We begin this article by delineating the explanatory gaps left by prevailing gene‐focused approaches in our understanding of phenotype determination, inheritance, and the origin of novel traits. We aim not to diminish the value of these approaches but to highlight where their implementation, despite best efforts, has encountered persistent limitations. We then discuss how each of these explanatory gaps can be addressed by expanding research foci to take into accountbiological agency—the capacity of living systems at various levels to participate in (...) their own development, maintenance, and function by regulating their structures and activities in response to conditions they encounter. Here we aim to define formally what agency and agents are and—just as importantly—what they are not, emphasizing that agency is an empirical property connoting neither intention nor consciousness. Lastly, we discuss how incorporating agency helps to bridge explanatory gaps left by conventional approaches, highlight scientific fields in which implicit agency approaches are already proving valuable, and assess the opportunities and challenges of more systematically incorporating biological agency into research programs. With the shift toward online environments due to COVID-19 pandemic, particularly for educational sector, employees’ performance has been affected by an array of different factors. Personal aspects as well as organizational focus on individuals’ wellbeing are the main focus of this study through inclusion of job autonomy and work-life conflict alongside other factors, such as informational support that can aid academic staff regarding their wellbeing during times of crisis. In response to the effects of COVID-19 on employees, this study aims (...) to provide tangible data to protect university teachers during crises and establish key points that can improve their wellbeing. For this purpose, we used interviews to provide in-depth understanding of the subject. A total of 16 teachers as interviewees have provided qualitative data that was analyzed with MAXQDA. This study highlights the importance of work-life conflict and vitality of job autonomy on academic staffs’ performance and overall wellbeing through a conceptual analysis. We emphasize the role of organizations in maintaining a work environment where university teachers’ wellbeing is prioritized and various elements such as training and support are used to help stabilizing work-life balance. The current findings can be beneficial for both scholars and decision-makers in schools and universities to enhance elements of remote work for their staff. (shrink)

The COVID-19 outbreak has ravaged all societal domains, including education. Home confinement, school closures, and distance learning impacted students, teachers, and parents’ lives worldwide. In this study, we aimed to examine the impact of COVID-19-related restrictions on Italian and Portuguese students’ academic motivation as well as investigate the possible buffering role of extracurricular activities. Following a retrospective pretest–posttest design, 567 parents reported on their children’s academic motivation and participation in extracurricular activities. We used a multi-group latent change score model to (...) compare Italian and Portuguese students’: pre-COVID mean motivation scores; rate of change in motivation; individual variation in the rate of change in motivation; and dependence of the rate of change on initial motivation scores. Estimates of latent change score models showed a decrease in students’ motivation both in Italy and in Portugal, although more pronounced in Italian students. Results also indicated that the decrease in students’ participation in extracurricular activities was associated with changes in academic motivation. Furthermore, students’ age was significantly associated with changes in motivation. No significant associations were found for students’ gender nor for parents’ education. This study provides an important contribution to the study of students’ academic motivation during home confinement, school closures, and distance learning as restrictive measures adopted to contain a worldwide health emergency. We contend that teachers need to adopt motivation-enhancing practices as means to prevent the decline in academic motivation during exceptional situations. (shrink)

El objetivo de este artículo es hacer una reconstrucción racional del uso del examen de proporcionalidad en contextos de adjudicación judicial de derechos sociales constitucionales. Dicho trabajo de reconstrucción será desarrollado en dos pasos. En primer lugar, se tratará el interrogante referido a si el examen de proporcionalidad en su variante “por omisión” exhibe o no una estructura diferente con respecto a su, mucho más conocida e investigada, variante “por exceso”. En segundo lugar, se describirán las reglas y formas de (...) argumentación que están implícitas en el uso del examen de proporcionalidad por omisión y que componen a sus respectivos sub-exámenes de idoneidad, necesidad y proporcionalidad stricto sensu. Este artículo continúa la investigación iniciada en «Los trasmundos del joven Ortega (1902-1914)». En esta ocasión, reconstruiré algunas ideas en torno a la religión y Dios presentes en los años correspondientes a la primera navegación de Ortega. El objetivo es superar las interpretaciones reduccionistas que rápidamente identifican a Ortega como una persona reacia a la religión. En primer lugar, recuperaré una categoría clave de la primera navegación, “la altura de los tiempos”, para mostrar cómo Ortega sitúa la religión entre otras (...) formas superiores de la cultura que considera que deben avanzar. En segundo lugar, analizaré aquellos aspectos que harían una religión indigna de la altura de los tiempos y que motivan el ansia de reforma religiosa. Por último, en tercer lugar, dilucidaré la segunda concepción orteguiana de Dios compatible con la propuesta de una “nueva” religión. (shrink)

