BackgroundThe informed consent process in clinical trials has been extensively studied to inform the development processes which protect research participants and encourage their autonomy. However, ensuring a meaningful informed consent process is still of great concern in many research settings due to its complexity in practice and interwined socio-cultural factors.ObjectivesThis study explored the practices and meaning of the informed consent process in two clinial trials conducted by Oxford University Clinical Research Unit in collaboration with the Hospital for Tropical Diseases in (...) Ho Chi Minh City, Vietnam.MethodsWe used multiple data collection methods including direct observervations, in-depth interviews with study physicians and trial participants, review of informed consent documents from 2009 to 2018, and participant observation with patients’ family members. We recruited seven physicians and twenty-five trial participants into the study, of whom five physicians and thirteen trial participants completed in-depth interviews, and we held twenty-two direct observation sessions.ResultsWe use the concept “fragmented understanding” to describe the nuances of understanding about the consent process and unpack underlying reasons for differing understandings.ConclusionsOur findings show how practices of informed consent and different understanding of the trial information are shaped by trial participants’ characteristics and the socio-cultural context in which the trials take place. Despite the frequency of stillbirths, the subsequent implications are overlooked and underappreciated. We present findings from comprehensive, systematic literature reviews, and new analyses of published and unpublished data, to establish the effect of stillbirth on parents, families, health-care providers, and societies worldwide. Data for direct costs of this event are sparse but suggest that a stillbirth needs more resources than a livebirth, both in the perinatal period and in additional surveillance during subsequent pregnancies. Indirect and intangible costs of stillbirth are (...) extensive and are usually met by families alone. This issue is particularly onerous for those with few resources. Negative effects, particularly on parental mental health, might be moderated by empathic attitudes of care providers and tailored interventions. The value of the baby, as well as the associated costs for parents, families, care providers, communities, and society, should be considered to prevent stillbirths and reduce associated morbidity. Emotion recognition plays an important part in human-computer interaction. Currently, the main challenge in electroencephalogram -based emotion recognition is the non-stationarity of EEG signals, which causes performance of the trained model decreasing over time. In this paper, we propose a two-level domain adaptation neural network to construct a transfer model for EEG-based emotion recognition. Specifically, deep features from the topological graph, which preserve topological information from EEG signals, are extracted using a deep neural network. These features are then passed through (...) TDANN for two-level domain confusion. The first level uses the maximum mean discrepancy to reduce the distribution discrepancy of deep features between source domain and target domain, and the second uses the domain adversarial neural network to force the deep features closer to their corresponding class centers. We evaluated the domain-transfer performance of the model on both our self-built data set and the public data set SEED. In the cross-day transfer experiment, the ability to accurately discriminate joy from other emotions was high: sadness, anger, and fear on the self-built data set. The accuracy reached 74.93% on the SEED data set. In the cross-subject transfer experiment, the ability to accurately discriminate joy from other emotions was equally high: sadness, anger, and fear on the self-built data set. The average accuracy reached 87.9% on the SEED data set, which was higher than WGAN-DA. The experimental results demonstrate that the proposed TDANN can effectively handle the domain transfer problem in EEG-based emotion recognition. (shrink)

