We propose a construct, the Trust Triangle, that highlights three primary mechanisms that provide ex post accountability for opportunistic behavior and motivate ex ante trust in economic relationships. The mechanisms are a society’s legal and regulatory framework, market-based discipline and reputational capital, and culture, including individual ethics and social norms. The Trust Triangle provides a framework to conceptualize the relationships between trust, corporate accountability, legal liability, reputation, and culture. We use the Trust Triangle to summarize recent developments in the empirical (...) finance literature that examine how trust is formed and how trust, or its absence, affects financial markets, firm performance, and the incidence of financial fraud. To date, most studies examine only one leg of the Trust Triangle in isolation. The evidence, however, indicates that all three legs of the Trust Triangle have first-order effects on a wide range of financial outcomes and that they are interrelated. Attempts to model trust and trustworthiness that do not incorporate all three aspects of the Trust Triangle will therefore miss essential aspects of the basic economic problem of how counterparties overcome the risks of moral hazard, asymmetric information, and opportunism to engage in mutually beneficial exchange and production activities. We focus especially on culture-related mechanisms, a recently developed area in empirical finance research that has potential to influence the more established research on laws and reputation. Our knowledge of ancient history has been tremendously enlarged in the last hundred years. Ancient civilizations, formerly scarcely glimpsed or completely unknown, have emerged from the obscurity in which they were buried. In other domains, already more or less well known, the discovery of documents year after year has shed a clearer—sometimes even a harsh—light upon the great pages of the human past. These discoveries, which reveal to us what the man of earlier days was like and which enable us (...) to achieve a better understanding of the man of today, have at times been due to the purest chance. In this brilliant analysis of mind-body problems Edward Pols adds new dimen­sions to the discussion of basic issues. The prisoner is Socrates, who, in a se­ries of actions involving moral decisions, finds himself under sentence of death, and who has now decided to undergo the sentence rather than accept the opportuni­ty to escape provided by powerful friends. Pols takes as his point of departure Socrates’ nai;ve statement of the contrast be­tween a scientific analysis of a moral action and the point (...) of view taken by the agent himself, and his rejection of the adequacy of the scientific analysis. Science and technology studies concerned with the study of lay influence on the sciences usually analyze either the political or the normative epistemological consequences of lay interference. Here I frame the relation between patients, knowledge, and the sciences by opening up the question: How can we articulate the knowledge that patients develop and use in their daily lives and make it transferable and useful to others, or, `turn it into science’? Elsewhere, patient knowledge is analyzed either as essentially different from (...) or similar to medical knowledge. The category of experiential knowledge is vague and is used to encompass many types of experience, whereas the knowledge of the `expert patient’ may be assumed to have the shape of up-to-date medical information. This paper shows through a case study of people with severe lung disease that patient knowledge can be understood as a form of practical knowledge that patients use to translate medical and technical knowledge into something useful to their daily life with disease. Patients coordinate this with homegrown know-how and advice from fellow patients, weighing different values - of which `taking good care of one’s body’ is but one - that may conflict in a specific situation. These practices result in sets of techniques that may be made useful to others. The paper argues for two alternatives to state-of-the-art medical research to turn patient knowledge into science: ethnographies of knowledge practices and the collection and making accessible of techniques. Dignity is a fundamental concept, but its meaning is not clear. This paper attempts to clarify the term by analysing and reconnecting two meanings of dignity: humanitas and dignitas. Humanitas refers to citizen values that protect individuals as equal to one another. Dignitas refers to aesthetic values embedded in genres of sociality that relate to differences between people. The paper explores these values by way of an empirical ethical analysis of practices of washing psychiatric patients in nursing care. Nurses legitimate (...) the washing of reluctant patients with reference to dignity. The analysis shows the intertwinement of humanitas and dignitas that gives dignity its fundamental meaning. This work investigates the early encounters of French philosophers and religious thinkers with the phenomenological philosophy of Edmund Husserl. Following an introductory chapter addressing context and methodology, Chapter 2 argues that Henri Bergson's insights into lived duration and intuition and Maurice Blondel's genetic description of action functioned as essential precursors to the French reception of phenomenology. Chapter 3 details the presentations of Husserl and his followers by three successive pairs of French academic philosophers: Léon Noël and Victor Delbos, Lev Shestov (...) and Jean Hering, and Bernard Groethuysen and Georges Gurvitch. Chapter 4 then explores the appropriation of Bergsonian and Blondelian phenomenological insights by Catholic theologians Édouard Le Roy and Pierre Rousselot. Chapter 5 examines applications and critiques of phenomenology by French religious philosophers, including Jean Hering, Joseph Maréchal, and neo-Thomists like Jacques Maritain. A concluding chapter expounds the principal finding that philosophical and theological receptions of phenomenology in France prior to 1939 proceeded independently due to differences in how Bergson and Blondel were perceived by French philosophers and religious thinkers and their respective orientations to the Cartesian and Aristotelian/Thomist intellectual traditions. Recently, there has been a strong push for binding human rights due diligence (HRDD) legislation, both at the national and European levels. As empirical evidence of such legislation's impact gradually emerges, it is time to take stock. In this article, we conduct a systematic literature review to assess available empirical evidence on (1) how HRDD legislation affects the policies and practices through which companies engage with human rights; (2) how these policies and practices, in turn, affect different actors in companies’ (...) value chains. While it is too early to make conclusive judgements, existing evidence allows us to identify several worrying trends: most companies opt for managerialist and compliance-oriented approaches to HRDD; revert primarily to earlier (and flawed) private governance mechanisms; and try to cascade responsibilities and costs in their supply chain. This risks perpetuating or reinforcing marginalisation and exclusion dynamics. Based on these findings, we formulate some lessons for policy-makers. (shrink)

