The systems of patent rights in force in Europe today, both at the level of national law and on the regional level, contain general clauses prohibiting the patenting of inventions whose publication and exploitation would be contrary to “ordre public” or morality. Recent years have brought frequent discussion about limiting the possibility of patent protection for biotechnological inventions for ethical reasons. This is undoubtedly a result of the dynamic development in this field in the last several years. Human genome sequencing, (...) the first successful cloning of mammals, and the progress in human stem cell research present humanity with many new questions of an ethical nature. Directive 98/44 of the European Parliament and of the Council of July 6, 1998, on the Legal Protection of Biotechnological Inventions created a new basis for patent protection in this field of technology. Based on the European experience to now, however, it must be said that patent law is not the right place to legislate the consequences of the morality of an invention. (shrink)

Legal probabilism is the view that juridical fact-finding should be modeled using Bayesian methods. One of the alternatives to it is the narration view, according to which instead we should conceptualize the process in terms of competing narrations of what happened. The goal of this paper is to develop a reconciliatory account, on which the narration view is construed from the Bayesian perspective within the framework of formal Bayesian epistemology.

This article proposes a mereological approach to the dao-you relation in the Daodejing. It is claimed here that dao and you can be conceived of as two integrated subregions, defined in terms of rules of composition and their persistence through time. It is shown that dao is an atemporal object (a fourdimensional unrestricted composition), whereas you is a temporal object (a three-dimensional restricted composition). This particular approach can provide a new understanding of essential issues in Daoist metaphysics.

W analizowanych audycjach problematyka ta prezentowana jest z perspektywy osób, wydarzeń i miejsc związanych z miastem bądź regionem zarówno w ujęciu współczesnym, jak i historycznym. Szczególnie wyraźnie wyłania się z nich m.in. (...) problematyka żydowska, ale także wizerunek miasta (i regionu), w którym niejednokrotnie rozgrywały się wydarzenia przełomowe dla całego kraju. Dramaturgia reportaży o ziemi łódzkiej budowana jest w oparciu o opozycje takie, jak pamięć i zapomnienie, przeszłość i teraźniejszość czy sceny – audialne obrazy o silnym ładunku emocjonalnym, a dźwiękowe oblicze miasta współtworzą głosy jego mieszkańców bądź osób z nim związanych, licznie reprezentowane archiwalia i muzyka. The article focuses on the role of civil society in the aggregate of causes that eventually brought about the collapse of the communist block and — in consequence — changed the global balance of power. The concept of ‘ethical civil society’ is introduced in explaining the path to democracy of former Soviet bloc countries. The article also explores cultural determinants of democratisation in Central and Eastern Europe after 1989; in particular the relation between religious confession and likelihood of democratic outcome (...) of post-communist transformation is examined. According to contrastivism in epistemology - advocated chiefly by Jonathan Schaffer - the knowledge relation is not binary (s knows that p) but ternary (s knows that p rather than q). Thus knowledge ascriptions are contrast-sensitive. The aim of this paper is to portray, investigate and assess the details of this view. In the first three sections I focus mainly on arguments for contrastivism. Section fourth is devoted to the contrastivist solution to the skeptical puzzle. In the last three sections (...) Wittgenstein’s philosophy endeavored to define the role of language as communicative. Language became an original “code” of multifarious meanings and designations but it is also a code which entails emotions and different sorts of internal and external reactions of an individual. The mechanism of penalty and the notion of penalty have invariably raised emotions and meaningful reactions. The analysis focuses on a short derivation of the notion of penalty. One of the streams in the early development of set theory was an attempt to use mereology, a formal theory of parthood, as a foundational tool. The first such attempt is due to a Polish logician, Stanisław Leśniewski . The attempt failed, but there is another, prima facie more promising attempt by Jerzy Słupecki , who employed his generalized mereology to build mereological foundations for type theory. In this paper I situate Leśniewski's attempt in the development of set theory, describe (...) and evaluate Leśniewski's approach, describe Słupecki's strategy without unnecessary technical details, and evaluate it with a rather negative outcome. The issues discussed go beyond merely historical interests due to the current popularity of mereology and because they are related to nominalistic attempts to understand mathematics in general. The subject of the presentation was to reveal the main components of the views of Rev. Włodzimierz Sedlak (31.10.1911-17.02.1993) concerning the origin of life. The development of these views passed through the following stages: 1) the theory of silicic life forms (1959-1967) which he labeled \"the theory of siliconides\", 2) the bioelectronic model of abiogenesis (1967-1988), and 3) speculations about electromagnetic biogenesis. The basic claims of the theory of silicic life forms are the following: (a) silicon is an essential component (...) of biosystems and fulfils significant roles in phylogenetically older forms of life; (b) the previous essential role of silicon in the organization of life has been reduced in higher organisms to the role of a microelement; (c) the attempts at the reconstruction of the chemical evolution of life should be undertaken, to extend it beyond the organic compounds of carbon, namely to those containing silicon and forming the most primitive forms of life on the Earth; (d) hypothetic silicic organisms made up the most primitive life on the Earth.. The main theses of bioelectronic model of abiogenesis are the following: (a) there exists the coupling between chemical reactions and electronic processes in organisms (he calls it \"the quantum seam of life\"); photons act as a coupling factor between these two classes of processes; (b) the existence the such coupling makes the generation and duration of the plasma state of particles possible in all metabolizing parts of the organism; (c) there exists bioplasma - a new state of matter - that is characteristic for living organisms only; (d) the first act of the creation of the chemical-electronic coupling is to be regarded as equivalent with biogenesis: (e) bioplasma existed well before the macroscopic organic morphological structures were formed and functioned already when the life was based on aluminosilicates. Sedlak\'s speculation on the electromagnetic biogenesis implies that the evolution of biosphere began with the moment of birth of light, i.e. in one of the earliest phases of existence of Universe. God, identified by him with the Light, created life, possessing the luminous nature. Life never altered its electromagnetic foundation: either at any new stage, or at a new level of organization, or when the first human being was created. It seems that Sedlak\'s works can be valuable for the present and future investigations aimed at the reconstruction of biogenesis. Although they are undervalued now, they should be regarded as containing many valuable intuitions. They deserve a thorough analysis and - where it is possible - empirical testing of implications drawn from them. (shrink)