Although the doctrine of divine simplicity has faced substantial criticism in recent years, Jeffrey Brower has recently offered a novel defense of the view by appealing to contemporary truthmaker theory. In this paper, I will argue that Brower’s defense of divine simplicity requires an implausible account of how truthmaking works for essential intrinsic predications. I will first argue that, unless Brower is willing to make an ad hoc exception for how truthmaking works in God’s case, he is committed to saying (...) that essential intrinsic predications about any object are made true by that object alone, not by its having essential properties. I will then argue that reflecting on cases where distinct essential intrinsic predications about an object have different causal explanations behind them shows that this general view of truthmaking is implausible. The contention that medical artificial intelligence (AI) should be ‘explainable’ is widespread in contemporary philosophy and in legal and best practice documents. Yet critics argue that ‘explainability’ is not a stable concept; non-explainable AI is often more accurate; mechanisms intended to improve explainability do not improve understanding and introduce new epistemic concerns; and explainability requirements are ad hoc where human medical decision-making is often opaque. A recent ‘political response’ to these issues contends that AI used in high-stakes scenarios, including medical (...) AI, must be explainable to meet basic standards of legitimacy: People are owed reasons for decisions that impact their vital interests, and this requires explainable AI. This article demonstrates why the political response fails. Attending to systemic considerations, as its proponents desire, suggests that the political response is subject to the same criticisms as other arguments for explainable AI and presents new issues. It also suggests that decision-making about non-explainable medical AI can meet public reason standards. The most plausible version of the response amounts to a simple claim that public reason demands reasons why AI is permitted. But that does not actually support explainable AI or respond to criticisms of strong requirements for explainable medical AI. (shrink)

A principal hipótese deste trabalho é a de que Sócrates, na Apologia de Platão, utiliza determinados jogos de palavras como uma específica ferramenta retórica. O intuito disso parece ser convencer o leitor de uma prevalência da verdade no conjunto do discurso socrático. Para tanto, busca-se contrabalancear um jogo entre os termos discurso (logon 18b, 19b, 20e, 23d, 27c 28b, 31b, 34b; logos 20c, 26b, 34e; logou 23b; logoi 28c, 32d, 34a, 40b), verdade (aletheian, 17b, 20d, 33c; aletheiai 23b, 28d, 36d; (...) aletheias 29e, 39b) e falsidade ou mentira (epseusanto 17a; pseude 18a; pseudei 26a; pseudetai 20e, 21b; pseudomenoi 34b; pseudos 34e). Nesse sentido, a proposta é apresentar como o discurso de defesa expõe, por meio desses termos, um sentido de hermenêutica socrática, como uma forma peculiar de interpretar oráculos e enigmas. Como obra dramática, a Apologia promove com essa encenação de Sócrates diante do tribunal um efeito retórico claro, pois o foco do discurso não é o júri, mas o leitor. Portanto, é necessário, no plano do discurso de defesa, que Sócrates utilize os recursos de linguagem que o mostrem ao leitor como distinto dos seus acusadores, que “muitas mentiras disseram” (ton pollon hon epseusanto). Speech, Truth and Enigma in the Apology Abstract: The main hypothesis of this work is that Socrates, in Plato's Apology, uses certain wordplays as a specific rhetorical tool. The purpose of this seems to be to convince the reader of the prevalence of truth in the whole of Socratic discourse. Therefore, we seek to counterbalance a game between the terms discourse (logon 18b, 19b, 20e, 23d, 27c 28b, 31b, 34b; logos 20c, 26b, 34e; logou 23b; logoi 28c, 32d, 34a, 40b), truth (aletheian, 17b, 20d, 33c; aletheiai 23b, 28d, 36d; aletheias 29e, 39b) and falsehood or lie (epseusanto 17a; pseude 18a; pseudei 26a; pseudetai 20e, 21b; pseudomenoi 34b; pseudos 34e). In this sense, the proposal is to present how the defense discourse exposes, through these terms, a sense of Socratic hermeneutics, as a peculiar way of interpreting oracles and enigmas. As a dramatic work, the Apology promotes with this staging of Socrates in front of the court a clear rhetorical effect, since the focus of the discourse is not the jury, but the reader. Therefore, it is necessary, at the level of the defense discourse, that Socrates uses the language resources that show him to the reader as distinct from his accusers, who “told many lies” (ton pollon hon epseusanto). RESUMO: A relação entre arte e filosofia é examinada com base na noção de Stimmung, que surge no século XVIII, na teoria musical, como relação de proporção entre tons ou instrumentos, sendo, em seguida, transposta para a estética, no final do século, com Kant e Fichte. Em Kant, a Stimmung refere-se à disposição das faculdades de conhecimento para um conhecimento em geral, isto é, como o pressuposto da apresentação estética, por meio da qual se preserva a noção de proporção entre (...) as faculdades. Em Sobre o espírito e a letra na