In their recent and influential book Rethinking Innateness, Jeffrey Elman and his co‐authors argue that evidence from neurobiology provides us with grounds to reject representational nativism (RN). I argue that Elman et al.’s argument fails because it makes a series of unwarranted assumptions about RN and about the extent to which neurobiological data constrain claims about the innateness of mental rep‐resentations. Moreover, I briefly discuss how we ought to understand RN and argue that on two prima facie plausible approaches, far (...) from refuting nativism, the evidence from neurobiology may not even be relevant to the question of whether or not RN is true. Higher-Order Representational theories of consciousness — HORs — primarily seek to explain a mental state’s being conscious in terms of the mental state’s being represented by another mental state. First-Order Representational theories of consciousness — FORs — primarily seek to explain a property’s being phenomenal in terms of the property being represented in experience. Despite differences in both explanans and explananda, HORs and FORs share a reliance on there being such a property as being represented. In this paper I develop (...) an argument — the Unicorn Argument — against both HORs and FORs. The core of the Unicorn is that since there are mental rep- resentations of things that do not exist, there cannot be any such prop- erty as being represented, and thus no such property with which to identify either being conscious or being phenomenal. Quand il s'agit de définir le sens et le but du dialogue ou de démêler les liens qui le rattachent aux autres dialogues ou à des écrits contemporains, on est loin d'aboutir à un accord. Platon veut-il simplement établir le programme d'une rhétorique philosophique pour (...) faire pièce à l'action envahissante des écoles de rhétorique ? Vise-t-il plus spécialement telle ou telle doctrine rhétorique ? Vu les points de contact avec des écrits d'Isocrate, d'Alcidamas et d'autres, a-t-il peut-être voulu trancher certaines questions brûlantes, intervenir en conciliateur ou en arbitre ? Le fait est que l'examen dialectique se termine à la p. 272b par la récapitulation et la réponse définitive à la question posée p. 258d et reprise p. 259e. Alors que le débat portait sur le logos en tant que discours écrit ou prononcé, Socrate introduit dans la finale la notion du logos de l'âme pour répondre aux objections de Phèdre. Alors qu'il a prouvé (261e-262b) la nécessité de la connaissance de la vérité, peu importe de quel genre de discours il s'agit, il revient en arrière pour discuter à nouveau la théorie de la vraisemblance de Tisias appliquée au seul genre judiciaire. Pourquoi, après chacune des objections (273d-274a, 278bc) répéter la conclusion finale et reprendre coup sur coup le problème de l'œuvre écrite, qu'il avait expédié en passant, p. 257d-258d ? Au terme de cette dernière diversion, Socrate oppose à la philosophie les techniques spéciales qui lui sont subordonnées : législation, poésie, éloquence. Est-ce peut-être dans ce message destiné à Lysias et doublé d'un message analogue à Isocrate que Platon a voulu nous donner la clef de l'œuvre ? Le Phèdre été conçu comme un drame parfait axé sur la mission et la condamnation de Socrate et cette structure lui donne son sens et son unité. Le cœur, c'est la péripétie et cette „reconnaissance” dans laquelle le daimonion ouvre les yeux de Socrate. Ecoutant son daimonion, il embrasse ses dieux à lui, son Eros, et dès lors sera traité d'impie par le jury. Les politiques, les poètes et les orateurs impuissants à appuyer leurs paroles (par la philosophie) (273c) deviendront ses accusateurs, et c'est Socrate qui, ignorant leur éloquence, sera impuissant à se défendre. On lui reprochera de corrompre la jeunesse. C'est que son discours ici se termine par cette prière significative : „Accorde-moi... d'être, plus encore qu'à présent, en crédit auprès des beaux garçons” (257a trad. Robin). Bref, la scène du Phèdre est le prélude, ou, si l'on veut, la contre-partie du drame de 399. Quel est le rôle de Lysias ? Exactement le même que dans la République et le Clitophon. Contrairement à son frère Polémarque (257b) il ne pense que politique et barreau, une politique qui en définitive adopte les principes de violence de Thrasymaque (Rép. I et Phèdre 266c). Dans une soi-disant Défense de Socrate, il a répondu à Polycrate en ramenant toute