Ceramics workshops and exchange networks in the south-western Black Sea in the Classical period and the beginning of the Hellenistic period Within the archaeometrical programmes carried out in the framework of the National Research Agency project «Pont-Euxin » and thereafter within the French archaeological team at Apollonia Pontica, a representative sampling of 123 sherds focusing on Apollonia but also extending to the main Greek settlements along the Western Black Sea coast was submitted to XRF chemical analyse. Their data processing revealed (...) the existence of several distinct geochemical groups potentially corresponding to local or regional products. Concerning Apollonia itself, it evidenced the prominent role played by this city in pottery manufacture and distribution throughout the SW Pontic area, unveiling pottery trade networks along the Western Black Sea coast during the classical period. This article examines algorithmic content moderation, using the moderation of violent extremist content as a specific case. In recent years, algorithms have increasingly been mobilized to perform essential moderation functions for online social media platforms such as Facebook, YouTube, and Twitter, including limiting the proliferation of extremist speech. Drawing on Katherine Hayles’ concept of “cognitive assemblages” and the Critical Security Studies literature, we show how algorithmic regulation operates within larger assemblages of humans and non-humans to influence the surveillance and regulation (...) of information flows. We argue that the dynamics of algorithmic regulation are more liquid, cobbled together and distributed than it appears. It is characterized by a set of shifting human and machine entities, which mix traditional surveillance methods with more sophisticated tools, and whose linkages and interactions are transient. The processes that enable the consolidation of knowledge about risky profiles and contents are, therefore, collective and distributed among humans and machines. This allows us to argue that the cognitive assemblages involved in content moderation become a cobbled space of preemptive calculation. (shrink)

