RESUMEN: En el presente artículo se intentará demostrar que la libertad de conciencia y religiosa conforman un único derecho que tienen como fin proteger las creencias e ideologías de las personas, independientemente de su carácter religioso o secular. Por ende, se sostendrá que la fórmula adoptada por el sistema jurídico colombiano de promover el fenómeno religioso es contraria al principio de igualdad porque privilegia una visión del mundo teísta frente a otras visiones, también válidas en un Estado constitucional y pluralista (...) como el colombiano.ABSTRACT: In this article we will try to demonstrate that the freedom of conscience and religion constitute a single right that have as a purpose to protect the beliefs and ideologies of people, regardless of their religious or secular character. The purpose of this study is to determine empirically the state of the art of the medical care, when healthcare personal is confronted with ethical dilemmas related with the care they give to the geriatric population. An observational, longitudinal, prospective and qualitative study was conducted by analyzing the correlation between healthcare personnel–patient relationship, and ethical judgments regarding dilemmas that arise in daily clinical practice with geriatric patients. Mexican healthcare personnel with current active practices were asked to write up an ethical (...) dilemma that arose frequently or that had impacted their medical practice. From the narrative input, we were able to draw up a database with 421 dilemmas, and those corresponding to patients 60 years and older were selected (n = 54, 12.8 %). The axiological analysis of the narrative dilemmas of geriatric patients was made using dialectical empiricism. The axiological analysis values found most frequently were classified into three groups: the impact of healthcare, the roles of the physician, and refusal of therapy; the healthcare role of educator, caring for the patients’ life and the risk of imminent death where the values found more often. The persistence and universality of certain dilemmas in geriatrics calls for awareness and requires a good training in the ethical discernment of these dilemmas. This would help to improve substantially the care and the life quality of this population. (shrink)

Lower extremity non-contact soft tissue injuries are prevalent in elite futsal. The purpose of this study was to develop robust screening models based on pre-season measures obtained from questionnaires and field-based tests to prospectively predict LE-ST injuries after having applied a range of supervised Machine Learning techniques. One hundred and thirty-nine elite futsal players underwent a pre-season screening evaluation that included individual characteristics; measures related to sleep quality, athlete burnout, psychological characteristics related to sport performance and self-reported perception of chronic (...) ankle instability. A number of neuromuscular performance measures obtained through three field-based tests [isometric hip strength, dynamic postural control and lower extremity joints range of motion ] were also recorded. Injury incidence was monitored over one competitive season. There were 25 LE-ST injuries. Only those groups of measures from two of the field-based tests, as independent data sets, were able to build robust models [area under the receiver operating characteristic curve score ≥0.7] to identify elite futsal players at risk of sustaining a LE-ST injury. Unlike the measures obtained from the five questionnaires selected, the neuromuscular performance measures did build robust prediction models. The inclusion in the same data set of the measures recorded from all the questionnaires and field-based tests did not result in models with significantly higher performance scores. The model generated by the UnderBagging technique with a cost-sensitive SMO as the base classifier and using only four ROM measures reported the best prediction performance scores. The models developed might help coaches, physical trainers and medical practitioners in the decision-making process for injury prevention in futsal. (shrink)

Latin American and Latinx philosophers have a long and rich history of deep engagement in public life through a variety of different projects and venues. This chapter offers a brief survey of the historical development and practice of philosophy in public life in Latin American and Latinx traditions. Because of their unique histories, it engages public philosophy in Mexico and Argentina separately. The chapter shows that a guiding thread in Argentinian public philosophy is a deep‐rooted concern about the threats created (...) by political and intellectual authoritarianism and strategies for pushing back against this oppression by developing emancipatory practices and democratic alternatives. This work runs through a long line of Argentinian philosophers from José Ingenieros and Alejandro Korn to María Lugones and Diana Maffía. Public philosophy is clearly a vibrant and ongoing enterprise in contemporary Mexico. Argentina also possesses a long and rich tradition of public philosophy. (shrink)

Anecdotes have shown that some articles on profitable drugs are constructed by and shepherded through publication by pharmaceutical companies and their agents, whose influence is largely invisible to readers. This is ghost-management, the substantial but unrecognized research, analysis, writing, editing and/or facilitation behind publication. Publicly available documents suggest that these practices extremely widespread affecting up to 40% of clinical trial reports in key periods but it has been unclear how representative these documents are. This article presents the results of an (...) investigative sampling of the self-presentation of publication planning services, and presents this and other evidence of a sizable publication planning industry. Thus different lines of evidence indicate that ghost-management is a common and important phenomenon, strongly affecting the published medical literature in the service of marketing. (shrink)

Kant’s views on the relation between freedom and moral law seem to undergo a major, unannounced shift. In the third section of the Groundwork, Kant seems to be using the fact that we must act under the idea of freedom as a foundation for the moral law. However, in the Critique of Practical Reason, Kant claims that our awareness of our freedom depends on our awareness of the moral law. I argue that the apparent conflict between the two texts depends (...) on a reading of the opening paragraphs of Groundwork III, and on an interpretation of Kant’s claim that we “act under the idea of freedom”, that is implausible on textual and on philosophical grounds. I then present an alternative interpretation of what Kant means by “acting under the idea of freedom” and of the opening paragraphs of Groundwork III. I argue that the only substantive conclusion of these paragraphs is that no theoretical proof of freedom is necessary. Moreover I argue that although these paragraphs raise concerns about the validity of the moral law, these concerns and Kant’s answers to them, do not give rise to any significant conflict with his views in the Critique of Practical Reason. Ecological developmental biology considers the phenotype as actively produced through an environmentally informed process of individual development, rather than predetermined by the genotype. Accordingly, the genotype is viewed as one among many interactants that contribute formative elements; it is understood to do so no differently from the way other organism-internal and environmental resources do. Although the EcoDevo approach is evidently particularly apt to inform approaches to human development, which mostly takes shape in rich cultural environments, it is remarkable that, at (...) least within some highly influential circles of the linguistic sciences, the study of many distinctive human cognitive traits including language remains strongly anchored to a preformationist stance. This article brings an EcoDevo approach to the biologically focused study of language to argue that an aspect of language design commonly assumed to be “blueprinted,” namely, the lexicon-syntax interface, may instead be explained as a plastic effect of ongoing developmental processes in the mind of the child, in which designated aspects of the environment fulfill a key constructive role. Diversos estudios han concluido que los pacientes con daño en la Corteza Frontal –CF– o Corteza Prefrontal Ventromedial –CPV– muestran una disposición a herir directamente a otra persona con el fin de salvar varias vidas en sus respuestas a los “dilemas morales personales”, revelando una posible carencia de empatía. No obstante, cuando evalúan conductas carentes de empatía sin justificación utilitarista, sus respuestas son normales. Defendemos aquí que los pacientes sufren una deficiencia cognitiva relacionada con la hipótesis de marcador somático de (...) Damasio y con juicios de valor.
