Although significant differences undoubtedly exist between Daoism and Kant’s philosophy, the two systems also have some noteworthy similarities. After calling attention to a few such parallels and sketching the outlines of Kant’s philosophy of religion, this article focuses on an often-neglected feature of the latter: the four guiding principles of what Kant calls an “invisible church”. Numerous passages from Lao Zi’s classic text, Dao-De-Jing, seem to uphold these same principles, thus suggesting that they can also be (...) interpreted as core features of a Daoist philosophy of life. A crucial difference, however, is that members of a Daoist church would focus on contentment, whereas Kantian churches modeled on Christianity would strive for perfection. The article therefore concludes by considering what a synthesis might look like, if a Kantian church were to be based on a Daoist interpretation of these four fundamental principles. (shrink)

Many think that the aim of Hume’s Dialogues is simply to discredit the design argument for the existence of an intelligent designer. We think instead that the Dialogues provides a model of true religion. We argue that, for Hume, the truly religious person: believes that an intelligent designer created and imposed order on the universe; grounds this belief in an irregular argument rooted in a certain kind of experience, for example, in the experience of anatomizing complex natural systems (...) such as the eye; and retains this belief, on the basis of these reasons, even after careful scrutiny. We argue that two of the Dialogues’s characters, Philo and Cleanthes, exhibit true religion. A third character, Demea, exhibits false religion and a persistent impiety. Taken as a whole, we see the Dialogues as an educational performance for the benefit of Pamphilus, Cleanthes’s ward, as well as for the benefit of readers of the Dialogues. Specifically, we think, given that its lessons concern theology and the principles of religion, the dynamics of the Dialogues’s discussion and the interplay between its characters can be seen as a demonstration of a method for becoming truly religious. In lieu of an abstract, here is a brief excerpt of the content:Streminger: "Religion a Threat to Morality" Joseph Ellin The question posed by Gerhard Streminger is, "What did Hume think of the effect of religion on morality?" Professor Streminger makes an important contribution to our understanding of Hume's views. Streminger demonstrates that, in addition tohis critique ofthe rational basis ofreligion, and his perhaps less well-known critique ofthe origins ofreligion in what we may call the dark side ofhuman (...) nature, Hume strongly objected to religion on moral grounds. Religion is a threat to morality, Hume thinks. There is no doubt that this is Hume's view; in fact, as I shall show, Hume's opposition to religion is even more far-reaching than Streminger acknowledges. Though Hume did not write systematically on the subject, Streminger has ingeniously brought some order to Hume's views by arranging them under three heads. I shall, in turn, continue this clarification by summarizing Streminger's report of Hume's criticisms into sixteen propositions, as follows: 1.Because "fear of the unknown is the origin of religion," clergy have an incentive to limit knowledge. 2.Religious devotion arises from sorrow and terror (terror is the primary principle ofreligion [D 225-6]), so clergy have an interest in increasing human misery. 3.Clergy are necessarily hypocrites, who sometimes feign more devotion than they possess, and guard against the natural, cheerful sentiments. 4.The God of common religion is no moral authority because, among His other faults, He is malevolent, vengeful and wicked. 5.Due to His omnipotence and omniscience, He is an object offear, from whom nothing can be hidden. 6.This dominating God evokes flattery and adulation. 7.Because He is the product of human prejudices, God embodies discordant elements. 8.He unjustly inflicts excessive punishments and contradicts our natural human generosity. 9.False religion leads to an unnatural life and threatens our natural moral sentiments, in that superstitious terror evokes the monkish virtues ofmortification and humility. 10.Monotheism especially leads to intolerance, Volume XV Number 2 295 JOSEPH ELLIN 11.and to the suppression of the love ofknowledge and liberty. 12.In order to produce amazement and wonder, and to give value to service to the deity by provoking opposition and ridicule, religion deliberately promulgates absurdities. 13.The product of this is an obstinate, dogmatic spirit, guided by the rule that the greater the absurdity, the more zealous the advocacy. 14.Absurdities are also promulgated to assure that religious acts are done, not for morality, which, since itis natural and rational cannot be done for God, nor be an object offavour in God's eyes, but for God's sake alone. 15.The consequence of this is that superstition, rites and ceremonies, and not morality, are made the essence ofreligious observance. 16.By encouraging attention to eternal salvation, religion is likely to extinguish the benevolent affections, rendering its devotees untrustworthy. These are the criticisms. They are rather an odd catalogue of horrors, reflecting, no doubt, Hume's deep dislike of conventional religion as well as his unsystematic treatment ofthe subject. But what exactly are they criticisms of? Streminger thinks that Hume's target is "common religion," "established churches," religion "found in the world," "corruption," "popular," "vulgar" beliefs and practices, etc. Hume's target is thus not religion itself, but a certain degenerate or false form of it, not "true" but "false" religion. Thus for Hume there is a form of religion, "true religion," which escapes the criticisms, Streminger seems to suggest. But this is a distortion of Hume's views, based on a misreading of Hume's text. There is no evidence that for Hume there is any form of religion which can be identified as "true religion." What is supposed to be the distinction between true and false religion? Streminger quotes Hume on the "proper office of religion," whichis toinculcate goodmoral order. He quotes a passage, ultimately excised from the History ofEngland, but appearing in the Dialogues: The proper office of religion is to regulate the heart of men, humanize their conduct, infuse the spirit oftemperance, order, and obedience; and as its operation is silent, and only enforces the motives of mortality and justice, it is in danger of being overlooked, and confounded... June 2022 A Revolutionary New Metaphysics, Based on Consciousness, and a Call to All Philosophers We are in a unique moment of our history unlike any previous moment ever. Virtually all human economies are based on the destruction of the Earth, and we are now at a place in our history where we can foresee if we continue on as we are, our own extinction. As I write, the planet is in deep trouble, heat, fires, great storms, and record flooding, (...) weather patterns drastic everywhere. Capitalism has been so successful in supplying us with an endless array of consumer items, that we have never noticed there is a cost. But there is a cost, the cost is the very life of the Earth herself, and now the day of reckoning is here. Days of reckoning are most often days of rath. But I am hoping that this is a day of major Awakening over the entire planet. We have caused a crisis so great for the Earth we can hardly get our minds around it. But I am proposing that deeply embedded in the crisis are ideas, about who and what the Earth is, Ourselves, and what we are here for. I am proposing that this is a call to all philosophy and philosophers to rethink ourselves from the ground up. The human race has never gotten the Earth right and now we must, for the Earth is the true foundation for civilization. We are in deep trouble with the Earth, and it owes to the fact that the great male thinkers never got the Earth right, they could never make the connection between the life of mind and the life of the Earth. I am proposing that deeply embedded in the crisis we are in are ideas. And that in fact the planet is in the grip of a false metaphysics, and scientific image of nature that really comes most recently from Descartes. His conviction that matter, and with it the Earth, are simply the weighable, the measurable the extended in space and time, utterly devoid of any inner life of mind thoughts or Consciousness. This view of matter and the Earth goes back to the very