The Thesis of Theory-Laden [TTL] holds that is not possible a neutral observation. From this thesis, some philosophers have inferred that the facts, i.e., the subject’s independent reality, do not exist or that they are social constructions only. The aim of this paper is assess if TTL necessarily implies a constructivist point of view or if, conversely, we can still speak about the reality. In order to do this, we will clarify these terms: "the theory-ladenness of observation" (...) and "constructivism". Then, we will argue that although TTL is possible, we are not committed to constructivism, and on the contrary, TTL can be an interesting frame to the realistic thesis. Finally, we will point out the impact this had has when evaluating many epistemological proposals. La tesis de la carga teórica de la observación [CTO] sostiene que no es posible una observación neutral. A partir de esta tesis, algunos filósofos han derivado que los hechos, o mejor, la realidad independiente del sujeto, no existen o que son solo construcciones sociales. El objetivo de este artículo es evaluar si CTO implica necesariamente una visión constructivista o si, por el contrario, permite seguir hablando de realidad. Para ello, se aclararán los conceptos de "carga teórica de la observación" y de "constructivismo". Posteriormente, se defenderá que pese a la plausibilidad de CTO, no estamos comprometidos a adoptar el constructivismo, antes bien, CTO puede ser un interesante marco para las tesis realistas. Theory-ladenness is the view that observation cannot function in an unbiased way in the testing of theories because observational judgments are affected by the theoretical beliefs of the observer. Its more radical cousin, incommensurability, argues that because there is no theory-neutral language, paradigms, or worldviews, cannot be compared because in different paradigms the meaning of observational terms is different, even when the word used is the same. There are both philosophical and practical components to these problems. I (...) argue, using a procedurally-defined, theory-neutral experiment that paradigms are indeed commensurable. The practical problems of theory ladenness include experimental design, failure to interpret observations correctly, possible experimenter bias, and difficulties in data acquisition. I suggest that there are methods to deal with these problems, although sometimes they cannot be dealt with completely. I believe that the philosophical problems of theory-ladenness have been solved, although the practical problems remain. (shrink)

We use evidence from cognitive psychology and the history of science to examine the issue of the theory-ladenness of perceptual observation. This evidence shows that perception is theory-laden, but that it is only strongly theory-laden when the perceptual evidence is ambiguous or degraded, or when it requires a difficult perceptual judgment. We argue that debates about the theory-ladenness issue have focused too narrowly on the issue of perceptual experience, and that a full account of (...) the scientific process requires an examination of theory-ladenness in attention, perception, data interpretation, data production, memory, and scientific communication. The thesis of theory-ladenness of observations, in its various guises, is widely considered as either ill-conceived or harmless to the rationality of science. The latter view rests partly on the work of the proponents of New Experimentalism who have argued, among other things, that experimental practices are efficient in guarding against any epistemological threat posed by theory-ladenness. In this paper I show that one can generate a thesis of theory-ladenness for experimental practices from an (...) influential New Experimentalist account. The notion I introduce for this purpose is the concept of ‘theory-driven data reliability judgments’, according to which theories which are sought to be tested with a particular set of data guide reliability judgments about those very same data. I provide various prominent historical examples to show that TDRs are used by scientists to resolve data conflicts. I argue that the rationality of the practices which employ TDRs can be saved if the independent support of the theories driving TDRs is construed in a particular way. (shrink)

Kuhn 's contribution should be viewed as posing a number of important problems, not as a full-fledged theory of the structure of science. Kuhn 's alleged theory-ladenness of observations is examined as a test case in the light of Hintikka's interrogative model of inquiry. A certain superficial theory-ladenness is built into that model. Moreover, the model provides a deeper analysis of theory-ladenness via the two-levelled character of experimental science. A higher-level and a lower-level (...) inquiry rely on different kinds of initial premises and operate with different kinds of "answers" by nature. Most philosophers of science now believe that scientific data are theory laden, i.e., the evaluation of data is influenced by prior theoretical beliefs. Although there is historical and psychological evidence that is consistent with the theory-laden position, experimental evidence is needed to directly test whether prior beliefs influence the evaluation of scientific data. In a fully counterbalanced design, one group of subjects received evidence that dinosaurs were cold-blooded, and another group of subjects received evidence that dinosaurs were warm-blooded. (...) The subjects reported a strong belief in whichever theory they had read about. Then subjects were presented with a piece of data that supported one theory and contradicted the other theory. The identical piece of data was rated as more believable when it was consistent with the subject's theory than when it was inconsistent. These results provide clear support for the position that scientific data are theory laden. (shrink)

