Dans tous les pays et particulierement en Europe, les citoyens, les magistrats et les juristes en general deplorent la complexite normative. Comment traiter la complexite des normes a prendre en compte dans toutes les decisions fondees sur la regle de droit? Depuis une quinzaine d'annees, l'etude des systemes complexes a fait de grands progres tant du point de vue des methodes que de la modelisation. L'approche politique et l'approche scientifique semblent a priori eloignees, mais elles convergent sur l'interet de prendre (...) en compte un objet nouveau: la complexite des systemes. Ces systemes font emerger de nouvelles proprietes, non observables au niveau des elements constitutifs, par une dynamique difficilement previsible, et rendent vaine toute analyse en sous-systemes plus simples. Pour la premiere fois, des specialistes des systemes complexes, des juristes, des philosophes, des experts de l'action publique et de l'evaluation des lois conjuguent leurs reflexions pour depasser les problematiques de la simplification et proposent des concepts et des outils totalement nouveaux pour comprendre et traiter de facon simple l'inevitable complexite du droit. Philippe Fournier | : Le point de départ de ma proposition est que la responsabilité est un terme plus approprié que la vertu pour désigner les exhortations au devoir civique dans l’ère contemporaine. De même, à défaut de voir l’implication citoyenne comme l’expression de la rationalité individuelle ou de la conscience morale dans la sphère publique, je propose de comprendre la responsabilité comme une matrice discursive et gouvernementale qui perpétue des modèles comportementaux bien spécifiques. J’entends ainsi démontrer que (...) la responsabilité est devenue une modalité indispensable du « gouvernement de la conduite » au sein d’une rationalité néolibérale. En plus de constituer une série de dispositions morales qui remédierait aux failles et aux lacunes de l’individualisme libéral, la responsabilité se matérialise dans les incitations à une citoyenneté active et participe de ce fait à la rationalisation du retranchement de l’État de la sphère sociale. Comme l’illustrent des courants aussi divers que le néoconservatisme, le communautarisme et l’économie sociale, la responsabilité se présente moins comme une solution de rechange aux créneaux du néolibéralisme qu’une série de techniques et de standards comportementaux visant à compléter et renforcer l’application élargie d’une logique micro-économique. Je montrerai que le recours à la notion de responsabilité est particulièrement visible dans les politiques d’aide sociale et au sein des nouveaux partenariats entre l’État, le milieu communautaire et les communautés locales. En effet, l’aide étatique est de plus en plus conditionnelle à la démonstration de certaines dispositions morales et psychologiques comme la volonté, la ténacité et la probité. L’article se divise en quatre parties. La première s’attarde à définir brièvement la « gouvernementalité », concept initialement développé par Michel Foucault. La deuxième se penche sur des travaux plus contemporains, notamment ceux du sociologue britannique Nikolas Rose qui se préoccupe de la responsabilité en tant que modalité gouvernementale au sein du néolibéralisme. La troisième partie met en relief les particularités du néolibéralisme américain. En vue de cerner les pratiques et discours associés à la responsabilité de façon plus précise, la dernière partie examine l’un des principaux programmes d’aide sociale aux États-Unis, l’Aid to Families with Dependent Children, devenu le Temporary Assistance for Needy Families en 1996, des années 1980 jusqu’à aujourd’hui. | : Our point of departure is that responsibility is a more appropriate term than virtue to designate the contemporary exhortations to civic duty. Instead of seeing civic engagement as a means to express individual rationality or moral conscience in the public sphere, this paper suggests that we should understand responsability as a discursive and governmental matrix that perpetuates specific behavioral standards. More specifically, the article aims to show that responsability has become an indispensable instrument of rule within a neoliberal rationality of government. As well as pointing to a range of moral dispositions that can offset neoliberalism’s shortcomings, the notion of responsibility is mobilised in the repeated public calls to active citizenship and plays a strategic role in the discursive justification of the state’s withdrawal from the social sphere. As illustrated by strands of thought as diverse as neoconservatism, communitarianism and social economy, responsibility is less an alternative to neoliberal tenets than a series of techniques and behavioral standards that complement and reinforce the extension of a microeconomic logic to all spheres of human activity. The appeals to responsibility are particularly visible in contemporary social policies and in the strategic partnerships between the state, community organisations and local communities. Indeed, state assistance has become increasingly conditional on the demonstration of aptitudes and moral qualities like earnestness, tenacity and willpower. The article proceeds in four parts. The first part briefly defines governmentality, a concept initially developed by Michel Foucault. The second part explores Nikolas Rose’s work on advanced liberalism and takes a look at contemporary articulations of responsibility. The third part examines the specificities of American neoliberalism. In order to identify the practices and discourses linked to the notion of responsibility, the final part of the article looks at one of the main social programs in the United States, namely the Aid to Families with Dependent Children, renamed the Temporary Assistance for Needy Families in 1996, from the early 1980s to our day. Throughout our entire evolutionary history, the physical environment has played a significant role in shaping humans’ subsistence adaptations. As early humans began to colonise novel biomes and construct ecological niches, their behavioural flexibility appeared as an unquestionable fact. During the Late Pleistocene-Holocene transition, the shift from foraging to farming radically altered ecosystem services, resulting in increased exposure to zoonotic pathogens and the emergence of structural inequalities that pervade our current human condition in the Anthropocene epoch. The article seeks to use (...) an anthropological biosocial analysis to explore the diverse evolutionary paths humans have taken, which in turn shape their relationships with the natural world. Given the enigmatic nature of human behavior, it is essential to examine it holistically to understand how different subsistence patterns (e.g., intensive agriculture, foraging, and horticulture) have influenced resilience and adaptation to environmental challenges. Abū Ishāq al-Ṣaffār was one of scholars of the Western Qarakhānids’ period who followed the Kalām thought of al-Māturīdī (d. 333/944). His theological works Talkhīs al-adilla and Risāla fī al-kalām, his method in kalām, and frequent reference to his works by Ottoman and Arab scholars indicate that al-Ṣaffār is a respected and authorative Māturīdī theologian. The article focuses on his defense of the kalām. By adding a long introduction to Talkhīs about the naming, importance, and religious legitimacy of the science (...) of kalām, Saffār asserted that the kalām should be learned. When systematical vindication of the science of kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the kalām among Ḥanafī-Māturīdīs. Even though he does not state its systematic, it can be understood that vindication of kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation. Al-Ṣaffār’s defending the science of kalām shows that there were opposite thoughts against kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania. In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists. His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- SUMMARY: Abū Ishāq Ibrahīm b. Ismāil Zāhid al-Ṣaffār al-Bukhārī is