Drawing on managerial discretion and conflicting institutional logics literature, this study investigates the relation between the personal sustainability behaviors of owner–managers and the corporate sustainability practices of SMEs. The research proposes a contingency model that assesses the moderating effects of perceived economic advantages and environmental hostility on this relationship. Based on linear hierarchical multiple regression analyses of a cross-sectoral sample of French SMEs, the results suggest a positive influence of the manager's PSB on the SME's CS practices that appears to (...) be differently moderated depending on the type of practice considered. The influence on environmental practices is fostered through the perception of economic advantages. The influence on workplace practices is only effective when the business environment is deemed benign and the influence on community practices is dampened by the perception of environmental hostility. Highlighting the trade-off between the manager's personal values and the SME's economic constraints, these findings contribute to a better understanding of the critical antecedents of sustainability in small businesses. Dans son discours intitulé "Maladie et privation d'amour", elle s'interrogeait sur l'évolution de la médecine moderne dont les progrès en matière d'appareils médicaux éloignaient toujours davantage les praticiens de leurs patients. Par-delà son regard sur la relation entre l'âme et le corps, Christa Wolf informait aussi des attentes des femmes qui avaient pris au mot les promesses d'égalité des sexes en régime (...) "socialiste réel". Quelques années plus tôt Georges Canguilhem, résistant au scientisme triomphant, se proposait de continuer à penser la médecine comme un art qui devait s'adapter à chaque individu malade. Déplorant la disparition progressive de la clinique, il plaidait pour un dialogue continu entre le patient et le médecin Tandis que Sonia Combe s'appuie sur le discours de Christa Wolf pour appréhender l'expérience communiste à partir de l'étude de genre, revenant sur la double leçon de Christa Wolf et de Canguilhem, Antoine Spire se demande dans quelles conditions un retour de la médecine à la pratique clinique pourrait se faire et répondre à la demande des malades. This study focuses on retraction notices from two major Latin American/caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

Informed consent to medical intervention is fundamental in both ethics and law. But in practice it is often not taken seriously in developing countries. This paper provides an appraisal of informed consent practices in Bangladesh. Following a review of the ethical and legal principles of informed consent, it assesses the degree to which doctors adhere to it in Bangladesh. Based on findings of non-compliance, it then investigates the reasons for such non-compliance through an appraisal of informed consent practices in Bangladesh (...) and provides recommendations aimed at improving such practices. The significance of this paper lies in unveiling the interdependence between the ethical and legal traits of informed consent and their ramifications on strengthening the patient-oriented approach of duty to care. This paper is devoted to Franz Brentano’s conception of intentionality, and aims to reveal some of its lesser known aspects, like the implications of his studies for our understanding of Aristotle’s psychology. I try to show two “currents” in Brentano’s thought: beside what is widely known as Franz Brentano’s philosophy of mind, I also present the Aristotelian side of his thinking. Each of these currents, which I call A and B, makes different assumptions about the ontological status of the soul (...) and God, and from these different conceptions of mental life and its relation to God follow different accounts of immortality. By discussing them in detail I also hope to show Brentano as a philosopher of religion. (shrink)