Since the late 1950s one of the most important and influential views of post-positivist philosophy of science has been the theory-ladenness of observation. It comes in at least two forms: either as a psychological law pertaining to human perception (whether scientific or not) or as conceptual insight concerning the nature and functioning of scientific language and its meaning. According to its psychological form, perceptions of scientists, as perceptions of humans generally, are guided by prior beliefs and expectations, and (...) perception has a peculiar holist character. In its conceptual form it maintains that scientists’ observations rest on the theories they accept and that the meaning of the observational terms involved depends upon the theoretical context in which they occur. Frequently, these two versions are combined with each other and give rise to a constructivist view of scientific knowledge (I shall use the term “constructivism” roughly in the same way as Golinski [1998, chap. 1]). According to this outlook, our experience is categorized and preconditioned by prior belief since the process of gaining knowledge through science always involves the use of concepts from some theory or other. This view can easily be strengthened to serve as the cornerstone of a constructivist and anti-empiricist account of science: The categories in terms of which we carve up our experience are not read off from the external world but follow from prior theoretical commitments. In this paper, I investigate two potential ways to experimentally test the thesis that observation is theory-laden. One is a proposal due to Schurz (J Gen Philos Sci 46:139–153, 2015) and the other my own. The two are compared and found to have some features in common. One such feature is that both proposals seek to create conditions that compel test subjects with diverse theoretical backgrounds to resort to bare (or at least as bare as possible) observational judgments. Thus, (...) if judgments made under those conditions are convergent across test subjects, the said convergence would lend credibility to the view that theory-neutral observations are feasible. This still leaves the question of why any such convergence exists unanswered. Towards the end of the paper, it is argued that the best explanation for observational judgment convergence is the veridicality of those judgments. (shrink)

Several developments for diverse scientific goals, mostly in physics and physiology, had to take place, which eventually gave us fMRI as one of the central research paradigms of contemporary cognitive neuroscience. This technique stands on solid foundations established by the physics of magnetic resonance and the physiology of hemodynamics and is complimented by computational and statistical techniques. I argue, and support using concrete examples, that these foundations give rise to a productive theory-ladenness in fMRI, which enables researchers to (...) identify and control for the types of methodological and inferential errors. Consequently, this makes it possible for researchers to represent and investigate cognitive phenomena in terms of hemodynamic data and for experimental knowledge to grow independently of large scale theories of cognition. This paper attempts to argue for the theory-ladenness of evidence. It does so by employing and analysing an episode from the history of eighteenth century chemistry. It delineates attempts by Joseph Priestley and Antoine Lavoisier to construct entirely different kinds of evidence for and against a particular hypothesis from a set of agreed upon observations or (raw) data. Based on an augmented version of a distinction, drawn by J. Bogen and J. Woodward, between data and phenomena it is (...) shown that the role of theoretical auxiliary assumptions is very important in constructing evidence for (or against) a theory from observation or (raw) data. In revolutionary situations, rival groups hold radically different theories and theoretical auxiliary assumptions. These are employed to construct very different evidence from the agreed upon set of observations or (raw) data. Hence, theory resolution becomes difficult. It is argued that evidence construction is a multi-layered exercise and can be disputed at any level. What counts as unproblematic observation or (raw) data at one level may become problematic at another level. The contingency of these constructions and the (un)problematic nature of evidence are shown to be partially dependent upon the scientific knowledge that the scientific community possesses. (shrink)

Anthony Simon Laden explores the kind of reasoning we engage in when we live together: when we are responsive to others and neither commanding nor deferring to them. He argues for a new, social picture of the activity of reasoning, in which reasoning is a species of conversation--social, ongoing, and governed by a set of characteristic norms.

