Do we have positive duties to help others in need or are our moral duties only negative, focused on not harming them? Are any of the former positive duties, duties of justice that respond to enforceable rights? Is their scope global? Should we aim for global equality besides the eradication of severe global poverty? Is a humanist approach to egalitarian distribution based on rights that all human beings as such have defensible, or must egalitarian distribution be seen in an associativist (...) way, as tracking existing frameworks such as statehood and economic interdependence? Are the eradication of global poverty and the achievement of global equality practically feasible or are they hopelessly utopian wishes? -/- This book argues that there are basic positive duties of justice to help eradicate severe global poverty; that global egalitarian principles are also reasonable even if they cannot be fully realized in the short term; and that there are dynamic duties to enhance the feasibility of the transition from global poverty to global equality in the face of nonideal circumstances such as the absence of robust international institutions and the lack of a strong ethos of cosmopolitan solidarity. The very notion of feasibility is crucial for normative reasoning, but has received little explicit philosophical discussion. This book offers a systematic exploration of that concept as well as of its application to global justice. It also arbitrates the current debate between humanist and associativist accounts of the scope of distributive justice. Drawing on moral contractualism (the view that we ought to follow the principles that no one could reasonably reject), this book provides a novel defense of humanism, challenges several versions of associativism (which remains the most popular view among political philosophers), and seeks to integrate the insights underlying both views. This essay explores the relation between two perspectives on the nature of human rights. According to the "political" or "practical" perspective, human rights are claims that individuals have against certain institutional structures, in particular modern states, in virtue of interests they have in contexts that include them. According to the more traditional "humanist" or "naturalistic" perspective, human rights are pre-institutional claims that individuals have against all other individuals in virtue of interests characteristic of their common humanity. This essay argues that (...) once we identify the two perspectives in their best light, we can see that they are complementary and that in fact we need both to make good normative sense of the contemporary practice of human rights. It explains how humanist and political considerations can and should work in tandem to account for the concept, content, and justification of human rights. (shrink)

The topic of alienation has fallen out of fashion in social and political philosophy. It used to be salient, especially in socialist thought and in debates about labor practices in capitalism. Although the lack of identification of people with their working lives—their alienation as workers—remains practically important, normative engagement with it has been set back by at least four objections. They concern the problems of essentialist views, a mishandling of the distinction between the good and the right, the danger of (...) paternalistic impositions, and the significance of democratic authorization. This paper recasts the critique of alienation in a way that vindicates its importance for social and political philosophy and rebuts these objections. First, it provides an analytic framework to understand alienation—distinguishing its various conceptual, explanatory, and normative dimensions. Second, it accounts for the normative aspect of the critique of alienation by articulating it in terms of prudential and moral ideas of positive freedom regarding human flourishing and solidaristic empowerment. Finally, the normative account is developed further, and sharpened to respond to the four objections, through the introduction of the Dignitarian Approach—the view that we have reason to organize social life in such a way that we respond appropriately to the valuable features of individual human beings that give rise to their dignity. Human dignity: social movements invoke it, several national constitutions enshrine it, and it features prominently in international human rights documents. But what is human dignity, why is it important, and what is its relationship to human rights? -/- This book offers a sophisticated and comprehensive defence of the view that human dignity is the moral heart of human rights. First, it clarifies the network of concepts associated with dignity. Paramount within this network is a core notion of human dignity as (...) an inherent, non-instrumental, egalitarian, and high-priority normative status of human persons. People have this status in virtue of their valuable human capacities rather than as a result of their national origin and other conventional features. Second, it shows how human dignity gives rise to an inspiring ideal of solidaristic empowerment, which calls us to support people's pursuit of a flourishing life by affirming both negative duties not to block or destroy, and positive duties to protect and facilitate, the development and exercise of the valuable capacities at the basis of their dignity. The most urgent of these duties are correlative to human rights. Third, this book illustrates how the proposed dignitarian approach allows us to articulate the content, justification, and feasible implementation of specific human rights, including contested ones, such as the rights to democratic political participation and to decent labour conditions. Finally, this book's dignitarian approach helps illuminate the arc of humanist justice, identifying both the difference and the continuity between the basic requirements of human rights and more expansive requirements of social justice such as those defended by liberal egalitarians and democratic socialists. -/- Human dignity is indeed the moral heart of human rights. Understanding it enables us to defend human rights as the urgent ethical and political project that puts humanity first. (shrink)