dawn of thought, Descartes is just its most recent and comprehensive version of things. This view of matter is really a false metaphysics that dominates most of the modern world and underpins the whole scientific image of nature itself. I am proposing this is a false metaphysics and offering a new version of things based on Consciousness. If there is a single idea fueling and driving the destruction of the planet, it is the conviction that the Earth is something without Consciousness. When you intend to ravage and savage the planet, turn it into consumer items to be converted into money in the bank, first pretend that all of the bright beings in the natural world are devoid of Consciousness, just “things” you do not have to have any conscious about destroying them. I am proposing that this term Consciousness, that has appeared as term and a problem for modern science, is the key to getting ourselves right with the Earth. I propose this new theory for science will ramify into every other disciplines as well, and the ways we think just about everything. This old paradigm based on a false theory of matter, has run its course, it has brought us to the brink of our own extinction. We need new ideas, and we need them now. You will find my recent work in the Scientific God Journal under the title: Consciousness as the Organizing Principle, and a very complete version of my arguments for this term Consciousness, along with radical reinterpretation of modern science itself, on the Galileo Commission site. It is a radical moment for all of the thinkers among us, take this as my small contribution to rethinking ourselves in new terms, based on my understanding that the true basis for the whole of Being, the Universe, the Cosmos, and with them Ourselves, is this term Consciousness. And unpack it. And I predict that with this term Consciousness every intractable human problem in both science and the modern world will go down like a line of dominos before it. And so, here are a few new ideas I would offer you. These are the times of the Reappearance of the Feminine, a great Awakening as of Springtime after a long dark and lonely Winter. We are leaving behind us an old civilization based on male dominance, fear lies and control, now in decay, disease, and death disintegrating all around us. We are moving into a whole new civilization based on Love and Truth. A new civilization requires new basic terms values and first principles. And so, I return to Descartes. 1. Just over 300 years ago a young man travelling with the army found himself stranded in a foreign town in a bare room lit by a candle with nothing to do but think. And in a couple of nights Descartes laid the entire thought foundations for modern science and most of the modern world. It isn’t clear that modern philosophers with their funding sources of grants, their graduate students, their reputation and all the perks and privileges of academia can do any better. Descartes claimed there are just two principles in the Universe, Matter and Mind. God was pure mind; human beings were mind and matter. And we are the only ones on the planet with mind. Everything else all of the bright array of beings who share the planet with us are simply matter. And matter? The weighable the measurable the extended in space and time utterly devoid of any inner life of thoughts, feelings, or Consciousness This classification was a boon for developing science. Scientists did not have to worry about any inner life in nature, ideas or Consciousness, they could just set about weighing and measuring, as they have until the present day. But it was a disaster for the Earth. Earth was once worshiped as a Goddess. With Descartes she became almost overnight “things.” Simply commodities and resources, an endless of supply of consumer items, to be turned into money in the bank. And now Descartes concept of matter is up for us. If there is a single idea that is enabling and driving the destruction of the Earth, it is the conviction that Earth is something without Consciousness. This whole scientific image of nature as something devoid of Consciousness is driving the destruction of the Earth, and driving us all insane, and it needs to change. Ever since Descartes formulated Dualism, scientists and philosophers have been trying to get rid of it. They have done this by attempting to make matter the fundamental term of reality, and to explain mind or Consciousness in terms of matter. And now, Consciousness has emerged as term and a problem for modern science. 2. The prevailing Universe picture has been mainly based on the belief that Consciousness appears only at the end of evolution in ourselves and some of the higher animals when matter attains “a certain state of complexity” and it is produced by neurons in the brain. But Consciousness is nothing real in itself, the neurons are doing the work, Consciousness is simply a byproduct of neural activity. As William James summed up this position, not his: Consciousness is to the brain as a shadow to the runner, it runs beside him but never influences his stride. And so, the great problem of neuroscience: How do neurons produce Consciousness? So far, no one has been able to say how. All we have is parallelism. Two processes are running in parallel a train of neural events and a train of Consciousness events. And so, which one is primary? The face of neuroscience and much of the modern world is that the neural events are what is really real, Consciousness is secondary. The conviction that Consciousness is something produced by neurons is so deeply held and has been so for so long, that it seems like an obvious fact. It is in fact an assumption and a theory, and it could all well be the other way around. The scientific image of nature as something devoid of Consciousness is now up for us. It has enabled the destruction of the Earth, and we are now at a unique place in our own evolution where we can foresee if we continue on as we are, our own extinction. And so, there are the best reasons for rethinking Descartes concepts of matter. Scientists and philosophers have been trying to escape dualism by making matter the fundamental term. And now, this has not worked. In a nutshell: The mind body problem, the “hard problem of Consciousness” ---how do neurons in the brain, atoms and molecules give rise to ideas thoughts and feelings and who what and where is the “I” who sees them? And then, the near-death experience. I remind you of the truth of the near-death experience. The body in the bed is brain dead eeg flat, but the patient, pure Consciousness is hovering at the ceiling watching the doctors work over the body below, able to read dials he could not have seen from the bed, sometimes able to events in the corridor beyond the room, all subsequently confirmed by the doctors. Evidence as good as it gets that the patient really was out of his body. And so, the patient is able to see without eyes, hear without ears and to think and remember without a brain. There is not a single scientific principle that can account for this. And I am proposing that the near-death experience is a threshold and a key for a much deeper understanding of the Universe. These three problems are so hard they cannot be solved by present scientific principles and therefore call all present principles and ways of thought into question. When your axioms cannot account for the data, it is time to drop them and find better fundamental terms. We have not been able to solve the problems of Consciousness with the assumption that matter is the most basic and fundamental term. And so, if Cartesian dualism is to be overcome at all, we need to try it the other way around. 