Healthcare professionals often face ethical conflicts and challenges related to decision-making that have necessitated consideration of the use of conscientious objection (CO). No current guidelines exist within Spain’s healthcare system regarding acceptable rationales for CO, the appropriate application of CO, or practical means to support healthcare professionals who wish to become conscientious objectors. As such, a procedural framework is needed that not only assures the appropriate use of CO by healthcare professionals but also demonstrates its ethical validity, legislative compliance through (...) protection of moral freedoms and patients’ rights to receive health care. Our proposal consists of prerequisites of eligibility for CO (individual reference, specific clinical context, ethical justification, assurance of non-discrimination, professional consistency, attitude of mutual respect, assurance of patient rights and safety) and a procedural process (notification and preparation, documentation and confidentiality, evaluation of prerequisites, non-abandonment, transparency, allowance for unforeseen objection, compensatory responsibilities, access to guidance and/or consultative advice, and organizational guarantee of professional substitution). We illustrate the real-world utility of the proposed framework through a case discussion in which our guidelines are applied. (shrink)

Parental beliefs and knowledge about child development affect how they construct children’s home learning experiences, which in turn impact children’s developmental outcomes. A rapidly growing population of dual language learners (DLLs) highlights the need for a better understanding of parents’ beliefs and knowledge about dual language development and practices to support DLLs. The current study examined the dual language beliefs and knowledge of parents of Spanish-English preschool DLLs (n= 32). We further asked how socioeconomic and sociocultural factors were associated with (...) parental beliefs and knowledge, and how parental beliefs and knowledge related to DLLs’ home dual language experiences and school readiness skills as rated by their teachers. Results suggested both strengths and opportunities for growth in parental beliefs and knowledge. Moreover, parents from higher-SES backgrounds reported beliefs and knowledge that were more consistent with scientific evidence. Furthermore, parental beliefs and knowledge was positively related to relative Spanish input at home and negatively related to the frequency of English language and literacy activities. However, parental beliefs and knowledge were not associated with children’s dual language output at home or the frequency of Spanish language and literacy activities. Finally, parental beliefs and knowledge were associated with children’s school readiness skills in Spanish but not in English. Together, these findings highlight the need for culturally responsive interventions and parent education programs, which must recognize both the strengths and areas of improvement in parents of DLLs and support parents to transform knowledge into high-quality language and literacy experiences that benefit DLLs. Despite abundant evidence associating CD38 overexpression and CD4 T cell depletion in HIV infection, no causal relation has been investigated. To address this issue, a series of mechanisms are proposed, supported by evidence from different fields, by which CD38 overexpression can facilitate CD4 T cell depletion in HIV infection. According to this model, increased catalytic activity of CD38 may reduce CD4 T cells’ cytoplasmic nicotin‐amide adenine dinucleotide (NAD), leading to a chronic Warburg effect. This will reduce mitochondrial function. Simultaneously, CD38's (...) catalytic products ADPR and cADPR may be transported to the cytoplasm, where they can activate calcium channels and increase cytoplasmic Ca2+ concentrations, further altering mitochondrial integrity. These mechanisms will decrease the viability and regenerative capacity of CD4 T cells. These hypotheses can be tested experimentally, and might reveal novel therapeutic targets. (shrink)

Philosophical accounts of moral responsibility are standardly framed by two platitudes. According to them, blame requires the presence of a moral defect in the agent and the absence of excuses. In this chapter, this kind of approach is challenged. It is argued that (a) people sometimes violate moral norms due to performance mistakes, (b) it often appears reasonable to hold them responsible for it, and (c) their mistakes cannot be traced to their moral qualities or to the presence of excuses. In this article, I examine recent debates concerning the existence and the nature of basic actions. The discussion is structured around four theses, with which Arthur Danto introduced basic actions to contemporary theorists. The theses concern (i) the relationship between agency and causality, (ii) the distinction between basic and complex actions, (iii) the regress argument for basic actions, and (iv) the structure of practical knowledge in the light of these actions.