The problem of causality is presented in the context of the research devoted to biogenesis. The significant works concerning the philosophy of biogenesis and scientific theories of abioge­nesis have been reviewed. Special attention is paid to: (i) the role of the non-equilibrium thermo­dynamics and quantum mechanics in the explaining of causal relations involved the origins of life, (ii) the need of constructing of a quantum logic of life. Mereology in its formal guise is usually couched in a language whose signature contains only one primitive binary predicate symbol representing the part of relation, either the proper or improper one. In this paper, we put forward an approach to mereology that uses mereological sum as its primitive notion, and we demonstrate that it is definitionally equivalent to the standard parthood-based theory of mereological structures.

This article investigates the structures of an identifiably Buddhist philosophy of religion, understood as the philosophical exposition and exploration of Buddhist religiosity. I thus theorize what forms a philosophy of religion structured according to Buddhist principles and paradigms might take, address various theoretical and methodological considerations, and survey a range of candidate schemas, which latter are arranged under textual, sectarian, and doctrinal rubrics. Overall, this project is undertaken on the understanding that the study of Buddhism, among other global traditions, need (...) not and should not replicate conceptual structures imposed upon it from without, and that philosophy of religion is enriched by attention to the resolutely plural philosophies of religions worldwide. In the second installment to Gruszczyński and Pietruszczak we carry out an analysis of spaces of points of Grzegorczyk structures. At the outset we introduce notions of a concentric and \-concentric topological space and we recollect some facts proven in the first part which are important for the sequel. Theorem 2.9 is a strengthening of Theorem 5.13, as we obtain stronger conclusion weakening Tychonoff separation axiom to mere regularity. This leads to a stronger version of Theorem 6.10. Further, we show (...) that Grzegorczyk points are maximal contracting filters in the sense of De Vries, but the converse inclusion is not necessarily true. We also compare the notions of a Grzegorczyk point and an ultrafilter, and establish several properties of topological spaces based on Grzegorczyk structures. The main results of the paper are representation and completion theorems for G-structures. We prove both set-theoretical and topological representation theorems for various classes of G-structures. We also present topological object duality theorem for the class of complete G-structures and the class of concentric spaces, both restricted to structures which satisfy countable chain condition. We conclude the paper with proving equivalence of the original Grzegorczyk axiom with the one accepted by us as axiom. (shrink)

This paper aims to formalize Galileo’s argument against the Aristotelian view that the weight of free-falling bodies influences their speed. I obtain this via the application of concepts of parthood and of mereological sum, and via recognition of a principle which is not explicitly formulated by the Italian thinker but seems to be natural and helpful in understanding the logical mechanism behind Galileo’s train of thought. I also compare my reconstruction to one of those put forward by Atkinson and Peijnenburg (...) :115–136, 2004), and propose a formalization which is based on a principle introduced by them, which I shall call the speed is mediative principle. The article reconstructs main assumptions and the theoretical context of Arnold Gehlen’s conception of institution. I argue that this conception is mainly a theory of action. At its centre Gehlen sets not so much specific institutions but rather specific forms of human activity that bring to life the over-individual normative structures. He describes them by means of a series of categories which, in his opinion, have a universal character. We do not find any genealogical analyzes here, but only a constellation (...) of concepts deduced a priori, referring to empirical facts. (shrink)

