Diez años desde la entrada en vigor de la Ley Orgánica 5/2000, de 12 de enero, de la Responsabilidad Penal de los Menores han servido para mucho. Desde que se optó por legislar los ilícitos penales cometidos por aquellos menores con edades comprendidas entre los 14 y los 18 años, muchas y variadas son las certezas e incertidumbres que, al respecto de un tema tan complejo y tortuoso, han visto la luz en nuestro entramado social.

La visión de la esen-cia divina constituye para la crea-tura intelectual la culminación de su deificación iniciada en el bau-tismo. Según el Aquinate, el beato contempla a Dios sin ningún inter-mediario puesto que la esencia divina actúa como especie impresa y expresa. Ningún intelecto creado está capacitado naturalmente para ver a Dios, pero puede ser elevado obediencialmente a esta visión debido a la inmaterialidad de su intelecto. La potencia intelectual creada debe ser confortada por el hábito de luz de gloria (...) para ade-cuarse a la sobrenaturalidad del acto beatífico. La visión beatífica implica eminentemente un cono-cimiento especulativo y afectivo, plenificando y rebalsando todas las potencias del beato. (shrink)

Con ocasión del trigésimo aniversario de la publicación de Divine Hiddenness and Human Reason (1993) del filósofo canadiense John L. Schellenberg (1959-), este artículo tiene como objetivo examinar el argumento del ocultamiento divino, algunas objeciones a sus premisas realizadas por connotados filósofos contemporáneos, la última reformulación del argumento por parte Schellenberg y, finalmente, la elaboración de una revisión crítica a sus supuestos fundamentales, inspirándonos en el pensamiento de Tomás de Aquino. Estos supuestos señalan, por un lado, que Dios –al ser (...) perfectamente amoroso– debe manifestarse a cualquier persona y en cualquier tiempo y, por otro, que existen agnósticos y ateos sin resistencia que no tienen culpa de su increencia. En 1588, el jesuita Luis de Molina publicaría su famosa Concordia liberi arbitrii cum gratiae donis, en la cual intenta defender –contra el fatalismo protestante- la libre determinación de la voluntad con respecto a su fin último sobrenatural. Sin embargo, las explicaciones teológicas del P. Molina suponen graves errores metafísicos, particularmente con respecto al concurso general o simultáneo de Dios sobre las causas segundas en las que Dios no obra in sino cum causa, donde la acción de la creatura determina (...) al Creador a producir conjuntamente un efecto. A partir de la Apología de los Padres Dominicos que recoge la doctrina de Santo Tomás acerca de la premoción física, procederemos en la crítica de esta tesis molinista: sólo Dios es Acto Puro y por eso es causa del movimiento actualizador tanto de las potencias naturales como espirituales, pues todo efecto –sea contingente o necesario– depende de la voluntad divina que trasciende todo orden de necesidad y contingencia: de allí que sólo Dios puede mover eficazmente nuestro intelecto y voluntad, y no por eso nuestros actos dejan de ser nuestros y personales. En esta investigación sometemos, a 640 alumnos/as de cuarto a sexto de Primaria, a prueba un modelo relacional entre seis habilidades socio – emocionales, la percepción y el resultado académico en Lengua Castellana y Literatura. Los resultados obtenidos en el análisis nos muestran significatividad entre la percepción y el resultado real obtenido en Lengua y las habilidades de toma de conciencia y control emocional, las habilidades socioemocionales, la cooperación y ayuda durante el trabajo, las habilidades de vida y bienestar subjetiva (...) como mejora de la calidad de vida y como poder motivacional en el rendimiento académico en Lengua Castellana y Literatura. En más de 100 conflictos bélicos que se han producido en los últimos diez años, más del 80 por ciento de las víctimas son civiles. Se ha producido un desarrollo acelerado en las investigaciones concernientes a las consecuencias psico-sociales de la guerra en la población civil, la cual es el blanco principal de las víctimas en la guerra contemporánea. Este trabajo constituye una revisión bibliográfica sobre la guerra como desastre, acerca de los conceptos “modernos” de “guerra total”, desastre y (...) las consecuencias psicológicas de la guerra en la población civil, la utilización de los niños como soldados lo cual acarrea desórdenes mentales marcados y se aborda el problema de la violencia sexual como arma de guerra. Las mujeres, las jóvenes, e incluso niñas, son a menudo sometidas, violadas, secuestradas y forzadas a la esclavitud sexual o cualquier tipo de abuso sexual; son vejadas, humilladas y dañadas en lo más profundo de sus sentimientos psicológicos, y valores morales, lo que también trasciende al grupo social, comunidad, clase social o etnia a la que pertenecen. El deterioro o la destrucción de la infraestructura económica, social y política de las naciones en conflicto impide la atención de las necesidades básicas de la población. El trastorno por estrés postraumático es la entidad nosológica más frecuente en