Two of the most influential arguments for Bayesian updating ("Conditionalization") -- Hilary Greaves' and David Wallace's Accuracy Argument and David Lewis' Diachronic Dutch Book Argument-- turn out to impose a strong and surprising limitation on rational uncertainty: that one can never be rationally uncertain of what one's evidence is. Many philosophers ("externalists") reject that claim, and now seem to face a difficult choice: either to endorse the arguments and give up Externalism, or to reject the arguments and lose some of (...) the best justifications of Bayesianism. The author argues that the key to resolving this conflict lies in recognizing that both arguments are plan-based, in that they argue for Conditionalization by first arguing that one should planto conditionalize. With this in view, we can identify the culprit common to both arguments: for an externalist, they misconceive the requirement to carry out a plan made at an earlier time. They should therefore not persuade us to reject Externalism. Furthermore, rethinking the nature of this requirement allows us to give two new arguments for Conditionalization that do not rule out rational uncertainty about one's evidence and that can thus serve as common ground in the debate between externalists and their opponents. This paper explores the significance of dignity for our understanding of the rights of workers. It surveys important uses of the idea of dignity in several discursive contexts, and offers an interpretation that illuminates the content, scope, and normative force of labor rights. The discursive contexts considered include human rights, socialism, Kantian practical philosophy, and Christian social thought. The interpretation of dignity offered illuminates basic rights to decent conditions in which workers for example choose their occupation, receive adequate remuneration, and (...) are able to form unions to defend their interests. It is also illuminates more ambitious rights to work in ways that fully further workers’ interests in flourishing and involve avoidance or minimization of their domination, exploitation, and alienation. This paper offers a normative exploration of what exploitation is and of what is wrong with it. The focus is on the critical assessment of the exploitation of workers in capitalist societies. Such exploitation is wrongful when it involves a contra-solidaristic use of power to benefit oneself at the expense of others. Wrongful exploitation consists in using your greater power, and sometimes even in making other less powerful than you, in order to get them to benefit you more than they (...) ought to. This account of exploitation is appealing because it simultaneously captures three morally significant dimensions of exploitation—its material and social background, the relational (interpersonal and systemic) attitudes it enacts, and the final distributive results it generates. Exploitation is indeed a multidimensional social process. The flipside of the proposed critical characterization of this process is a positive ideal of solidaristic empowerment in the allocation and use of economic power, which the paper articulates in terms of the socialist Abilities/Needs Principle (“from each according to their abilities, to each according to their needs”). The Abilities/Needs Principle is grounded in human dignity. (shrink)

The current legal and political practice of human rights invokes entitlements to freely chosen work, to decent working conditions, and to form and join labor unions. Despite the importance of these rights, they remain under-explored in the philosophical literature on human rights. This article offers a systematic and constructive discussion of them. First, it surveys the content and current relevance of the labor rights stated in the most important documents of the human rights practice. Second, it gives a moral defense (...) of these rights arguing that their support involves an appropriate response to important human interests and to the human dignity of workers. Finally, it explores central normative issues about the relation between labor rights and human dignity. It responds to some objections about the importance of work, explains why labor human rights may not exhaust the demands of dignity regarding labor and arbitrates a common tension between independence and solidarity within our practical affirmation of human dignity. This paper provides a critical exploration of the capability approach to human rights (CAHR) with the specific aim of developing its potential for achieving a synthesis between “humanist” or “naturalistic” and “political” or “practical” perspectives in the philosophy of human rights. Section II presents a general strategy for achieving such a synthesis. Section III provides an articulation of the key insights of CAHR (its focus on actual realizations given diverse circumstances, its pluralism of grounds, its emphasis on freedom of choice, (...) its demand for public reasoning, its context-sensitive universalism, and its broad view of obligations). These insights go some way toward the achievement of the desired synthesis. But, as explained in IV.1, in its current form CAHR faces two serious objections by the defenders of the political perspective: the Gap Between Capabilities-Interests and Rights Objection and the Disconnect From Practice Objection. Answering these criticisms requires some amendments to CAHR. Section IV.2 suggests a response to the first objection based on the introduction of a contractualist framework of justification. Sections IV.3 and IV.4 tackle the second objection by introducing a re-characterization of the cosmopolitan standard underlying the humanist perspective and by identifying the differences and relations between various dimensions of a conception of human rights and their significance for actual political practice. The paper illustrates the practical implications of CAHR, in its modified form, for the pursuit of some important rights. (shrink)