a scholar belonging to the Ḥanafī theological tradition which was improved by the contribution of Ḥanafī theologians who used thinking system of Abū Ḥanīfa (d. 150/767) as base and adopted Abū Manṣūr al-Māturīdī (d. 333/944) and his thoughts in historical process. The contents of his theological works Talkhīs al-adilla li-qawāʿid al-tawḥīd and Risāla fī al-Kalām, the method that he used, and references to his works made by Ottoman and Arab scholars indicate that he is an important Māturīdī theologian. The article focuses on his defense of the science of Kalām. -/- In Talkhīs al-adilla, there are two sections including the subject of naming, and importance and necessity of Kalām discipline. Here, the necessity of learning Kalām and its value are defended in detail. -/- Besides, rumors “Abū Ḥanīfa turned away from the science of Kalām in his doomsdays” and that “He prohibited to make occupation with Kalām completely” are evaluated. -/- When systematical vindication of the science of Kalām is examined, it is understood that al-Ṣaffār is the first theologian who reserved a private and voluminous part for defensing the Kalām among Ḥanafī Māturīdīs. Even if Abū Manṣūr al-Māturīdī, Abū al-Yusr al-Bazdawī (d. 493/1100) and Abū Muʿīn al-Nasafī (d. 508/1115) defend that the science of Kalām is not wrong for religion; yet, the vindication of Kalām does not take a place under a separate title and in a detailed manner in any of Māturīdī theologians works. -/- The method that al-Ṣaffār used when he is defending the science of Kalām, differs from strategy of Abū Ḥanīfa. While Abū Ḥanīfa has mentioned that there is a need for the science of Kalām under these new circumstances, al-Ṣaffār has defended theologians who were charged with being Ahl al-Bidaʿ, by trying to prove that the prophets especially the Prophet Ibrāhīm, even the Companions of the Prophet Muḥammad (Ṣaḥāba) and the Successors of the Companions (Tābiʿūn) scholars use their minds and make arguments in religious matters. In this respect, he emphasizes that the Qurʾān orders to think and discuss gently, not to be stay in silence: “And dispute with them, using what is best” (16.125-126). Therefore, he states that this discipline which took a mission to explain and defend the creed of Islam (ʿaqīda), cannot be characterized as an innovation (bidʿah) or illicit. -/- His vindication method can be defined as a more developed type of method that Abu’l-Ḥasan al-Ash’arī’s (d. 324/935) used in Risāla fī istiḥsān al-khawḍ fī ʿilm al-kalām. Even though he does not state its systematic, it can be understood that vindication of Kalām in al-Ṣaffār divides into three parts as of explanation, demonstration and refutation: -/- a) Explanation: Explaining the necessity and importance of the science of Kalām by giving information about its definition, names, value and place among other principles. -/- b) Demonstration: Revealing the religious basics of the science of Kalām from the Qurʾān, the Sunna of the Prophet Muḥammad, the Companions of the Prophet, and the Successors of the Companions thus specifying that it is legitimate for religion. -/- c) Refutation: Replying the claims having aim to weaken the value of Kalām principle and its religious legality. -/- Al-Ṣaffār describes ‘the science of Kalām’ as ‘Knowing the Real with the evidences which help to reach the absolute information’. By allocating the concept of 'Ḥaqq', he repeats the definition of Kalām as “it is to know God with certain evidences” in a part of his work, and “it is to know the principles of religion (uṣūl al-dīn) with certain evidences” in another part. He describes Kalām as “Knowing ḥaqq / God / uṣūl al-dīn by depending on evidence”, and tries to prove that it is wrong to consider a science which performs the stated duty, as illicit and abominable and thus turn away from it. -/- Al-Ṣaffār thinks that it is right to call this principle as ‘Kalām’ because of the certain evidences leading to the truth that this science has used. This thought was defended by other theologians as well. -/- For example, according to Saʿd al-Dīn Masʿūd al-Taftazānī (d. 792/1310) it seems like to say “This is the word (kalām), not the other knowings” by the way of the power of evidences used in Kalām.Thus, it is appropriate to give name Kalām for this science which based on certain evidences. -/- Al-Ṣaffār’s explanations revealed in scope of vindication of the Kalām are adopted by some of following scholars. Ḥusām al-Dīn al-Sighnāqī (d. 714/1314) in his book called al-Tasdīd sharḥ al-Tamhīd fī qawāʿid al-tawḥīd quotes Saffâr’s explanations as the same. -/- Al-Ṣaffār indicates that the method told in the Qurʾān is to reply questions about religion, beliefs and rejection instead of remaining in silence. The duty taken on by Kalām is this vindication activity performed by the prophets whose examples are described in the Qurʾān and which is legal and demanded. His way of thinking and vindication of the Kalām resembles that of Abū Manṣūr al-Māturīdī. Al-Māturīdī says, “Prophets and we were ordered to invite infidels to Islam. When this invitation happens, the respondents will ask for evidence and explanation, and discussion will be inevitable. Therefore, discussing and talking about subjects of Kalām is not objectionable”. -/- Thoughts of al-Māturīdī and al-Ṣaffār regarding the vindication of the Kalām were repeated by Nūr al-Dīn al-Ṣābūnī (d. 580/1184), and Fakhr al-Dīn al-Rāzī (d. 606/1210) later. According to al-Ṣābūnī, the evidences put against deniers and especially the discussion made by the Prophet Ibrāhīm to defend his own belief, prove the legality of Kalām discipline. Likewise, according to al-Rāzī, the duty of Kalām is just an activity performed already in the Qurʾān and ordered to the prophets. At this point of view, since the prophets were leading to Kalām, banning this activity is nonsense. -/- According to al-Ṣaffār, the reason for why Abu Hanifa avoids his son Hammād from these discussions is that Abu Hanifa does not like discussions based on obstinate. Otherwise, it cannot be that Abū Ḥanīfa prohibits to learn Kalām and make discussion about Kalām. According to him, this behavior of Abū Ḥanīfa results from that people discussing with him are ignorant about the subject of Kalām, discussion turns to an obstinate, and coming to an end of discussion seems impossible. This comment of al-Ṣaffār is quoted in Miftāḥ al-saʿāda wa-miṣbāḥ al-siyāda by ʿIṣām al-Dīn Aḥmed b. Muṣṭafā Tashköprüzāde (d. 968/1561) and in Minaḥ al-rawḍ al-azhar fī sharḥ al-Fiqh al-akbar by ʿAlī b. Sulṭān Muḥammad al-Qārī (d. 1014/1606) as same as his words. -/- Al-Ṣaffār’s defending the science of Kalām shows that there were opposite thoughts against Kalām in the 4th/10th and 5th/11th centuries throughout in Transoxania.In this period Aṣḥāb al-Ḥadīth and Ikhwān al-Ṣafāʾ were the opposite fronts of Kalām. In addition, he was trying to go beyond the oppositions of Ḥanafī jurists (fuqahāʾ). Because some of the Ḥanafī jurists thought that Abū Ḥanīfa forsook occupation with the science of Kalām and even he prohibited his son to have interest in this discipline. But some of Ḥanafī theologians such as al-Māturīdī, al-Nasafī and al-Ṣaffār protested this thought which describes Abū Ḥanīfa as a banner for Kalām. -/- His vindication is consistent and has scholarly depth because it is able to be against a strong opposition. -/- His book Talkhīs al-adilla li-qawāʿid al-tawḥīd is a unique source in terms of containing vindication of the Kalām in detail and also influencing the approaches of the next period scholars. Thus the demand on Wi-Fi connections increased rapidly. Rule Based System is an essential method in helping using the human expertise in many challenging fields. In this paper, a Rule Based System was designed and developed for diagnosing the wireless connection problems and attain (...) a precise decision about the cause of the problem. SL5 Object expert system language was used in developing the rule based system. An Evaluation of the rule based system was carried out to test its accuracy and the results were promising. (shrink)