3. We are in the position of Copernicus. Remember Copernicus? He was making his calculations on the assumption that the Earth was the center of the Universe until they became so unwieldy that he decided to try it all the other way around. To make the sun the center, the Earth revolving around it. And lo, all of his data fell neatly into place. I am proposing a whole new Universe picture. Evolution makes us continuous with every other being, Consciousness would not be in us if it were not in them also, and then, in the atoms and molecules and cells that make up living beings. I propose to make Consciousness the most basic term and see what follows. I am in fact, proposing a new Copernican Revolution, that Consciousness is the true basis for the Universe and the right fundamental term, for science itself all other disciplines as well, and the whole of the modern world. And I predict that every intractable problem in science or the modern world, will go down like a line of dominos before it. In a nutshell: Consciousness and not matter is “first and fundamental” in the Universe, it is there from the very “Beginning” everything has it and all of the true causalities, the explanatory principles belong to it. Not to matter. What then is matter? All matter is an Appearance of something much more real, Consciousness. All matter is an expression of Consciousness, even the least little bit of matter contains Consciousness, and is an expression of Consciousness. And so, we revise the scientific image of nature. Science at present is two termed, matter/energy. It needs to become three termed: Matter/energy/Consciousness, with the recognition that all of the basic principles, the true causalities of events, and of the Universe belong to Consciousness. And now physics. To accommodate this new Universe picture physics needs to alter just one term, energy. All energy contains Consciousness, that idea alone will change our world forever. The animals the trees the plants are just as conscious as we are, as is the Earth herself, a continuum of many forms of Consciousness of which our own is one. The Earth consists of interacting and intersecting forms of Consciousness, Consciousness within Consciousness within Consciousness within Consciousness. A remarkable work has just appeared entitled “Beyond Words What Animals Feel and Think.” Describing in detail how like ourselves all of the animals are. And the more we can see how like us everything else really is, the harder it will be for us to do them all in, in the interest of turning them into consumer items. And so, here is a new principle of understanding, that entails completely new forms of explanation, and a whole new Universe picture to be spelled out in terms of Consciousness and its various properties. This is a Universe that is aware awake and Enspirited throughout. And so, there is only one principle, not two. And so, how does Consciousness work? There is “no mind/body problem.” My Consciousness is aligning the Consciousness of neurons in the brain, that aligns the Consciousness of all other cells in the body, that aligns the Consciousness of molecules and atoms themselves. Mainly from the top down, but also interactive, and not reduction to the purely physical forces. 4. And so, here is a radical new Universe picture, and with it a new way to think about the Universe itself, the Earth, Ourselves, and Spirit. It requires a complete revision of both of the terms of modern science itself. The problem of the modern world owes in deep measure to Descartes concept of matter as something devoid of interior life. But he is only the most powerful and simple expression of a whole tradition of thought that predates him, that goes back to the very dawn of thought itself. It owes to the conviction of both Plato and Aristotle that the Earth was something devoid of reason, or mind, and therefore something to be held in complete contempt. We are emerging from a civilization based on contempt for the Earth, and down the road, it will become contempt for the body, sex, women, the Native people, and people of color everywhere. And so, this entire tradition is now up for us, it has brought us to the brink of our own extinction, and we need to get beyond it. I am proposing that this term Consciousness is the way out. The missing piece of the puzzle and the idea whose time has come. And it will enable us to move into a completely new civilization based on respect for the Earth, women, sex, people of color, that honors everyone and has a place for all. Revolutions in science occur when new data show up that cannot be accounted for by existing paradigms (Thomas Kuhns: The Structure of Scientific Revolutions). Consciousness, and all the properties and problems of Consciousness are just such data, and they compel a new scientific revolution. But we are a scientific age. A new Copernican revolution in science is such as revolution everywhere. And Consciousness is the key to getting every other reality at all levels and depths right as well. It will enable us finally to get the Earth right, get ourselves right with the Earth, and with one another. Archimedes: Give me a place to stand, and I will move the world. I am proposing a new synthesis among our fundamental terms in which this term Consciousness is the new lynchpin. And so, I return once more to Descartes. Descartes in the Mediations was a dualist, they were two realities interacting in the pineal gland mind and body. But Descartes age was high on “Cartesianisms,” on Descartes concept of matter. Animals were simply cleverly wired machines (Hobbes called them automata). Rumor had it that Descartes followers went about kicking dogs reasoning that their howls were not due to any feelings of pain, but simply the wiring of the machine. We have been doing this to the Earth ever since, and now the Earth is not going to stand for it any longer. It is time we all woke up. There is no matter in Descartes sense of it, or in Plato and Aristotle’s sense of it. This old concept of matter is embedded in all of the crisis and catastrophes---fires, drought, pandemics, over population, the disintegrating economies, our ways of life, capitalism and consumerism themselves. All matter is Enspirited, contains Consciousness, and is an expression of Consciousness. Now I tell you something about Descartes you may not know. In the Mediations was a dualist, there are minds and bodies. But by the end of his life, he knew the truth. Descartes guided his whole life by these vivid dreams, and toward the end of his life he had this dream: He saw the Universe as a giant machine and in the heart of the machine propelling the whole, was Consciousness. And so, out of the shades and shadows and into the light of day. Here is a renewed and a new science, a new cosmology. And with it, a revolutionary new metaphysics. The whole of the modern world is in the grip of a false metaphysics, based on Descartes theory of matter. Here is a new, and finally true metaphysics based on the single term, Consciousness. 5. And in all my works, I spell out this new metaphysics based on Consciousness, and what it means for how we think about virtually everything: The Universe, the Earth, Ourselves, and Spirit. Of who, what and where Spirit is, that we may connect with Spirit everywhere. There is only one term for the Universe, and not two, this single term Consciousness, that manifests itself in two modes: Consciousness in Form, Consciousness Formless. And so, here is a sketch of what this new term Consciousness really means. For four great aspects of the real, four new cornerstones for a whole new civilization on Earth, based on Love and Truth. A. For the Universe: New causalities, all matter is an expression of Consciousness, awake and aware, Enspirited throughout, which has a place for the causalities of love ideas intent plan and purpose, what Aristotle called final causality, that for the sake of which. And it has a place for subjectivity, the greatest mystery in the whole of the Universe, knowable only in ourselves, but there in everything else as well, bedrock in the chain of causalities. The buck stops here. Here are two very different Universe pictures. The Cartesian Universe consists of things, pushed, and pulled around by the physical forces that function blind. The true Universe consists of selves and not things. Selves at least in ourselves, are organized and focused about an I, an I am, or a sense of self in everything, ever other being dear to itself. Just one aspect of subjectivity. And so, it is Consciousness all the way down, and subjectivity all the way down. Science proceeds on the basis of the negligible of what it can leave out as unimportant. Subjectivity is the ultimate animating principle of the Universe. What Descartes really did was to strip from nature what is most essential about it, its animating principle Consciousness. And so, we come out of a long history of “clunk.” The great male thinkers have killed creation. First in concepts and now in the lived life. And so, after centuries of fruitless search, not all of it in vain, finally, and just in time the true basic principle for the Universe has shown up in virtually all disciplines, this term Consciousness. B. And so, the Earth: What does this term Consciousness really mean for the Earth? It means that all of the bright array of beings around us have Consciousness. And the more we can realize how like us they