Algorithmic Justice Algorithmic bias can lead to harmful forms of algorithmic discrimination. In this article, I argue that technology does not exist in a vacuum and is always part of power relations. I therefore criticize technological fixes that reduce social problems to a technical solution. Dominant solutions like ‘debiasing’, while important, avoid questions about deep-rooted injustices. They ‘accept’ and work with and within the frames of existing social (power) structures. Justice requires considering the structural dimensions of inequality. I draw attention (...) to Langdon Winner’s call to ask whether a technology is ‘just’ rather than approaching the issue of algorithmic discrimination from a solutionist angle of optimization and functionality. I propose that we draw inspiration from the work of philosophers who approach justice from a structural or systemic perspective. This results in a philosophical approach that stretches the concept of ‘discrimination’ and exposes the relationships between inequalities. Moreover, it questions the structures and boundaries in which the technology is embedded. Finally, I criticize the current hype around AI that distracts us from the fact that we have had existential problems with AI for a long time and that these problems are deeply intertwined with (the history of) our social power relations. Compulsory labor, justice and the foundations of social law The author argues that normative questions in social law are in need of a more philosophical approach. This is particularly true for the evaluation of Work-first arrangements. She proposes to evaluate workfare policies from the perspective of the reciprocity principle as it is deployed in the work of the liberal egalitarians John Rawls and Stuart White. While Rawls’ interpretation of the reciprocity principle seems to be at odds with Dutch jurisprudence on (...) workfare policies, which allows for Work-first arrangements within the boundaries that are set by article 4 of the European Convention on Human Rights (a prohibition on compulsory labor), White’s approach rather encourages work obligations for welfare recipients, on the condition that citizens acquire individual drawing rights on collective participation funds. Enforcing Global Justice: War, Necessity and Rights of Armed Resistance of the World’s Poor Global justice theorists have long focused on the nature and grounds of duties of the affluent to alleviate the plight of the global poor and to realize justice worldwide. The last few years has seen a flurry of work that shifts perspective to the agency and remedial rights of the global poor. Suppose due assistance is not forthcoming. Could this give the severely deprived a just cause (...) to secure their basic rights by armed force? If so, under which conditions is it all-things-considered morally permissible for them to resort to violence? This article contrasts two possible ways of grounding and conceptualizing remedial rights of armed resistance against economic injustice. Some modern global justice-based accounts endow the global poor with limited rights to wage defensive war to force the affluent to comply with duties of global justice. The old right of necessity conditionally entitles the severely deprived to use armed force to secure access to privately-owned resources and spaces to meet urgent needs. While lethal force will on both accounts be seldom all-things-considered morally permissible in practice, my analysis reveals that the old right of necessity is, for better or worse, a more capacious ground for armed resistance than modern human rights of subsistence, as it sidesteps the issues of indeterminate and underdetermined moral liability. John Rawls wordt algemeen beschouwd als een van de meest invloedrijke filosofen van de voorbije eeuw. In zijn befaamde boek 'A Theory of Justice' uit 1971 staat het principe van de rechtvaardigheid centraal dat hij beschouwt als de belangrijkste maatschappelijke waarde in de samenleving. Mensen zijn fundamenteel gelijkwaardig. Daarom is het voor Rawls evident dat een ethisch systeem zich richt tot iedereen. Natuurlijk beseft hij dat mensen niet gelijk zijn of beter gezegd, niet over dezelfde begaafdheden beschikken noch over dezelfde (...) startposities. Waar het bij hem op aan komt is de onvrijwillige achterstanden, dus achterstanden die niet gebaseerd zijn op vrijwillige keuze, weg te werken. De denktank Liberales organiseerde tussen 2012 en 2016 vijf John Rawlslezingen. Ze werden gehouden door schrijver en oud-politicus Jan Terlouw, en de hoogleraren Frank Vandenbroucke, Paul Cliteur, Philippe Van Parijs en Patrick Loobuyck. De inleidingen werden gegeven door de Liberales-kernleden Daniël Boomsma, Claude Nijs, Kasper Ossenblok, Andreas Tirez en Dirk Verhofstadt. 0Het doel van deze lezingen was om het gedachtegoed van Rawls bekend te maken bij een breder publiek en te toetsen aan de hedendaagse politieke, sociaaleconomische en maatschappelijke omstandigheden. In The Law of Peoples , Rawls tries to develop a theory of international justice by extending a liberal conception of domestic justice to a society that consists not only of reasonable and well-ordered liberal peoples, but also of decent nonliberal peoples. Within the boundaries set by his theory of political liberalism Rawls hopes to convince us that a reasonably just Society of Peoples might be possible. Such a society, according to Rawls, consists of all those peoples who observe the (...) different ideals and principles of the Law of Peoples in their mutual relations. It is a society that can at least eliminate the ‘gravest forms of political justice’ and prevent new ‘great evils of human history’ from taking place’. The target that Rawls sets for himself is of course very admirable, but one has to remain cautious about the way in which he tries to develop such a political conception of international justice. One has to keep a keen eye on the different steps that take place in the extension of a liberal conception of domestic justice to a reasonably just Law of Peoples. We try to claim that Rawls loses an essential element of international justice in this extension, that is the idea of equal liberty. (shrink)

