This article reacts against the undesirable ideological separation between dialectical and rhetorical approaches to argumentative discourse. It argues that a sound evaluation of argumentation requires an analysis that reveals all aspects of the discourse pertinent to critical testing. To explain the rationale of the various moves made in the discourse and the strategic patterns behind them, not only the interlocutors' dialectical goals must be taken into account, but also their rhetorical goals. After explaining how rhetorical insight (...) can be instrumental in deepening and justifying a dialectical analysis, an integrated analysis is made of the rhetorical strategies that are brought to bear in an advertorial published by the oil company Shell. The subject of the study is the institution of the ancient Indian dispute, the theoretical understanding of which has become part of the doctrines of all religious and philosophical schools. The “Shraman period” (5th century BC) is considered in detail, during which there was a sharp controversy between religious and philosophical schools, during which effective methods of conducting disputes “crystallized” and developed argumentative normativity. It is shown that the pluralism and diversity of ontological models that existed in the spiritual (...) culture of that time were reflected in the logical and epistemological doctrine - pramana-vada. Thus, in the first (pre-logical) period, epistemological and logical questions were raised within the framework of anvikshika, “the science of conducting public disputes,” and the widespread culture of philosophical disputes and their actual practice were completely determined by the original cultural context. The argumentative canon of the Nyaya school is analyzed, the categories of the Indian and Western European traditions are compared, illustrating the discussion, in particular, of the Aristotelian syllogistic and the Nyayak five-term syllogism, the doctrine of the dispute between the ancient Chinese school of the late Mohists and ancient Chrya. The productive methodological ideas of the polemical strategy of conducting philosophical disputes in late Buddhism are revealed, the role of the dual unity of proof and refutation, as well as examples, questions and tricks, as topoi of the ancient Indian culture of dispute is shown. In this paper, a case study is presented of constitutional debates about abortion. An analysis is given of arguments from the Roe v. Wade case for definitions concerning the key notions of `person' and `human life'. The paper illustrates how the Court has gradually taken a more pragmatic or rhetorical position on definitional matters crucial to the purpose of regulating abortion.

In this essay, first the pragma-dialectical theory of strategic maneuvering is explained. Then the focus is on the conventionalization of communicative practices in communicative activity types and the institutional constraints it imposes on strategic maneuvering. Thus, an adequate background is created for discussing, on the basis of several recent projects, pragma-dialectical research of argumentative discourse in the political domain.

This paper deals with the question whether some morally normative content is grounded in the dialogical practice that both Apel and Habermas call argumentative discourse, and if so how to demonstrate that it is so grounded. Apel (unlike Habermas) claims that discourse has rationally necessary conceptual presuppositions; that morally normative content is part of such presuppositions; and that this can be ascertained in transcendendal reflection, i.e. by a kind of transcendental argument. I argue that these claims can (...) be charitably interpreted but require clarifications of their key concepts, i.e. “discourse”, “validity claims”, “performative self-contradiction”, and “community of communication”. I argue that discourse as a practice of reason-sensitive agents who are communicatively connected via argumentation can be explained by its normatively constitutive aim, namely fixing the true values of our reasons; that the primary level of validity claims are claims concerning good reasons; that performative self-contradictions are pragmatic-cum-logical inconsistencies that we can know apriori to be incompatible with discourse’s constitutive aim; and finally, that competent discourse participants can know apriori that they would be performatively inconsistent if they flouted a moral kernel that is intrinsic in discourse. When analysing and evaluating discourse, the discourse itself, the speech event and the activity type it represents, forces the analyst to search for a theoretical and methodological framework which is suitable for analysing the activity exposed in the data. Interactive political argumentation demands both a theory of argumentation and a theory of spoken language to fully grasp what is going on in the discourse. The pragma-dialectical argumentation theory offers both analytical and evaluative tools, but rests upon a (...) reconstruction of the argumentative discourse which is hierarchical and static. If applied to interactive argumentation this kind of reconstruction will not reveal interactive aspects of the parties' argumentation. On the other hand, conversation analysis, which concentrates on interactive aspects of the discourse, does not offer a tool for the evaluation of the quality of each party's argumentation. (shrink)