are, the harder it will be to do them all in. Is this what it really means to be “made in the image of Spirit?” To destroy ever other living being? The god of Genesis is a creator god who has created billions and billions of living forms. Man, taking himself to be made in the image of Spirit has destroyed virtually all of it. The Earth is not things, not commodities and resources, not an endless array of consumer goods. The Earth consists of conscious living spiritual beings like ourselves, who need to be honored and respected, nurtured and cared for, to be Loved. And if the human race can finally pull it off and bring Love here and start helping the Earth rather than destroying her, even our vast numbers now at 8 billion, may not matter. Deeply embedded in the modern world is a false cosmology based on the hitherto useful but ultimately false metaphysics of Descartes. In particular it owes to Descartes concepts of matter, and of the Earth, as something devoid of Consciousness. And now this concept is up for us. If there is a single idea enabling and driving the destruction of the planet, it is the conviction that the Earth is something devoid of Consciousness. And we all have a vested interest in keeping this false concept in place. When you intend to ravage and savage the Earth, to turn it into consumer items, and money in the bank, first pretend she has no Consciousness that way we need not have any conscious about it. We are in deep trouble with the planet. Virtually all human economies are based on the destruction of the Earth, and we are now at a place in our history where we can foresee if we continue on as we are, our own extinction. And so, here are a few new guiding principles for the planet, based on Consciousness. Consciousness has field properties. The Earth is Consciousness throughout, connected and interconnected throughout, intersecting and interacting fields of Consciousness of which our own is one. To harm one is to harm all. Only this understanding of the Earth can set our destructive technologies, and capitalism, their goals, and their limits. The real problem with capitalism, and with civilization itself is it has no true understanding of the Earth, all the exquisite networks and webworks that connect all beings with one another. Nor it is about to admit that the Earth is our “life support system,” reason gone insane in the modern world. We are destroying our life support system, capitalism is the full expression of the human death wish in the modern world, and it needs to change. And now, let the barriers between ourselves and all other beings go down. C. And so, Ourselves. This new Universe picture based on Consciousness opens into and has a place for new concepts of human identity. In particular, it has a place for reincarnation, a process whereby one Consciousness dons’ bodies again and again and lays them down. This is a process wholly impossible on materialistic theories. This new view of things puts a higher perspective on Freudian determinism, which is a partial knowing in a greater account. We are something more than the victims of genes drives and childhood. We are immortally eternal evolving spiritual beings who take on a cycle of earthly lives in order to achieve certain goals and abilities, and then, our earthly cycle complete, we depart the Earth plane for other areas of the Universe physical or purely spiritual, to continue our evolution elsewhere. The scientific evidence for reincarnation is increasing on all sides, see for example the work of Michael Newton, a mainstream scientist forced to confront the fact of reincarnation. A completely new reincarnational picture is now emerging everywhere. We choose our parents for abilities we could acquire through them. We all come here with reasons for being here, and we all have free will, an original property of Consciousness, and we work out our issues accordingly. We all come here with the same reason for being here. It is to experience the Earth plane and human society at all levels and depths, in every social role, every climate, both sexes male and female and in all races. We are all here to acquire a deep understanding of the Earth plane with all its challenges and all of its present problems. We are not here to devour and consume the Earth, but to honor her for the learning experience she makes available for us. And so, reincarnation is the great equalizer, the fundamental basis for any bill of rights. Many of the problems of the modern world owe to the fact that reincarnation has not been taught in the West. Reincarnation was the center piece of Jesus teachings. It was banned by a fourth century council that decided the populous could best be controlled through fear. They edited all mention of reincarnation from the scriptures, and inserted fear terms instead, a judgmental god, and so on. If reincarnation had been taught, there would have been no suppression of women, but the gift of both sexes would have been honored and developed. And there would have been no reason for contempt for people of color because who they are, we have been or will be. There is no reason to look down on anyone when we know that our own identity includes membership in theirs. The truth of reincarnation needs to be the foundation for getting ourselves right with the Earth, and with one another. D. And so, Spirit. This new Universe picture, based on Consciousness, has a place for Spirit as simply Infinite Consciousness. All universes all worlds are formed out of this Consciousness, divine and sacred throughout. And Spirit is everywhere in the Earth and can be connected everywhere. And the Native North American people had things right. Everything has its own Spirit, and without contradiction is also an expression of Spirit. And what I am really doing in terms of concepts of modern science is presenting the Native North American version of the Real. And this new Universe picture has a place for the essential insight of all religions almost smothered by church tradition: Love. Not an emotion but a great Oneness, that can be found everywhere, even in a busy city street. But especially in the Earth, that is levels and depths of Oneness everywhere. And so, for the first time in their long and bitter antagonistic history, science and religion now share a common base with this term Spirit, the lynchpin in a new conceptual framework. And I offer an interpretation of where we are in our history, this present moment of historical grace, and these tumultuous times in which we live, the return of the Goddess and the Divine Feminine, the Reappearance of the Feminine in history, the Advent of Women, this great Awakening, as of Springtime after a long dark Winter, the Awakening, the Second Coming. Spinoza's Maimonideanism Now it is precisely with the belief that the prophets were philosophers and the Bible offers veiled insights into the central doctrines of philosophy, so powerfully argued and deeply held by Maimonides that he included (...) it as one of his Thirteen Principles of Jewish Faith the acceptance of which is a necessary condition of a share in the World to Come, 1 that Spinoza took strong issue. 2 At the same time, however, Spinoza agreed with Maimonides' doctrine [End Page 385] of the a. imaginative (literary) character 3 and b. the political function 4 of the Bible and of its authors and of the major prophetic figures. The quite obvious influence of Maimonides' account of prophecy upon Spinoza's account in the Tractatus Theologico-Politicus (TTP) has been widely recognized and commented upon. That is to say (although no commentator up till now, as far as I know, has made this point explicit), Spinoza adopted Maimonides' conception of prophecy as mimetic or productive and not only—or chiefly—as receptive. 5 The Maimonidean account of the (prophetic) imagination clarifies why the atomic fact model of the receptive function of the imagination is inapplicable to the TTP. The imaginative character of prophecy is not about picking up information (in a dream or otherwise) delivered from God; rather, it concerns how one understands (and presents) certain truths (in the case of Spinoza's notion of prophecy, namely, those of ethics and in Maimonides' those of science as well as of ethics) imaginatively rather than rationally, i.e., within a web of (narrative and symbolic) associations instead of within the deductive order of rational causal explanation. "Now we see," Spinoza, in the first chapter [End Page 386] of the Tractatus, 6 writes, echoing Maimonides (esp. Guide II, 47), "why the teachings of the prophets were nearly all in the form of parables and allegories, and why all spiritual matters were expressed in corporeal form, for this is more appropriate to the imaginative faculty." Prophecy does not consist in the simple reception of pieces of information transmitted directly from God. This is not what it is for Maimonides nor for Spinoza.Thus we find that Spinoza formally defines the prophet in the beginning of TTP, chapter i, as "one who interprets (interpretatur) God's revelations to those who cannot attain to certain knowledge of the matters revealed... For the Hebrew word for prophet is nabi, that is, speaker and interpreter (orator et interpres)." 