Fifty years on from its first publication, The Concept of Law is still the starting point for the study of legal philosophy and is widely heralded as a classic work of modern philosophy. This third edition features a new introduction by Leslie Green, looking at Hart's work from the perspective of modern jurisprudence.

Sleep enhances integration across multiple stimuli, abstraction of general rules, insight into hidden solutions and false memory formation. Newly learned information is better assimilated if compatible with an existing cognitive framework or schema. This article proposes a mechanism by which the reactivation of newly learned memories during sleep could actively underpin both schema formation and the addition of new knowledge to existing schemata. Under this model, the overlapping replay of related memories selectively strengthens shared elements. Repeated reactivation of memories in (...) different combinations progressively builds schematic representations of the relationships between stimuli. We argue that this selective strengthening forms the basis of cognitive abstraction, and explain how it facilitates insight and false memory formation. (shrink)

ABSTRACTGrounded in Emotional Cascade Theory, we explored whether rumination and multisensory imagery-based cognitions moderated the relationships between affect and both odds of non-suicidal self-injury, and frequency of the behaviour. A sample of 393 university students completed self-report questionnaires assessing the constructs of interest. Contrary to expectations, rumination did not emerge as a significant moderator of the affect-NSSI relationship. However, the relationship between affect and frequency of NSSI was moderated by the use of imagery. Further, the relationship between negative affect and (...) NSSI was moderated by positive affect, underscoring the need to consider both negative and positive affect in models of NSSI. Most youth who self-injured reported thinking in images while the urge to self-injure was strong, with 53% thinking in images at least half the time. This article offers an overview of philosophical methodologies. In an attempt to avoid a certain circularity, the article itself tries to avoid consciously or solely deploying and engaging with any current standard notion of what constitutes a philosophical method or philosophy itself. It hopes to find some of the possible places in which philosophy occurs, and this turns out to include such endeavours as literature, art, poetry, and linguistics. From here it considers how almost anything—for example, conversation, everyday life, and (...) love—can also be philosophy. An attempt is made to identify some characteristic feature of philosophy as it occurs in all such forms. In the end, the simultaneous enacting of a peculiar optimism and particular humility both, in the search for knowledge, is put forward as potentially sufficient to at least begin to identify philosophy across its many guises. IntroductionAcademic integrity policy that is inaccessible, ambiguous or confusing is likely to result in inconsistent policy enactment. Additionally, policy analysis and development are often undertaken as top down processes requiring passive acceptance by users of policy that has been developed outside the context in which it is enacted. Both these factors can result in poor policy uptake, particularly where policy users are overworked, intellectually critical and capable, not prone to passive acceptance and hold valuable grass roots intelligence about policy enactment.Case (...) descriptionThe case study presented in this paper describes the actions of a community of practice at a regional Australian university to deconstruct and translate ambiguous academic integrity policy into a suite of accessible academic integrity resources that were intelligible to staff and students, and which assisted academic staff to consistently enact policy. The paper narrates the formation of the CoP, the tangible and intangible value it created, the social learning practices enacted by its members, its grassroots policy work and the material resources produced from that work.Discussion and evaluationAn evaluation of the CoP was conducted using a value creation framework to explore its immediate value, potential value, applied value, realised value, and reframing value. These values were considered at each stages of the CoP’s lifespan. The evaluation was a useful process that demonstrated the wide-ranging value created by the CoP. Six insights were drawn from the evaluation which promote understanding of the value created for a university by a CoP, particularly in contributing to academic integrity culture over a sustained period of time.ConclusionsThis paper contributes to a research gap on specific examples of discretion within rule-based systems. It illustrates how academics and members of the CoP used their discretion to interpret and enact academic integrity policy within a higher education setting. Drawing from the evaluation of the CoP we argue for greater understanding of the grass-roots contribution of academic and professional staff to academic integrity policy translation and enactment. I should like to draw attention to a metrical phenomenon observable in the hexameters of Callimachus and propound a ‘law’ which so far as I know has not been remarked on before; the accompanying discussion involves some refinements to our understanding of the metrical effect of proclitics of general importance to Greek metrical studies. In analysing the data I have made use of some standard statistical methods which could in my view be used throughout the whole field of Greek metrical (...) studies with great profit. The analysis also provides some detailed evidence useful for a comparison of Callimachus, Apollonius Rhodius, Theocritus, and Aratus, and the earlier writers by whom the Hellenistic poets were influenced. In 1930 Hunt and Johnson published the remains of P. Oxy. 2064, a roll containing at least some of the poems attributed to Theocritus and dating from the late second century A.d. . The papyrus was important, even though very fragmentary , since at its time of publication it was one of the three earliest witnesses to the text of Theocritus. Fragments of other early papyri of Theocritus have been published since then, but P. Oxy. 2064 has remained the most (...) important known witness prior to the fifth century because of the spread of poems which the extant fragments show it to have contained. No other papyrus allows us to reconstruct the contents of an early Theocritus book to such an extent. In 1983 the editors of Oxyrhynchus Papyri published a further collection of Theocritus fragments from various papyri , among which were more remains from P. Oxy. 2064 edited by P. J. Many philosophers claim to be naturalists, but there is no common understanding of what naturalism is. Maddy proposes an austere form of naturalism called 'Second Philosophy', using the persona of an idealized inquirer, and she puts this method into practice in illuminating reflections on logical truth, philosophy of mathematics, and metaphysics.

