The first part of this article contains (i) considerations as to the relationship between jurisprudence and legal dogmatics, legal philosophy, and sociology of law; (ii) considerations about the status of jurisprudence both as a meta‐ and an object‐theory. These lead to the suggestion that jurisprudence should be defined as a general juristic theory of law and legal science. In the second part, the character and elements of this definition are explained systematically. This paper is my contribution to round three of a longstanding debate between Robert Alexy and me about the principles theory’s concept of principle. In the first round, Alexy—bucking tradition—proposed a nongradualist distinction between rules and principles that divided the ontology of norms into two categorically distinct norm‐types. He connected this norm‐theoretical analysis with a theory of fundamental rights according to which such rights had to be understood as principles and thus interpreted as optimization requirements. In the first (...) round I objected to the norm‐theoretical assumptions and questioned the doctrinal merit of the principles theory approach. Unlike Alexy, I saw no merit in his notion of principle over and above optimization requirements, which by that time Alexy, too, regarded as rules. In round two, Alexy defended his concept of principle by taking refuge in the notion of an ideal ought, which he defined as a command to be optimized. In this second round, I criticized the new attempt to save his view of principles on the ground that the norms Alexy had in mind optimized not commands but states of affairs and thus were ordinary norms or rules according to the misguided taxonomy of the principles theory. Alexy opened round three of our exchange by admitting that my critique of round two was justified and that he had erred in identifying principles as ideal commands to be optimized. He now proposes an index theory of principles. In the paper, I recapitulate the motive and the main points of our debate and scrutinize Alexy’s latest innovation. (shrink)

Proportionality has become one of the primary standards for violations of fundamental and human rights in various constitutional and international jurisdictions. Proportionality in the strict sense requires a comparison of the infringement of a right with the achievement of a state interest pursued by a measure. The incommensurability of the two is an often-raised challenge to this comparison. The Article does not adopt a fully-fledged sceptical stance. Instead, it looks to proportionality as a means of overcoming the challenge of incommensurability. (...) It then examines the structure of comparisons in general and of comparisons of incommensurables employing proportionality in particular. As for the latter it focuses on its performance by exploring the example of decathlon, where this type of comparison works exceptionally well. The example allows us to analyse the preconditions for comparing incommensurables. Unfortunately, most of these preconditions are lacking in the law. This explains why the proportionality principle in law only produces convincing results in cases where the disproportionality is very pronounced. In many other cases, however, the courts decide based on proportionality as well. This raises the question: What is really going on in these cases? The article concludes with a brief account of a benevolent explanation. (shrink)