7 The prophet is interpreter in imaginative terms, whether he reformulates belief imaginatively or instead merely understands it in that way himself to begin with. Prophecy is an imaginative (narrative, symbolic) rather than a philosophical (logical and demonstrable) type of understanding and presentation. If one looks at Spinoza's account of prophecy in TTP i, one finds that immediately after Spinoza defines prophecy, he then goes on to tell us what revelation is scientifically: "the nature of [the human] mind... is the primary cause of divine revelation." That is to say, the mind itself, whether rationally in intellectual thought or in its imaginative capacity and in both cases as itself a product of divine (i.e., natural) causes, supplies the content of revelation. 8 Spinoza then goes on to say that now that we have understood the true explanation of prophecy, we must return from this scientific understanding to the biblical account of prophecy. At that point he tells us that "the Jews never make mention of intermediate or particular causes nor pay any heed to them, but to serve religion and piety... they refer everything to God." One of the most common contemporary approaches for developing an ethics of artificial intelligence (AI) involves elaborating guiding principles. As the subtitle indicates, this book intends to discuss Descartes’ attempt of laying a new foundation of knowledge. In a lively and critical interpretation of Descartes’ writings, especially of his Discours de la Méthode and of his Meditationes, and a competent use of the corresponding philosophical literature the success of this attempt of enlightenment and its shortcomings, identified with the Cartesian re-introduction of the traditional metaphysics, are explained in order to allow the author in a concluding discussion to present his (...) ideas of the necessary revision of Descartes philosophy. Presenting the I as the subject not only for the first time but in an unique way, and concentrating upon the problem of the self-originating human knowledge in an exemplary manner, Descartes is found to have become the founder of subjective philosophy. As knowledge of knowledge, philosophy is not concerned primarily with objects, but with knowledge and has self-foundation as its main task. So it has to start with human knowledge and to place the self as the fountain from which all knowledge proceeds. The demands of subjective philosophy dictate its method described in the Discours. The foundation of knowledge, which as such can only be true and certain knowledge, leads to enlightenment, i.e., to the rebellion against and to the great confrontation with the culture of the time, that is, with the guiding principles of understanding and evaluating the world of his society, and to the introduction of self-experience as the primary source of knowledge. Appointing human reason as the only leader of his intellectual life, Descartes determines the program and future order of his thoughts; the method, in the form of the four rules, has "correctly to direct his reason and to seek the truth in the sciences." It brings Descartes over the methodical doubt to the unquestionable and unsurpassed foundation of human knowledge, the absolute certitude of the self in the Cogito. His analysis of the poor, unprotected I, related to itself knowingly, is unique and of priceless philosophical value. However, the further stations of the philosophical way of Descartes who, unable to stand the ontological loneliness of this philosophically determined self-awareness, sacrificed the idea of scientific progress to a rational theology, cannot be followed. The claim of the metaphysician to be able to discover or, at least, to test every humanly possible knowledge in terms of the absolute knowledge, disintegrates in view of the progress of the new sciences. Not eternal, necessary truth, but the finite human I is the origin of subjective philosophy. The stability of rational relations does not lie in these relations themselves as if they were existing for themselves, but in the strict consequence of logical reason. "'God’ is... the title for the transcendental-philosophical background of consciousness, for the conditions to which the I-think is always already subjected." All contents which allegedly are already given in the infinite knowledge and can always be deduced from it, have to be produced and developed out of the first human knowledge by way of scientific research. Science which received its new foundation in subjective philosophy and is sought in the efforts of communication of the scientists, is not characterized by truth, but by certitude. "'Truth’ is the concern of metaphysics or better of religion. It is of the essence of such truth, not to be capable of demonstration. The absolutely true has no need to prove itself; it is entitled to faith." The Principle of Semantic Compositionality (sometimes called Frege''s Principle) is the principle that the meaning of a (syntactically complex) whole is a function only of the meanings of its (syntactic) parts together with the manner in which these parts were combined. This principle has been extremely influential throughout the history of formal semantics; it has had a tremendous impact upon modern linguistics ever since Montague Grammars became known; and it has more recently shown up as a guiding principle for (...) a certain direction in cognitive science.Despite the fact that The Principle is vague or underspecified at a number of points — such as what meaning is, what counts as a part, what counts as a syntactic complex, what counts as combination — this has not stopped some people from viewing The Principle as obviously true, true almost by definition. David Hume's relatively short essay 'Of the Standard of Taste' deals with some of the most difficult issues in aesthetic theory. Apart from giving a few pregnant remarks, near the end of his discussion, on the role of morality in aesthetic evaluation, Hume tries to reconcile the idea that tastes are subjective (in the sense of not being answerable to the facts) with the idea that some objects of taste are better than others. 'Tastes', in this context, are the pleasures (...) or displeasures that a person can take in the beauties of poems, paintings, and other artistic compositions (though Hume also wants to stress the continuities between tastes, so understood, and the bodily sense of taste). The position at which Hume arrives in the essay (despite some dialectical unclarity) is that some people – the 'true judges'– determine by their 'joint verdict' which works are meritorious. This solution continues to exercise a fascination, as does Hume's complicated route to it. Any study of the 'Scientific Revolution' and particularly Descartes' role in the debates surrounding the conception of nature (atoms and the void v. plenum theory, the role of mathematics and experiment in natural knowledge, the status and derivation of the laws of nature, the eternality and necessity of eternal truths, etc.) should be placed in the philosophical, scientific, theological, and sociological context of its time. Seventeenth-century debates concerning the nature of the eternal truths such as '2 + 2 = 4' (...) or the law of inertia turn on the question of whether these truths were created along with nature, or were uncreated and subsisting in God's mind. The goal of this article is to introduce a narrative about forgiveness as the guiding principle toward what I call universal renaissance and universal humanism. This narrative is universal for two reasons: first, it can be applied to all individuals and nations; nobody should be excluded from offering or accepting forgiveness. Second, forgiveness is a very complex act, including human reason, emotions, feelings, and spiritual dimensions of our existence, and touching the whole existence of the individual.