Beginning with the relation between the question of Nature and the status of philosophy, this essay interprets the theme of the mirror through the chiasm between multiplicity and thought. This relation is not substantial dualism’s relation of the subject with the object, but rather, following the image used by Merleau-Ponty, it is like the relation between two mirrors facing each other, thus suggesting that the “subject” herself is a multiplicity. From thence, drawing inspiration from this quote in Eye and Mind, (...) “the Cartesian does not see himself in the mirror”, I formulate both the problem of the body and the question of intersubjectivity as a field of individuation for all possible forms of subjectivity. Following this theme, the essay retraces the use of the mirror in the Note on Machiavelli. Finally, given that the theme of subjectivity as a multiplicity is related to the theme of corporeality, the essay ends with an analysis of the idea of the body-mirror which, from an intersubjective point of view, becomes an expressive relation in which each body is mirror and expression of the whole universe, thus unlocking an existential monadology. The purpose of this article is to make a rational reconstruction of the use of the proportionality test in contexts of judicial adjudication of constitutional social rights. This reconstruction will be developed in two stages. Firstly, I will deal with the question of whether the proportionality test in its variation by omission (that is, in cases of positive rights) exhibits or not a different structure with respect to its (better known and developed) variation by excess (that is, in cases of (...) negative rights). Secondly, I will describe the rules and forms of argumentation implied in the use of the proportionality test by omission, which constitute its respective sub-tests of suitability, necessity and proportionality stricto sensu. This paper argues that a Wittgensteinian understanding of language as an integral dimension of human forms of life speaks against the view that our relationship to texts is interpretive in nature. Wittgenstein’s re-orientation to language entails that meaning is immediate rather than interpretive, and that our works don’t stop short of the facts. The aim of this paper is to show that the immediate mutuality of meanings and facts carries over to our textual practices so that our texts make available (...) immediate unities of meanings and narrative facts. Wittgenstein’s reflections on following rules, customs or forms of life allow us to steer a careful course between the view that a text is determined by the author’s intentions and a relativism of variable interpretations that results from denying the relevance of authorial intentions. For example, Stanley Fish holds that meanings vary insofar as they are “predetermined’ by our “presuppositions” – our interests, goals and assumptions. But Wittgenstein’s work suggests that following rules, and hence grasping meanings, does not involve something as variable as individual “presuppositions.” Rather, our training into forms of life opens up a second-nature where grasp of both facts and meanings is immediate. This allows us to re-affirm the view that there are textual facts that do not depend on interpretation; that there is a difference between apprehending the facts of a text and going on to provide further interpretations of those facts. The ‘co-constitution’ of meanings and facts does not foreclose interpretive practices but allocates them to their proper sphere – as practices that we may wish to undertake in order to go beyond the initial immediate openness of the world of a text. We can test this view by considering the way our changing forms of forms affect the way we read a text such as Jane Austen’s Mansfied Park. (shrink)

This article deals with Donald Davidson�s concept of metaphor and Richard Rorty�s use of it for his version of political liberalism. Rorty assumes that metaphor is a linguistic element that is impossible to understand. Metaphor is an unintelligible �call� that, from within the private sphere, provokes in individuals the desire to create alternative forms of life. Once metaphor has become literal, it �and the new form of life that it entails� can form part of public life. Metaphor is the guarantee (...) of the constant renewal of political liberalism. As against Rorty, yet also relying on Davidson, I argue that both metaphor and literal meaning are comprehensible,... (Leer más) and must therefore be said to exist in a relationship of mutuality. Avec les ruptures successives du XXe siècle, l'artiste a endossé l'habit du critique et la négativité s'est substituée à la pratique effective. Herder is often criticized for having embraced cultural relativism, but there has been little philosophical discussion of what he actually wrote about the nature of the human species and its differentiation through culture. This book focuses on Herder's idea of culture, seeking to situate his social and political theses within the context of his anthropology, metaphysics, epistemology, ethics, theory of language and philosophy of history. It argues for a view of Herder as a qualified relativist, who combined the conception of (...) a common human nature with a belief in the importance of culture in developing and shaping that nature. Especially highlighted are Herder's understanding of the relativity of virtue and happiness, and his belief in the impossibility of constructing a single best society. The book will appeal to a wide range of readers interested both in Herder and in Enlightenment culture more generally. (shrink)