La méthode psychoprophylactique d’accouchement sans douleur se développe en URSS dans un contexte stalinien sur les principes de la médecine pavlovienne, définie officiellement lors de la « session pavlovienne » de 1950. En France, c’est la figure de Fernand Lamaze qui est associée à la promotion de l’accouchement sans douleur, après qu’il ait importé la MPP d’Union soviétique l’année suivante. D’abord soutenue par les organisations marxistes et le mouvement d’émancipation des femmes, elle sera ensuite contestée sous l’effet des transformations dans (...) la gestion médicale de l’accouchement et des rivalités politiques de la guerre froide. L’article interroge les origines historiques, épistémologiques et politiques de la médecine pavlovienne. Il compare la réception du pavlovisme à l’Ouest et à l’Est en suivant le fil de l’histoire de l’accouchement sans douleur et les enjeux en France et en URSS d’une controverse dans laquelle médecine et politique s’entremêlent. Dans cette étude je poursuis deux objectifs : d�une part, je tente d�établir d�un point de vue théorique les tenants et aboutissants de la question de savoir si le pardon entre deux communautés est possible ; d�autre part, j�examine les obstacles et les dangers d�un tel pardon. En ce qui concerne le premier objectif, je fais appel à Hannah Arendt qui nous a donné dans La condition de l�homme moderne une définition du pardon que j�applique aux relations entre communautés. Afin (...) d�examiner les problèmes d�un pardon inter-communautaire, je fais usage du roman de J. M. Coetzee, Disgrâce, qui offre à mon sens une illustration de ce qu�un tel pardon entraînerait. La situation que décrit Coetzee, et à laquelle je me réfère egalement, est celle de l�Afrique du Sud après l�apartheid. (shrink)

This paper argues that many so-called digital technologies can be construed as notational technologies, explored through the example of Monegraph, an art and digital asset management platform built on top of the blockchain system originally developed for the cryptocurrency bitcoin. As the paper characterizes it, a notational technology is the performance of syntactic notation within a field of reference, a technologized version of what Nelson Goodman called a “notational system.” Notational technologies produce abstracted entities through positive and reliable, or constitutive, (...) tests of socially acceptable meaning. Accordingly, this account deviates from typical narratives of blockchains, instead demonstrating that blockchain technologies are effective at managing digital assets because they produce abstracted identities through the performance of notation. Since notational technologies rely on configurations of socially acceptable meaning, this paper also provides a philosophical account of how blockchain technologies are socially embedded. (shrink)

While there are many books on the romantics, and many books on Heidegger, there has been no book exploring the connection between the two. Pol Vandevelde’s new study forges this important link. Vandevelde begins by analyzing two models that have addressed the interaction between literature and philosophy: early German romanticism, and Heidegger’s work with poetry in the 1930s. Both models offer an alternative to the paradigm of mimesis, as exemplified by Aristotle’s and Plato’s discussion of poetry, and both German romanticism (...) and Heidegger owe a deep debt to Plato. The study goes on to defend the view that Heidegger was influenced by romanticism. The author’s project is thus both historical, showing the specificity of the romantic and Heideggerean works, and systematic, defending aspects of their alternative mode of thinking while also pointing to their weaknesses. The “patient perspective” serves as an analytical tool to present patients as knowing subjects in research, rather than as objects known by medicine. This paper analyses problems encountered with the concept of the patient perspective as applied to long-term mental health care. One problem is that “having a perspective” requires a perception of oneself as an individual and the ability to represent one’s individual situation in language; this excludes from research patients who do not express themselves verbally. Another problem is (...) that the idea of “talk” as a representation of the world ignores the fact that talk is also performative in the world: it requires, at least, the ability to deal with an interview situation. To think up alternative ways of including patients as subjects in research, I develop an approach that takes this performativity as a starting point. Analysing practical situations and activities, I argue that patients enact appreciations, making known what they like or dislike by verbal or non-verbal means in a given material environment, in situations that are co-produced by others. Thus, subjectivity is linked to situations and interactions, rather than just to individual characteristics; to “patient positions,” rather than “patient perspectives.”. (shrink)

We study the algebraic implications of the non-independence property and variants thereof on infinite fields, motivated by the conjecture that all such fields which are neither real closed nor separably closed admit a henselian valuation. Our results mainly focus on Hahn fields and build up on Will Johnson’s “The canonical topology on dp-minimal fields” :1850007, 2018).