This article paradoxically tries to come closer to an idea of justice with the help of the destructive — anything but nihilistic — criticism thereof by Hans Kelsen. It argues that his relativistic approach, in which this idea undergoes a metamorphosis to become a realisable value of a social order, brings us closer to an obvious and objective form of justice that is almost taken for granted. Just in our liberal and plural democracy this approach might prove to be of (...) more value than a transcendental theory that passes speculative judgements on the essence of absolute justice, about which we are unable to come to an agreement. Research into Kelsen’s conception of judicial justice seems at first sight contradictory to his own Pure Theory of Law. Upon closer consideration this prima facie contradiction turns out to be only an appearance due to the paradoxical effect that is produced by Kelsen’s pure theory of law itself. By revealing three paradoxical effects of Kelsen’s work in this article, I try to show that research into a Kelsenian representation of judicial justice is not only possible but also meaningful. The first (...) paradox originates from Kelsen’s formalised and value-free concept of law, which unexpectedly confronts the judge with his moral responsibility for the material valuation of the law. Secondly, a paradox arises from Kelsen’s rationalised notion of relative justice, which in fact forces the judge to be absolutely convinced of the moral rightness of his judgement. The third paradox is a result of Kelsen’s idea of objectivised ‘social peace’, by which the judge just realises the subjective and irrational demands of justice. From my analysis of these three seeming contradictions in Kelsen’s pure theory of law emerges an apparent Kelsenian representation of judicial justice. Starting from his pure theory of law it should be possible to conceive of a ‘pure’ form of administration of law, which would stipulate social peace as a condition for the ‘purity’ of a judicial judgement. I even imagine that Kelsen considered peace as a conditio tacita for the validity of the whole legal order, just as he regarded the basic norm as conditio per quam and effectivity as conditio sine qua non for the validity of the legal order. In any case, according to Kelsen’s conception of judicial justice, social peace proves to be the implicit or tacit condition for a ‘pure’ judgement. With that this ‘pacifying jurisprudence’ can be understood as a surprising paragon of a ‘pure’ administration of justice, on the understanding that peace is not a sufficient but an obvious condition for a just administration of law. That this should also apply mutatis mutandis for Kelsen’s concept of the legal order as a whole will be made subject of further research. (shrink)

Whataboutism is een strategie waarbij op een beschuldiging wordt gereageerd met een wedervraag die eveneens een beschuldiging impliceert, waardoor de oorspronkelijke vraag eerder wordt ontweken dan beantwoord. Het is een effectieve methode om de aandacht te verplaatsen naar een andere situatie door een vergelijkbaar, dan wel onvergelijkbaar, contrast te bieden, waardoor de beschuldigde het eigen gedrag probeert te rechtvaardigen en verantwoordelijkheid probeert te ontlopen. Maar niet alle vormen van whataboutism impliceren echter een drogredenering, noch worden ze altijd verkeerd toegepast. Het (...) contrast dat voortkomt uit de vraag ‘what about’ kan dan een cruciale bijdrage leveren aan een situatie die een verdere kritische analyse vereist, en daarmee de geloofwaardigheid van de argumentatie versterken. 'Volgens de Duitse denker Carl Schmitt is zonder vijandbeeld geen politiek mogelijk,' schreven Coen Simon en Frank Meester aan Arnon Grunberg. Zij vroegen hem Het begrip politiek van Carl Schmitt (1888-1985) te lezen om na te gaan wat hij ons nu nog te zeggen heeft. Hoeveel natiestaat hebben wij nodig? Hoeveel vijanden? Waartoe dient politiek? En is een samenleving zonder oorlog en geweld mogelijk? Aan de hand van Schmitt en denkers als Walter Benjamin en Jacques Derrida probeert Grunberg antwoord te (...) geven op die vragen. 'Onze cultuur heeft de vegetarische slager voortgebracht en zal uiteindelijk ook de geweldloze oorlog produceren. Hoe die er precies uit zal zien is onduidelijk, maar Schmitts vermoeden dat die oorlog om de oorlog eens en voor altijd uit te roeien gruwelijk zal zijn lijkt me gerechtvaardigd,' aldus Grunberg. Maar ook stelt hij dat er geen rechtvaardigheid kan bestaan als het geweld wordt afgezworen. Loven is het verheerlijken en aanbidden van wat ons bevattingsvermogen en begrip te boven gaat. Dat maakt het een religieuze aangelegenheid: het voorwerp van lof is transcendent, blijvend en troostrijk. Wanneer het over menselijke, imperfecte zaken gaat, zoals de politiek, weten we dat we lof moeten behoeden voor afgoderij. Daarom spreken we in die context in plaats van aanbidding over loven als begrensde rechtvaardiging, als een rationele afweging. In de politiek klinken geen lofzangen. De taal van de politiek moet de (...) spreektaal van het volk zijn over het hier en nu, de echte wereld van de mogelijkheden, niet het transcendente hiernamaals. Het is een menselijke wereld waar we vat op hebben, waar we elkaar in de ogen kunnen zien, vanuit rationele overwegingen waardering kunnen toekennen en onthouden, in plaats van op onze knieën neer te vallen en eer te betonen aan een rechtvaardigheid en genade die ons begrip te boven gaat. Politiek is een realistische ontgoocheling voor en door het volk en dat is precies wat haar zo waardevol maakt. (shrink)

Deze opvatting van grootheid heeft het leven van Hitler mogelijk gemaakt, en omdat wij haar (...) nog altijd aanhangen, kan de geschiedenis zich nog steeds herhalen. Weil pleit voor een wijziging van ons begrip van grootheid, waarbij niet macht, maar ons gevoel voor waarheid, rechtvaardigheid en liefde, dat eeuwigheidswaarde bezit, het uitgangspunt wordt.