La vida consagrada está lejos de extinguirse, sin embargo, tanto su futuro como su significancia para la sociedad actual, no son del todo claros ni convincentes. Uno de los atributos más importantes ha sido su posibilidad creativa, su innovación como forma de vida y el ser una alternativa en sus múltiples manifestaciones carismáticas y apostólicas, respecto de la sociedad. Hoy aquello tampoco es tan claro y por lo tanto la pregunta por el futuro y, mejor aún, por ser propuesta de (...) futuro está en cuestión. A esta dimensión se le ha denominado “política”, y el siguiente estudio busca esbozar algunas respuestas en lo referente al contexto latinoamericano. A partir de bibliografía especializada, de datos estadísticos, del aporte de otras disciplinas afines, –como la geografía, la ética y la antropología–, y una reflexión experiencial se presentan algunos potenciales caminos en vistas de que la dimensión política de la vida consagrada continúe siendo alternativa para otros mundos posibles. The aim of this paper is to propose a model for understanding the relation between substance and procedure in discourse ethics and deliberative democracy capable of answering the common charge that they involve an ‘empty formalism’. The expressive-elaboration model introduced here answers this concern by arguing that the deliberative practical rationality presupposed by discourse ethics and deliberative democracy involves the creation of a practical medium in which certain general basic ideas of solidarity, equality and freedom are expressed and elaborated in (...) the context of widespread moral disagreement. In the course of this paper I propose an elucidation of these ideas and argue for the thesis that they are internally related to the endorsement of deliberative practical rationality. The three basic substantive ideas contribute to the determination of the existence, the form, the topics and intended outcomes, and the effects of the practice of public deliberation. This amounts to an elucidatory defense of deliberative practical rationality by explicating its substantive significance or point. In his important new book National responsibility and global justice, David Miller presents a systematic challenge to existing theories of global justice. In particular, he argues that cosmopolitan egalitarianism must be rejected. Such views, Miller maintains, would place unacceptable burdens on the most productive political communities, undermine national self-determination, and disincentivize political communities from taking responsibility for their fate. They are also impracticable and quite unrealistic, at least under present conditions. Miller offers an alternative account that conceives global justice in (...) terms of a minimum set of basic rights that belong to human beings everywhere. Primary responsibility for securing such rights for an individual lies with his or her state, but in so far as these rights go unprotected, responsibilities for fulfilling them may fall on outsiders. While less ambitious that cosmopolitan egalitarian justice, Miller argues that his own view would nevertheless enable us to articulate what is most morally objectionable about our current world. In this article it is argued that none of Miller's critiques of cosmopolitan egalitarianism is effective, and that while certainly preferable to the status quo, a world governed by Miller's principles is not an attractive ideal. Speculative realists have directed a radical critique towards what they call “correlationism,” the stance according to which we only have access to the correlation between thinking and being, and never to either term considered apart from the other. Both Quentin Meillassoux and Ray Brassier have used Gilles Deleuze’s ontology as a paradigmatic example of correlationism. Instead of defending Deleuze from this accusation, I argue that we need to accept it, but that the correlation is drastically transformed when we take into (...) account Deleuze’s panpsychism. I hence contend that Deleuze is a panpsychist, grounding my argument in (a) his theory of contemplations and (b) his account of the universe as a cinema in itself. This changes everything, since a panpsychist type of correlationism avoids the main problem that leads both Meillassoux and Brassier to try to overcome correlationism, namely, that of the possibility of existence before and after humans. El propósito de este artículo es estudiar el papel que, según Francisco Suárez, en una situación de gobierno tiránico, juegan la legítima defensa y la existencia de pacto previo con el tirano. Como se verá, en la teoría de la resistencia suareciana el primer elemento prevalece sobre el segundo, pero es preciso analizar el fundamento de dicha primacía. Para ello se examinan concretamente los casos del juicio de deposición del tirano y de magnicidio del tirano a manos de un particular, (...) tal como los aborda Suárez en la Defensio fidei. Dicho análisis se lleva a cabo teniendo en cuenta el diferente tratamiento que Suárez da a los dos clásicos tipos de tirano: el mal gobernante y el usurpador. Por último, intentaremos dar respuesta a diversas contradicciones en las que aparentemente Suárez incurre. (shrink)