According to the pragma-dialectical approach to argumentation, for analysing argumentative discourse, a normative reconstruction is required which encompasses four kinds of transformations. It is explained in this paper how speech act conditions can play a part in carrying out such a reconstruction. It is argued that integrating Searlean insights concerning speech acts with Gricean insights concerning conversational maxims can provide us with the necessary tools. For this, the standard theory of speech acts has to be amended in several (...) respects and the conversational maxims have to be translated into speech act conditions. Making use of the rules for communication thus arrived at, and starting from the distribution of speech acts in a critical discussion as specified in the pragma-dialectical model, it is then demonstrated how indirect speech acts are to be transformed when reconstructing argumentative discourse. Arguments have always played a central role within logic and philosophy. But little attention has been paid to arguments as a distinctive kind of discourse, with its own semantics and pragmatics. The goal of this essay is to study the mechanisms by means of which we make arguments in discourse, starting from the semantics of argument connectives such as `therefore'. While some proposals have been made in the literature, they fail to account for the distinctive anaphoric behavior of (...) `therefore', as well as uses of argument connectives in complex arguments, suppositional arguments, arguments with non-declarative conclusions, as well as arguments with parenthetical remarks. A comprehensive account of arguments requires imposing a distinctive tree-like structure on contexts. We show how to extend our account to accommodate modal subordination and and di fferent flavors of `therefore'. (shrink)

The study of argumentation is prospering. After its brilliant start in Antiquity, highlighted in the classical works of Aristotle, after an alternation of ups and downs during the following millennia, in the post-Renaissance period its gradual decline set in. Revitalization took place only after Toulmin and Perelman published in the same year their landmark works The Uses of Argument and La nouvelle rhétorique. The model of argumentation presented by Toulmin and Perelman’s inventory of argumentation techniques inspired a great many scholars (...) in various ways to take up the study of argumentation in a serious manner. Nowadays there are well-established logical approaches to argumentation, but also social and socio-psychological, linguistic, juridical and other approaches. In most of these approaches traces can be found of the influence of the classical and neo-classical argumentation theories just mentioned. (shrink)

This article seeks to extend existing models of argumentation by considering an important dimension of real-life argumentative discourse: how complex argumentative discussions evolve over time. We define a complex argumentative discussion as a multi-issue discussion, in which the different issues are interrelated in the form of a hierarchy. We claim that justified reframing might be used to transform a single-issue argumentative discussion into a complex argumentative discussion. To illustrate this, we examine the Facebook (...) class='Hi'>discourse of the Rhodes Must Fall movement in South Africa. We analyse how reframing is justified by means of arguments, allowing the protagonists to claim as legitimate their reframing of a single issue into a complex argumentative discussion. Our findings complement existing sociological research on social movements by highlighting how their goals are achieved by means of argumentative discourse. (shrink)

Researchers in science education have converged on the view that argumentation can be an effective intervention for promoting knowledge construction in science classrooms. However, the impact of such interventions may be mediated by individuals’ task goals while arguing. In argumentative discourse, one can distinguish two overlapping but distinct kinds of activity: dispute and deliberation. In dispute the goal is to defend a conclusion by undermining alternatives, whereas in deliberation the goal is to arrive at a conclusion by contrasting (...) alternatives. The latest book is a timely application of the Pragma-Dialectical argumentative approach to medical consultation. The book consists of six chapters, which are concerned with topics pertaining to resolving differences of the opinion in doctor-patient interaction. With the publication of the book, the authors have made new contributions to the field of doctor-patient argumentative discourse.

Mencius, a prominent Confucian philosopher in the Warring States period of ancient China, is well-known for his argumentative skills, including his refutational skills used to maintain his own standpoints. This paper attempts to reveal how Mencius refuted his opponents argumentatively and strategically on the issue of human nature. To this end, the pragma-dialectical approach to argumentation is adopted to first reconstruct Mencius’s argumentative discourse on human nature according to the four stages in critical discussion—the confrontation, opening, argumentation (...) and concluding stages. Under the ancient Chinese historical and cultural context, Mencius’s argumentative discourse about human nature was developed in three critical discussions, between Mencius the protagonist, and his explicit interlocutors and implicit adversaries who held different views on human nature—the antagonists. The discussions were undertaken around three single mixed differences of opinion concerning three propositions, with resolution of the first difference of opinion serving as a starting point of the second, and the resolution of the second as a starting point of the third. Then based on the reconstruction, the paper elaborates the refutational strategies that Mencius employed in various stages, such as dissociation, reductio ad absurdum based on refutational analogy, and conciliation. It further points out that the employment of these strategies is strategic maneuvering undertaken by Mencius in an attempt to realize both dialectical and rhetorical aims. (shrink)