In recent years, the changing landscape for the conduct and assessment of research and of researchers has increased scrutiny of the reward systems of science. In this context, correcting the research record, including retractions, has gained attention and space in the publication system. One question is the possible influence of retractions on the careers of scientists. It might be assessed, for example, through citation patterns or productivity rates for authors who have had one or more retractions. This is an emerging (...) issue today, with growing discussions in the research community about impact. We have explored the influence of retractions on grant review criteria. Here, we present results of a qualitative study exploring the views of a group of six representatives of funding agencies from different countries and of a follow-up survey of 224 reviewers in the US. These reviewers have served on panels for the National Science Foundation, the National Institutes of Health, and/or a few other agencies. We collected their perceptions about the influence of self-correction of the literature and of retractions on grant decisions. Our results suggest that correcting the research record, for honest error or misconduct, is perceived as an important mechanism to strengthen the reliability of science, among most respondents. However, retractions and self-correcting the literature at large are not factors influencing grant review, and dealing with retractions in reviewing grants is an open question for funders. (shrink)

Simone de Beauvoir and the Politics of Ambiguity is the first full-length study of Beauvoir's political thinking. Best known as the author of The Second Sex, Beauvoir also wrote an array of other political and philosophical texts that together, constitute an original contribution to political theory and philosophy. Sonia Kruks here locates Beauvoir in her own intellectual and political context and demonstrates her continuing significance. Beauvoir still speaks, in a unique voice, to many pressing questions concerning politics: the values (...) and dangers of liberal humanism; how oppressed groups become complicit in their own oppression; how social identities are perpetuated; the limits to rationalism; and the place of emotions, such as the desire for revenge, in politics. In discussing such matters Kruks puts Beauvoir's ideas into conversation with those of many contemporary thinkers, including feminist and race theorists, as well as with historical figures in the liberal, Hegelian, and Marxist traditions. Beauvoir's political thinking emerges from her fundamental insights into the ambiguity of human existence. Combining phenomenological descriptions with structural analyses, she focuses on the tensions of human action as both free and constrained. To be human is to be a paradoxical being, at once capable of free choice and yet, because embodied, vulnerable to injury from others. Politics is thus a domain of complexly interwoven, multiple, human interactions that is rife with ambiguity, and where freedom and violence too often closely intertwine. Beauvoir accordingly argues that failure is a necessary part of political action. However, she also insists that, while acknowledging this, we should assume responsibility for the outcomes of what we do. (shrink)