El presente trabajo pretende abordar en profundidad algunos de los aspectos esenciales en el origen de las posturas ecofascistas actuales. Entendidas como aquellas que pretenden preservar los recursos naturales para una minoría privilegiada por medio de la exclusión de las grandes mayorías populares, las ideas ecofascistas están experimentando un momento de fuerte auge en una coyuntura de crisis ecosocial que se desarrolla, además, en el contexto de una importante crisis civilizatoria. Entendemos que los orígenes de esas crisis se hallan precisamente (...) vinculados a una cosmovisión que alienta unos determinados imaginarios colectivos ante las mismas y que, a la postre, alimenta esas posturas ecofascistas. Dicha cosmovisión parte, dentro del paradigma moderno occidental, de la idea de un ser humano ilimitado, lo que conlleva inevitablemente una configuración cultural y práctica de carácter eco-colonial negadora de otros pueblos, que son de este modo subalternizados. Sostenemos que la tentación de superar la crisis socioambiental mediante soluciones tecnooptimistas no hará más que profundizar en este modelo. No sólo eso. Las tecnocracias entrañan una amenaza potencial para la democracia, en cuanto pueden ser cauce para la normalización de autoritarismos propios de los proyectos ecofascistas. (shrink)

El presente artículo pretende analizar la discusión que Francisco Suárez mantiene con las tesis contrarias a la distinción entre tipos de tirano en la cuestión del tiranicidio (Defensio fidei, Libro VI, capítulo IV, números 10-13). Para esta visión no le es lícito a una persona privada matar a ninguno de los dos tipos de tirano; sólo es posible darles muerte en legítima defensa, porque se entiende que en tal caso se actúa en ejercicio de autoridad pública. Suárez acaba admitiendo esta (...) tesis en el número 13, lo que parece contradecirse con lo sostenido en el número 7, donde se aceptaba la muerte del usurpador por cualquier particular. Sin embargo, en el fondo mantiene la diferencia entre ambos tipos de tirano, por cuanto que en el caso del usurpador sostiene que siempre se dan las condiciones para alegar legítima defensa. Queda sin aclarar qué ocurre en tal caso con las condiciones dispuestas en los números 8 y 9. (shrink)

La primera parte del estudio atiende a la disputa teórica planteada por los filósofos posmarxistas Toni Negri y Paolo Virno que establece una oposición radical entre los conceptos de pueblo y multitud. La segunda parte se apoya en los escritos de Jacques Rancière, Hannah Arendt y Judith Butler para proponer un “retorno a lo sensible” que sea capaz de romper la drástica distinción entre pueblo y (...) multitud y arrastre este último concepto hacia el plano sensible. El efecto que estos tienen sobre las humanidades es analizado a través de dos aspectos críticos. En segundo término, se discute la significación epistémica de la ocurrencia como principio común de ciencias y humanidades apelando a (...) la obra de Georg Christoph Lichtenberg a manera de caso ejemplar. Resumen Este artículo analiza la crítica de Gilles Deleuze a la dualidad kantiana de la estética. El autor atribuye la no-coincidencia entre la estética trascendental como teoría de la sensibilidad y la estética como teoría del gusto a una doble presuposición que se debe abandonar, esta es, relegar la síntesis a la actividad, y la noción de condiciones de la experiencia posible en lugar de condiciones de la experiencia real. El intento deleuziano por superar la dualidad corre el riesgo de (...) recaer en dos estéticas, y se sugiere una manera diferente de realizar dicho proyecto por medio del concepto de sensación.This paper analyses the critique posed by Gilles Deleuze to the Kantian duality of aesthetics. The noncoincidence between transcendental aesthetics as theory of sensibility and aesthetics as theory of taste is, according to the French philosopher, due to a double assumption that must be left behind: firstly, the relegation of synthesis to activity, and secondly, the notion of conditions of a possible experience instead of conditions of real experience. We argue that the Deleuzean attempt of overcoming the duality risks falling back into two aesthetics and suggest a different way of achieving that project through the concept of sensation. (shrink)

This paper aims to clear two regular misunderstandings when comparing the thoughts of Gilles Deleuze and Martin Heidegger: firstly, the alleged opposition between Heideggerian negativity and Deleuzian positivity; secondly, the assumed contrariety between Deleuzian immanence and Heideggerian transcendence. In this fashion, the proposal is not so much to point at coincidences as to underline the fact that the differences are not where they are usually sought. The method used consists in taking Deleuze’s mentions to Heidegger in Difference and Repetition as (...) a common thread for tracking the Deleuzian use of Heideggerian concepts. We will attempt to show that both aspects of the Deleuzian transcendental field, the virtual and the intensive, hold a certain “negativity” and “concealment”, respectively, which runs against the picture of Deleuze as a philosopher of thorough and unconcealed manifestation. We will likewise argue that Heideggerian transcendence is not necessarily opposed to Deleuzian immanence, and that the Heideggerian concepts of Zwiefalt and Selbe are used by Deleuze in order to think of immanence. We contend that the distinction between the negative and the problematic allows Deleuze to speak of being even while accepting ontological difference. (shrink)