filosofia, Fichte assinala que a disposição estética é o modo de atuar do impulso estético, ligado livremente e diretamente à faculdade da imaginação e à atividade de criação. Essa tradição estética é revista pelo historiador Aloïs Riegl, em 1899, no ensaio intitulado Die Stimmung als Inhalt der moderne Kunst, no qual o conceito de Stimmung é pela primeira vez apresentado em chave histórica, enquanto conteúdo da arte moderna, no sentido de atmosfera, isto é, da vivência de uma relação por meio da qual a consciência, em conformidade com a lei imanente, adquire alguma certeza. Revisão semelhante foi realizada pelo jovem filósofo György Lukács, em A alma e as formas, de 1910, na qual o autor pensa as diferenças de sentido entre as noções de Stimmung e de atmosfera. ABSTRACT: The relationship between art and philosophy is examined based on the notion of Stimmung, which appears in eighteenth-century music theory as a proportional relationship between tones or instruments; it was then incorporated into aesthetics at the end of the century in the works of Kant and Fichte. In Kant's works, Stimmung refers to the capacity of the faculties of knowledge for knowledge in general, that is, as a presupposition of aesthetic presentation through which the notion of proportion between the faculties is preserved. In his On the Spirit and the Letter in Philosophy, Fichte points out that the aesthetic disposition is the mode by which the aesthetic impulse acts out, connected freely and directly to the faculty of imagination and to the activity of creation. This aesthetic tradition is revisited by the historian Alois Riegl in 1899 in the essay Die Stimmung als Inhalt der moderne Kunst, where the concept of Stimmung is first presented from historical perspective as content of modern art in the sense of atmosphere, i.e., the experience of a relationship by which awareness, in accordance with immanent law, acquires certainty. A similar review was done by the young philosopher György Lukács in 1910 in Soul and Form, where the author conceptualizes the differences in meaning between the notions of Stimmung and Atmosphäre. Esta pesquisa apresenta uma análise da filosofia de Antístenes sobre a epískepsis tôn onomáton – investigação dos nomes. Este tema está relacionado ao problema da orthótes onomáton, que esteve sempre envolvida nas atividades dos sofistas. Nesse aspecto, a orthótes de Pródico, possivelmente um precedente inspirador para a análise antistênica dos nomes, está relacionada com a epískepsis de Antístenes naquilo que convergem e divergem as duas perspectivas. Tanto Pródico quanto Antístenes convergem na mesma base filosófica do princípio do eikeîos lógos e, (...) consequentemente, se identificam na mesma hipótese de uma linguagem objetiva que está estritamente ligada às coisas. Mas, os dois pensadores divergem não só no problema da relação entre linguagem e realidade como também no problema da polissemia. Além do mais, expõe-se na conjectura textual o exame do pressuposto filosófico antistênico, a saber, o eikeîos lógos, concernente ao problema interpretativo da passagem que Aristóteles menciona Antístenes: “ eikeîos lógos hèn eph´ henós ”, ou seja, enunciado próprio para cada coisa. A questão debatida é se a expressão “ hèn eph´ henós ” faz referência ao ónoma ou ao lógos. (shrink)

Fonte principale e punto costante di riferimento nella trattazione egidiana è la dottrina dell'Aquinate. L'A. mette costantemente a confronto le posizioni dei due filosofi evidenziando i tentativi di Egidio di staccarsi da Tommaso e criticarne (...) la dottrina, in particolare rispetto alla trattazione dell'ira. Tomás de Aquino define a alma humana de maneira semelhante a Aristóteles: ela é a forma substancial do corpo humano potencialmente vivo. Todavia, um dos problemas da psicologia tomista consiste, de acordo com D. Abel, em classificar a alma humana por meio de termos comumente utilizados para nomear os compostos hilemórficos, a saber, substância e hoc aliquid. Se a alma humana é parte de um composto, como poderia ser chamada de substância e de hoc aliquid? O objetivo deste artigo consiste (...) em mostrar qual é a estratégia subjacente a esta classificação utilizada por Tomás. Sugerimos que ela remonta a Aristóteles quando ele atribui diferentes significados aos termos substância e hoc aliquid. A novidade de Tomás está em expandir este campo semântico, introduzindo um significado que se aplica exclusivamente à alma humana, a saber, o sentido peculiar. (shrink)