las víctimas de la guerra, pero existen otros trastornos mentales que hay que tener en cuenta In over 100 war conflicts that have occurred in the last 10 years, m ore than 80 percent of the victims were civilians. The scope of recent studies has been increasingly focused on psychological and social effects among civilians who are the target and main victims of contemporary wars. This article is an explanation of why war is considered a disaster, a revision of modern terms for war, disaster and the psychological effects of war on civilians, the training of children as soldiers, and the resulting mental disorders. It touches upon sexual violence problem as a war weapon. Women, adolescents and young children are often violated and forced into sexual slavery or any other type of sexual abuse, causing humiliation and psychological, ethical and moral damage, which can affect social groups, communities, social classes, or races. The deterioration or destruction of the economic, social and political infrastructure of the countries in conflict hinders the satisfaction of the citizens' basic needs. The most common psychological effect among war victims is posttraumatic stress, but there are also other mental disorders which must be taken into consideration. (shrink)

In Heraclitus’ time, thymos and psyche carried highly similar or even identical meanings, because both could refer to life, courage, personality, emotions, and reason. Heraclitus probably worked with all of these meanings. He may have been partly inspired by Homer and post-Homeric literature, where the two terms were likewise placed side by side and often used interchangeably. In Heraclitus, thymos and psyche are not opposites in terms of signification. Oftentimes, they can be “swapped,” and their meaning and “costs” exchanged. The (...) source and cause of this special exchange is desiring or wanting (thelein), which connects all these senses but is also the source of conflict and fighting. Desire—regardless of what it is and what is desired—is simultaneously the acquisition of the desired object or person and a way of paying for it. This struggle for the desired object is difficult not only because of its consequences (the price), but also because it is not possible to permanently stop desiring, which is why this struggle cannot be brought to an end. The article presents a reconstruction of Heraclitus’ saying in DK 22 B 14, which is generally thought to be two discontinuous statements (B 14a and B 14b), inorganically linked by a commentary by Clement of Alexandria. Although this sentence of Clement’s is almost unanimously rejected as a Christian misinterpretation of the pagan mysteries, the author of the article attempts to demonstrate that the core of the sentence does come almost certainly from Heraclitus. All that Clement did was to change the (...) meaning of the sentence by changing the subjects for the objects. This new reading of the fragment makes it possible to link the two parts of the saying in a meaningful way, and at the same time to shed light on what were probably Heraclitus’ main criticisms of the initiates of the four different mysteries and the initiatory cults (B 14a). This is supported by a detailed historical and religious analysis of the probable meaning of the different designations for the initiates and the possible interconnections between them. (shrink)

Within post - Kuhnian, philosophy of science, much effort has been devoted to issues related to conceptual change, such as incommensurability, scientific progress and realism, but mostly in terms of reference, without a fine - grained theory of scientific concepts/senses. Within the philosophy of language and of mind tradition, there is a large body of work on concepts, but the application to scientific concepts has been very tentative. The aim of this paper is to propose a general framework for a (...) theory for the individuation of scientific concepts. The general view about the individuation of concepts favored here is the possession - condition approach: to individuate a concept is to identify its possession conditions. The general metascientific tools for the analysis of scientific theories are model - theoretic, more specifically, structuralist: scientific theories, the entities to which scientifc concepts belong, are model - theoretic theory - nets. The general idea about the content of scientific concepts that inspires this proposal comes from: (i) our grandfathers’ "laws - plus - correspondence rules", (ii) Kuhns "laws applied to exemplars" views and (iii) moderate operationalism. The aim is to show that some clarification can be gained applying the possesion condition appproach to (an expansion of) these three elements using structuralist metascientific tools. First, I briefly present the two main structuralist ideas I shall use: the difference between observability and non - theoreticity, and the notion of theory - net. Second, I informally introduce the five components that come from my reading of the three traditional elements; these