The purpose of this article is a critical reconstruction of the Platonic conception of laughter, which is presented primarily in Republic and Philebus. A comic quality calls, in his opinion, to lower emotions, it throws human mind out of balance and undermines the prevailing order of values. The philosopher associates a laughter with the feeling of envy, which comes down to the joy of humiliating of someone weaker. The comic envy - as opposed to passive jealousy - almost automatically leads (...) to the activity, to the enhancement of humiliation. Laughter is caused according to Plato by a defect resulting from the ignorance about himself. The key feature of the comic situation is the asymmetry between the victim's weakness and the strength of a laughing person. Plato's concept of laughter turns out to be one-sided, when we compare it with "laughter of Democritus" which serves as a therapeutic and catharctic means. Laughter is here a clear signal that initiates the critical reflection on himself and gives impetus to a change of attitude towards the world. In his writings Plato did not include such educational and cognitive aspects of laughter because in his philosophy it becomes a specific antagonist of true knowledge. The negative attitude towards laughter does not go hand in hand with Plato’s recognition of Socrates, who used irony as a key element in his method of inquiry leading to truth. (shrink)

Contextualism is an epistemological claim that truth-conditions of knowledge ascribing sentences depend on context in which they are uttered. The discussion concerned with its background and assumptions is predominant in recent epistemology. However, contextualism is known better as the suggested solution for skepticism about the external world. In this paper I present one of the most important contextualist theory which have been proposed in 90's by Keith DeRose. In what follows I outline this proposal's main sources, i.e. i) a relevant (...) alternative theory, ii) Nozick's definition of knowledge and iii) two earlier contextualist ideas made by David Lewis and Gail Stine. Next, I consider some weak aspects of this theory that have been pointed out by critics. (shrink)

It is a commonplace remark that the identity relation, even though not expressible in a first-order language without identity with classical set-theoretic semantics, can be defined in a language without identity, as soon as we admit second-order, set-theoretically interpreted quantifiers binding predicate variables that range over all subsets of the domain. However, there are fairly simple and intuitive higher-order languages with set-theoretic semantics in which the identity relation is not definable. The point is that the definability of identity in higher-order (...) languages not only depends on what variables range over, but also is sensitive to how predication is construed. This paper is a follow-up to , where it has been proven that no actual axiomatization of Leśniewski’s Ontology determines the standard semantics for the epsilon connective. (shrink)

Nagarjuna (c. 150-250), founder of the Madhyamaka or Middle Way school of Buddhist philosophy and the most influential of all Buddhist thinkers aside from the Buddha himself, concludes his masterpiece, Fundamental Verses on the Middle Way, with these baffling verses: -/- For the abandonment of all views He taught the true teaching By means of compassion I salute him, Gautama -/- But how could anyone possibly abandon all views? In Buddhism between Religion and Philosophy, Rafal K. Brown (The laboratory of the mind. Thought experiments in the natural science, 1991a , 1991b ; Contemporary debates in philosophy of science, 2004 ; Thought experiments, 2008 ) argues that thought experiments (TE) in science cannot be arguments and cannot even be represented by arguments. He rest his case on examples of TEs which proceed through a contradiction to reach a positive resolution (Brown calls such TEs “platonic”). This, supposedly, makes it impossible to represent them as arguments for logical reasons: (...) there is no logic that can adequately model such phenomena. (Brown further argues that this being the case, “platonic” TEs provide us with irreducible insight into the abstract realm of laws of nature). I argue against this approach by describing how “platonic” TEs can be modeled within the logical framework of adaptive proofs for prioritized consequence operations. To show how this mundane apparatus works, I use it to reconstruct one of the key examples used by Brown, Galileo’s TE involving falling bodies. (shrink)

The goal is to sketch a nominalist approach to mathematics which just like neologicism employs abstraction principles, but unlike neologicism is not committed to the idea that mathematical objects exist and does not insist that abstraction principles establish the reference of abstract terms. It is well-known that neologicism runs into certain philosophical problems and faces the technical difficulty of finding appropriate acceptability criteria for abstraction principles. I will argue that a modal and iterative nominalist approach to abstraction principles circumvents those (...) difficulties while still being able to put abstraction principles to a foundational use. In this article, I discuss parthood status in mereologi- cally interpreted Daoist metaphysics, based on the Daodejing. I depart from the dao and you interrela- tion, which mereologically overlap by sharing parts. I consider the case of a complete overlap, which (a) challenges proper parthood, according to which a part cannot be identical with the whole that it com- poses, and (b) entails the question of identity that, while complying with classical mereology, cannot be consis- tent with Daoist metaphysics. The (...) discussion leads to abandoning proper parthood and antisymmetry axiom from classical axiomatics. It also shows a plausible fur- ther direction for mereological reconstruction. (shrink)

I distinguish its two basic meanings: copying (imitation) and expression. The older meaning (mimesis as expression) comes from the Pythagorean tradition, (...) whereas the newer one (mimesis as copying) can be traced back to the philosophy of Plato. Analysis of Plato’s dialogues step by step reveals ambivalence of the notion, and, what is most important, points out how useful it can be in epistemology, philosophy of language, psychology and aesthetics.