Das weit uber die Zeit seiner Abfassung und uber die Grenzen seines Entstehungslandes hinaus unter dem Namen "Qabusname" bekannte, literarisch wie kulturgeschichtlich bedeutsame Werk heisst wortlich "Buch der Ratschlage," persisch "nasihat-name." Sein Verfasser Kej Kawus wurde um 1021/22 n.Chr. geboren und genoss die fur die persischen Furstensohne seit Jahrhunderten vorgeschriebene Erziehung, bei der eine Synthese von ritterlichen und geistigen, vornehmlich religiosen Tugenden angestrebt wurde. Es handelt sich um eines der interessantesten und eigenartigsten Erzeugnisse der mittelalterlichen iranischen Literatur. Mit Recht werden (...) der intime Ton des Werks und die reizvolle Schlichtheit der hubschen Anekdoten sowie die auf Schmuck verzichtende Einfachheit der Erzahlkunst geruhmt. Die vorliegende Ubersetzung des "Qabusname" ist die erste in deutscher Sprache, die nach dem persischen Original vorgenommen wurde. Die einzige fruhere deutsche Ubersetzung des Orientalisten H. F. von Diez erfolgte aus dem Turkischen und wurde 1811 veroffentlicht. Schon Goethe beschaftigte sich bei seiner Begegnung mit dem klassischen Schrifttum der Perser unter der Fuhrung H. F. von Diez eindringlich mit dem Qabusname. Der Beziehung des Dichters zu diesem so bedeutsamen Stuck der persischen Literatur ist daher ein besonderes Kapitel gewidmet. (shrink)

A problemática do justo relacionamento entre o sagrado e o profano foi objecto de uma particular clarificação no Concílio Vaticano II. Ao estabelecer o conceito de secularidade como estatuto que compete à ordem temporal ou da natureza em face da ordem sobrenatural ou da graça, aquela instância do magistério da Igreja legitimou a sua aplicação ao domínio da cultura em geral e da filosofia em especial. A secularidade é aí definida como autonomia relativa. Como tal, ela representa a posição justa (...) entre dois possíveis excessos: o do secularismo e o do sacralismo. Afirmá-la da filosofia, na hipótese da sua elaboração por um filósofo cristão, implica em primeiro lugar admitir que, para este, existe a possibilidade de ser verdadeiramente filósofo sem necessidade de renunciar ou colocar entre parêntesis a sua condição de cristão. Por outro lado, essa condição de filósofo cristão tem implícita uma atitude de abertura mútua, no seu espírito, entre a fé religiosa e a razão filosofante, da qual porém não resulta para este prejuízo mas benefício. Na recta atitude secular, pois, a autonomia supõe que a razão filosófica não perde a sua dignidade, o seu valor e a sua função próprios, deixando-os absorver totalitariamente pela fé; em compensação, porém, o carácter relativo de uma tal autonomia impede que esta seja ignorada por aquela, perdendo-a de vista no seu horizonte filosófico. Sacralismo fideísta e secularismo racionalista estão aí necessariamente ausentes. A possibilidade de uma filosofia qualificada de cristã parece decorrer de uma abordagem do problema por este prima. ///La problématique des relations correctes entre le sacré et le profane a fait l'object d'une clarification spéciale au Concile de Vatican II. Par le fait d'établir le concept de sécularité comme statut qui revient à l'ordre temporel ou a celui de la nature face a l'ordre surnaturel ou de la-grace, l'instance du Magistère de l'Eglise a legitimé son application au domaine de la culture en général et de la philosophie en particulier. La sécularité y est définie comme autonomie relative. En tant que telle, elle représente la position juste entre deux excés possibles: celui du sécularisme et du sacralisme. L'affirmer de la philosophie, dans l'hypothèse de son élaboration par un philosophe chrétien,implique en premier lieu que Ton admette que pour celui-ci, il est possible d'être vraiment philosophe sans nécessairement à sa condition de chrétien ou sans devoir la mettre entre parenthèses. Par ailleurs, cette condition de philosophe chrétien présuppose implicitement une attitude d'ouverture mutuelle, en son esprit, entre la foi religieuse et la raison pensante, ouverture dont pourtant il ne resulte pour celle-ci aucun préjudice, mais bien un acquis positif. Car dans l'attitude seculiere correcte, l'autonomie suppose que la raison philosophique ne perde pas sa dignite, sa valeur et sa fonction propre, en se laissant absorber totalitairement par la foi; en revanche, cependant, le caractere relatif d'une telle autonomie empeche que celle-ci soit ignoree par celle-la, la perdant de vue dans son horizon philosophique. Sacralisme fideiste et secularisme rationaliste doivent la disparaitre. La possibility d'une philosophic qualifiee de chretienne semble surgir d'une approche du probleme par ce biais. /// The problem of the proper relation between the sacred and the profane was object of a particular clarification in the Council Vatican II. In establishing the idea of secularity as a statute which belongs to the temporal order or of the nature in view of the supernatural or of grace, that instance of the Church teaching made