components are, or are not, plausible independently of how they will be integrated within a theory of concept - identity. Third, I present the kore of the theory of possession conditions for concept - identity that we shall use for the integration of such components. Finally, I propose the general traits of the possession condition that corresponds to each of these five components, I present some problems and point out some possible ways of dealing with them. The epistemic status of Natural Selection has seemed intriguing to biologists and philosophers since the very beginning of the theory to our present times. One prominent contemporary example is Elliott Sober, who claims that NS, and some other theories in biology, and maybe in economics, are peculiar in including explanatory models/conditionals that are a priori in a sense in which explanatory models/conditionals in Classical Mechanics and most other standard theories are not. Sober’s argument focuses on some “would promote” sentences that (...) according to him, play a central role in NS explanations and are both causal and a priori. Lange and Rosenberg criticize Sober arguing that, though there may be some unspecific a priori causal claims, there are not a priori causal claims that specify particular causal factors. Although we basically agree with Lange and Rosenberg’s criticism, we think it remains silent about a second important element in Sober’s dialectics, namely his claim that, contrary to what happens in mechanics, in NS explanatory conditionals are a priori, and that this is so in quite specific explanatory models. In this paper we criticize this second element of Sober’s argument by analyzing what we take to be the four possible interpretations of Sober’s claim, and argue that, terminological preferences aside, the possible senses in which explanatory models in NS can qualify, or include elements that can qualify, as a priori, also apply to CM and other standard, highly unified theories. We conclude that this second claim is unsound, or at least that more needs to be said in order to sustain that NS explanatory models are a priori in a sense in which CM models are not. (shrink)

Part II: Suppes and the mature theory. Representation and uniqueness.

BackgroundThe H2020 i-CONSENT project has developed a set of guidelines that offer ethical recommendations and practical tools aimed at making the informed consent process in clinical studies more comprehensive, tailored, and inclusive. An analysis of the appropriateness of some of its novel recommendations was carried out by a group of experts representing different stakeholders.MethodsAn adaptation of the RAND/ucla Appropriateness Method was used to assess the level of agreement on the recommendations among 14 representatives of different stakeholders, including patients, regulators, investigators, (...) ethics experts, and the pharmaceutical industry. The process included two rounds of rating and a virtual meeting.ResultsFifty-three recommendations were evaluated. After the first round, 34 recommendations were judged “appropriate”; 19 were judged “uncertain”; and none was judged “inappropriate”. After the second round, 9 “uncertains” changed to “appropriate”. All recommendations rated medians of 6.5–9 on a 1–9 scale (1 = “extremely inappropriate”, 5 = “uncertain”, 9 = “extremely appropriate”). The sections “General recommendations” and “Gender perspective during the consent process for clinical studies” showed the highest “uncertainty” rating. The four keys to improving the understanding of the ICP in clinical studies are to: (1) consider consent a two-way continuous interaction that begins at the first contact with the potential participant and continues until the end of the study; (2) improve investigators’ communication skills; (3) co-create the information; and (4) use a layered approach, including information to compensate for the potential participant’s possible lack of health literacy and a glossary of terms.ConclusionsThe RAND/ucla method has demonstrated validity for assessing the appropriateness of recommendations in ethical guidelines. The recommendations of the i-CONSENT guidelines were mostly judged “appropriate” by all stakeholders involved in the informed consent process. (shrink)

Do Muslims and Christians worship the same God? We answer: it depends. To begin, we clear away some specious arguments surrounding this issue, to make room for the central question: What determines the reference of a name, and under what conditions do names shift reference? We’ll introduce Gareth Evans’s theory of reference, on which a name refers to the dominant source of information in that name’s “dossier,” and we then develop the theory’s notion of dominance. We conclude that whether Muslims’ (...) use of “Allah” co-refers with Christians’ use of “God” depends on how much weight is given to what type of information in the dossiers of these two names, and we offer a two-part test by which the reader can determine whether Muslim and Christian uses of the divine names