l'affaire sur le plan purement politique et en reniant le verdict de 399, imputable à l'absence d'une défense efficace. Soucieux du relèvement de la démocratie, il désire reléguer à l'arrière-plan l'affaire de 399, faire oublier les griefs religieux et peut-être tendre la main aux Socratiques, pour, ainsi, passer à l'ordre du jour. Or, se prêter à cette manoeuvre, pour Platon, c'est renier son maître. Que reproche-t-il à Lysias ? De tourner le dos à la Philosophie en médisant d'Eros. Et nous apprenons en finale, pour mettre fin à toute équivoque, qu'Isocrate n'échappe pas à ce même reproche. Mais tout cela se situe à l'arrière-plan. Dans la trame du Phèdre, celui qui est directement accusé d'impiété, celui qui s'accuse lui-même, c'est Socrate. S'il n'y avait vu clair, s'il avait quitté ce lieu sacré après un succès oratoire sur un thème imposé par Lysias, il aurait renié ses daimonia ; il aurait trouvé grâce auprès des hommes, mais serait justiciable des dieux (242d). In lieu of an abstract, here is a brief excerpt of the content:BOOK REVIEWS 387 vs. "objective" is all no doubt rather imprecise, but points toward an important truth. In fact, in the contrast between them, we can see, I believe, not merely a clash of methods, standards or styles in writing history, but, more deeply still, an instance of the general antithesis between a "formalist" and a "sympathetic" sensibility, one encountered over and over in humanistic studies.6 PLATO New in (...) this section is an essay on "Some Controversial Points of Plato Interpretation Reconsidered" (pp. 183-209). Its first two parts combat the view that Plato ever gave up the metaphysics of his "middle period," but they do so only by rehearsing familiar theses about the Idea of the Good and the "two worlds" theory. These pages afford nothing new (apart from an extremely unfortunate appeal [p. 185 and again on p. 230] to an Homeric usage of the genitive to settle a problem at Rep. 518C9). The third part (pp. 194209 ) expands upon some views about later Plato for which Mme. de Vogel is already widely known, and these are very useful indeed. They offer a welcome expansion and defense of her view that in order to "do justice" (196-197, cf. 228) to the famous phrase,o) 7r,,v,e)~r ~v,t at Soph. 248E7, we must concede that Plato came to assign "the motion of a thinking mind" (208-209) to the very being of the Ideas, i.e., came to regard "the intelligibleworld as a vo~r (p. 194). Two interesting objections to her reading are confronted at some length (pp. 200-206) and several others are more briefly dealt with, thus affording her a good chance to explain her view. Valuable as these pages are, however, their upshot is rather unsatisfactory: just what Plato's view would, on her reading of it, really come to, remains mightily obscure--an obscurity she tends to concede but to explain away as Plato's "seeming peculiar to a modern mind" though we can get some grip upon his views if we but "take the trouble to follow his lead" (pp. 201, 198; cf. pp. 228-230, etc.). Such reminders of the genuine strangeness of Plato's view can no doubt be healthy in themselves, but can also be stultifying when reiterated in the face of genuine dissatisfaction with the sense that she makes of his meaning. This situation is not helped by the fact that, at crucial junctures in her argument, she buttresses her case about Plato's meaning by appeals to Aristotle's report at de Anima 1.2, 404b18-27 (see pp. 193-194, 199-200, 208, 277-281, 384-385). As she rightly reports (pp. 280, 385), Prof. Harold Cherniss has vigorously opposed the view that Aristotle is there giving Plato's view at all; yet--despite the fact that she has dedicated this volume to Cherniss--she never makes any reference to his most extended and most powerful defense of his position on this text, and much less does she attempt to answer his argument. (See Cherniss' review of H. D. Saffrey's book--a book to which de Vogel does refer, and repeatedly--in Gnomon 31 [1959], 36-51.) This matter is crucial, not merely as a bibliographical nicety, but because she tends to argue ]rom this text, maintaining that, however peculiar and isolated the sense of Soph. 248-249 and of certain phrases in the Timaeus may, on her reading of them, seem, this text proves that Plato must be read in her way. If it is not about Plato's view at all, it of course proves no such thing. The full weight of her argument