These are the answers I gave to Brian Bix, Peter Koller, Ralf Posher, Torben Spaak, Timothy Endicott, and Jan Sieckmann at the end of a splendid conference day in 2018. The critique given to me concerned important aspects of three main themes in my work: the claim to correctness, human and constitutional rights, and the ideal dimension of law. This book presents the theory of the validity of legal norms, aimed at the practice of law, in particular the jurisdiction of the constitutional courts. The postpositivist concept of the validity of statutory law, grounded on a critical analysis of the basic theories of legal validity elaborated up to now, is introduced. In the first part of the book a contemporary German nonpositivist conception of law developed by Ralf Dreier and Robert Alexy is analysed in order to answer (...) the question whether the juristic concept of legal validity should include moral standards or criteria. In the second part, a postpositivist concept of legal validity and an innovative model of validity discourse, based on the juristic presumption of the validity of legal norms, are proposed. La educación en valores conservacionistas representa una vía para promover cambios permanentesde actitudes, formación de conciencia y sensibilidad hacia los problemas socioambientales, por lo que serequiere la cooperación y participación de las universidades para lograr la internalización de valores en lascomunidades. El presente estudio tiene como objetivo proponer un modelo de gestión ambiental basado envalores conservacionistas que contribuya a la integración de la Universidad Nacional Experimental delTáchira [UNET] con la comunidad Río Chiquito, Parroquia La Petrolea, Municipio Junín, Estado Táchira,Venezuela. Metodológicamente se ubicó en una investigación de campo, descriptiva, bajo la modalidad deproyecto factible, con apoyo en el paradigma cuantitativo, adoptándose el diseño no experimentaltranseccional. La población estuvo conformada por cinco informantes claves encargados del desarrollo deprogramas ambientales y 137 familias del área en estudio; como muestra se seleccionó la totalidad de losinformantes y 102 familias, a quienes se les aplicó un guión de entrevista y un cuestionario, respectivamente,validados mediante la técnica juicios de expertos y obteniéndose un coeficiente Alfa de Cronbach de 0.97indicativo de una confiabilidad muy alta. Los resultados evidencian que en la comunidad poco se practicanvalores conservacionistas, como consecuencia a la no presencia de líderes vecinales que fomenten estosvalores, además, hay una exigua participación comunitaria y universitaria en materia ambiental. Conservation values education represents a way to promote permanent changes in attitudes, raisingawareness and sensitivity to environmental problems, so it requires the cooperation and participation ofuniversities to achieve the internalization of values in communities. This study aims to propose a model ofenvironmental management based on conservation values that contribute to the integration of the UniversidadNacional Experimental del Táchira [UNET] – Río Chiquito, Parroquia La Petrolea, Municipio Junín, EstadoTáchira, Venezuela. Methodologically was located in a field research, descriptive, in the form of feasibleproject, supported in the quantitative paradigm, adopting the experimental design is not transactional. Thepopulation consisted of five key informants responsible for the development of environmental programs and137 families in the study area, as the entire sample was selected informants and 102 families who wereadministered an interview guide and questionnaire, respectively, validated by technical experts and trialsyielding a Cronbach alpha coefficient of 0.97 indicating a very high reliability. The results show that inpractice little community conservation values, due to the non presence of neighborhood leaders to promotethese values, in addition, there is a low participation in community and university environment. Spice is also peppered throughout the Old Testament.2 The Song of Solomon recites: “Thy plants are an orchard of pomegranates, with pleasant fruits; camphire, with spikearion 28.1 spring/summer 2020 2 a vexed pharmacopeia nard and saffron; calamus and cinnamon, with all trees of frankincense; myrrh and aloes, with all the chief spices.”3 Every one of these fruits, plants and spices remained popular in the West throughout antiquity, into the Middle Ages, and beyond. As early as 3000 bc, trade routes had connected the Mediterranean to the near east. Courtesy of this “Spice Road,” ancient Mediterranean civilizations had access to a wide range of horseradishes, mustards, peppers, gingers and other spices. The Greeks and Romans had a special relationship with black pepper—so much so that four out of five recipes in Apicius’s famous 1st century cookbook4 called for a sprinkling of this sometimes-costly commodity. It is perhaps not coincidental that black pepper contains heat-producing alkaloids very similar to those found in New World chili peppers. Much has been written about the important role of chilis in South and Central American culture—a region that, by the Middle Ages, was in many respects the equal of Europe in “artistic sensibility, social complexity, and political organization.”5 The habanero and its capsainoid cousins were at the heart of the culinary and ceremonial customs of Mesoamerica, their biting heat and florid livery an apt metaphor for the “extravagant feats of human butchery”6 —very much in the tradition of the spectacular venationes of ancient Rome—for which the Aztecs at least were well known. To what extent was hot spice also a significant part of the culinary, medical and cultural landscape of the Old World? At a conference hosted by the Institute for Digital Archaeology at the University of Oxford last December, experts from Europe and North America examined the literary, historical, archaeological and scientific evidence around these questions. Their inquiry received a boost from new and rapidly developing techniques for examining the physical evidence of ancient diet and food production—laboratory techniques not available even five years ago. There was also fresh medical evidence to consider: significant research is being done in the area of chemosensation in the context of spicy foods. This Roger Michel, Alexy Karenowska, George Altshuler, Matthew Cobb 3 includes trying to understand how different so-called “TRP channels” in the nervous system process spice information— in particular, the connection between spice and endorphin levels. It appears that many of the hot spices available in antiquity could potentially trigger the same TRP channels as the capsaicin-charged Mesoamerican peppers. This creates a nice connection between old and new world spice that helps to explain and contextualize both. However, in the end, firm conclusions at the Oxford conference were scarce. It quickly became clear that more work, a greater diversity of viewpoints, better refined questions, and a change of venue were required to make additional progress. Carrier in a recent paper urges for consideration an argument for skepticism which is based on premises one of which in turn is to be defended by yet another principle (the "Janus Principle" of the text). We feel that the latter principle and the way Carrier wants to use it to defend his skeptical argument will find adherents, but we show that this argument rests on an interesting equivocation quite beyond repair even if we accept the "Janus Principle".