co-refer: If Christianity were true and Islam false, might “Allah” still refer to God? And: If Islam were true and Christianity false, might “God” still refer to Allah? We explain the implications of your answers to those questions, and we close with a few reflections about what, in addition to reference, might be required for worship, and whether, from a Christian perspective, salvation turns on this issue. Many controversies within philosophy of science have been attempted to be explained in terms of the metaphilosophical prescription/description distinction over the goal of philosophy of science. The aim of this paper is to show that the controversy between Popper and Kuhn about the ir/rationality of Normal Science cannot be fully explained in these terms, not even if we also take the truth/problem-solving distinction over the goal of science into account. It is argued that, to gain full understanding of this controversy, (...) it is necessary to take into account their differences regarding a topic apparently not involved in it, namely the structure of scientific theories. The conclusion is that both Popper and Kuhn were descriptive/prescriptive at the same time in their attempt to make the rules of scientific practice explicit, yet Kuhn did it better because he had a richer and more accurate idea of what scientific theories are. Although this work is mainly a piece of history of philosophy of science, it also aims at shedding some light on epistemological issues. If the conclusion is sound, it also shows how structural aspects of scientific theories may be relevant to the epistemology of science.Keywords: Falsificationism; Normal science; Rationality; Theories; Thomas Kuhn; Karl Popper. The no-miracles argument is the main inference-to-the-best-explanation kind of argument for scientific realism, and the pessimistic induction is considered a main, if not the main, challenge for a NMA-based scientific realism. Doppelt advocates a new kind of inference-to-the-best-explanation supported scientific realism that he labels Best Theory Realism. If successful in replacing standard selective realism as the best version of scientific realism, BTR would be particularly good since it is not committed to the partial truth of past theories and thereby it (...) is immune to the antirealist strategy of finding cases of past, predictively successful theories with predictively essential components not retained by later theories. The goal of this paper is to raise doubts about Doppelt’s attempt and argue that, other benefits of his proposal notwithstanding, it fails. In section 1 I summarize the main tenets of standard, retentive selective realism relevant for the present discussion. In section 2 I show that Doppelt’s main arguments against retentive selective realism do not work. In section 3, I argue that the way BTR faces the challenge posed by the historical record that motivates PI is unsatisfactory and puts Doppelt into a fatal trilemma: either he is committed to two claims that are untenable together; or endorses an extremely implausible form of present-science chauvinism; or unjustifiably discriminates explanation against prediction in historical record. The conclusion is that BTR falls short of substituting standard retentive selective realism as the most plausible realist position, and that thereby the cases of past successful theories with predictively essential parts not retained by posterior theories are still a real problem for a plausible realist position. It has been often claimed that physicalism challenges the explanatory autonomy of psychological sciences. Most who advocate for such explanatory autonomy and do not want to renounce to physicalism, presuppose a causalist account of explanatoriness and try to demonstrate that, adequately construed, (causal) psychological explanations are compatible with (some sufficient version of) physicalism. In Sect. 1 we summarize the different theses and assumptions involved in the seeming conflict between explanatory autonomy and physicalism. In Sect. 2 we review the main attempts (...) to make them compatible assuming a causalist account of explanation and argue that none succeeds. In Sect. 3 we introduce a recent, non-causalist account of scientific explanation as ampliative, specialized embedding (ASE) that has been successfully applied to other fields. In Sect. 4 we apply ASE to elucidate two paradigmatic cognitive explanations of psychological phenomena: déjà vu and action production. We conclude that ASE elucidates well the autonomy of the cognitive explanations of these phenomena independently of what finally happens with the causal exclusion problem and that it may be generalized to other psychological explanations. The paper deals with the metaphysics of Valerian Magni, a seventeenth-century Capuchin thinker and Church politician. It follows Stanislav Sousedik’s and Paul Richard Blum’s interpretations of Magni’s thought and aims to systematize Magni’s metaphysical notions and present their gradual development. The paper first focuses on Magni’s critique of Aristotelianism, which the Capuchin regards as an atheistic philosophy due to incorrect conceptions of God and the world. Then, Magni’s attempt to create a metaphysical system in his late work Opus philosophicum in (...) particular is presented. The influence of the Augustinian-Bonaventurian tradition and the subjectivist tendencies in Magni’s thought are taken into account. (shrink)