Are sensory experiences, perceptual beliefs and observation reports faithful encoders of truthful information about the world? The theory-ladenness thesis poses an important challenge to answering this question in the affirmative. Roughly the thesis holds that theoretical factors affect the content of those experiences, beliefs and reports. In other words, it holds that their content is laden with theory. Theoretical factors here are construed broadly so as to include scientific theories, beliefs and cognitive processes. Two crucial questions arise (...) in relation to the theory-ladenness thesis. First, how pervasive is theory-ladenness? And, second, what is the extent of the distortion theory-ladenness has on the content of experiences, perceptual beliefs and observation reports? Theories of rational choice focus on the question of how to choose what to do. They are, that is, concerned with the selection of one among a set of possible actions. Furthermore, they tell us how to make such a choice rationally. They accomplish this aspect of their task by telling us how to choose ‘in order to achieve our aims as well as possible.’Theories of reasonable deliberation, as I describe them in this paper, analyze a different domain of reasoning (...) in the service of action. First, their subject matter is the deliberation that leads to action, rather than the final selection of the action itself. Second, they ask about the intrinsic character of a deliberative path, rather than its likely outcome. That is, they are theories of the reasonableness of deliberation, rather than its rationality. To see the distinctiveness of this theoretical domain, it helps to approach it by backing away from the domain of rational choice theories one step at a time. (shrink)

This chapter takes a naturalized approach to the philosophy of science using evidence from cognitive psychology and from the history of science. It first describes the problem of the theory ladenness of perception. Then it provides a general top-down/bottom-up framework from cognitive psychology that is used to organize and evaluate the evidence for theory ladenness throughout the process of carrying out science (perception, attention, thinking, experimenting, memory, and communication). The chapter highlights both the facilitatory and inhibitory (...) role of theory in the scientific process. Both the historical record and the evidence from cognitive psychology suggest that the top-down factors have their greatest impact when the bottom-up information is weak or degraded. Feyerabend claims that what is perceived depends upon what is believed ; and he maintains that among really efficient alternative theories "each theory will possess its own experience, and there will be no overlap between these experiences". According to Feyerabend "scientific theories are ways of looking at the world; and their adoption affects our general beliefs and expectations, and thereby also our experiences...". Toulmin, Hanson, and Kuhn concur with this view. Toulmin claims that men who accept different "ideals" and (...) "paradigms" will see different phenomena. He thinks theories not only give significance to facts, but also determine what facts are for us at all. Like Feyerabend, Toulmin asserts that "we see the world through" our fundamental concepts of science "to such an extent that we forget what it would look like without them". Bas van Fraassen’s recent book Scientific Representation: Paradoxes of Perspective modifies and refines the “constructive empiricism” of The Scientific Image in a number of ways. This paper investigates the changes concerning one of the most controversial aspects of the overall position, that is, van Fraassen’s agnosticism concerning the veridicality of microscopic observation. The paper tries to make plausible that the new formulation of this agnosticism is an advance over the older rendering. The central part of this investigation is an attempt (...) to answer Marc Alspector-Kelly’s 2004-criticism of an early version of van Fraassen’s new position. Alspector-Kelly’s contribution it is to date the most extensive attack on van Fraassen’s twenty-first-century work on the topic of microscopic observation. One of the central ideas emerging from the present discussion is a link between the debate over the veridicality of microscopic observation and the issue of the theory-ladenness of experience. The theory-ladenness of perception argument is not an argument at all. It is two clusters of arguments. The first cluster is empirical. These arguments typically begin with a discussion of one or more of the following psychological phenomena: (a) the conceptual penetrability of the visual system, (b) voluntary perceptual reversal of ambiguous figures, (c) adaptation to distorting lenses, or (d) expectation effects. From this evidence, proponents of theory-ladenness typically conclude that perception is in some sense "laden" (...) with theory. The second cluster attempts to extract deep epistemological lessons from this putative fact. Some philosophers conclude that science is not (in any traditional sense) a rational activity, while others conclude that we must radically reconceptualize what scientific rationality involves. Once we understand the structure of these arguments, much conventional wisdom about the significance of the psychological data turns out to be false. (shrink)