Existentialism and phenomenology seem, at first glance, to constitute one of those rare strands of modern Western philosophy that converges productively with feminism. They form a tradition that opposes abstract, rationalist thought and is instead committed to elucidating concrete, “lived experience,” including experiences of embodiment and emotion. As such, they anticipate much “second‐wave” feminist thought that criticizes abstraction, beginning from accounts of women's concrete experiences and emphasizing the importance of personal politics. However, feminists engaged with the tradition have also cautioned (...) that the main canonical figures remained ensconced in masculinism, since their allegedly generic accounts of “human existence” were tacitly grounded in male experience. During the 1980s interest in existentialism and phenomenology waned, as notions of women's experience increasingly came under suspicion with the poststructuralist, or “postmodern,” turn in feminism. But in the last few years interest has grown again, as theorists have sought insights from the tradition that might move theory beyond the impasses that postmodernism now seems to some to present. It is precisely through movement that the subject inscribes itself into the world and becomes visible to others. The subject is a movement directed to the outside, that is to say, the subject is desire. Desire is the “tension” toward the “extrême dehors” that we call the world. In all of his works Maurice Merleau-Ponty reaffirms, without thematizing it, a conception of life as movement, and of body as action and desire: the human being is “a certain lack of....” In (...) other words, it is the distance between myself and the absent that drives me to move, to annul the distance through motion. Thus life is nothing but the unfinished act of moving into space and thereby creating space—the space in which we, as desire and movement, encounter both others and the world. As the act of moving is the way one appears to another, every relationship is based on appearing. In short, life is the movement that leads us towards the world and coincides with our desire to make it appear.C’est précisément par le mouvement que le sujet s’inscrit dans le monde et devient visible pour les autrui. Le sujet est un mouvement dirigé au dehors, c’est-à-dire, le sujet est désir. Le désir est la « tension » vers le « dehors extrême » que nous appelons le monde. Cet article prend comme point de départ de sa réflexion les défis de l’éducation dans un « univers problématique », tel qu’il est analysé par Ricœur dans un entretien accordé à Anita Hocquard en 1985. Le caractère éminemment conflictuel de la tâche éducative nous amène à discuter les notions de traditionalité, de traditions et de tradition. Il s’agit, ainsi, de réfléchir autour de la lutte pour la reconnaissance, la légitimité et l’autorité des différentes traditions dans un contexte culturel où l’héritage (...) colonialiste s’est imposé comme le modèle qui délégitime les traditions plurielles qui coexistaient et rivalisaient avec cet héritage. Enfin, nous émettons l’hypothèse que la littérature représente une manière alternative de revitaliser ces héritages silencieux, sur la base d’une brève analyse du roman L’histoire de Poncia, de l’écrivaine brésilienne Conceição Evaristo. Dans cette contribution nous analysons l’interprétation de Merleau-Ponty du schéma corporel et du mouvement, en relation avec les découvertes récentes en neurosciences cognitives, afin de proposer une esquisse d’une phénoménologie du politique. Plus précisément, nous nous focaliserons, d’une part, sur le concept dynamique de schéma corporel chez Merleau-Ponty et sur sa compréhension de l’intentionnalité motrice et corporelle, ainsi que sur l’image du miroir qu’il utilise souvent, notamment dans la « Note sur Machiavel », et, d’autre part, sur la théorie des (...) neurones miroirs proposée par le neurophysiologiste Giacomo Rizzolatti sur la compréhension de la compréhension. C’est précisément la figure du miroir, et les théories pertinentes sur le réflexe et les réflexions, qui constituent la clé pour relier les études phénoménologiques du corps, du mouvement et de l’empathie avec les approches neuroscientifiques sur ces mêmes questions. Le concept de miroir se révèle comme essentiel afin de comprendre le fonctionnement des neurones miroirs ainsi que la base de l’empathie, qui doit être comprise comme compréhension et imitation incarnées. L’autre se révèle comme notre miroir. Nous fournissons ainsi, suivant à la fois les théories phénoménologiques et neuroscientifiques, la preuve qu’il existe effectivement une connexion entre phénoménologie et pensée politique, ainsi qu’une communication inter-corporelle entre moi et autrui, qui peut servir de base pour développer une théorie de l’intersubjectivité en tant qu’intentionnalité corporelle partagée, voire une introduction à une phénoménologie politique. Drawing on Merleau-Ponty’s hypothesis about transcendental geology in the final phase of his work, this article examines the debate about the Anthropocene from the perspective of philosophy of history. Firstly, we follow the author through the preliminary materials for The Visible and The Invisible by situating transcendental geology within the book’s complex theoretical architecture, and by foregrounding the necessity of rethinking the notion of Earth through the reading that the French philosopher offers of Husserl’s phenomenology. We will thus focus on (...) the theme of the overturning of the Copernican doctrine in an ethico-practical perspective, showing that Merleau-Ponty’s ecology can be considered a philosophical ecology ante litteram. Finally, drawing on the hypothesis proposed by historians Bonneuil and Fressoz, the essay will attempt to highlight the relevance of Merleau-Ponty’s practical thought for the debate about the Anthropocene. The standards for translating texts in specialized fields have become particularly rigorous with the increasing complexity of material and growing demand for its translation. While translations simply aimed at communication and produced by machine translation are proliferating, the need for reliable and high-quality translations is also increasing. The demand for expert-dependable legal translation is higher than ever, requiring competence-based training in the field of legal translation. This paper describes a guided-task framework for developing subject area competence at the earliest stage (...) of an English–Arabic legal translation course. It presents the three most problematic phases of concept processing in legal translation in terms of: legal systems; branches of law; and genre-based phraseology. The approach presented below is part of a more general study that aims to describe the first course in a series of three graduate courses on legal translation, each of them motivated by a guided-task framework that has the aim of developing three specific competences in legal translation: legal concept processing => subject area competence; documentary research => instrumental competence; and legal rhetorics => communicative and textual competence. In this paper we intend to focus on the first course of legal concept processing as a key prerequisite for legal knowledge development. We illustrate the relevance of addressing specific variables when analysing legal concepts in the text that is to be translated, before proceeding to the information search and communication, according to established formulae and conventions.