Resumo: Este artigo tenta revelar o significado da disseminação contemporânea das teorias da conspiração, seguindo a sugestão de Frederic Jameson de que as teorias da conspiração são sintomas de um “mapeamento cognitivo” empobrecido. Para isso, transpõe-se o problema do mapeamento cognitivo para uma questão mais ampla de narratividade, em diálogo com o florescente campo da ética narrativa, interpretando-o por meio das lentes da teoria crítica e da psicanálise. Resumidamente, afirma-se que as teorias da conspiração são narrativas substitutivas para lidar com (...) a opacidade das sociedades contemporâneas e a consequente deficiência na narratividade pessoal. Previous scientific contributions show that interactive learning environments have contributed to promoting learners' learning and development, as interaction and dialogue are key components of learning. When it comes to students with special needs, increasing evidence has demonstrated learning improvements through interaction and dialogue. However, most research focuses on children's education, and there is less evidence of how these learning environments can promote inclusion in adult learners with SEN. This article is addressed to analyse a case study of an interactive learning (...) environment shared by adults with and without special needs. This case shows several improvements identified by adult learners with special needs participating in this study. Based on a documental analysis and a qualitative study, this study analyses a context of participatory and dialogic adult education. From the analysis undertaken, the main results highlight some improvements identified in the lives of these adult women and men with SEN, covering educational improvements, increased feeling of social inclusion, and enhanced well-being. Varios filósofos han pensado que la analogía debe ser considerada como una forma de ambigüedad. Argumentamos aquí que los predicados atribuidos a Dios y a las criaturas no son ambiguos o vagos. Siguiendo algunas sugerencias de McDaniel, proponemos una concepción de la analogía donde el fenómeno semántico está asociado con el carácter más o menos natural de la propiedad o (...) propiedades que instancian las entidades que satisfacen el predicado análogo. Un predicado "θ" es análogo si y sólo si, la propiedad Θ, que algo instancia, si y sólo si es θ, es menos natural que cualquier propiedad Ξ tal que todo lo que instancie Ξ, instancia Θ. Además, se requiere que las entidades de las cuales el término análogo es predicado deban ser ontológica o epistémicamente dependientes unas de otras. || It has been traditionally sustained that predicates attributed to God and to the creatures are analogical predicates. But, what is analogy? Several philosophers have thought that analogy should be taken as a form of ambiguity. Here we argue that predicates attributed to God and to creatures are neither ambiguous nor vague. Following some suggestions given by McDaniel, we propose a view of analogy in which the semantic phenomenon is associated with the more or less natural character of the property or properties that the entities that satisfy the analogous predicate instantiate. A predicate "θ" is analogous if and only if the property Θ, which something instantiates, if and only if it is θ, is less natural that any property Ξ so that anything that instantiates Ξ, instantiates Θ. Históricamente, los estudios de desastres han presentado dos comprensiones antagónicas de las catástrofes: singularidades extremas que producen historia o procesos que perpetúan estructuras sociopolíticas e inequidades. Mediante un análisis del terremoto de 1970 en Ancash, Perú, y su influencia en la implementación de discursos de (des)aceleración en medio de grandes transformaciones en la sociedad peruana, este artículo presenta una comprensión alternativa de los desastres más allá de la disrupción y continuidad, para enfocarse en las articulaciones temporales que estos producen. Al (...) ser concebidos como dispositivos temporales, los desastres tienen la capacidad de reestructurar ritmos, escalas y temporalidades de manera heterogénea y múltiple. El artículo pretende aportar argumentos que, aunque basados en el terremoto de Ancash, pueden aplicarse a otros debates sobre catástrofes, crisis y desastres como desencadenantes de aceleración y desaceleración económica, social o cultural. It works on humanistic foundation of Osiander’s thought and his elaboration of the tradition of the antient wisdom and Christian cabbala of Giovanni Pico della Mirandola in particular in the biblical exegesis. The article deals with Osiander’s edition of Nicolaus Copernicus’ book De revolutionibus orbium caelestium as well and with his edition of the mathematical work of (...) Girolamo Cardano. In the context of philosophy of science Osiander’s foreword to Copernicus is analyzed and its role in the controversy between instrumentalism and realism is assessed. Osiander’s instrumentalism is viewed as an anachronism. Finally, the influence of Neoplatonism and Paracelsism in Osiander’s theology is analyzed and judged as too general. (shrink)