Purpose This study aims to analyse the impacts of Edward Snowden’s revelations in Spain focusing on issues of privacy and state surveillance. This research takes into consideration the Spanish context from a multidimensional perspective: social, cultural, legal and political. Design/methodology/approach The paper reviews the Spanish privacy and state surveillance situation. Responses to a questionnaire were collected from 207 university students studying at Universitat Rovira i Virgili or Burgos University. The quantitative responses to the survey were statistically analysed as well as (...) qualitative considerations of free-text answers. Findings The survey outcomes demonstrate that a majority of respondents are aware of Snowden’s revelations, but only a few have even considered taking serious actions to improve their online privacy. One of the most relevant findings is that Spanish citizens find it acceptable to lose privacy and be subject to state surveillance if that provides a benefit in security. Practical implications The research points out the importance of privacy in a multicultural environment. A sensitised society is a keystone for the healthy and balanced development of state surveillance policy and practice. Social implications Training programmes are a critical dimension to ensure awareness across society regarding privacy and digital technologies. Suitable educational policies and curricula at all levels should be fostered. Originality/value Privacy and state surveillance based on information and communication technologies is an emerging research topic with important consequences for social values and ethics. This study provides an overview of Spanish higher education students’ attitudes in these areas. (shrink)

Questions about the relationship between linguistic competence and expertise will be examined in the paper. Harry Collins and others distinguish between ubiquitous and esoteric expertise. Collins places considerable weight on the argument that ordinary linguistic competence and related phenomena exhibit a high degree of expertise. His position and ones which share close affinities are methodologically problematic. These difficulties matter because there is continued and systematic disagreement over appropriate methodologies for the empirical study of expertise. Against Collins, it will be argued (...) that the term ‘expertise’ should be reserved for expertise (esoteric experts) and exclude everyday performance (ubiquitous experts). Wittgensteinian ideas will be employed to maintain that it is mistaken and misleading to derive substantive conclusions about the epistemology of expertise from ordinary linguistic competence and vice versa. Significant attention will be devoted to the notion of following a rule with particular reference to the intelligibility of tacit rule following. A satisfactory theoretical approach to expertise should not involve making important claims about ordinary linguistic competence. (shrink)

This paper studies Robert Boyle's account of kinds and classification. A number of commentators have argued that, for Boyle, classifications are inevitably the product of conventions. Others have challenged this reading, arguing that, according to Boyle, the corpuscular makeup of bodies gives rise to hard-edged natural kinds and classes. We argue that Boyle's position is more complicated than the available realist and conventionalist readings acknowledge. We argue that, according to Boyle, the individuation of kinds was to some degree the result (...) of convention. At the same time, however, Boyle held that our classificatory practices are subject to constraints. We identify some of these constraints by turning to Boyle's discussion of the late scholastic debate about the plurality of forms, in particular the contributions of Jacopo Zabarella and Daniel Sennert. In this way, we clarify how Boyle strikes a balance between realist and conventionalist elements in his treatment of kinds. (shrink)