First collected in Italy in 1985, _Art's Claim to Truth_ is considered by many philosophers to be one of Gianni Vattimo's most important works. Newly revised for English readers, the book begins with a challenge to Plato, Aristotle, Kant, and Hegel, who viewed art as a metaphysical aspect of reality rather than a futuristic anticipation of it. Following Martin Heidegger's interpretation of the history of philosophy, Vattimo outlines the existential ontological conditions of aesthetics, paying particular attention to the works of (...) Kandinsky, which reaffirm the ontological implications of art. Vattimo then builds on Hans-Georg Gadamer's theory of aesthetics and provides an alternative to a rationalistic-positivistic criticism of art. This is the heart of Vattimo's argument, and with it he demonstrates how hermeneutical philosophy reaffirms art's ontological status and makes clear the importance of hermeneutics for aesthetic studies. In the book's final section, Vattimo articulates the consequences of reclaiming the ontological status of aesthetics without its metaphysical implications, holding Aristotle's concept of beauty responsible for the dissolution of metaphysics itself. In its direct engagement with the works of Gadamer, Heidegger, and Luigi Pareyson, _Art's Claim to Truth_ offers a better understanding of the work of Vattimo and a deeper knowledge of ontology, hermeneutics, and the philosophical examination of truth. La discusión acerca de la capacidad de nuestra inteligencia de acceder al conocimiento de la realidad en sí es y sigue siendo una de las más antiguas y apasionantes de la filosofía. Piaget revolucionó la historia de la psicología y la pedagogía a partir de sus descubrimientos científicos relativos al modo en que el ser humano conoce. Sin embargo, por su misma inclinación filosófica, su constructivismo pedagógico quedó fuertemente arraigado en tradiciones filosóficas inmanentistas, a punto tal que la asociación entre (...) constructivismo pedagógico y antirrealismo constituye una suerte de lugar común y un cierto presupuesto dogmático. Lo cierto es que esta asociación no constituye la única alternativa posible y, hasta cierto punto, ni siquiera parece responder cabalmente a los principios o consecuencias últimas de los hallazgos del constructivismo de Piaget. Es posible justificar el constructivismo pedagógico desde posiciones realistas, siempre y cuando se revisen algunos supuestos que la modernidad ha instalado de manera no muy crítica en los círculos educativos y filosóficos. La revisión de la noción de representación, concebida según la tradición aristotélica y aggiornada por los aportes del constructivismo, permite abrir un camino de conciliación entre el constructivismo pedagógico y un tipo de realismo que sea, a la vez, robusto y plural. The concept of fitness has generated a lot of discussion in philosophy of biology. There is, however, relative agreement about the need to distinguish at least two uses of the term: ecological fitness on the one hand, and population genetics fitness on the other. The goal of this paper is to give an explication of the concept of ecological fitness by providing a reconstruction of the theory of natural selection in which this concept was framed, that is, based on the (...) way the theory was put to use in Darwin’s main texts. I will contend that this reconstruction enables us to account for the current use of the theory of natural selection. The framework presupposed in the analysis will be that of metatheoretical structuralism. This framework will provide both a better understanding of the nature of ecological fitness and a more complete reconstruction of the theory. In particular, it will provide what I think is a better way of understanding how the concept of fitness is applied through heterogeneous cases. One of the major advantages of my way of thinking about natural selection theory is that it would not have the peculiar metatheoretical status that it has in other available views. I will argue that in order to achieve these goals it is necessary to make several concepts explicit, concepts that are frequently omitted in usual reconstructions. (shrink)