The article presents a set of articles on the present and projection of the scholastic tradition. The starting point is the anthropological turn that, within scholasticism and at the beginning of the fourteenth century, privileged the study of ethics, law and politics and, consequently, the forced development of a moral theology concerned with the human coexistence. The second scholasticism, prolonging this tradition throughout the 16th and 17th centuries, could not remain oblivious to the implications of the profound changes that were (...) taking place: the Discovery of America, the Protestant Reformation, the development of a commercial proto-capitalism and the strengthening of the monarchies. As the Reformation was consolidated in a good part of the European territories, intellectual borders were raised between the various confessions. However - and this is the focus of the papers presented - these borders were porous and, despite the climate of confrontation, various indirect communication channels managed to maintain a single intellectual republic. El artículo repasa el debate que enfrentó a estos grandes autores tomistas durante dos años (1934-1936). Según J. Maritain, la fi losofía moral es el tipo más perfecto de filosofía cristiana y, por esta razón, ella no puede prescindir de la Revelación. Es decir, si la filosofía moral quiere permanecer complète et adéquate en su objeto, debe considerar al hombre no según su sola naturaleza, sino también, según su estado de naturaleza caída y redimida, en relación con su verdadero fin (...) último que es sobrenatural. De allí que S. Ramírez critique, por un lado, el error epistemológico cometido por el filósofo francés al no distinguir los objetos formales de la filosofía y la teología; y, por otro, no considerar que el fin último del hombre efectivo no es el mismo que el propio. Organizational membership seems to be linked to a more participatory and informed political culture, to foster electoral participation, and to promote positive feelings toward democracy. More recently, the social capital and associative democracy debates have introduced new arguments about the positive effects of associational involvement. However, little attention has been paid to the problems of measuring associational involvement and to their consequences for our theories. This article discusses the various problems of validity and reliability of our measurements of associational membership. (...) It is shown that different questionnaire formats produce substantially different results. The article also addresses the issue of measurement errors and emphasizes the problems they introduce when doing cross-national comparisons. (shrink)

In the context of comparing linguistic profiles across neurodevelopmental disorders, Down syndrome has captured growing attention for its uneven profile. Although specific weaknesses in grammatical and phonological processing have been reported, research evidence on phonological development remains scarce, particularly beyond early childhood. The purpose of this study was to explore the phonological profiles of children and adolescents with Down syndrome. The profiles were based on the frequency and relative proportion of the processes observed by classes, and they were compared to (...) those of typically developing preschool children of similar verbal age. A complementary goal was to assess the effect of two different methods of elicitation: a test of articulation and spontaneous speech sampling. Finally, intergroup and intragroup differences in full match percentages between three positions at syllable-level were assessed. The results of the present study confirmed that the frequency of phonological processes in children and adolescents with DS is atypically high and is above what is expected for lexical age and at the same level as grammatical age. Highly increased frequency of processes, consistent in all kinds of processes and positions at the syllable-level, and asynchronous with verbal age and mental age suggest atypical developmental trajectories of phonological development in the Down syndrome population. Este trabajo propone reconstruir los sucesos que marcaron las calles de la ciudad de La Plata entre 1968 y 1969. Con este telón de fondo, nos enfocaremos en cómo impactó el Cordobazo en dicha ciudad y más precisamente en los discursos y las acciones de su movimiento estudiantil. El foco lo colocaremos en dicho actor, intentando precisar sus corrientes internas y las formas como estas se identificaban y enunciaban a la Reforma Universitaria.