The Kantian legacy has had a key impact on the landscape of theoretical philosophy in the first half of the twentieth century. Philosophers both in Germany and in Russia saw Immanuel Kant’s ideas as seminal for their philosophical research. The main schools of that era were formed in discussions of the problems and the solutions which were proposed by Kant. The methodological legacy of the critical philosophy effectively became the main benchmark of the thinking of a whole generation of intellectuals. (...) Research into the unity of “form” in the structure of human cognition was also in many ways mediated by the Kantian tradition. To prove this thesis I first look at the philosophy of Gustav Shpet who creatively interpreted the German tradition and proposed an original project of his own, and then I examine the theory of Ernst Cassirer, an outstanding representative of Neo-Kantianism who in the later period of his work proposed considering the phenomena of the humanities to be symbolic forms closest to the spontaneity of the biological. The common feature of the approaches of the two philosophers is their attempt to preserve the integrity of cognition which is destroyed by mathematisation of the common denominator (ultimate categorisation) and hierarchisation of the phenomena of human life. The alternative is the metaphor of mutational change, through which the concept of “form” acquires a new meaning. In conclusion I show that the analysis of the projects of Shpet and Cassirer has heuristic value for the historical-philosophical understanding of the fate of the Kantian philosophy and for modern philosophical culture. Following mainly Ricoeur’s understanding of ideology and assuming as fundamental premise the idea that this phenomenon is rooted in the exact same ground as the metaphysics of everyday life, the author argues that every ideology, at a social level, has two types effects: vulgar effects (in the originary sense of the word) and limit effects defined as those types of effects which exceed any institutional or communitarian reason and whose distinctive mark is the excessive violence in an arbitrary or pathological (...) form. The paper centres on this latter type and traces its history in the sphere of philosophy since Pythagoras, through Socrates Boethius, Descartes, Schelling and up to Russian or Romanian philosophy of our times. Many drugs used in paediatric medicine are off-label. There is a rising call for the use of adaptive clinical trial designs in responding to the need for safe and effective drugs given their potential to offer efficiency and cost-effective benefits compared with traditional clinical trials. ADs have a strong appeal in paediatric clinical trials given the small number of available participants, limited understanding of age-related variability and the desire to limit exposure to futile or unsafe interventions. Although the ethical value (...) of adaptive trials has increasingly come under scrutiny, there is a paucity of literature on the ethical dilemmas that may be associated with paediatric adaptive designs. This paper highlights some of these ethical concerns around safety, scientific/social value and caregiver/guardian comprehension of the trial design. Against this background, the paper develops a non-static conceptual lens for understanding PADs. It shows that ADs are epistemically open and reduce some of the knowledge-associated uncertainties inherent in clinical trials as well as fast-track the time to draw conclusions about the value of evaluated drugs/treatments. On this note, the authors argue that PADs are ethically justifiable given they have multiple layers of safety, exposing enrolled children to lesser potential risks, create social/scientific value generally and for paediatric populations in particular, specifically foster the flourishing of paediatric populations and can significantly improve paediatric trial efficiency when properly designed and implemented. However, because PADs are relatively new and their regulatory, ethical and logistical characteristics are yet to be clarified in some jurisdictions, the cooperation of various public and private stakeholders is required to ensure that the interests of children, their caregivers and parents/guardians are best served while exposing paediatric research subjects to the most minimal of risks when they are enrolled in paediatric trials that use ADs. This essay deploys the existence of epistemic vices in the trajectory of Western philosophy to map the erasures and complicities that accompanied the emergence of contemporary African philosophy (CAP1). It argues that the complicity of CAP1 in the hyperspecialization and academic self‐absorption that marked the professionalization of Western philosophy, makes it difficult to attend to the conditions for its own possibility. CAP1 arguably needs to make a critical turn into critical African philosophy (CAP2), understood as a metatheoretical and metaphilosophical framework (...) for an internal transformation that is emancipatory. CAP2 is envisioned, first, as a critique of postcoloniality that rehumanizes the autonomous African subject; and, second, as an ethicopolitical project that explores the cracks between philosophy as theoretical practice and philosophy as praxis in opening up the spaces for postcolonial emancipation. The essay identifies three conditions that instigate the emancipatory possibility of philosophizing on the continent: the spatial/platial, demosophic, and political. (shrink)

Gallicanism is specifically related to the Catholic Church of France, and it is a set of ecclesiastical and political doctrines and practices which tried to limit the powers of the Papacy in France in general. In particular, it characterized the situation of the Catholic Church in France at certain periods. The emergence of Gallicanism as a specific idea came about in the 14th century and was first used as a term in 1810. Almost everything expressed by Gallicanism is a distinctive (...) development within the French Catholic Church. Gallicanism was mostly about the riches of the Catholic Church and administrative matters rather than a theological movement. These issues were mostly related to episcopal jurisdiction, appointments of bishops, church properties and revenues, and at the core of all these issues lay the sharing of church revenues. The French Crown began to acquire gains, especially regarding the property and financial income of the church with the weakening of the power of the Papacy. This new situation left the bishops between the popes and the kings, and prepared the ground for the development of Gallicanism in the country. However, Gallicanism did not come around as a separatist movement and did not lead to the separation of the Catholic Church of France from the Roman Catholic Church. Due to the conflicts of interests between the king, parliament and the clergy, Gallicanism could not develop into a monolithic thought or doctrine, it manifested itself in different perspectives. These manifestations have been treated as Episcopal, Parliamentary, and Royal Gallicanism in most academic studies. Each of these different Gallican ideas brought to the fore the institutions indicated in their naming and received support from them. However, all three versions of Gallicanism shared some common ideals. These are the common ideals of different Gallicanisms: (1) the independence of the king of France in worldly affairs, (2) the supremacy of an ecumenical council over the pope, and (3) the restriction of the pope's intervention in the French Catholic Church. Royal Gallicanism aimed to gather the powers snatched away from the Papacy in the hands of the king. Parliamentary Gallicanism shared similar principles with Royal Gallicanism. (shrink)

A history of the comic has not yet been written. According to historians, the comic had very different, and sometimes even opposite causes, in relation to different ages and cultures. What provoked laughter in one civilization could be taken quite seriously in another. The comic has always had a particular function and its nature, its internal composition, has not been immutable. It could be kept within the limits of a single sphere that was assigned to it in particular (the comic, (...) as opposed to the tragic), but it could also be elevated to a conceptual vision of the world, and in this case, it embraced much more universal domains of human history. Nevertheless, nothing has been written on the history of the comic throughout all ages and encompassing all peoples. Serious studies concerning the place it occupies in the history of civilizations are, however, of great interest. (shrink)

Simply stated, Pragmatic Invariantism is the view that the practical interests of a person can influence whether that person’s true belief constitutes knowledge. My primary objective in this article is to show that Pragmatic Invariantism entails external world skepticism. Toward this end, I’ll first introduce a basic version of Pragmatic Invariantism (PI). Then I’ll introduce a sample skeptical hypothesis (SK) to the framework. From this I will show that it is extremely important that the phenomenally equivalent skeptical scenarios generated by (...) SK are actually false. We’ll then see that by combining PI and SK, the effect will be to place extremelyhigh demands upon evidence for ~SK. It will finally be observed that, while we may have good evidence for ~SK, we do not have extremely strong evidence sufficient for establishing ~SK. This supports my conclusion that any standard version of Pragmatic Invariantism ultimately entails external world skepticism. If successful, my conclusion will critically undermine the current view that Pragmatic Invariantism is actually a skeptically resistant position. (shrink)