In this paper, I investigate the logical relation between two claims: observations are theory-laden1 and there is no empirical common ground upon which to evaluate successive scientific theories that belong to different paradigms. I, first, construct an argument where is the main premise and is the conclusion. I argue that the term „theory-laden” has three distinct senses: semantic, psychological and epistemic. If ‘theory-laden’ is understood in either epistemic or psychological senses, then the conclusion becomes a claim about (...) people. If incommensurability is to be a claim about theories, then ‘theory-laden’ in the main premise should be understood in the semantic sense. I, then, argue that there is a further distinction to be drawn between the absolute and relative senses of theory-laden. The relative sense of theory-laden allows observations that are relatively neutral between the theories under examination. I then conclude that the argument from theory-ladenness only shows that foundational empiricism is not a tenable philosophical position, but it fails to show that no empirical test can decide between successive theories that belong to different paradigms. The aim of this paper is to analyze a philosophical question (neutrality vs. theory-ladenness of observation) taking into consideration the empirical results of Cognitive Psychology (theories of perception). This is an important debate because the objectivity of science is at stake. In the Philosophy of Science there are two main positions with regard to observation, those of C. Hempel and N. R. Hanson. In the Philosophy of Mind there are also two important contrasting positions, those of J. Fodor (...) and Paul M. Churchland. In this paper, I claim that since there is a cognitively impenetrable stage of visual perception, namely early vision, and cognitive penetrability and theory-ladenness are coextensive, the CI of early vision entails that early vision content is theory neutral. This theory-neutral part undermines relativism. In this paper, I consider two objections against the thesis. The one adduces evidence from cases of rapid perceptual learning to undermine my thesis that early vision is CI. The other emphasizes that (...) the early perceptual system, in order to solve various underdetermination problems, relies on certain principles, which may be taken to constitute a sort of a theory about the world that affect early vision, rendering it theory-laden. Both objections purport to show that early vision is CP and theory-laden. Against this thesis, I argue that the evidence on which the two objections are based does not show that early vision is CP and is fully compatible with the view that early vision is CI. (shrink)

The recent surge of interest in Bacon's own attempts at natural history has revealed a complex interplay with his speculative ideas in natural philosophy. This research has given rise to the concern that his natural histories are theory-laden in a way that Bacon ought to find unacceptable, given his prescription in the Parasceve for a reliable body of factual instances that can be used as a storehouse for induction. This paper aims to resolve this tension by elaborating a moderate (...) foundationalist account of Bacon's method and by appealing to a distinction he makes, in a letter to Father Fulgentio, between pure and impure natural histories. I argue that the discussions of causes and axioms in the published histories render them impure, since that material properly belongs to Part Four of the Instauratio, but that this interplay with Part Four is necessary for the sake of the continued refinement of Part Three (the natural historical part). Bacon ultimately aims for a storehouse of instances, to be attained at the culmination of this process of refinement, and at that point the history should be published in its pure form. (shrink)