The dual nature thesis sets out the claim that law necessarily comprises both a real or factual dimension and an ideal or critical dimension. This thesis, however, remains as thus stated abstract and formal. In order to arrive at a concrete content and a clear structure, the thesis has to be explicated within a system. The overarching idea of this system is the institutionalization of reason. The political form manifested by the system is discursive constitutionalism. This system is generated in (...) three steps. First, the claim to correctness raised by law and the procedure of discourse are analysed. This leads, second, to the necessity of the positive dimension of law. The necessity of positivity, however, by no means implies positivism. On the contrary. Non-positivism is elaborated in a third step, which is concerned with the connection of law as idea, as defined at the first step, and law as fact, as adumbrated in the second step. This connection comprises the postulate of an outermost limit of law (Radbruch formula), the ideas of human and constitutional rights, democracy, and constitutional review, the conception of legal argumentation as a special case of general practical argumentation, and the theory of principles. We raise a problem for modal dispositionalism: nothing within the theory rules out that there could be necessary, perfect masks, which make the manifestation of a disposition impossible. Unless such necessary perfect masks are ruled out, modal dispositionalism runs the risk of failing to provide a (...) sufficient condition for possibility, and indeed of engendering contradictions. This paper shows that the law, in subtle ways, may set hitherto unrecognized incentives for the adoption of explainable machine learning applications. In doing so, we make two novel contributions. First, on the legal side, we show that to avoid liability, professional actors, such as doctors and managers, may soon be legally compelled to use explainable ML models. We argue that the importance of explainability reaches far beyond data protection law, and crucially influences questions of contractual and tort liability for (...) the use of ML models. To this effect, we conduct two legal case studies, in medical and corporate merger applications of ML. This chapter relates the problem of demarcating the pathological from the non-pathological in psychiatry to the general problem of defining ‘disease’ in the philosophy of medicine. Section 2 revisits three prominent debates in medical nosology: naturalism versus normativism, the three dimensions of illness, sickness, and disease, and the demarcation problem. Sections 3–5 reformulate the demarcation problem in terms of semantic vagueness. ‘Disease’ exhibits vagueness of degree by drawing no sharp line in a continuum and is combinatorially vague because there are (...) several criteria for the term’s use that might fall apart. Combinatorial vagueness explains why the other two debates appear hopeless: Should we construe ‘disease’ in a naturalistic or in a normative way? Neither answer is satisfactory. How should we balance the three dimensions of pathology? Causal queries about singular cases, which inquire whether specific events were causally connected, are prevalent in daily life and important in professional disciplines such as the law, medicine, or engineering. Because causal links cannot be directly observed, singular causation judgments require an assessment of whether a co‐occurrence of two events c and e was causal or simply coincidental. How can this decision be made? Building on previous work by Cheng and Novick (2005) and Stephan and Waldmann (2018), we propose a (...) computational model that combines information about the causal strengths of the potential causes with information about their temporal relations to derive answers to singular causation queries. The relative causal strengths of the potential cause factors are relevant because weak causes are more likely to fail to generate effects than strong causes. But even a strong cause factor does not necessarily need to be causal in a singular case because it could have been preempted by an alternative cause. We here show how information about causal strength and about two different temporal parameters, the potential causes' onset times and their causal latencies, can be formalized and integrated into a computational account of singular causation. Four experiments are presented in which we tested the validity of the model. The results showed that people integrate the different types of information as predicted by the new model. (shrink)

The eight papers in this book are drawn from two conferences that honored Lewis White Beck, an influential Kant scholar.

