of nature or pachasophy results from topography and mode of production that, merged together, have produced an integrated and interacting worldview that blurs the line between culture and nature. Respecting Pacha, or the interconnectedness of life and geography, maintaining complementarity and equilibrium through symbolic interactions, and caring for Pachamama, the feminine presence of Pacha manifested mainly as cultivable soil are the basis of Andean environmental and social ethics. Reciprocity or ayni is the glue that holds everything together. This (...) weaving of traditional beliefs, customs, and ecologi­cal knowledge is rooted in the landscape and has sustained Quechua and Aymara societies during many millennia of knowing, using, and transforming the varied environments of the central Andes of South America. Any environmental ethics that influences people’s lives and promotes respectful and sustainable relationships with nature will be framed by already held worldviews. In Bolivia indigenous intellectuals are drawing on the ancient tradition of Pacha to trace an environmental ethics of pacha qamaña or the harmonious and integral well-being of life, the Earth, and the cosmos, and the ethics of suma qamaña as an all em­bracing ethical framework for the “good life” or “living well.” Although pacha qamaña and suma qamaña are rooted in the Andean mythological worldview, they will interest Western philosophers because the values they promote can be correctives for Western cultural traits that see little more than instrumental value in nature. In this sense, pacha qamaña and suma qamaña contribute to the broader discussion of environmental ethics. (shrink)

This brief study is to examine whether some legal questions do influence the administrative control in general and more particularly the administrative control of merged municipalities. First are analysed the propositions aiming the administrative control in the new local government act as proposed by the Association of Belgian Towns and Villages. It says that administrative control must not be excessivily hindering. It would rather change the control phylosophy and procedures in order to relieve the administrative control. The two important State (...) Reform Acts of 8 and 9 august 1980 present in fact major institutional changes concerning the administrative control. The Flemish and the Walloon regions obtain the competence to organise the procedures and to exercise the administrative control with regard to provinces, towns, villages and agglomerations. After revision of article 108 of the Constitution in 1980opportunity-control of administrative acts is maintained and the exercise of the autonomy of action must take place in harmony with the jurisprudence of the «Council of State». Finally, comparison between theFrench Act of March 2nd, 1982 about decentralisation of administrative control in France and the opportunity-control in Belgium is made. (shrink)

RedekopScholarly interest in the emergence of a “public sphere” and “public opinion” in eighteenth-century Europe remains strong, and with good reason. The ideological construct of a modern public in Europe “was a characteristic product of the Enlightenment, and it marked one of the critical zones of intersection between Enlightenment discourse and a broad range of socio-economic and institutional (...) changes.” 1 Analysis of the emerging figure of “the public” helps illuminate the relationship between intellectual and material culture, between “Enlightenment” and society. The recognition of the constitutive nature of language and its role in the interplay between “meaning” and “experience” 2 lead one to take seriously terms like “the public” and “public opinion” as important links between linguistic and social domains. Text and context merge into one as social entities like “the public” become rhetorical ones, and vice-versa.Keith Baker, for example, resolves the contextual dimension of “public opinion” in France into the textual one, whereby it emerges as a “rhetorical figure” or “political invention” in the latter decades of the eighteenth century. 3 Others stay closer to the social domain, including the salons of Paris, to look for the emergence of the notion of rational public opinion. 4 Taken together, these are two sides of the same coin—an emerging sphere of “public” discourse carried on by “private” individuals, and a more private sphere in which public discursivity was nurtured. 5 [End Page 81]In this article I explore these themes in a German context, focusing on the writings of Thomas Abbt (1738–66) as an attempt to grapple with the exigencies of German social and intellectual life in a novel fashion. Making use of a variety of European sourc es, Abbt—an academic with broad interests—strove in On Dying for the Fatherland (1761), On Merit (1765), and in his contributions to the seminal journal Letters Concerning the Newest Literature to conceptualize and to create a sense of citizenship and the “common good” which cut across the various divisions of German society, uniting all orders into a greater and harmonious whole or Publikum (public). The written word was the primary vehicle available for this simultaneous mo vement of enlightenment and socio-political formation, and Abbt’s works represent an early attempt to inscribe a public sphere—to create a space in which it became possible for individuals to think, talk, and act in reference to a larger socio-political whole. While Prussian patriotism was behind his initial foray into the topic of the public sphere in On Dying for the Fatherland, Abbt’s On Merit reveals an expansion in perspective, and with it the emergence of “the public” as a moral and s ocio-political point of reference. There is a good degree of continuity, however, between the two works, concerned as they are with overcoming the basic German problem of a fragmented public sphere with enlightened arguments designed to lead readers to lo cate themselves and their well-being in an enlarged societal frame.While at least one commentator has argued that Abbt was seeking to write for the common German Volk, 6 his primary audience was clearly that of the middling and higher orders. 7 The general problem Abbt addressed, however, was that of reconciling Enlightenment and reform with the entire spectrum of German society. This entailed the exploration of new, informal, and inclusive terms and modes of address: an available term was “the public,” and the mode of address a writing style which transformed ancient forms of public oratory into text—the public speaker became, under modern circumstances, the public writer.It is in this sense that Abbt was original and influential. This paper examines the well-known pragmatist claim to mediate between philosophical disputes. While recognizing the reconciliatory and harmonizing role that pragmatism plays in traditional debates between, for example, realism and antirealism, naturalism and culturalism, or science and religion, it is argued that the pragmatist also needs to acknowledge that there are situations in which no such mediation is reasonably possible, such as the conflict between racism and antiracism. The metaphilosophical question to be raised is how – in terms of pragmatism (...) itself – we are able to distinguish between these different cases and what exactly it means to apply the pragmatic method to resolving this meta-level issue. Pragmatism here emerges as a thoroughly fallible and antifoundationalist reflexive inquiry into what it means, and what it ought to mean, for us to view philosophical issues in terms of their conceivable practical consequences. The project of mediation must be subordinated to this more fundamental understanding of pragmatist methodology. (shrink)