Intercultural discourse (especially via a lingua franca when interlocutors have a false impression that they are speaking one and the same language) adds a new dimension – facework (the establishment of culture-sensitive politeness strategies) – to the theory and practice of argumentation from a number of perspectives: its specificity as compared to ordinary argumentational discourse, the interpretation of the concept of incommensurability, and the conduct of international negotiations. Politeness systems relevant for different cultures are not unpredictable, but represent (...) linguistically and cognitively a highly generalised universal system which can be adopted by interlocutors and used in practical discourse. Politeness expressions are governed by linguistic components – by language forms of a certain type and by specific discourse patterns. The proper choice of language forms and discourse patterns adds a special dimension to argumentative schemata. The politeness-relevant packaging of discourse adds a zero-step to the normative stages of an argumentative discussion (establishing hierarchical relations as such), and needs permanent alignment of these relations, by using correct language forms and discourse patterns. This paper analyzes how, during the Juncker Presidency, the European Commission employed argumentative strategies to address the question of member-states’ compliance with European Union law. There is a literature gap regarding how European leaders employ argumentative strategies to coax member-states to comply with EU legislation and how those strategies can be associated with multilevel governance designs and problem-solving approaches. Building on van Eemeren and Grootendorst’s pragma-dialectical approach to argumentation, the paper explores what dialectical and rhetorical strategies were employed (...) by the Juncker European Commission to build an argumentative regime where the question of compliance with European Union law is articulated with the representation of the European Union as an efficient multilevel governance system. Starting from the distinction between procedural and operational concepts of problem-solving in multilevel governance polities, the paper questions whether the Juncker Commission’s arguments on the need to ensure European Union law compliance favor a particular conception of problem-solving in multilevel governance systems. The paper argues that the argumentative strategies employed by the Juncker European Commission in the field of compliance reveal a preference for an operational notion of problem-solving combined with some aspects of a more procedural perspective of problem-solving in multilevel governance polities. The background of this paper is associated with the growing impact that European legislation has on member-states and also with the efforts developed by the Juncker European Commission in discussing how to improve EU regulation to increase compliance with EU law. In this paper, I explore the potential of systematically studying the linguistic surface of discourse for the purposes of identifying markers of argumentative moves and other related categories, such as types of arguments and argumentative strategies. Such a list of argumentative markers can prove useful for the (semi)automatic treatment of a large corpus of texts. After reviewing literature on the linguistic realization of argumentative moves as well as literature on the subject of discourse markers, (...) it becomes clear that the search for representative items of argumentative markers cannot be restricted to those elements marking relations but that it should also include elements that signal a certain function that is of pertinence to argumentative analysis. In this view, argumentative markers can be any single or complex lexical expression as well as a discursive configuration whose presence in a given utterance marks that utterance or the one preceding/following it, or a larger piece of discourse as having a certain argumentative function (as an argumentative move, a type of argument or an argumentative strategy). Examples taken from a French corpus on the controversy surrounding the development and applications of nanotechnology currently under study are used to illustrate the different types of argumentative markers proposed. Although not generally regarded as a significant area of inquiry, the condensation of argumentative structures and the presence of `miniaturized' yet self-sufficient arguments in stand-alone, sub-discursive linguistic units, especially those below the level of a compound sentence, deserve a close look. Built skillfully into key words, catchy phrases, subtly appealing tropes, etc., these condensed arguments are often instrumental in accounting for the way some small linguistic units work magic on the audience. Taking such mini structures seriously holds two promises (...) for argumentation studies: a widened scope of investigation and a unique contribution to the understanding of how rhetorical effects are being produced at the sub-syntactic or lexical level. Rather than the art of putting forward logically valid arguments leading to Truth, argumentation is here viewed as the use of verbal means ensuring an agreement on what can be considered reasonable by a given group, on a more or less controversial matter. What is acceptable and plausible is always coconstructed by subjects engaging in verbal interaction. It is the dynamism of this exchange, realized not only in natural language, but also in a specific cultural framework, that has to be (...) accounted for. From this perspective, it is not enough to reconstruct patterns of reasoning. As logos is by definition both Reason and Language, abstract schemata have to be examined in their verbal realization in a given situation of discourse. Such an approach to arguments allows for a “thick” description taking into account their discursive and communicational aspects, as well as argumentation’s constitutive dialogism and its inscription in a set of common representations, opinions and beliefs (a doxa). This approach, exemplified by the analysis of a short text on stock options borrowed from the French newspaper Libération, is an attempt at establishing a dialogue between disciplines like argumentation theories, rhetorical criticism and discourse analysis. The paper examines the argumentation strategies of the Constitutional Tribunal’s case law on the reprivatisation of Warsaw real estate, a significant social issue in modern Poland. Following the post-war expropriation by the communist regime, legal successors of dispossessed individuals (both heirs and buyers of the claims to particular land) initiated widespread litigations to reclaim property and obtain compensation. This process led to the forceful eviction of thousands of tenants and the relocation of public institutions. This complex legal landscape lacks a (...) comprehensive regulation for property restitution, resulting in reprivatisation cases being handled solely as court disputes without central legislation, leading to a decentralised system of reprivatisation. The Polish Constitutional Tribunal, with its unique position within the legal system, has played a crucial role in shaping the legal framework and influencing the outcomes of reprivatisation cases. The study employs an analysis of all Constitutional Tribunal judgments related to the reprivatisation of Warsaw’s real estate, highlighting the evolution of the discourse of the Constitutional Tribunal in this regard. It consists of two parts: mixed method (quantitative and qualitative) was utilised to assess how Constitutional Tribunal judges justified their decisions (what types of argument they used), and the discourse analysis method was used to analyse how they approached reprivatisation in the real-world context. This study gives insight into the arguments and reasoning that the judges used and how their framing of the legal discourse changed over 30 years. (shrink)

