The founder of modern chemistry, he headed the movement that turned it from an occult science into a subject well-grounded (...) in experiment, sound methodology and observation. His pioneering experiments on the properties of gases and his mechanistic theory of matter are the forerunners of the modern theories of chemical elements and atomic theory. He is best known for founding the renowned Boyle Lectures and for Boyle's Law that states that the pressure and volume of a gas are inversely proportional. A founding fellow of the Royal Society, three consecutive kings of England conversed familiarly with him. The article begins with an outline of the balancing construction as developed by the German Federal Constitutional court since the Lüth decision in 1958. It then takes up two objections to this approach raised by Jürgen Habermas. The first maintains that balancing is both irrational and a danger for rights, depriving them of their normative power. The second is that balancing takes one out of the realm of right and wrong, correctness and incorrectness, and justification, and, thus, out of the (...) realm of the law. The article attempts to counter these objections by showing that there exists a rational structure of balancing that can be made explicit by a “Law of Balancing” and a “Disproportionality Rule.” These rules show, first, that balancing is not a danger for rights but, on the contrary, a necessary means of lending them protection, and second, that balancing is not an alternative to argumentation but an indispensable form of rational practical discourse. The place of self-concern in Christian love is studied, beginning with Fénelon's extreme claim that in perfect love for God one would desire nothing for its own sake except that God's will be done. This view is criticized. A distinction is made between self-interest (desire for one's own good for its own sake) and other sorts of self-concern; and it is argued that self-concern has an important role in the Christian virtues, but that self-interest has a less important role than (...) other sorts of self-concern. Finally, it is argued that Eros and Agape are not opposites, but Agape includes a certain sort of Eros. (shrink)

The author outlines his thesis that legal discourse is a special case of general practical discourse (Sonderfallthese) and develops it as an attempt to cover both the authoritative, institutional, or real and free, discursive, or ideal dimension of legal reasoning. On this basis, he examines the objections raised by Habermas (1996) to the special case thesis. First, he discusses the reduction of general practical discourse to moral discourses (genus proximum problem) holding that the former is a combination of moral, ethical, (...) and pragmatic arguments within the priority of just; second, he examines the objection that general practical arguments change their character or nature when employed in legal contexts (subset and specification problem) and the related problems concerning legal validity and unjust law. I argue for a conciliationist treatment of peer disagreement, on the grounds that the evidence that non-conciliatory theorists point to--the evidence that conciliatory-friendly independence principles would rule out--bears a troubling relation to accuracy. Namely, we can anticipate that trying to respond to it is a bad deal with respect to our expected accuracy. I consequently argue that we shouldn't try to respond to it. Instead we should ignore it, and be conciliationists.

The emergence of cognitive science over the past thirty years has stimulated new approaches to traditional problems and materials in well-established disciplines. Those approaches have generated new insights and reinvigorated aspirations for theories in the sciences of the socio-cultural (about the structures and uses of symbols and the cognitive processes underlying them) that are both more systematic and more accountable empirically than the recently available alternatives. Without rejecting interpretive proposals, projects in both the cognitive science of religion and in cognitive (...) archaeology seek to redress imbalances within those disciplines favoring the interpretive over the explanatory. (See Lawson and McCauley, 1990 and Renfrew, 1994a, respectively.) Both projects aim to reinvigorate scientific aspirations without reviving any sort of scientistic or explanatory exclusivism. Both have arisen, in part, in response to the science-bashing crusades that have enjoyed such prominence in both disciplines over the past twenty years. With the exception, perhaps, of linguistics, the influence of cognitive science has been as notable in archaeology and religious studies as it has been in any discipline in contemporary intellectual life. In both disciplines new sub-fields have begun to thrive, which take theoretical inspiration from cognitive science and, at least sometimes, deploy its findings and, in the case of the cognitive science of religion, even its methods in the course of testing their theories. This paper contains three sections. The first provides a framework for thinking about the constituents of culture as a means both for situating ritual and for considering its accessibility to cognitive and archaeological analysis. The second section outlines our theory of religious ritual competence and the ritual form hypothesis. The final section reviews the theory=s predictions about an assortment of properties of both individual religious rituals and religious ritual systems. As a representative of the humanities, I understood my charge this afternoon to be to offer some sort of response to what is at the very least a book publishing or market phenomenon – the flood of recent books especially in the last decade by neuroscientists, primatologists, computer scientists, evolutionary biologists and economists about what had traditionally been considered issues in the humanities - issues like morality, politics, the nature of rationality, what makes a response to an object an aesthetic (...) response, and value theory - and the incorporation of such research methods by academics traditionally thought of as humanists. The organizers of our symposium have singled out for special attention the themes of autonomy, creativity and singularity, as these have come to be treated in these new interdisciplinary ways. I do not in any way count myself an expert in this emerging literature, but I do want to try to offer some initial and very general reasons to hesitate before jumping on this particular bandwagon. It argues that “the absurd” there refers primarily to the practical paradox that in faith (so it is claimed) one must simultaneously renounce and gladly accept a loved object. In other words it is about a problem of detachment as a feature of religious life. This paper couples the variation and selection analogy utilized in evolutionary epistemology with the hermeneutical insight that novel data and theoretical texts are obscure in meaning. Dissensus must be valued as a distancing mechanism of variation on the space of possible meanings while argumentation attacks the initial obscurity. The objection that evolutionary accounts can only describe practice is countered by indicating how dissensus has normative purchase wherever science is producing novel text.