The Law has always been an instrument to exorcise different kinds of fear, primarily the fear of differences, through the distribution of shares of power. Perhaps, this system, inherently conflictual, is behind the failure of the multicultural policies of many countries, that have divided the society in as many separate communities as are the elements that differentiate each human being. The Law has also recognized to men a total power over Nature, feeding its illusion of control, that in recent decades (...) has shattered in front of several natural disasters. Ecuador, Buthan and South Africa have introduced in their Constitutions ideas belonging to the indigenous cultural tradition (buen vivir, buddhism and ubuntu), which express harmony between men and Nature. The paper analyzes these experiences in order to propose a new model of eco-friendly constitutionalism. (shrink)

The problem of merging several ontologies has important applications in the Semantic Web, medical ontology engineering and other domains where information from several distinct sources needs to be integrated in a coherent manner.We propose to view ontology merging as a problem of social choice, i.e. as a problem of aggregating the input of a set of individuals into an adequate collective decision. That is, we propose to view ontology merging as ontology aggregation. As a first step in (...) this direction, we formulate several desirable properties for ontology aggregators, we identify the incompatibility of some of these properties, and we define and analyse several simple aggregation procedures. Our approach is closely related to work in judgment aggregation, but with the crucial difference that we adopt an open world assumption, by distinguishing between facts not included in an agent’s ontology and facts explicitly negated in an agent’s ontology. Além de atrativos turísticos, as celebrações religiosas no (...) país são também patrimônio imaterial e estão inseridas dentro da cultura "do festejar" dos brasileiros. Esse presente artigo tem por finalidade abordar aspectos da Procissão ao Nosso Senhor dos Passos na cidade sergipana de São Cristóvão. A metodologia utilizada foi a pesquisa bibliográfica, com discussão no campo teórico sobre Barroco, Festa Devocional, Tradição, Religiosidade, Procissão, Turismo Religioso, Cultura e Identidade. Também foi realizada a pesquisa de campo, com observação direta. Com esse estudo, ficou perceptível que, como território distante de Portugal, as festas religiosas do Brasil tomaram uma dinâmica própria, absorvendo elementos profanos e se resignificando através do apelo popular. These were the subject of harmony, but also of struggles and social control held by the Church and the Portuguese State. Currently in Brazil, the Catholic party moving a lot of people in the period of their events. Apart from tourist attractions, religious celebrations in the country are also intangible heritage and culture are embedded within "the feast" of Brazilians. This present article seeks to address aspects of the Procession of " Nosso Senhor dos Passos " the city of São Cristóvão state of Sergipe. The methodology used was literature, with discussion in the theoretical field of Baroque, Devotional Feast, Tradition, Religion, Procession, Religious Tourism, Culture and Identity. We also carried out field research, with direct observation.With this study, it was noticeable that, as distant territory of Portugal, the religious feasties in Brazil have taken a very dynamic, absorbing the profane elements and reframing through popular appeal. Alternative food networks, such as farmers’ markets and community-supported agricultural and fishery programs, often struggle to reach beyond a consumer base that is predominantly white and affluent. This case study explores seven inclusion strategies deployed by a community-supported fishery program (Fishadelphia, in Philadelphia, PA, USA) including discounting prices, accepting payment in multiple forms and schedules, offering a range of product types, communicating and recruiting through a variety of media (especially in person), and choosing local institutions and people of color (POC) (...) as pickup location hosts. Our analysis indicated that all of these strategies were associated with increased participation of customers of color and/or customers without a college degree. For Asian customers, accepting cash, offering whole fish, recruiting in-person, and POC-hosted pickup locations were key factors. For Black customers, discounted price, accepting cash, offering fillets, and communicating through means other than email were most important. Discounted price and communicating through means other than email were most important for customers without a college degree. Payment method, payment schedule and communication method were highly correlated with other strategies; we suggest that these strategies work in synergy to make the program attractive and feasible to these customers. We consider how Fishadelphia’s inclusion efforts have benefitted from both tactical approaches (i.e., programmatic features) and a structural approaches (i.e., the people and places represented within the project), and suggest that elements of both tactical and structural inclusion can be applied in other contexts. This work is crucial for increasing food access, and underscores the importance of relationships in recruiting diverse customers. (shrink)