We adopt and extend the concept of ‘noncooperative space’ to analyze how (aspirant) black women intellectual activists attempt to sustain their efforts within settings that publicly endorse racial equality, while, in practice, the contexts remain deeply racist. Noncooperative spaces reflect institutional, organizational, and social environments portrayed by powerful white agents as conducive to anti-racism work and promoting racial equality but, indeed, constrain individuals who challenge racism. Our work, which is grounded in intersectionality, draws on an autoethnographic account of racially motivated (...) domestic violence suffered by our lead author. Our analysis suggests that (aspirant) black women intellectual activists must develop courage to sustain their ‘voice’ within noncooperative spaces. However, the three interlinked dimensions of noncooperative spaces—namely, deceiving design, hegemonic actors’ indifference to racism, and (some assimilated gatekeepers’) false equivalence—may gradually erode a black female scholar’s courage. This forces her ‘voice’ to vanish temporarily, or even permanently. Courage is thus fragile and depletable. Yet, courage can be regenerated, resulting in regaining voice. Consequently, we propose courageous collective action by white allies and black and brown individuals who voluntarily and officially cooperate within and across various spaces to achieve racial equality. The topic is what limits there are on the counterfactual possibilities for individuals: in other words, what essential properties, if any, they have. ;In Chapters 3-6 three answers to this question that have been given in recent philosophical literature are examined. They are: that each thing has a unique individual essence ; (...) that there are features of the origin of an individual without which it could not possibly have existed ; and, finally, that there are sortal concepts that represent essential properties of the things that fall under them . ;All of these answers, and many of the arguments that have been given for them, are criticised. Sometimes the criticism takes the form of pointing to unpalatable consequences that result from the acceptance of the doctrine in question. Sometimes the criticism consists in pointing to difficulties or inadequacies in the arguments that have been presented in its favour. ;A preliminary chapter prepares the ground by setting out the conceptual framework, and the chief formal characteristics, of the essentialism discussed in the later chapters. Chapter 2 discusses the nature of necessary a posteriori truth, touching on questions in the philosophy of language and mind concerning the notion of de re thought. ;It is argued that essentialism about natural kinds raises problems of its own: some of these are discussed in Chapters 7 and 8. Here the main topic is the connection between semantic theory and natural kind essentialism. Concluding that the essentialism should be regarded as in an important sense independent of semantic theory, the chapters add to, and also criticise, the work of other writers who have reached the same verdict. Scepticism is also expressed about the independent plausibility of natural kind essentialism. ;Recent interest in essentialism owes its genesis chiefly to the work of Saul Kripke and Hilary Putnam: these figures stand in the background throughout the discussion. Foucault's Futures brings together his work on sexuality and biopolitics to provide new insights into the conflicted political status of reproductive conduct and what it means for feminism and critical theory.

Non-suicidal self-injury is a complex behaviour, routinely engaged for emotion regulatory purposes. As such, a number of theoretical accounts regarding the aetiology and maintenance of NSSI are grounded in models of emotion regulation; the role that cognition plays in the behaviour is less well known. In this paper, we summarise four models of emotion regulation that have repeatedly been related to NSSI and identify the core components across them. We then draw on social cognitive theory to unite models of cognition (...) and models of emotion in developing a new cognitive-emotional model of NSSI. Our model articulates how emotion regulation and cognition can work in concert to govern NSSI, and offers several new research questions that can be addressed within this framework. (shrink)