ABSTRACT:The extant literature on cross-national differences in approaches to corporate social responsibility (CSR) has mostly focused on developed countries. Instead, we offer two inter-related studies into corporate codes of conduct issued by developing country multinational enterprises (DMNEs). First, we analyse code adoption rates and code content through a mixed methods design. Second, we use multilevel analyses to examine country-level drivers of differences in code content—specifically, elements of a country’s National Business System (NBS). We find that DMNEs are much more likely (...) to adopt a code of conduct than their domestic counterparts; however, this does not translate into greater code comprehensiveness. We also find support for the ‘substitute view’ of CSR in developing countries, i.e. that MNEs from poorer countries and from countries with lower governance effectiveness tend to express more comprehensive commitments. However, this dynamic does not extend to a country’s labour system; instead, CSR appears here to match the efficiency of a country’s labour market, thus reflecting the ‘mirror view’ of CSR. (shrink)

The notion of the highest good used to occupy a primary role in ethical theorising, but has largely disappeared from the contemporary landscape. The notion was central to both Aristotle's and Kant's ethical theories, however--a surprising observation given that their approaches to ethics are commonly conceived as being diametrically opposed. The essays in this collection provide a comprehensive treatment of the highest good in Aristotle and Kant and show that, even though there are important differences in terms of content, there (...) are also important similarities in terms of the structural features of Aristotle's and Kant's value theories. By carefully analysing Aristotle's and Kant's theories of the highest good, a team of experts in the field shed light on their respective ethical theories and highlight the richness, complexity, and fruitfulness of the notion of the highest good. Philosophen Delphi im Konlexl einer mehrfigurigen Stiftung p. 407-433 Zu den prominentesten Skulpturenfunden in Delphi zâhlt die Statue des sog. Philo sophen (Inv. 1819). Sie fand Aufnahme in die wichtigsten Handbûcher griechischer Plas- tik, obwohl weder Datierung noch Deutung oder gar ursprunglicher Aufstellungszusam- menhang geklàrt sind. Meist wird sie mit stilistischen Argumenten um 250 v. Chr. datiert, ausgelôst durch die hypothetische und falsche Zuweisung an das ebenfalls ungedeutete und (...) undatierte (hâufig aber um die Mitte des 3. Jhs. angesetzte) «Hufeisenmonument» westlich der Daochosgruppe durch L. Lerat. Wie die Neuuntersuchung zeigen kann, ist der « Philosoph » Bestandteil einer mehrfîguren Stiftung gewesen. Die Forschung hat gera- dezu «vergessen», daB er zusammen mit zwei weiteren Statuen, einer weiblichen bekleide- ten (Inv. 1817) und einer ebenfalls langgewandeten mânnlichen (Inv. 1820) gefunden wurde. Technische Indizien belegen den Werkstattzusammenhang, die drei Figuren waren auch zusammen aufgestellt. Sie rechneten zu einer u.U. noch grôBeren (môglicher- weise ist die nackte mànnliche Figur Inv. 1793 zugehôrig) um 300 v. Chr. oder in den ersten Jahrzehnten des 3. Jhs. im Nordsektor des Heiligtums geweihten Gruppe. Das Portràt, der Statuen- und Gewandtypus charakterisieren den « Philosophen » als bûrgerlichen alten Mann — fur die Deutung als wirklicher Philosoph gibt es kein stich- haltiges Argument. Die Frauenfigur lehnt sich ebenfalls an das Darstellungsrepertoire weiblicher Sterblicher (etwa auf attischen Grabreliefs) an. Die dritte Statue bezeugt einen seit dem Strengen Stil gelàufîgen Dionysos-Typus. Als Stifter kommt ein dionysischer Technit oder Chorege in Frage. Auf jeden Fall handelt es sich um ein Familienmonu- ment, das Portràts von mindestens zwei Verwandten prâsentierte und den Gott, dem es geweiht war, in das Ensemble miteinbezog. (shrink)

The role of Caenorhabditis elegans as a model for developmental processes has encouraged us to cultivate a second nematode, Pristionchus pacificus, as a comparative counterpoint to address questions in development, behavior and ecology in nematode evolution. We hope that this endeavor, now more than a decade underway, will allow us to project findings onto other comparative models for biological processes. To this end, our laboratory has made an extensive genetic map and (...) mutant screens to understand changes in developmental programs. Recently, we have been capitalizing on the whole genome sequence of P. pacificus to describe more thoroughly the molecular basis for these changes, as well as to better integrate our molecular knowledge with the biodiversity of Pristionchus species.