This article describes and proposes the “environmental subsidiarity principle” as a guiding ethical value in forestry governance. Different trends in environmental management such as local participation, decentralization or global governance have emerged in the last two decades at the global, national and local level. This article suggests that the conscious or unconscious application of subsidiarity has been the ruling principle that has allocated the level at which tasks have been assigned to different agents. Based on this hypothesis this paper (...) describes the principle of subsidiarity and its application to environmental policies within forest governance and proposes the “environmental subsidiarity” principle as a critical conceptual tool for sustainable resource management. The paper explains as an example how “environmental subsidiarity” is the key principle that can link payment for ecosystem services (PES) with environmental public policies and applies this principle with all its political consequences to reducing emissions from deforestation and forest degradation, and enhancing forest carbon stocks in developing countries (REDD+) architecture. It concludes by showing how the adoption of “environmental subsidiarity” as a ethical principle could help to maximize benefits to all stakeholders involved in PES schemes such as REDD+. (shrink)

The convergence of India’s rich cultural and religious heritage with its rapidly transforming economy provides a unique opportunity to understand how senior executives navigate the demands of the business environment within the context of their religious convictions. Forty senior executives with varying religious backgrounds and global responsibilities within Indian multinational corporations participated in this study. Drawing from virtue ethics theory and using systematic content analysis, several themes emerged for ethical virtues. The analysis illustrates how these deeply seated ethical virtues helped (...) to form and refine these executives’ ethical mindsets via guiding principles such as an ethical culture, environment, molding, education, commitment and leadership. In turn, these ethical mindsets influenced the executives’ ethical decision-making processes. We find that these executives’ ethical virtues and mindsets are inspired by their religious backgrounds. In summary, a very complex mental tug-of-war appears to take place as these executives rationalize and negotiate unethical circumstances while being cognizant of personal religious beliefs. We contend that in a pluralistic multi-faith society such as India, it is critical for corporations to align the virtues of its senior executives with those of the corporation so that virtues are applied consistently when dealing with various stakeholders. The findings present several theoretical and practical implications, which are discussed. (shrink)

Most commentators who consider Hegel's treatment of the female principle (Weiblichkeit) in the Phenomenology of Spirit only believe that it refers to "True Spirit" and is limited to a brief discussion of Sophocles's character Antigone. This is not actually true. The paper deals with both with the broader question of who represents the female principle and also goes into detail on the first appearance of Antigone in chapter five and on her final appearance in chapter seven, Reason. The (...) female principle returns in Religion as an aspect of Absolute Being. The female goddesses, especially the mother goddess and the Erinyes, embody this principle. Maimonides looks for the true axiom for a demonstration of the existence of God, and he finds it in the universal fact of movement. His logical argumentation is as follows: given the hypothesis of the eternity of the Universe, of its eternal movement, if we can think of a First Mover, that Mover has all the characteristics of the First Principle according to Aristotle; the characteristics of eternity and to be essentially moving. Maimonides' contribution to the Aristotelian theory of (...) the First Principle is precisely the crossing of the invisible barrier between the physical proof of the First Mover and the metaphysical proof of the First Principle. By transforming Aristotle's corollary into the postulate that supports the whole proof, Maimonides avoids the aporia of the First Principle being confused with the First Mover. But setting a postulate, that is, a proposition whose opposite is equally possible, at the foundations of the theory, transforms what was meant to be "a true and indubitable proof" into a scientific theory in the modern sense of the term: a theory that can be accepted as true only regarding certain parameters or system of propositions. If there was creation of the world in time, then no doubt there is a Creator. If the world is eternally moving, then it has a Mover that is essentially moving, incorporeal, one and eternal itself, namely the divinity. (shrink)

I propose a new guide for assessing claims about what is possible. I offer examples of modal claims that are, in a certain intuitive respect, ?continuous? with one another. I then put forward a general, defeasible principle of modal continuity that can account for our intuitions about those examples. According to this principle, statements that differ by a mere quantitative term don't normally differ with respect to being possibly true. I offer a precise statement of the principle, and then (...) I consider exceptions in an effort to find a more nuanced continuity principle that is more reliable and still sufficiently general. Next, I offer a possible explanation of why modal continuity tends to hold and why exceptions occur where they do. Although my primary purpose is to introduce a new technique for modal reasoning, I showcase the power of the principle by applying it to a philosophical dispute concerning parts and wholes: the principle, if true, reveals a new cost of the thesis that composition is restricted. Furthermore, I point out examples of other philosophical inquiries (in philosophy of mind, metaphysics, and philosophical cosmology) that may benefit from a principle of modal continuity. Suppose you’d like to believe that p, whether or not it’s true. What can you do to help? A natural initial thought is that you could engage in Intentionally Biased Inquiry : you could look into whether p, but do so in a way that you expect to predominantly yield evidence in favour of p. This paper hopes to do two things. The first is to argue that this initial thought is mistaken: intentionally biased inquiry is impossible. The second (...) is to show that reflections on intentionally biased inquiry strongly support a controversial ‘access’ principle which states that, for all p, if p is part of our evidence, then that p is part of our evidence is itself part of our evidence. The article that discusses the issue of culturalism as an element of the idea of representation tries to examine a concept, which claims to represent reality through conceptualization, from scratch, or by going to the bottom in a manner of excavation. Foucault's archaeology was chosen as the most suitable method for this excavation activity. Because the archaeological method does not make a historical or meta-historical claim beyond the truth; it does not impose the necessary violence of the method on its (...) object. It grasps its object in its singularity, and most importantly, it thinks and suggests that the truth is no more than an invention. This archaeological study on the concept of culture tries to reveal the difference between the current meaning of the concept and its etymological origin and to grasp it in its singularity. In this way, the problematic relationship between the concepts that man invented and applied while engaging in understanding things that are happening around him will be revealed. Conceptualization is inherent in the idea of truth, which is based on absolutism and is no more than an invention, while ultimately subordinating the particular to the universal. While the article reveals the intolerance of the act of dichotomous thinking, which operates as a product of the effort to represent the truth, as in the nature-culture distinction, it acts according to the approach known as deconstruction in social sciences. In a representative thought, truth is what can actually be represented, presenting itself to the observer as an object of display. The fact that the understanding of truth is based on essentialist principles such as absolute, unchangeable, fixed, universal thanks to Plato makes an idealized representation inevitable. In fact, intellectual endeavors such as conceptualization, abstraction, and generalization mean the idealization of the concrete, singular, and unique by detaching it from its context. It can be said that underlying the idea of representation is the belief that the human mind can grasp the essence of things and therefore can represent them in thought, depending on the idea that truth is rational. As is, it is a thought that tries to keep realism in its hands, blesses it, and strives with all its might to declare its divine absolutism. Ultimately, while the mechanism of representation operates for the stable, it acts with the aim of establishing dominance. The distinction between the representative and the represented is ultimately the product of an anthropocentric perspective. Thanks to this distinction, it is inevitable that everything except the observer subject becomes the object of study. This point of view, believed to be one and universal, requires the fixation of the object of study. It can be said that the idea of representation, which signifies the ideal of absolute truth, underlies today's issues that are based on differences, such as language, religion, race, and gender, that have always been on the world agenda. As the products of representative thought, both binary categorization based on distinction such as nature and culture, and the concept that implies a direct relationship between thought and the outside world, realism is a state of alienation in which whatever is related to the human being ceases to belong to it and is used against it. The reification made possible by the distinction between the representative and the represented is actually nothing but alienation. It can be said that the rooted problem of the world of thought and the peoples of the world since Platonism is that reification and commodification have become so universal that they seem almost like natural, organic entities, and forms. The attempt of representative thought, which confines external reality to the conceptual world, to impose a framework on reality, breaks the connection with reality, and moreover, by being guided by concepts and abstractions, it builds iron cages around the human being. The insistence of Western thought on representation, no matter if it is true or false, no matter it is accepted or not, has led to the radical consequence of the abolition of certainty over reality. Today, the world of thought has evolved from the representation of the truth, which implies the idea that there is a necessary connection between the order of things and the order of words, to the reality of representation, where the boundary between reality and image is abolished, the reality is aestheticized and transformed into images, and society ultimately becomes cultural. With an entry into the cultural turn, everything has become cultural and conventional in the postmodern period. (shrink)

I EXAMINE VARIOUS SUGGESTED PRINCIPLES FOR WEIGHING TESTIMONY TO PAST EVENTS AND IDENTIFY ONE WHICH SEEMS TO BE BOTH TRUE AND ROUGHLY IN THE SPIRIT OF DAVID HUME’S ESSAY. I ARGUE THAT HUME FAILS TO PROVIDE GOOD REASONS FOR SAYING THAT THIS PRINCIPLE, WHEN APPLIED TO REPORTS OF MIRACLES PURPORTING TO SUPPORT RELIGIOUS BELIEFS, WILL ALWAYS LEAD US TO REJECT THE OCCURRENCE OF THE MIRACLE.