Todo el esfuerzo filosófico heideggeriano puede reducirse a su intento de pensar el ser en términos no metafísicos, efectuando mediante un «pensar poetizante» una Destruktion de la metafísica occidental. El ser, pensado en su sentido y verdad como “fundamento” del ente, es nombrado metafóricamente de diversas maneras, lo cual problematiza esta búsqueda de pureza conceptual y terminológica. Si, como señala Derrida, «el ser […] no puede ser dicho, no puede decirse más que en la metáfora óntica. Y la elección de (...) tal o cual metáfora es necesariamente significativa» (Derrida, 1994 [1972]: 169), el empleo de términos geológicos/geográficos para pensar la (des)fundamentación del Seyn no podrán jamás ser neutros, sino que ilustrarán de manera particularizada la forma de concebir la verdad del ser como acontecimiento abisal. Hay un correlato entre el “fundamento” expresado y construido en un discurso y entre una ontología, así como una sub-correlación esencial entre el sentido del fundamento y la metáfora que lo expresa. De este modo, abordando las figuras de la tierra [Erde], la fisuración [Zerklüftung] y el abismo [Abgrund], entre otras, veremos que estas funcionan como un a priori conceptual que condicionará totalmente el pensamiento heideggeriano, con límites y potencialidades específicos que permitirán una mejor comprensión de la fundamentación como estructura ontológica. This article traces the radical devaluation of the phantasm throughout Western civilization. With the help of Nietzsche’s critical perspective, I develop a notion of hystery as the series of collective traumas repeated in each individual’s growth, whereby the phantasm changes value from psychosomatic interface, to evil incarnate, to disease of learning. Beginning with the Classical episteme represented by Plato, Aristotle, and the Stoics, then moving up through the Christian era, I focus primarily on Enlightenment thinkers such as Hobbes and Bacon, (...) who represent the last nail in the imagination’s coffin. The next section examines Nietzsche’s rediscovery of the phantasm and the theoretical contributions of post-structuralism that follow in Nietzsche’s wake. Juxtaposing Bataille and Deleuze, I look at Deleuze’s early enthusiasm and ultimate betrayal of the phantasm, and I posit Bataille’s emphasis on the affective force of the mythological phantasm as an insurrection to reclaim our experience and life along with it. The article ends with speculation, offering Bruno’s art of memory as an ontic and epistemic alternative to dominant Western hystery, other pasts opening to other possible futures, an ungrounding that paradoxically leads to a restoration of the human house in a re-enchanted cosmos. En uno de los ataques más reiterados a Darwin, que todavía subsiste en la literatura actual, se señala que la teoría de la selección natural es tautológica, analítica o, al menos, irrefutable. En docenas de artículos, diversos autores han señalado las condiciones en que la selección natural quedaría refutada, intentando mostrar que no carece de contenido empírico. La estrategia seguida en este trabajo será otra. Teniendo en cuenta que la crítica de tautologicidad o irrefutabilidad ha sido esgrimida contra leyes fundamentales (...) de otras teorías, insertaré la discusión en un marco metateórico más amplio. Para discutir el estatus del segundo principio de la mecánica clásica, Moulines introduce el concepto de "principio guía". Los principios guía no serían contrastables directamente, sino a través de especializaciones. Desde mi punto de vista, considerar a la selección natural como principio guía permitiría explicar por qué muchos la han considerado tautológica y cómo esto no implica vacuidad. One of the most repeated objections to Darwin, still present in contemporary literature, outlines that theory of natural selection is tautological, analytical or at least irrefutable. There are many authors that point out the conditions in which natural selection would be refuted, trying to prove that it doesn't lack of empirical content. This essay will work on a different strategy. Taking into account that tautological or irrefutable criticism has been put forward against other theories' fundamental laws; I will insert the argumentation in a wider theoretical frame. To argue about the status of the second principle about classic mechanical Moulines introduces the 'guiding principle' concept. The guiding principles wouldn't be directly contrastable. The only way in which they could be contrastable would be through special laws. From my point of view natural selection, considered as the guiding principle, would explain why many thinkers had considered it a tautology and how this does not imply vacuity. (shrink)

Theories of emotional justification investigate the conditions under which emotions are epistemically justified or unjustified. I make three contributions to this research program. First, I show that we can generalize some familiar epistemological concepts and distinctions to emotional experiences. Second, I use these concepts and distinctions to display the limits of the ‘simple view’ of emotional justification. On this approach, the justification of emotions stems only from the contents of the mental states they are based on, also known as their (...) cognitive bases. The simple view faces the ‘gap problem’: If cognitive bases and emotions (re)present their objects and properties in different ways, then cognitive bases are not sufficient to justify emotions. Third, I offer a novel solution to the gap problem based on emotional dispositions. This solution (1) draws a line between the justification of basic and non-basic emotions, (2) preserves a broadly cognitivist view of emotions, (3) avoids a form of value skepticism that threatens inferentialist views of emotional justification, and (4) sheds new light on the structure of our epistemic access to evaluative properties. Can the realization of a written musical piece appear as a sufficient phenomenon to impulse a type of experience that suspends our need to decipher to understand and to separate to recognize? The execution of a score is commonly considered as the sound unfolding of the parts that the signs written on it disposes, however, it is precisely the abundance of what actually happens in the territory in which it is realized what that perspective cancels and may well constitute the (...) qualitative dimension of its occurrence. The present article aims to propose a series of reflections around the operations that assist the conformation of an experience in which the sound plane, delineated by the writing of a score, appears as a phenomenal horizon that makes it possible to problematize the complex notion of duration, treated here under the light of Henri Bergson's thought. From this, to compose appears as a conceptual bet that would allow us to think said action as the singular ordering of a musical experience carried out by each subject in the framework of the realization of a work. Nosso propósito é tratar dos Ensaios de Francis Bacon e de sua significação filosófica a partir da consideração de alguns aspectos de sua forma textual: o inacabamento da obra, a variação de seus fins, suas construções classificatórias. Embora à primeira vista tais características possam sugerir uma fraqueza teórica, em verdade exprimem a formação de um novo ideal de filosofia.