lawful its application to the domain of culture in general, and of philosophy in particular. Secularity is there defined as relative autonomy. As such, it represents the right position between two possible excesses: on one side the secularism, and on the other side the sacredness. To affirm it of philosophy, supposings its elaboration is made by a Christian philosopher, implies first of all to admit that for this the possibility exists of being truly philosopher, without needing to renounce or to put between parentheses his condition of Christian. On the other hand, this condition of Christian philosopher contains implicit an attitude of natural openness in his mind, between religious faith and philosophizing reason, from which however no harm results for it at all, but benefit. In the right attitude of secular, therefore, the autonomy supposes that the philosophical reason doesn't loose its own dignity, its value and its function, letting itself absorve wholly by faith; in compensation however the relative character of such an autonomy prevents this from being ignored by the other, loosing sight of it in its philosophical horizon. Fideistic sacradness and rationalistic secularism are there absent. The possibility of a philosophy qualified as Christian seems to derive from an approach of the problem from this point of view. Im Namen homogenisierter Identität widersetzt man sich gegenwärtig jeglichem Versuch, ‚eigene‘ bzw. angeeignete Kultur als in sich heterogen, mit Fremdem transkulturell vermischt zu verstehen. In meinem Beitrag setze ich mich ausgehend von klassischen Beiträgen zur Kulturtheorie mit dieser identitären Versuchung auseinander, um sie vor dem Hintergrund des Befundes verständlich zu machen, dass wir überhaupt nur aus einer unaufhebbaren Welt-Fremdheit heraus Zugang zu kulturellen Lebensformen finden – vorausgesetzt, man nimmt uns auf Dauer in ihnen auf. Dass auf diese Weise jene Fremdheit (...) nicht ‚aufzuheben‘ ist, bedeutet, dass wir niemals eine gewissermaßen ‚restlose’ Enkulturation erfahren, sondern dem Vorkulturellen zutiefst verbunden bleiben. Genau deshalb, so lautet die These, haben wir eine nicht zu tilgende Affinität zu allem Transkulturellen, das man in erster Annährung als dasjenige verstehen kann, was ‚jenseits’ vertrauter Lebensformen liegt und uns zu diesem ‚Jenseits‘ ins Verhältnis setzen kann, weil wir schon in deren ‚Diesseits‘ nie ganz heimisch werden können. Ironischerweise zehrt in dieser Perspektive das Transkulturelle vom Vorkulturellen. Letzteres leugnen die Apologeten des Identitären, indem sie Zerrbilder homogenisierter Zugehörigkeiten feilbieten, die keine innere Unzugehörigkeit, Fremdheit und Distanz mehr zuzulassen scheinen. Este trabalho pretende sustentar que o melhor conceito para tratar da relação entre metáfora e linguagem é o da subdeterminação semântica. Entretanto, o modo mais comum de tratar o fenômeno das metáforas relega à pragmática a função de explicar como o significado metafórico de uma frase é um acarretamento gerado pelo contexto. Segundo este quadro, metáforas seriam indeterminadas semanticamente pois acarretamentos pragmáticos são virtualmente infinitos e não precisam remeter à proposição semanticamente expressa. Argumentamos, entretanto, as melhores alternativas para o tratamento (...) da questão nascem do debate entre contextualismo e minimalismo semânticos. Metáforas seriam casos de flexibilidade semântica também presentes em outros fenômenos linguísticos. Para o minimalismo, metáforas podem ser tratadas através da introdução de um operador lexical que garantiria a flexibilidade contextual necessária a termos semânticos contextualmente dependentes. Para o contextualismo, metáforas acontecem quando termos em uma frase funcionam como conceitos ad hoc e são passíveis de enriquecimentos pragmáticos. Apesar de não chegarem a uma única solução, o debate entre minimalismo e contextualismo oferece explicações do fenômeno que corroboram a hipótese da subdeterminação semântica defendida neste trabalho. Nas ciências naturais comumente se aceita que apenas os profundamente imersos nos seus problemas são reconhecidos pesquisadores competentes para emitir comentários sobre estes campos de investigação. Paradoxalmente, parece que estes cientistas são os que encontram maior dificuldade para relacionar sua formação profissional e atividades acadêmicas com seu papel na sociedade. Um exemplo é a dificuldade em determinar a natureza e a origem de um evento científico, como a consciência humana. Dominique Pestre caracteriza o Science Studies na década de 1970 e (...) dá tons políticos ao seu discurso. A mudança de opinião desse historiador da ciência seria suficiente para sinalizar uma reviravolta neste movimento? (shrink)