La boîte à outils que constitue l’ensemble de ses développements prend des voies différentes en fonction de l’appareil avec lequel il se conjugue. On propose ainsi une présentation critique des principales lignes interprétatives de l’œuvre de Deleuze sur la question politique.

“Deleuze and the Inversion of Kantism”. In this paper we aim to look into French philosopher Gilles Deleuze’s work in order to see whether there is such a thing as a ‘reversal of Kantianism’, parallel to his more well-known reversal of Platonism. To this end, we will propose, firstly, to read in the key of reversal the movements made by Deleuze regarding intensity and extension, on the one hand, and the paradox of inner sense, on the other. Then, we will (...) analyze why Kant had already accomplished two great reversals, regarding the classical conception of both time and law, and consequently, we will develop the Deleuzean conception of Nietzschean eternal return as a simultaneous reversal of both aspects. Finally, we will inquire about the tropos of the aforementioned reversal, calling on the concepts of humor and irony. (shrink)

This paper examines Gilles Deleuze’s reading of Immanuel Kant’s “Critique of the Aesthetic Power of Judgment”. We will show a) that the author holds an interpretative thesis according to which the third Kantian Critique would not be a complement but rather a foundation of the previous ones, inasmuch as the determined agreements of the first two Critiques presuppose the possibility of an indeterminate agreement between the faculties; b) that the demand for a genesis of the sensus communis by Deleuze can (...) be summed up in three requisites: discordance, contingency, and vivification; and c) in which senses Deleuze considers that the aforementioned requirements are satisfied in the Kantian text. The aim of this paper is to provide an analysis of Gilles Deleuze’s interpreta- tion of the Critique of Pure Reason such as it appears in his 1963 monographic work La Philosophie critique de Kant. We will show that the originality of Deleuze’s reading lies in reading the critical project in retrospect, taking the sensus communis problem from the Critique of the Power of Judgment and applying it to the first Critique. In so doing, he points out the survival of (...) a pre-established harmony, now interiorized, both between heterogeneous faculties and between the matter of phenomena and the Ideas of reason. This implies a reinterpretation of the critical project that has passed unnoticed within Kantian studies and that places the Third Critique as the ground of the previous ones, unveiling common sense as a condition of possibility of knowledge. El presente trabajo analiza los relatos de Matilde Sánchez “Amsterdam, ‘79” y “Berlín, ‘86”, crónicas de viajes iniciáticos incluidos en La canción de las ciudades. En ambos casos, la protagonista y narradora nos presenta el viaje como un experimento sobre la propia subjetividad, consistente en la inmersión y exposición del cuerpo propio y la lengua materna a una proliferación de signos urbanos extraños, habitando y habituándose a aquellas ciudades. Se propone aquí pensar dichas crónicas a partir de los conceptos deleuzianos (...) de aprendizaje, percepto y afecto, y adentrarse en la composición de la canción en cuestión como una operación que involucra una temporalidad triple. El aprendizaje perceptivo, afectivo y lingüístico de los viajes remite a un pasado de la expectativa y a un futuro de la escritura, y los signos aprendidos se constituyen en notas de la canción de las ciudades solo en la resonancia entre los tres momentos. The present article aims to inquire the negativity implied in the relation between man and nature in Kant’s early philosophy. This negativity will be treated from the realm of the theodicy as the dimension from where human fate can be posed. The characterization of this fate will be possible via ethical and aesthetic dimensions set out by Kant in his works dedicated to the subject of theodicy and philosophy of nature; i.e. Über Optimismus, which dates back to the 1750´s. Followingly, (...) we will discuss certain aspects of the author´s Universal History of Nature and Theory of Heaven, and thereafter we will refer ourselves to three minor works concerning earthquakes. In the last chapter we will point out how the comprehension of the aforementioned works are essential in order to define the sentiment of the sublime. In conclusion we will define the sublime as incompatible with optimism. (shrink)