will thus be borne by her view of how best to "do justice" to the text of Soph. 248E. This paper addresses the doubts voiced by Wigner about the physical relevance of the concept of geometrical points by exploiting some facts known to all but honored by none: Almost all real numbers are transcendental; the explicit representation of any one will require an infinite amount of physical resources. An instrument devised to measure a continuous real variable will need a continuum of internal states to achieve perfect resolution. Consequently, a laboratory instrument for measuring a continuous variable in a finite (...) time can report only a finite number of values, each of which is constrained to be a rational number. It does not matter whether the variable is classical or quantum-mechanical. Now, in von Neumann’s measurement theory (von Neumann, Mathematical Foundations of Quantum Mechanics, Princeton University Press, Princeton, [1955]), an operator A with a continuous spectrum—which has no eigenvectors—cannot be measured, but it can be approximated by operators with discrete spectra which are measurable. The measurable approximant F(A) is not canonically determined; it has to be chosen by the experimentalist. It is argued that this operator can always be chosen in such a way that Sewell’s results (Sewell in Rep. Math. Phys. 56: 271, [2005]; Sewell, Lecture given at the J.T. Lewis Memorial Conference, Dublin, [2005]) on the measurement of a hermitian operator on a finite-dimensional vector space (described in Sect. 3.2) constitute an adequate resolution of the measurement problem in this theory. From this follows our major conclusion, which is that the notion of a geometrical point is as meaningful in nonrelativistic quantum mechanics as it is in classical physics. It is necessary to be sensitive to the fact that there is a gap between theoretical and experimental physics, which reveals itself tellingly as an error inherent in the measurement of a continuous variable. The symbolism introduced earlier provides a convenient vehicle for examining the status and consistency of Aristotle's three diverse justifications and for explaining how he means to avoid Protagorean relativism without embracing Platonic absolutism. When the variables ‘ x ’ and ‘ y ’ are allowed to range over the groups of free men in a given polis as well as over individual free men, the formula for the Aristotelian conception of justice expresses the major premiss of Aristotle's three justifications: (1) (...) These justifications are compatible with each other since they apply to different situations. The polises where democracy and true aristocracy are justified contain no godlike men, and the polis in which democracy is justified differs from that in which true aristocracy is justified in containing a large group of free men who individually have little virtue ( Pol. III.11.1281b23-25, 1282a25-26). Each of the justifications is a valid deductive argument. Aristotle affirms the major premiss they share on the basis of a twofold appeal to nature. The principle of distributive justice, the concept as distinguished from the various conceptions of distributive justice, is itself according to nature ( Pol. VII.3.1325b7-10) and so too is one particular standard of worth, the standard of the best polis. Consequently, the question of the status of these three justifications, whether they are purely hypothetical or not, is a question about the minor premiss or premisses of each. In the case of the democratic premiss Aristotle's answer is straightforward: it is sometimes but not always true ( Pol. III.11.1281bl5-21). Hence the justification of democracy is not purely hypothetical. Nor is the justification of absolute kingship. The man who is “like a god among men” ( Pol. III.13.1284a10-11) would be a man of heroic virtue (see VII.14.1332bl6-27); and such a man, Aristotle says, is “rare” ( σπávιoη ) (not nonexistent) ( E.N. VII.1.1145a27-28). The minor premisses of the aristocratic argument describe a situation where all of the free men in a given polis have sufficient wealth for the exercise of the moral and intellectual virtues and where all of the older free men of the polis are men of practical wisdom. In the Politics Aristotle makes only the modest claim that such a situation is possible: It is not possible for the best constitution to come into being without appropriate equipment [that is, the appropriate