Many collective decision making problems have a combinatorial structure: the agents involved must decide on multiple issues and their preferences over one issue may depend on the choices adopted for some of the others. Voting is an attractive method for making collective decisions, but conducting a multi-issue election is challenging. On the one hand, requiring agents to vote by expressing their preferences over all combinations of issues is computationally infeasible; on the other, decomposing the problem into several elections on smaller (...) sets of issues can lead to paradoxical outcomes. Any pragmatic method for running a multi-issue election will have to balance these two concerns. We identify and analyse the problem of generating an agenda for a given election, specifying which issues to vote on together in local elections and in which order to schedule those local elections. Reciting "Tajweed" the Holy Quran in the appropriate way is very important for all Muslims and is obligatory in Islamic devotions such as prayers. In this paper, the researchers introduce an intelligent tutoring system for teaching Reciting "Tajweed". Our "Tajweed" tutoring system is limited to "Tafkhim and Tarqiq in TAJWEED" the Holy Quran, Rewaya: Hafs from ‘Aasem. (...) Ou bien n'était-on pas amené à soupçonner que ces produits de (...) l'imagination populaire enfermaient des vérités de première importance, et toutes destinées à figurer dans un système strictement positif? L'auteur des Propos a réalisé pour la religion ce qu'il avait déjà essayé pour les Beaux-Arts avec le succès que l'on sait, c'est-à-dire donner tout son sens à l'imagination vraie par un exposé continu et systématique. Du moment que les mythes directeurs de notre civilisation signifiaient des vérités humaines de grand prix, il fallait chercher, en remontant, ce que signifiaient déjà les mythes olympiens de la puissance, et, encore au delà, le sens de ces étranges religions qui ont pour objets les choses de nature, le volcan, le serpent, la vache. Au delà, et comme un fond de tableau, s'offraient les Contes qui sont partout les mêmes et éternellement jeunes. Il s'agissait de discerner en quoi toutes ces religions sont vraies, en quoi les contes eux-mêmes sont vrais. C'est ce que l'auteur a exécuté en commençant par les contes, en passant de là à la religion panthéiste, puis à la religion politique qui est le culte des héros, et enfin à la religion de l'esprit, la plus haute. Et l'idée neuve, appuyée sur ces quatre assises, c'est que ces religions sont et seront toujours vraies, et indiquent plutôt, selon le mot de l'auteur, les étages de l'homme que les étapes de l'homme. L'exécution est faite dans un mouvement lyrique, mesuré sur le sujet même, en sorte que l'harmonie entre les mythes populaires et la structure humaine est toujours rappelée comme étant ici la preuve de choix. Et du reste il est évident, par la sobriété et l'équilibre de la composition, que l'auteur a voulu faire court autant qu'il était possible de façon que l'ensemble ne cessât jamais d'éclairer les parties. Le moins qu'on puisse dire c'est que cet ouvrage doit plonger les esprits profondément religieux, comme les esprits irréligieux, dans un prodigieux étonnement, par un radical changement des perspectives, et, on oserait dire, par l'abolition d'un genre de polémique qui n'a jamais mené à rien. This book expands the sociological canon by introducing non-Western and female voices, and subjects the existing canon itself to critique. Including chapters on both the 'founding fathers' of sociology and neglected thinkers it highlights the biases of Eurocentrism and androcentrism, while also offering much-needed correctives to them. The authors challenge a dominant account of the development of sociological theory which would have us believe that it was only Western European and later North American white males in the nineteenth and early (...) twentieth century who thought in a creative and systematic manner about the origins and nature of the emerging modernity of their time. This integrated and contextualised account seeks to restructure the ways in which we theorise the emergence of the classical sociological canon. Stemming from the realization of the importance of the role of explanation in the science classroom, the Next Generation Science Standards call for appropriately supporting students to learn science, argue from evidence, and provide explanations. Despite the ongoing emphasis on explanations in the science classroom, there seems to be no well-articulated framework that supports students in constructing adequate scientific explanations, or that helps teachers assess student explanations. Our motivation for this article is twofold: First, we think that the ways in (...) which researchers in science education have studied scientific explanation are, at best, leaves much to be desired and, at worst, simply incomplete. Second, we believe that research about the teaching and learning of explanation in science classrooms must be guided by explicit models or frameworks that specify elements involved in constructing explanations particularly applicable to science. More importantly, we think that the development of such models or guidelines should be based on theoretical and philosophical foundations. In order to develop these frameworks or guidelines, we first outline and clarify models of scientific explanation developed by philosophers of science over the last few decades. In the second section of this article, we present a more recent philosophical work on scientific explanation, the pragmatic approach to studying scientific explanations. This approach suggests a toolbox for analyzing scientists’ scientific explanations, which provides a useful instrument to science education. In Section 3, we discuss the ways by which the previous two sections are useful in developing a K-12 scientific explanation schema. Implications for future research on students’ explanations are discussed. (shrink)

This paper reports a psychological study of human categorization that looked at the procedures used by expert scientists when dealing with puzzling items. Five professional botanists were asked to specify a category from a set of positive and negative instances. The target category in the study was defined by a feature that was unusual, hence situations of uncertainty and puzzlement were generated. Subjects were asked to think aloud while solving the tasks, and their verbal reports were analyzed. A number of (...) problem solving strategies were identified, and subsequently integrated in a model of knowledge‐guided inductive categorization. Our model proposes that expert knowledge influences the subjects' reasoning in more complex ways than suggested by earlier investigations of scientific reasoning. As in previous studies, domain knowledge influenced our subjects' hypothesis generation and testing; but, additionally, it played a central role when subjects revised their hypotheses. (shrink)