Abstract During the last decades it has become widely accepted that scientific observations are ?theory?laden?. Scientists ?see? the world with their theories or theoretical presuppositions. In the present paper it is argued that they ?see? with their scientific instruments as well, as the uses of scientific instruments is an important characteristic of modern natural science. It is further argued that Euclidean geometry is intimately linked to technology, and hence that it plays a fundamental part in the construction and operation (...) of scientific instruments. Finally, Euclidean geometry is compared to fractal geometry, and the question of its a priori status is raised. Although the position that Euclidean geometry is a priori in the original Kantian sense is untenable, the paper concludes that in some restricted sense Euclidean geometry may be said to be a priori. Theory-ladenness of perception and cognition is pervasive and variable. Emerging maturationally natural perception and cognition, which are on-line, fast, automatic, unconscious, and, by virtue of their selectivity, theoretical in import, if not in form, define normal development. They contrast with off-line, slow, deliberate, conscious perceptual and cognitive judgments that reflective theories, including scientific ones, inform. Although culture tunes MN systems, their emergence and operation do not rely on culturally distinctive inputs. The sciences advance radically counter-intuitive representations that depart (...) drastically from MN systems’ deliverances. Extensive experience with RCI scientific theories can result in a practiced naturalness with their perceptual and cognitive consequences; nevertheless, automatic MN verdicts persistently intrude. Fodor suggests that the uniformity of the biases MN systems introduce can serve as a theory-neutral means for adjudicating scientific disputes. Findings about vision challenge Fodor’s proposal for circumventing problems that MN theory-ladenness presents. These considerations indicate that RCI scientific ideas are difficult to learn, master, and deploy; consequently, the corrective import of science’s social and institutional arrangements plays a critical role in its epistemic stature. I argue that if we allow that Moore’s Method, which involves taking an ordinary knowledge claim to support a substantive metaphysical conclusion, can be used to support Moore’s proof an external world, then we should accept that Moore’s Method can be used to support a variety of incompatible metaphysical conclusions. I shall refer to this as “the problem of many proofs”. The problem of many proofs, I claim, stems from the theory-ladenness of perception. I shall argue further that (...) this plethora of proofs for incompatible positions leads to a darker form of skepticism, one which maintains that each of the dogmatic views is probably false. The terms “perspectivism” and “perspectivalism” have been the focus of an intense philosophical discussion with important repercussions for the debate about the role of mechanisms in scientific explanations. However, leading exponents of the new mechanistic philosophy have conceded more than was necessary to the radically subjectivistic perspectivalism, and fell into the opposite error, by retaining not negligible residues of objectivistic views about mechanisms. In order to remove this vacillation between the subjective-cultural and the objective-natural sides of mechanisms, we shall raise (...) the question about theory-ladenness over again and interpret it in its connection with the technical–experimental nature of scientific knowledge, as affirming the perspectival character of scientific knowledge: It is because of the character at once theory-laden and practice-laden, i.e. technique-laden, of our putting questions to nature that empirical reality must be investigated from particular perspectives: nature can be known scientifically only from a potentially infinite number of perspectives or theoretical points of view, concretely exemplified by mechanisms or experimental ‘machines’ that allow specific access to specific aspects of sensible reality. This paper draws upon the history of scientific studies of inheritance in Mendel’s best-remembered model organism, the garden pea, as a source of two parables – one pessimistic, the other optimistic – on the challenges of data linkage in plants. The moral of the pessimistic parable, from the era of the biometrician-Mendelian controversy, is that the problem of theory-ladenness in data sets can be a major stumbling block to making new uses of old data. The moral of the (...) optimistic parable, from the long-run history of studies at the John Innes Centre of aberrant or “rogue” pea varieties, is that an excellent guarantor of the continued value of old data sets is the availability of the relevant physical materials – in the first instance, the plant seeds. Rawls criticizes utilitarianism for not taking the distinction between persons seriously, and suggests that his own theory: justice as fairness, does. I argue that justice as fairness aims to take the distinction seriously at four levels, ranging from the content of its principles to its conception of political philosophy, and that doing so at each stage is of fundamental importance in working out the basis of a conception of justice for a democratic society. John Rawls's form of constructivism can easily be ramped up into a fullblown metaethics. In this chapter, the author explores an alternative interpretive framework, which basically inverts the roles that the construction of the original position and the reliance on reflective equilibrium play in Rawls's argument. The author sketches out the basic contours of Rawls's thinking if we treat constructivism as his method for theory construction and reflective equilibrium as his metaethics. Metaethics is clearly a part of moral philosophy (...) outside of moral theory. At every major turn in the articulation of Rawls's theory there is a new or more developed account of reflective equilibrium and in particular its justificatory role in the theory. Giving one's argument a form that allows it to more easily appeal to a particular audience, is the job of rhetoric. So it turns out that constructivism is not a metaethical position, but a rhetorical strategy. (shrink)