Machine Learning (ML) is on the rise in medicine, promising improved diagnostic, therapeutic and prognostic clinical tools. While these technological innovations are bound to transform health care, they also bring new ethical concerns to the forefront. One particularly elusive challenge regards discriminatory algorithmic judgements based on biases inherent in the training data. A common line of reasoning distinguishes between justified differential treatments that mirror true disparities between socially salient groups, and unjustified biases which do not, leading to misdiagnosis and (...) erroneous treatment. In the curation of training data this strategy runs into severe problems though, since distinguishing between the two can be next to impossible. We thus plead for a pragmatist dealing with algorithmic bias in healthcare environments. By recurring to a recent reformulation of William James’s pragmatist understanding of truth, we recommend that, instead of aiming at a supposedly objective truth, outcome-based therapeutic usefulness should serve as the guiding principle for assessing ML applications in medicine. One prominent strand in contemporary moral particularism concerns the claim of "principle abstinence" that we ought not to rely on moral principles in moral judgment because they fail to provide adequate moral guidance. I argue that moral generalists can vindicate this traditional and important action-guiding role for moral principles. My strategy is to argue, first, that, for any conscientious and morally committed agent, the agent's acceptance of (true) moral principles shapes their responsiveness to (right) moral (...) reasons and, second, that if so, then those principles can contribute non-trivially to some reliable strategy for acting well that is available for use in the agent's practical thinking. My defense of these two claims appeals to an account of moral principles as a kind of hedged principles which I defend elsewhere, but my general line of argument should be acceptable to many other forms of generalism as well. I defend the epistemic significance of hedged principles in moral deliberation, and argue that the need for sensitivity to particulars in moral judgment doesn't supplant principles in moral guidance. I finish by arguing that the generalist model of moral guidance developed here isn't undermined by evidence from cognitive science about how we make moral judgments in actual practice, and that it compares favorably to particularism with respect to its capacity to offer adequate moral guidance. According to Principles of Sufficient Reason, every truth (in some relevant group) has an explanation. One of the most popular defenses of Principles of Sufficient Reason has been the presupposition of reason defense, which takes endorsement of the defended PSR to play a crucial role in our theory selection. According to recent presentations of this defense, our method of theory selection often depends on the assumption that, if a given proposition is true, then it has an explanation, (...) and this will only be justified if we think this holds for all propositions in the relevant group. I argue that this argument fails even when restricted to contingent propositions, and even if we grant that there is no non-arbitrary way to divide true propositions that have explanations from those that lack them. Further, we can give an alternate explanation of what justifies our selecting theories on the basis of explanatory features: the crucial role is not played by an endorsement of a PSR, but rather by our belief that, prima facie, we should prefer theories that exemplify explanatory power to greater degrees than their rivals. This guides our theory selection in a manner similar to ontological parsimony and theoretical simplicity. Unlike a PSR, our belief about explanatory power gives us a prima facie guiding principle, which provides justification in the cases where we think we have it, and not in the cases where we think we don't. This volume supplies a great deal of useful information on this in· struction which it prints in full in an appendix. Chapter 1 supplies an up-to-date survey of available reproductive technologies. Chapter 2 summarizes the Catholic tradition on sexual morality. Chapter 3 an· alyzes the Instructions, and 4 compares this to the regulations of the American Department of Health, Education, and Welfare (1979), the American College of Obstetricians and Gynecologists (1983), the American Fertility Society (1986), the British Medical Resarch Council (1982), the British Medical Association (1982) the Warmock Report (1984), the Australian National Health and Medical Research Council (1982) and the Victoria Government Committee (1982, 1983, 1984). Chapter 5 reports American reactions including those of Cardinal Bernadin and Archbishop Daniel E. Pilarczyk, theologians Richard A. McCormick, S.J. and James T. Burtchaell, C.S.C., and the columnist Charles Krauthammer. In Chapter 6 the authors draw their own conclusion. They think the Instruction has performed a service in calling attention to the need to set reasonable limits on the use of reproductive technologies, but they believe " The Vatican's call for legal prohibition of all reproduction technologies that eliminate sexual intercourse extends further than is morally necessary" (p. 138). They show, correctly, Humanae Vitae's principle of the inseparability of the unitive and procreative meaning of the marital act is the guiding principle by which the Instruction limits technological reproduction, but they reject this principle and propose in its stead that it is " the committed love relationship of the couple in its totality that gives the moral texture both to their sexuality and to their subsequent role as parents ", since " it is from the wholeness of the relationship that their specific physical acts of sex and 154 BOOK REVIEWS conception take their moral purpose. " Hence they would only exclude technologies that use gametes from donors other than the married couple. They omit discussion of another important principle proposed by the Instruction, namely the right of the child to be born of legitimate parents in a normal manner. They themselves seem to admit that the principle they propose to limit permissable techniques is not very helpful since after excluding donor methods they add, " although the authors recognize that further discussion may be necessary to clarify this point" (p. 138). In fact, couples consenting to insemination of the woman with a donor's sperm or contracting with a surrogate mother can easily justify their action as contributing to the wholeness of their loving relationship. Theologians who use this principle without further specification are logically forced to accept homosexual marriages and the artificial production of children for such marriages. This book simply ignores such obvious objections to their proposal. Indeed it does not seriously address in any detail the problem which the Instruction faces frankly and honestly, namely, what kind of reproductive acts are consistent with the totality of a committed loving relationship. Certainly, as the authors admit, some kinds of acts are not consistent with such a relationship, but they do not show critically how the principle they want to substitute for that of the Instruction can determine which reproductive technologies are not morally acceptable. The Instruction, on the contrary, took the necessary responsibility of proposing such a specification, by defining the structure of the marital act which is essential to this relationship. This does not mean that it defines it merely in its physical character, but in its specifying moral intention (its moral object) as an act which keps intact the intrinsic relation between the expression of love and the transmission of life. Artificial intelligence (AI) is becoming increasingly influential in most people’s lives. This raises many philosophical questions. One is what responsibility we have as individuals to guide the development of AI in a desirable direction. More specifically, how should this responsibility be distributed among individuals