Most scholarly contributions analysing the Han Feizi tend not only to overlook the influence military literature might have had on its conception and unfolding, but also to assert that the figure of the ruler, as described in this text, and that of the commander, as portrayed in military treatises, are incompatible. In refuting this view, I shall attempt to demonstrate that the writings collected in the Han Feizi fully embrace the logic of military con- frontation, which entails, among other things, (...) the deployment of deception and irregular procedures as a necessary means to secure sovereign power and to achieve a complete control of the administration. Accordingly, I shall show that a comprehensive understanding of this important work in the history of classical Chinese thought is not possible unless one takes into account this convergence of shared ideas and concepts from both spheres, that of military strategy and that of political science as set forth in the Han Feizi. Civil Sphere Theory (CST) provides a more dynamic, cultural, and democratically oriented model of contemporary society than either conflict or modernization theory. Civil spheres expand and contract in contradictory ways. Utopian periods of utopian repair trigger defensive efforts that primordialize and exclude. Late 20th century civil repair generated new relations of economic production and more multicultural modes of integration. Early 21rst century reactions have highlighted dangers, demanding more cultural homogeneity amidst rising concerns about inequality. Bas van Fraassen claims that constructive empiricism strikes a balance between the empiricist’s commitments to epistemic modesty – that one’s opinion should extend no further beyond the deliverances of experience than is necessary – and to the rationality of science. In “Should the Empiricist be a Constructive Empiricist?” I argued that if the constructive empiricist follows through on her commitment to epistemic modesty she will find herself adopting a much more extreme position than van Fraassen suggests. Van Fraassen and Bradley (...) Monton have recently responded. My purpose here is to contest their response. The goal is not merely the rebuttal of a rebuttal; there is a lesson to learn concerning the realist/anti-realist dialectic generated by van Fraassen’s view. (shrink)

Keeping to this book’s title, he now gives us a remarkable collation of recent studies on the social and theological contexts of the Bible itself. He seems quite confident that given a comprehensive review, we will intuit modern implications for ourselves and be drawn closer together by our common heritage.Written for a wide audience, Barrera’s clear and readable book compiles fascinating snapshots of the diverse cultural situations and beliefs that unfold across the millennium-spanning canon. Even biblical scholars will enjoy this lively, up-to-date tour of their field.As a monastic, Barrera is careful to show that those New Testament texts that seem to call for divestment of property describe a situation-related special calling and do not make poverty an end in itself. Yet he stresses how the “preferential status of the poor” and the “devaluation of wealth” are prime norms that recur throughout both the Old Testament and New Testament and that he sees backed by both revelation and natural experience.One may find the book limited by the procrustean selectivity that seems inevitable when pre-formed notions (e.g., what is proper to our modern discipline of ethics or to the field of economics) shape our apperceptions of ancient [End Page 205] peoples’ concerns. From Barrera’s viewpoint, ethics has to do primarily with the promulgation and refinement of set norms. So his main goal is to uncover abstract principles and norms for behavior that recur insistently across scripture’s enormous diversity. This, he does beautifully. But in the process, he lets the recurrent trump the emergent.For example, Barrera seems to not fully appreciate the revolutionary impact where Jesus finally declares it impossible for people to bolster their personal stature by pursuing such norms (see, e.g., Mk 10:27). Little attention is given the apostles’ insistence (with Ps 14 and Ps 53) upon this same ethical impasse. For when they find the normative redefined by Christ’s excruciatingly holistic love command, they not only discover their own incapacity but also find themselves catapulted into the totally grace-dependent motivational dynamic described by Paul’s Christian freedom (Rom 3:12, 5, passim, 11:32; Gal 3:22; Jas 2:10).Evidently preoccupied by his quest for the normative, Barrera bypasses the historical priority of Paul and virtually ignores how his grace-responsive freedom pervades the later Gospels and Acts. In constructivist contractualist theories, such as Rawls’, principles of justice should mirror beliefs that we all, in some sense, share. One would then arrive at principles that everybody could, in that sense, accept. These principles should specify, among other things, to whom to distribute the relevant benefits and burdens and to whom to assign responsibility for the distribution. In addition to this classical assignment problem, however, constructivist contractualism must also deal with a new, and quite different, assignment problem sincewhat to (...) count as beliefs that weall share depends on how the set of people that make up the “we” is delimited. Thus, for constructivist contractualism, the questions of whom to assign a part in the justification procedure and whom to exclude, and how to justify these inclusions and exclusions, are of crucial importance. In this chapter we consider the inclusion or exclusion of future generations, and how this case illuminates a general problem for constructivist contractualism. (shrink)