The primary aim of this paper is to critically evaluate the deductive model of ethical applications, which is based on normative ethical theories like deontology and consequentialism, and to show why a number of models have failed to furnish appropriate resolutions to practical moral problems. Here, for the deductive model, I want to call it a “Linear Mechanical Model” because the basic assumption of this model is that if a normative theory is sacrosanct, then the case is as it (...) is. The conclusion derived from the case will also be correct, true and acceptable. However, traditional ethicists used to apply their ethical theories, but they did not know which moral theory was effective on the ground level of reality. The study will show readers how ethical theories are in conflict with each other in the case of euthanasia. In more precise words, “which ethical theories are said to be applied, meta-ethical or normative, or both for the resolution of ethical problems? If normative theories are said to be applied, how the application can take place when it is contrary to our experience, that (then) in a situation of moral crises, no one really applies a theory?” For that, my argument is the linear model has failed because it is rigid, often ignores the agents’ intrinsic values, and has no space to amend it, no matter how bizarre the consequence is. Its alternative is the Inductive model. For that, the paper will take three moral principles (autonomy, beneficence including maleficence, and justice) of Beauchamp & Childress. This suggests us for resolving value-laden moral problems, we should consider some steps such as a) recognising moral issues to start with; b) developing the moral imagination; c) sharpening analytical/critical skills; d) testing out disagreements; e) effecting decisions and behavior; and f) implementation, closure, and process are of vital importance, in other words, it starts with the free and informed consensus of all interested parties, but this model also has been failed because the model could not give a systematic organization to their way of resolution. Here, my argument is that the inductive model provides resolution of the practical problem but ignores what is ethically obligatory, permissible, or wrong in that situation, and there are no appropriate suggestions in the case of a moral crisis. The brain is involved in theory-laden cognitive processes. But there are two different theory-laden processes. In cases where the theory is based on facts, more facts can either falsify or confirm a theory. In cases where the theory is about the choice of a benchmark or a standard, more facts can only make a theory either more or less warranted. Clark offers a review of a view of the brain where the brain pro- cesses (...) input information in a way that confirms its priors or its pre- dictions. This does not mean that the brain creates its own reality. The brain, rather, processes input data, but it does so in light of its own priors. The brain is a bidirectional hierarchical structure. While the top layers generate priors, the lower layers process input data. The brain amounts to the dynamics of image- making, where the top-down process generates unified images, while the bottom-up process, which takes data, corrects the images. (shrink)

Recent claims, mainly from computer scientists, concerning a largely automated and model-free data-intensive science have been countered by critical reactions from a number of philosophers of science. The debate suffers from a lack of detail in two respects, regarding the actual methods used in data-intensive science and the specific ways in which these methods presuppose theoretical assumptions. I examine two widely-used algorithms, classificatory trees and non-parametric regression, and argue that these are theory-laden in an external sense, regarding the framing (...) of research questions, but not in an internal sense concerning the causal structure of the examined phenomenon. With respect to the novelty of data-intensive science, I draw an analogy to exploratory as opposed to theory-directed experimentation. (shrink)