Approaching the question from a broadly naturalistic or second-philosophical point of view, Defending the Axioms isolates the appropriate methods for such evaluations and investigates the ontological and epistemological backdrop that makes them appropriate. This ambitious book explores the relationship between time and history and shows how an appreciation of long-term time helps to make sense of the past. The book is devoted to a wide-ranging analysis of the way different societies have conceived and interpreted time, and it develops a theory of the threefold roles of continuity, gradual change, and revolution which together form a "braided" history. Linking the interpretative chapters are intriguing brief expositions on time travel, time cycles, time lines, and time (...) pieces, showing the different ways in which human history has been located in time. In its global approach the book is part of the new shift toward “big history,” in which traditional period divisions are challenged in favor of looking at the entire past of the world from start to end. The approach is thematic. The result is a view of world history in which outcomes are shown to be explicable, once they happen, but not necessarily predictable before they do. This book will inform the work of historians of all periods and at all levels, and contributes to the current reconsideration of traditional period divisions (such as Modernity and Postmodernity), which the author finds outmoded. This Element looks at the problem of inter-translation between mathematical realism and anti-realism and argues that so far as realism is inter-translatable with anti-realism, there is a burden on the realist to show how her posited reality differs from that of the anti-realist. It also argues that an effective defence of just such a difference needs a commitment to the independence of mathematical reality, which in turn involves a commitment to the ontological access problem – the problem of how knowable (...) mathematical truths are identifiable with a reality independent of us as knowers. Specifically, if the only access problem acknowledged is the epistemological problem – i.e. the problem of how we come to know mathematical truths – then nothing is gained by the realist notion of an independent reality and in effect, nothing distinguishes realism from anti-realism in mathematics. Mathematicians tend to think of themselves as scientists investigating the features of real mathematical things, and the wildly successful application of mathematics in the physical sciences reinforces this picture of mathematics as an objective study. For philosophers, however, this realism about mathematics raises serious questions: What are mathematical things? Where are they? How do we know about them? This paper considers two among the several points of intersection in the work of Roberto Esposito and Jacques Derrida. First, and most obviously: in the context of conceptualizing community, and more broadly, Esposito and Derrida have elaborated concepts of immunity and auto-immunity to refer to auto-destructive modes of defense which profoundly threaten what – seemingly – ought to have been safeguarded through their mechanism. The second point of proximity is the use both make of figures of maternity and birth in (...) these conceptualizations. This comparison not only illuminates the differing philosophical commitments of Derrida and Esposito but also offers a means of challenging the fate of sexual difference in the work of Esposito. It’s often said that set theory provides a foundation for classical mathematics because every classical mathematical object can be modeled as a set and every classical mathematical theorem can be proved from the axioms of set theory. This is obviously a remarkable mathematical fact, but it isn’t obvious what makes it ‘foundational’. This paper begins with a taxonomy of the jobs set theory does that might reasonably be regarded as foundational. It then moves on to category-theoretic and univalent foundations, exploring (...) to what extent they do these same jobs, and to what extent they might do other jobs also reasonably regarded as foundational. Defining consciousness along the lines of Nagel, an organism has consciousness iff there is something it is like to be that organism, I relate three types of consciousness (phenomenal, access and reflexive) to the three types of short-term memory (sensory memories, short-term working memory and the central executive). The suggestion is that these short-term memory stores may be a key feature of consciousness.

The human microbiome has become one of the dominant biomedical frameworks of the contemporary moment that may be understood to be post-Pasteurian. The recognitions the human microbiome opens up for thinking about the biological self and the individual have ontological and epistemological ramifications for considering what and who the human being is. As this article illustrates, the microbiopolitics of the human microbiome challenges the immunitarian Pasteurian model in which the organismic self shores itself up and defends itself against a microbial (...) non-self or other. Instead, this theory presents the human organism as comprised of multiple ecosystems and as a multitude, suggesting that the thanatopolitical attempts to wipe out microbial others (evident in the overuse and misuse of antibiotics, for example) are giving way to an affirmative microbiopolitics grounded in generative multispecies relationality. This article sets out to make the case for this affirmative microbiopolitics. (shrink)

This paper reconstructs Steel’s multiverse project in his ‘Gödel’s program’ (Steel [2014]), first by comparing it to those of Hamkins [2012] and Woodin [2011], then by detailed analysis what’s presented in Steel’s brief text. In particular, we reconstruct his notion of a ‘natural’ theory, describe his multiverse axioms and his translation function, and assess the resulting status of the Continuum Hypothesis. In the end, we reconceptualize the defect that Steel thinks CH might suffer from and isolate what it would take (...) to remove it while working within his framework. As our goal is to present as coherent and compelling a philosophical and mathematical story as we can, we allow ourselves to augment Steel’s story in places (e.g., in the treatment of Amalgamation) and to depart from it in others (e.g., the removal of ‘meaning’ from the account). Traditional accounts of the feminist history of philosophy have viewed reason as associated with masculinity and subsequent debates have been framed by this assumption. Yet recent debates in deconstruction have shown that gender has never been a stable matter. In the history of philosophy 'female' and 'woman' are full of ambiguity. What does deconstruction have to offer feminist criticism of the history of philosophy? _Yielding Gender_ explores this question by examining three crucial areas; the issue of gender as 'troubled'; deconstruction; (...) and feminist criticism of the history of philosophy. The first part of the book discusses the work of Judith Butler, Jacques Derrida, and contemporary French feminist philosophy including key figures such as Luce Irigiray. Particular attention is given to the possibilities offered by deconstruction for understanding the history of philosophy. The second part considers and then challenges feminist interpretations of some key figures in the history of philosophy. Penelope Deutscher sketches how Rousseau, St. Augustine and Simone de Beauvoir have described gender and argues that their readings of gender are in fact empowered by gender's own contradiction and instability rather than limited by it. The enthusiastic reception for the first edition of this book has prompted us to produce a second. We were delighted by the interest from people thinking about and working in public services beyond health care, although the book had been unapologetically health focused. Eight years have passed, and although the issues we addressed are still very much with us, times have changed. 'Austerity' has bitten hard into the UK's public services, especially social care. Developments in policy, technology, organisation and practice (...) have affected health and social care, separately and together. Mindful of this, we have extended our reach to consider both sectors and, to an extent, the wider world of 'welfare'. Hence our new subtitle: 'rehabilitating the welfare state'. We have expanded our narratives, case studies and references accordingly, believing that the issues and perspectives in each field illustrate important points for all. (shrink)