Although they are often used as synonyms, emancipation and liberation constitute two distinct normative horizons in critical theory of society. In this article, I offer an analysis of these two concepts, including their historical and epistemological characteristics, pointing out similarities, differences and the possibilities for their combined use as basis of models of normative social criticism. I argue that the critical horizon of human emancipation emerges in post-Kantian European thought, while the horizon of liberation was developed in Latin American decolonial (...) thinking in the second half of the 20th century. The horizon of emancipation arises with the critique of the primacy of systemic domination, while liberation emerges in the resistance to the primacy of the experience of oppression. The analytical distinction between these two normative horizons can be helpful to better understand both the foundations of epistemic decolonization and the potential for dialogue between the critical perspectives of center and periphery. Moreover, his works have provoked at least that number of seldom-translated major studies by others. Bachelard reads as a modern, even post-modern, scholar. His polemical position as an anti-positivist and his fascination with dynamical process place him in the emerging paradigm within semiotics' major tradition. There is growing consensus that reward plays an important role in the control of attention. Until recently, reward was thought to influence attention indirectly by modulating task-specific motivation and its effects on voluntary control over selection. Such an account was consistent with the goal-directed (endogenous) versus stimulus-driven (exogenous) framework that had long dominated the field of attention research. Now, a different perspective is emerging. Demonstrations that previously reward-associated stimuli can automatically capture attention even when physically inconspicuous and task-irrelevant challenge previously (...) held assumptions about attentional control. The idea that attentional selection can be value driven, reflecting a distinct and previously unrecognized control mechanism, has gained traction. Since these early demonstrations, the influence of reward learning on attention has rapidly become an area of intense investigation, sparking many new insights. The result is an emerging picture of how the reward system of the brain automatically biases information processing. Here, I review the progress that has been made in this area, synthesizing a wealth of recent evidence to provide an integrated, up-to-date account of value-driven attention and some of its broader implications. This essay clarifies Nietzsche's early views on truth and falsity by giving a systematic reading of On Truth and Lie in the Extra-Moral Sense. Contrary to the prevailing view in recent Nietzsche scholarship, I argue that Nietzsche, in TL, affirms neither truth as correspondence nor the inevitable falsification of the world by cognition. I show that where Nietzsche appears to affirm falsification, he is in fact giving a reductio ad absurdum of truth as correspondence and the notion of objectivity on (...) which it relies. Though I limit my discussion to TL, I engage the more general debate around falsification by showing that more than one sense of falsification is at work in Nietzsche's discussions of truth and cognition. I argue that by criticizing illusory conceptions of truth, essence, and objective knowledge, Nietzsche develops a conception of cognition that prefigures his later naturalistic and perspectival accounts of knowledge. Because of the clear links between the views sketched in the early essay and Nietzsche's later philosophical project, I conclude that TL sets out positions and a project that Nietzsche continues to develop and experiment with throughout his "mature" work.Dieser Aufsatz erläutert Nietzsches frühes Verständnis von Warheit und Fälschung durch eine systematische Auslegung von Ueber Wahrheit und Lüge im aussermoralischen Sinne. In this article I discuss the emergence of Female Sexual Dysfunction (FSD) within American psychiatry and beyond in the postwar period, setting out what I believe to be important and suggestive questions neglected in existing scholarship. Tracing the nomenclature within successive editions of the American Psychiatric Association’s Diagnostic and Statistical Manual ( DSM), I consider the reification of the term ‘FSD’, and the activism and scholarship that the rise of the category has occasioned. I suggest that analysis of FSD benefits (...) from scrutiny of a wider range of sources (especially since the popular and scientific cross-pollinate). I explore the multiplicity of FSD that emerges when one examines this wider range, but I also underscore a reinscribing of anxieties about psychogenic aetiologies. I then argue that what makes the FSD case additionally interesting, over and above other conditions with a contested status, is the historically complex relationship between psychiatry and feminism that is at work in contemporary debates. I suggest that existing literature on FSD has not yet posed some of the most important and salient questions at stake in writing about women’s sexual problems in this period, and can only do this when the relationship between ‘second-wave’ feminism, ‘post-feminism’, psychiatry and psychoanalysis becomes part of the terrain to be analysed, rather than the medium through which analysis is conducted. This collection presents the first sustained examination of the nature and status of the idea of principles in early modern thought. Principles are almost ubiquitous in the seventeenth and eighteenth centuries: the term appears in famous book titles, such as Newton’s _Principia_; the notion plays a central role in the thought of many leading philosophers, such as Leibniz’s Principle of Sufficient Reason; and many of the great discoveries of the period, such as the Law of Gravitational Attraction, were described as (...) principles. Ranging from mathematics and law to chemistry, from natural and moral philosophy to natural theology, and covering some of the leading thinkers of the period, this volume presents ten compelling new essays that illustrate the centrality and importance of the idea of principles in early modern thought. It contains chapters by leading scholars in the field, including the Leibniz scholar Daniel Garber and the historian of chemistry William R. Newman, as well as exciting, emerging scholars, such as the Newton scholar Kirsten Walsh and a leading expert on experimental philosophy, Alberto Vanzo. _The Idea of Principles in Early Modern Thought_ charts the terrain of one of the period’s central concepts for the first time, and opens up new lines for further research. How is it possible, that after the exhilarating start of democratic transitions in the late 1980s and 1990s, today authoritarian–populist options seem to be emerging in many new, as well as old democracies? Why does populism, that in most of its historical varieties has been anti-institutional and anti-procedural, turn to constitution making and constitutional rhetorics as one of its main arenas of contestation? The answers to these questions are related. In the following, in the form of six theses, I start (...) with what I mean by ‘populism’. Next, I wish to point to the two deficits of liberal democracy that provides the context for the rise of populist politics. These deficits according to me have been intensified in many of the new democracies. I continue by stressing populisms own deficits as the reason for turning to the constituent power. I end with a consideration of what liberal democrats can do to address the causes of the populist temptation. (shrink)

Cet article s’intéresse à l’histoire et au contenu de la pensée corporatiste française pendant la période de l’Occupation. Dans ce cadre, son objet se limite cependant à l’étude de la contribution intellectuelle des seuls économistes français, et parmi eux uniquement aux universitaires. La référence à la pensée corporatiste concerne ici à la fois leurs analyses et leurs choix méthodologiques, ainsi que leurs réflexions en matière de politique économique. Notre article ne s’intéressera donc que très brièvement à l’origine strictement historique du (...) corporatisme à moins qu’elle ne recoupe certains des débats de fond qui ont eu lieu sous l’Occupation. La première partie de notre contribution porte sur le contexte de l’émergence de la pensée économique corporatiste pendant la période de l’Occupation allemande. La deuxième partie s’intéresse aux recherches universitaires qui ont tenté de mener un travail à dominante économique sur le corporatisme. Six auteurs voient leurs contributions mises en avant : Maurice Bouvier-Ajam, Louis Salleron, Louis Baudin, Gaëtan Pirou, François Perroux et Henri Denis. This article establishes the relevance of Anna-Teresa Tymieniecka’s work for understanding human communication. Tymieniecka’s cosmology, available in her four-volume series Logos and Life (1988–2000) and supplemented by prolific writings across several decades, articulates a ‘third phenomenology’ – a phenomenology of life. Her work fulfils Edmund Husserl’s original phenomenology of consciousness and Roman Ingarden’s second phenomenology of realism/idealism. Tymieniecka’s ontopoietic cosmology, which strenuously resists linear form, is interwoven with the possibilities of human communication. Her works explain life as the expansion of (...) logos: recursively the vital sphere initiates logos, forcing the existential sphere, concurrently prompting the social sphere of the human condition. The human station reveals meaning-bestowing functions: the creative-imaginative origin urges the aesthetic, moral, and intellective senses. Self-individualizing development concurrently desires communicative participation in life. The lived-body and sign/word allow one to re-establish ties to communal life after self-individualization. At the human ‘crown’, life recedes through an individual quest for spiritual development, inspired by a desire for transcendence. (shrink)