Abstract: In Mind and World, McDowell conceives of the content of perceptual experiences as conceptual. This picture is supposed to provide a therapy for skepticism, by showing that empirical thinking is objectively and normatively constrained. The paper offers a reconstruction of McDowell's view and shows that the therapy fails. This claim is based on three arguments: 1) the identity conception of truth he exploits is unable to sustain the idea that perception-judgment transitions are normally truth conducing; 2) it could be (...) plausible only from an externalist point of view that is in tension with the view of normativity that motivates conceptualism; 3) the identity conception of truth is incompatible with McDowell's recent version of conceptualism in terms of ‘non-propositional intuitive contents’. In everyday life, we think of skepticism as the position of a stubborn person who has higher epistemic standards than others. Hence, the skeptic is someone who defends extravagant ideas. Some skeptics may deny that climate change is real, while others claim that the first moon landing did not take place. Contemporary philosophers think of skepticism in a different way. In their view, skepticism is the conclusion of a paradoxical argument about epistemic statuses like knowledge and reasons. A paradoxical argument (...) is a logically valid argument that, starting from seemingly plausible premises, reaches an absurd conclusion. We introduce two skeptical arguments. The regress argument purports to show that we lack reasons to believe any claim whatsoever because the search for those reasons inevitably leads to an infinite regress. The underdetermination argument seeks to prove that we lack reasons to believe that there are chairs, trees, other people, and so on; it supports that conclusion by citing skeptical hypotheses, including the idea that we might be dreaming (Descartes 1641) or the suggestion that we could be brains in a vat connected to a supercomputer that mimics the pattern of neural activity that would be produced if we were perceiving external objects (Putnam 1981). In this paper, I examine Antisthenes’s conception of truth in order to better understand the relation between ontology and language in his thought. I intend to show that it presents a sharp contrast to Plato’s account of the problem of truth, which relies on an affirmative conception of ontology that involves both the concepts of correspondence and of predicative attribution. While for both philosophers the problem of truth is central, Antisthenes develops a peculiar perspective that subverts Plato’s attempt to sort, (...) through dialectics, the interferences that permeate language, in order to gain access to an essential instance that warrants a truthful discourse. For Antisthenes, truth cannot be understood in terms of correspondence, since, properly speaking, there are only true propositions. (shrink)

In _Basic Concepts_, Heidegger claims that "Being is the most worn-out" and yet also that Being "remains constantly available." Santiago Zabala radicalizes the consequences of these little known but significant affirmations. Revisiting the work of Jacques Derrida, Reiner Schürmann, Jean-Luc Nancy, Hans-Georg Gadamer, Ernst Tugendhat, and Gianni Vattimo, he finds these remains of Being within which ontological thought can still operate. Being is an event, Zabala argues, a kind of generosity and gift that generates astonishment in those who experience (...) it. This sense of wonder has fueled questions of meaning for centuries-from Plato to the present day. Postmetaphysical accounts of Being, as exemplified by the thinkers of Zabala's analysis, as well as by Nietzsche, Dewey, and others he encounters, don't abandon Being. Rather, they reject rigid, determined modes of essentialist thought in favor of more fluid, malleable, and adaptable conceptions, redefining the pursuit and meaning of philosophy itself. (shrink)

In this paper I tried to find a harm based solution to the non-identity problem. I explore the view upon which future persons are harmed if we prevent them from having what it is required by the Principle of Utility.

El presente trabajo analiza los diagnósticos, las soluciones, y el modo de implementación de un orden social igualitario por parte de Friedrich Schiller y Gerald Cohen. Para ello, ambos pensadores consideran la necesidad de erradicar el egoísmo y la desconfianza mediante una transformación cultural de tipo fraternal, fomentada por el “temple de ánimo estético” y el “principio de comunidad”. Asimismo, los autores enfatizan la relevancia de un aspecto común a sus reflexiones: la pugna por la realización de una “revolución del (...) sentimiento”, herramienta reconocida como la más adecuada para educar al hombre en el valor de la fraternidad. In this paper I carry out two tasks. First, I account for one of the distinctive uses of thought experiments in philosophy, namely, the fact that just a thought experiment is sufficient to confute a well-established theory. Secondly, I present three arguments to defend the claim that, at least in philosophy, we should remove thought experiments from our metaphilosophical toolkit. The central premise that motivates these arguments is the following: the very methodology of thought experiments permits to construct different scenarios (...) in which philosophical theories are refuted ad infinitum. In everyday life, we often understand skepticism as a position that one may set aside because of its absurdity or incoherence. In Greek philosophy, skepticism was rather an inquiring attitude that led to the suspension of judgment and, as a result, the freedom from distress. In Modern philosophy, many philosophers viewed skepticism as a phase of thought that had to be overcome before laying firm foundations for the sciences. These pictures differ from the outlook that dominates current analytic epistemology, where (...) skepticism has normally been understood as a series of paradoxes that arise when we reflect on the workings of ordinary epistemic concepts like KNOWLEDGE and EPISTEMIC JUSTIFICATION. A skeptical paradox emerges when we identify a condition that seems to be necessary to have knowledge or epistemic justification, while it also seems that that condition cannot be met. This chapter explains why the picture of skepticism as a series of paradoxes is central to contemporary analytic epistemology and identifies some of the main features of skeptical paradoxes about the external world. After identifying two types of replies, it presents two influential paradoxes based on the closure and underdetermination principles, identifies some relevant differences between the two paradoxes, and critically examines some attempts at solving them.