quality and quantity of territory and of citizens and noncitizens]. Hence one must presuppose many things as one would wish them to be, though none of them must be impossible ( Pol. VII.4.1325b37-38; see also II.6.1265al7-18). But Aristotle appears to subscribe to the principle that every possibility is realized at some moment of time ( Top. 11.11.115bl7-18, Met. Θ.4.1047b3-6, N.2.1088b23-25). This principle together with the claim that the situation described is possible entails that the situation sometimes occurs. Thus even Aristotle's justification of true aristocracy is not purely hypothetical. The final question is Aristotle's way of avoiding Protagorean relativism without embracing Platonic absolutism. The relativist, along with everyone else ( E.N. V.3.1131a13-14, Pol. III.12.1282bl8), can accept the principle of distributive justice: Q(x)/Q(y) = V(T(x))/V(T(y)) And he can concede that particular instances of this principle, particular conceptions of justice, accurately describe the modes of distributing political authority that appear just to particular polises and to particular philosophers. What he denies is that there is any basis for ranking these various conceptions of justice or for singling one out as the best (Plato, Theaet. 172A-B). Aristotle, following in Plato's track ( Laws X.888D7-890D8), maintains against the relativist that nature provides such a basis. But he departs from Plato in his conception of nature. For Plato “the just by nature” ( τó ρυσει δίκ↑oν }) ( Rep. VI.501B2) is the Form of justice, an incorporeal entity ( Phdo. 65D4-5, Soph. 246B8) that exists beyond time and space ( Tim. 37C6-38C3, 51E6-52B2), whereas for Aristotle the sensible world is the realm of nature ( Met. A.1.1069a30-b2). Thus in appealing to nature Aristotle does not appeal to a transcendent standard. Nor does he appeal to his main criterion of the natural, namely, happening always or for the most part. Aristotle's theory of justice is anchored to nature by means of the polis described in Politics VII and VIII, and he regards this polis as natural because it fosters the true end of human life and because its social and political structure reflects the natural hierarchy of human beings and the natural stages of life. Thus the nature that Aristotle's theory of justice is ultimately founded on is human nature. (shrink)

The Bellum Hispaniense, often considered alongside the two other pseudo-Caesarian commentarii, the Bellum Alexandrinum and the Bellum Africum, contains the account of Caesar's final battles with Pompey's forces in Spain during 46 and 45 b.c. In terms of its language and style, the BHisp. is certainly the most un-Caesarian of the pseudo-Caesarian Bella. The work abounds in phenomena belonging to different linguistic varieties, and is an important piece of evidence in the process of the standardization of written Latin.

Although the declaratory theory is arguably a central feature of common law adjudication, it is widely disparaged: either the law never changes, which is implausible, or it is changed retrospectively, which is unfair and contrary to the rule of law. These common objections are rooted in misconceptions about the nature of law. When we distinguish more clearly between the sources of law, whether in statute or precedent, and the corpus juris, shaped by general principles of justice, the declaratory theory is (...) vindicated. Structured by familiar precedents and principles, the common law offers a framework within which the rule of law is sustained by moral reflection and argument. There is a close analogy with Rawlsian reflective equilibrium. It is only in virtue of an inquiry into justice, guided but not irrevocably bound by past practice, that there is any law to be declared. Legal judgment is precisely a determination of the requirements of justice as they apply in all the circumstances. (shrink)

Testimony, even in the well-worked parts of antiquity, continues to accrue, some from new papyri, some from texts long known but overlooked. In the result the critic is discomfited, honest men come by their own. οιόνδ' πέβη τόδε πργμα. This document, which consists of two lives of Homer and the Agon inserted between them, has long been derived from the Μουσεîον of Alcidamas. The conjecture was contested and the survival of Alcidamas denied. The publication of twenty-five lines from a papyrus (...) of s. II.–III. p. C. by Professor J. G.