The ancient Athenians believed that their forebears sprang directly from the earth rather than being created by gods or born of human parents. In some version of the myth, the ancestor was depicted as having a man's form above the waist and a snake's form below: "Having emerged from the earth, he still in part resembled the creature that slips to and fro between the upper and lower worlds."'1 At the beginning of her 1947 work, The Ethics of Ambiguity, Simone (...) de Beauvoir asserts that there is a fundamental ambiguity to human life. According to her, every human, like the chthonic ancestor of the Athenians, exists at the same time in two realms: "he is still part of the world of which he is conscious."2 Rooted as they are in the earth, humans can transcend their material origin in thought but they can never escape it. The article analyzes the concept of practical ethics in the moral philosophy of Thomas Reid. The significance of this study is determined by the fact that Reid, for the first time in the history of ethics, offers an internally differentiated conception of moral philosophy, which includes two parts: the theory of morality and practical ethics. The theory of morality studies the conditions for the possibility of morality. Practical ethics is normative, deals directly with the content of morality. Both parts of (...) moral philosophy is cognitive in the nature. By distinguishing the theory of morality and practical ethics, Reid expresses a key idea for him: the distinction between good and evil and the fulfillment of duties is attainable to any reasonable person free from the influence of passions and prejudices. They do not need any special philosophical knowledge to fulfill their duty. Reid’s idea was perceived in contemporary ethics as a possible key for overcoming the difficulties that applied ethics faces today: the problem of confirming its philosophical status; the problem of the relevance of its guidelines, which are often perceived as abstract theorizing by specialists in specific fields. Reid showed that in morality, unlike other sciences such as anatomy, there can be no experts, and in order to be relevant, ethics must speak the same language with those to whom it addresses, and about those specific problems that are essential to them. This paper examines the economic impact of implementing Corporate Social Responsibility in the supply chain operations of multinational corporations. Because they have global supply chains in emerging markets, MNCs face certain operational challenges. For example, unethical operations often result in a huge loss to MNCs in the long run, even though their initial cost seems to be low. In this paper, we extend the Bullwhip Effect theory in supply chain management to the ethical operations context, and define and evaluate a (...) special Bullwhip Effect due to Unethical Operations. Using economic data from various sources including Ford, Toyota, and GM in the auto industry, we first estimate the indices of BEUO for the three companies and demonstrate the economic necessity for MNCs to incorporate CSR with supply chain operations. We then propose a coherent approach, blending what we term the bottom-up and proactive methods, to achieve such an outcome. The bottom-up approach requires MNCs to switch their focus on stakeholders, shifting from shareholders to consumers and workers, and on decision levels from public relationships to supply chain operations. The proactive approach recommends initializing specific CSR operations to mitigate the negative impact of BEUO. Both theoretical analysis and case studies are conducted to evaluate our developed propositions that MNCs adopting the proposed CSR operations will in the long run achieve better economic performance. Recommended actions for implementation, based on best practices, are also presented. (shrink)

The current global economic crisis is historically unprecedented in that it began when poor groups in the United States defaulted on their mortgage-payments and spread fear of 'toxic debt' through an internationalised financial system, bringing the banking system close to collapse and highlighting the very individualised nature of contemporary financial relations. The symposium explores contemporary finance and banking practices in the context of Marxist political economy seeking to develop the notion of financialisation and arguing that banks' increasing reliance on individual (...) households as a source of profits amounts to a form of financial expropriation or additional profit generated in the sphere of circulation. A major driving force behind the attention that cognitive neuroscience has received in recent decades is the deep mystery of how consciousness is related to brain activity. Many scientists have been fascinated by the wealth of empirical data for individual neurons, neural assemblies, brain areas, and related psychological and behavioral features, and by progressively powerful computational tools to simulate corresponding cortical networks. At the same time, the interested public has been attracted by fancy illustrations of brain activity (e.g., from imaging (...) techniques) and by pretentious claims of neural solutions to basic philosophical problems (e.g., free will versus determinism) in popular magazines and newspapers. However, heaps of data, extensive simulations, pretty pictures and bold statements cannot replace the insight that is inevitable to relate the available facts to one another in an intelligible manner. I am talking about the old-fashioned stance that understanding is the ultimate goal of scientific effort. In this respect, the need for new conceptual and theoretical ideas in cognitive neuroscience begins to be recognized by prominent representatives of the field. Theory in this sense must not be confused with models fitting data, e.g. by regression algorithms, cluster analyses, etc. It is uncontroversial that experimental and numerical work is and will remain mandatory for scientific progress. But it can only unfold its full value if it is embedded within a profound theoretical framework. To formulate a serious, clear-cut and transparent formal framework for cognitive neuroscience is a challenge comparable to the early stage of physics four centuries ago. Only very few approaches worth mentioning are visible in contemporary literature. I think that Wallace’s book presents an appreciable step in the right direction. However, it is not the ultimate breakthrough yet. Much is left for future work before a full-fledged theory of consciousness will be established. In two central conceptual respects, Wallace builds on earlier work: Dretske’s (1981) usage of informational terms in consciousness research and Baars’ (1988) global neuronal workspace model.. Many philosophical and scientific discussions of topics of mind-matter research make implicit assumptions, in various guises, about the distinction between mind and matter. Currently predominant positions are based on either reduction or emergence, providing either monistic or dualistic scenarios. A more-involved framework of thinking, which can be traced back to Spinoza and Leibniz, combines the two scenarios, dualistic (with mind and matter separated) and monistic (with mind and matter unseparated), in one single picture. Based on such a picture, the transition (...) from a domain with mind and matter unseparated to separate mental and material domains can be viewed as a result of a general kind of symmetry breaking, which can be described formally in terms of inequivalent representations. The possibility of whether this symmetry breaking might be connected to the emergence of temporal directions from temporally non-directed or even non-temporal levels of reality will be discussed. Correlations between mental and material aspects of reality could then be imagined as remnants of such primordial levels. Different conceivable types of inequivalent representations would lead to correlations with different characteristics. (shrink)