and between individuals and other actors? We investigate this question from the perspectives of five principles of distribution that dominate the discussion about responsibility in connection with climate change: effectiveness, equality, desert, need, and ability. Since (...) much is already written about these distributions in that context, we believe much can be gained if we can make use of this discussion also in connection with AI. Our most important findings are: (1) Different principles give different answers depending on how they are interpreted but, in many cases, different interpretations and different principles agree and even strengthen each other. If for instance ‘equality-based distribution’ is interpreted in a consequentialist sense, effectiveness, and through it, ability, will play important roles in the actual distributions, but so will an equal distribution as such, since we foresee that an increased responsibility of underrepresented groups will make the risks and benefits of AI more equally distributed. The corresponding reasoning is true for need-based distribution. (2) If we acknowledge that someone has a certain responsibility, we also have to acknowledge a corresponding degree of influence for that someone over the matter in question. (3) Independently of which distribution principle we prefer, ability cannot be dismissed. Ability is not fixed, however and if one of the other distributions is morally required, we are also morally required to increase the ability of those less able to take on the required responsibility. This paper addresses the topic of bioethics in reproductive medicine from the perspective of the religious implications for the field. The assumption underlying the approach is that religion remains a factor that influences the field of bioethics even in a secularized postmodern society. The first part of the paper analyses the main bioethical issues which mark obstetrics and gynecology, uttering that the four basic principles of bioethics are available both in obstetrics and gynecology and must be applied in (...) association with the practitioner’s virtues. The second part of the paper focuses on the main directions that guide the debate on the presence of religion in the field of bioethics, with a special interest in their relevance for reproductive medicine. Despite the difficulties implied by the task of advocating for the place of religion at the secular table of deliberation in medical ethics, the relevance of religion for bioethics cannot be ignored. This essay asks whether and how a Reformational epistemology should distinguish different types of knowledge within a unified conception of knowledge as a whole. I begin with the thesis that knowledge, in its deepest meaning, is not a thing to possess but a complex relationship to inhabit. It encompasses human knowers, practices of knowing, the knowable, known results, guiding principles, and procedures of confirmation. Within this complex relationship, humans achieve insight of various sorts. After briefly distinguishing artistic from (...) scientific knowledge, I examine two other social domains of knowledge, namely, technology and religion. Taking issue with Hendrik Hart, I then argue for the religious legitimacy of propositional beliefs, provided they support genuinely religious knowledge, which is post-propositional. Knowledge, I conclude, takes on distinct contours within different social domains; some of them, like art and technology, provide pre-propositional insight, and others, like religion, offer insight that is post-propositional. Using the Rule of Law as the theoretical framework in his paper, the author proceeds to discuss ASEAN integration. His ultimate objective is to examine the applicability of Brunnée and Toope’s Interactional International Law to ASEAN integration. To provide the background to the process of ASEAN integration, the author cites selected works of scholars and experts in the fields of international law and international relations. The most important factor to be considered is the ASEAN Charter’s inclusion of the principle of (...) the Rule of Law to guide its integration efforts. This is viewed by Western democracies as a commitment by the ASEAN Member States to the Rule of Law. Interestingly, Democracy and Human Rights stand side-by-side with the Rule of Law in the Charter. Quite expectedly, scholars and practitioners of International Law and International Relations see the inclusion of these principles as an indication of ASEAN embracing the rules, norms, and values that the West hold dearly. These are the same rules, norms and values that underpin the liberal democracies of North America and Europe, and which provide the European Union its theoretical foundation. In the EU, the Rule of Law is an important guiding principle. For the same reason, the emergence of supranational institutions became a matter of course in the process of their integration. In conclusion, the author suggests that IIL should provide the proper theoretical legal framework for ASEAN integration to move forward after taking into account the current heterogeneity in the political, economic, social and cultural profiles of the ASEAN Member States. The National Institute for Health and Care Excellence (NICE) is the UK’s primary healthcare priority-setting body, responsible for advising the National Health Service in England on which technologies to fund and which to reject. Until recently, the normative approach underlying this advice was described in a 2008 document entitled ‘Social value judgements: Principles for the development of NICE guidance’ (SVJ). In January 2020, however, NICE replaced SVJ with a new articulation of its guiding principles. Given the significant (...) evolution of NICE’s methods between 2008 and 2020, this study examines whether this new document (‘Principles’) offers a transparent account of NICE’s current normative approach. It finds that it does not, deriving much of its content directly from SVJ and failing to fully acknowledge or explain how and why NICE’s approach has since changed. In particular, Principles is found to offer a largely procedural account of NICE decision-making, despite evidence of the increasing reliance of NICE’s methods on substantive decision-rules and ‘modifiers’ that cannot be justified in purely procedural terms. Thus, while Principles tells NICE’s stakeholders much about how the organisation goes about the process of decision-making, it tells them little about the substantive grounds on which its decisions are now based. It is therefore argued that Principles does not offer a transparent account of NICE’s normative approach (either alone, or alongside other documents) and that, given NICE’s reliance on transparency as a requirement of procedural justice, NICE does not in this respect satisfy its own specification of a just decision-maker. Van Leeuwen’s Religion as Make-Believe, A Theory of Belief, Imagination, and Group Identity argues that religious and political beliefs are fundamentally different from mundane, factual beliefs and represent a cognitive attitude more akin to imagining. To ground this difference, Van Leeuwen proposes four principles defining factual beliefs: ‘involuntariness’ mandates that people cannot choose what they believe; ‘no compartmentalization’ says that factual – but not religious – beliefs guide behavior in all domains; ‘cognitive governance’ requires that inferences be readily (...) drawn from factual beliefs; ‘evidential vulnerability' entails that beliefs are revised given contradictory evidence. While factual beliefs are supposed to meet these standards, Van Leeuwen marshals evidence that religious and tribal beliefs – or “credences” – fail to obey these four principles. In this commentary, I argue that beliefs – both factual and religious – are often much more complicated than Van Leeuwen assumes. This complexity makes perfect conformity to the four principles unlikely, even for factual beliefs. I review Van Leeuwen’s evidence for credences and suggest that this evidence is compatible with the null hypothesis: that religious beliefs are simply beliefs. (shrink)