The recent trend in institutional communication research seems to foster the image of the University as a private organization significantly oriented towards a policy of customer satisfaction. Following the concept of organizational culture, institutional settings too are conceived as organizational contexts, where discourse is a privileged vehicle to convey and spread values, traditions and artifacts, both through internal and external communication practices. Thus, within academic discourse organizational culture is shaped and perpetuated by specific devices of rhetorical argumentation. The (...) corpus of data consists of two different examples of academic discourse: the self promotional endorsement letters of the academic candidates to the chancellor’s position on occasion of the elections and the inaugural speeches proclaimed by the chancellors in charge during the opening celebration of the academic year. The first kind of academic discourse could be meant as an example of political discourse since the candidates use communication strategically and manipulate their academic membership as a rhetorical device to support their aims. On the other hand, the second example is a mere celebration of academic culture which through linguistic rituals recalls and perpetuates the basic values of this microcosm. The data have been analysed with the critical discourse analysis and diatextual analysis which pay particular attention to the context of speech. Moreover, attention has been focused on the metaphors and on the meta-discursive cues. The results show that although with different purposes academic discourse use similar discursive and rhetorical strategies as both belong to the same organization. (shrink)

Discourse connection is a challenging aspect of writing in a second language. This study seeks to investigate the effects of two classroom instructions on discourse connection in writing for EFL college students, focusing on their argumentative writing. Three classes were exposed to different pre-task conditions: receiving reading materials that provide content support for the writing, receiving planning instructions on effective outlining, and receiving no resources. The results showed that the instructions helped students attain better overall coherence in (...) writing. However, noticeable differences between the two experimental groups emerged in terms of cohesion features. The reading group was found to employ more lexical cohesion devices in writing than the outline group, which indicated a heightened genre awareness. This inquiry helped us identify the reading group’s alignment with content support materials, particularly the change in stance as a factor that contributes to a higher level of lexical cohesion in writing. This paper proposes a methodological synthesis in order to study multimodal media discourse and argumentation in the context of the so-called ‘refugee crisis’ in Greece. It follows the framework of Multimodal Critical Discourse Analysis, integrating this with argumentation studies, with a particular emphasis on the analysis of inference. Our data come from the Greek newspapers Kathimerini and Ta Nea. We contend that the proposed methodological synergy enables scrutiny of (a) racist conceptualizations cultivated by the representation of migrants and (...) refugees in headlines and photographs in newspaper articles along with (b) the argumentative potential that is implicitly sustained in these multimodal representations. This paper addresses the question how to analyze multimodal public discourse in such a way that the resulting reconstruction of the rhetor’s accountability either obliges the rhetor to acknowledge the argumentative reconstruction as valid or to refute its validity in a meta-discussion. This is a challenge for discourse theory as well as for argument theory because multimodal discourse seems far removed from the ‘standard’ propositional format of an argument. We argue that multimodal discourse should be (...) analyzed as a coherent and relevant discourse, assuming the possibility of instant interactions between all modes. We introduce a method that allows us to account for an argumentative reconstruction in a systematic way. We illustrate our method by analyzing the ABC news item titled Hu Jintao Visit: Economics and Panda Bears of January 20, 2011, holding ABC news as a rhetor accountable for several far reaching standpoints that are implied in the multimodal format. This study analyses how online participants of celebrity gossip position themselves in relation to their audience through forms of moral argumentation and thereby contribute to social hierarchies. In this study, forms of moral argumentation are seen as enthymemes, that is, claim-reason units based on moral norms as premises. The material consists of a total of 900 asynchronous online comments in English and 900 in Finnish. In addition to rhetorical argumentation analysis, the study investigates the dependency of moral argumentation on three (...) contextual variables: gendered violence as the topic of discussion, as the shared culture of participants and a media institution as the moderator of online discourse. Four forms of moral argumentation were found in the material: 1) theoretical, 2) practical, 3) categorical and 4) digital enthymeme. Theoretical, practical and categorical enthymemes are rhetorical in a traditional sense because they include the hierarchical idea of moral norms as the shared, more or less authoritarian, basis of a community. Digital enthymemes, conversely, are texts without clear borders or any notion of moral norms. Such arguments characterized especially user-generated, English-language discussions concerning female celebrities’ fights. This indicates that the digital enthymeme is particularly prevalent where there is a lack of obvious hierarchies in the context of argumentation. As this study argues, however, the seemingly non-hierarchical and individualistic participation through digital enthymemes is a mere illusion, for these enthymemes are based on crowd behaviour supportive of sexist and class-bound domination.