Many contemporary thinkers of the Anthropocene, who attempt to articulate a non-modern and relational ontology, all too readily dismiss critical theory inherited from the Frankfurt School for being anthropocentric, failing to acknowledge certain basic similarities. Instead, this article argues that the scaffolding of Anthropocene thinking—the recognition of the origins of the contemporary condition of ‘loss of world’ and the hope of ‘living on in the ruins’—share much with earlier critical theorists’ recognition that the Holocaust necessitated a fundamental break with the (...) past. In reading these two sets of literatures together, we suggest we can get a better grasp of the stakes involved in the contemporary crisis of critique, and in the speculative framings enabling alternative futures to come into being. Este artículo trata sobre la labor llevada a cabo por el iusfilósofo Luis Recaséns Siches de renovación de la Filosofía del Derecho en España mediante la introducción de los postulados neokantianos y kelsenianos. Lo que se puede denominar el proyecto Recasens fue, sin embargo, abruptamente interrumpido por el estallido de la Guerra Civil. Las críticas al neokantismo que contiene fueron incorporadas en trabajos posteriores de Recasens, así como en la obra del profesor Legaz y Lacambra, conservando de este modo (...) el proyecto algo de su impulso inicial. ABSTRACT. This article addresses the renovation effort conducted by the Law philosopher Luis Recaséns Siches, who aimed to update Philosophy of Law in Spain through the introduction of neokantian and kelsenian postulates. What can be denominated as “the Recaséns’ project” was, however, harshly interrupted by the outbreak of the Spanish Civil War. The judgments targeting neokantism that can be found in such texts were included in Recaséns’ later publications, as well as in the work of the professor Legaz y Lacambra, hence yielding the project to maintain some of its original impulse. How do technologies such as webcams influence health care and what concepts may describe this? This article explores the literature and analyses what people looking through webcams do within a particular health care practice in the Netherlands, that is, within the rehabilitation of people suffering from severe chronic obstructive pulmonary disease or asthma. Several ways to describe the activities webcams support and perform are identified. The webcam is concentrating the activities of its users, by making them focus on the task (...) at hand and magnifies the characteristics of the already existing relationships between webcam users by imposing a relational distance that fits best with intimate contacts. Although webcams shift notions of space and distance, their working appears to be related, to a great extent, to their location. (shrink)

Edward Pols has made it his purpose in this perceptive study to deal with the aspects of Whitehead's philosophy that belong to traditional metaphysics. Mr. Pols closely examines Process and Reality, Whitehead's chief metaphysical work, and uses Science and the Modern World, Adventures of Ideas, and Modes of Thought to clarify difficulties with some of the doctrines in that work. Mr. Pols's primary concern is with freedom, and he uses this single theme to examine Whitehead's metaphysical system in depth.

Resumen: En su libro Whose Body is it Anyway? Justice and the Integrity of the Person, Cécile Fabre defiende que, en nombre de la justicia, los recursos de una sociedad deben redistribuirse entre los necesitados y que, entre esos recursos, está incluida la sangre humana, para cuya provisión propone la creación de un servicio civil obligatorio de donación de sangre. Lo que se hace aquí es examinar si, a pesar de lo paradójica que pueda resultar, cabría desarrollar su propuesta en (...) nuestro país. Abstract: In her book Whose Body is it Anyway? Justice and the Integrity of the Person, Cécile Fabre argues that, on behalf of justice, resources of a society should be redistributed to the needy and that, among those resources, human blood is included. For the provision of this material, she proposes the creation of a mandatory civilian service of blood donation. What we propose here is to check if, despite the paradox of his proposal, it could be developed a civilian service of blood donation in our country. (shrink)