This paper proposes a set of criteria for an appropriate experiment on the issue of the theory ladenness of perception. These criteria are used to select a number of experiments that use: belief-based ambiguous figures, fragmented figures, or memory color. Crucially, the data in experiments of this type are based on the participant’s qualitative visual experience. Across many different types of experimental designs, different types of stimuli, and different types of belief manipulation, these experiments show the impact of (...) belief/theory on visual perception. Using an ecological validity argument, I conclude that attention-based interpretations of these findings are not successful because the relevant epistemological issues only require that we examine final perception, in the sense of visual awareness of the everyday world. Finally, I argue that the epistemological consequences of theory-ladenness can be reduced by using a top-down/bottom-up theoretical framework and by adopting appropriate methodological procedures to data derived from individual observations. The author argues that the distinctive aspects of political liberalism have historical roots in the republican tradition that is often described as “neo-roman,” and recently given articulation in the work of Q. Skinner and P. Pettit. The primary task of this paper will be to layout these correlations, to provide, as it were, a mapping between the vocabulary of the neo-roman theory and that of political liberalism. By tracing the genealogy of political liberalism, the author argues that we ought (...) to rethink the history, the vocabulary, and conceptual framework of contemporary political philosophy. In particular, seeing political liberalism as a form of republican theory as well as a form of liberal theory changes how we understand it: it brings out certain distinctive features of the structure of the view that are often overlooked, such as its stress on certain civic duties and its conception of freedom as a freedom of the city. If leading republican and liberal thinkers turn out to have much in common, then we will have to rethink also our intellectual geography: we will have to sketch in some land-bridges between the continents. The persistence of certain illusions has been used to argue that some theories cannot affect our perceptual experiences. Learning that one of these illusions is an illusion involves accepting theories. Nevertheless, the illusion does not go away. It seems then that these theories cannot affect our perceptual experiences. This paper contests an assumption of this argument: that the only way in which our perceptions can be affected by holding these theories is by the illusion going away.

This article explores whether theory-ladenness makes empirical testing an inse cure foundation for objectivity. Specifically, this article uses path diagrams as visual heuristics to assist in (1) developing a parsimonious representation of the traditional empiricist view of empirical testing, (2) showing how the "New Image" view ostensibly threatens the objectivity of science, (3) proposing a unified, realist theory of empirical testing, (4) developing a representation of the unified theory, (5) exploring several potential threats to objectivity, (6) (...) discussing the proposed theory's implications for social science, and (7) adumbrating three foundational premises for scientific realism. Amartya Sen describes John Rawls?s ?justice as fairness? as ?transcendental institutionalism? and develops his realization-focused approach in contrast. But Rawls is no transcendental institutionalist, and Sen?s construal of their opposition occludes a third, relation-based position and a valuable and practical form of ideal theory. What Sen calls transcendental institutionalism and realization-focused comparative theory each treat justice as something to bring about, a problem for experts. A third position treats justice in terms of how we relate to one another (...) rather than of achievement. This position, called ?justice as reciprocity,? is consistent with Rawls?s ?justice as fairness? and Sen?s normative aspirations, and might form the basis of new and fruitful dialogue between them. By treating justice as a question of how we relate to one another, and treating relation-based ideals as the basis of respectful behavioral constraints (rather than of ends to pursue), ?justice as reciprocity? grounds an everyday form of just democratic citizenship. ArgumentIn the theory-dominated view of scientific experimentation, all relations of theory and experiment are taken on a par; namely, that experiments are performed solely to ascertain the conclusions of scientific theories. As a result, different aspects of experimentation and of the relations of theory to experiment remain undifferentiated. This in turn fosters a notion of theory-ladenness of experimentation (TLE) that is toocoarse-grainedto accurately describe the relations of theory and experiment in scientific practice. By contrast, (...) in this article, I suggest that TLE should be understood as anumbrella conceptthat has different senses. To this end, I introduce a three-fold distinction among the theories of high-energy particle physics (HEP) as background theories, model theories, and phenomenological models. Drawing on this categorization, I contrast two types of experimentation, namely, “theory-driven” and “exploratory” experiments, and I distinguish between the “weak” and “strong” senses of TLE in the context of scattering experiments from the history of HEP. This distinction enables identifying the exploratory character of the deep-inelastic electron-proton scattering experiments – performed at the Stanford Linear Accelerator Center (SLAC) between the years 1967 and 1973 – thereby shedding light on a crucial phase of the history of HEP, namely, the discovery of “scaling,” which was the decisive step towards the construction of quantum chromo-dynamics as a gauge theory of strong interactions.
