Nous invitons ici à une véritable promenade intellectuelle qui nous conduit à creuser l'histoire de la pensée et du penser en Islam pour y retrouver des rationalistes invétérés et endurcis dont le souci fut de défendre la raison au prix de leur foi : ce sont les rationalistes qu'on appelle communément " Mu'tazila ". Très tôt, ce mouvement prit une dimension rationnelle en développant au sein de l'Islam les thèses critiques et philosophiques les plus inattendues d'une religion. Cette histoire des (...) idées que nous voulons parcourir nous mènera au " siècle des lumières en Islam " même si l'expression est quelque peu contestée par certains intellectuels musulmans qui pensent à un manque de considération pour les nouveaux penseurs de l'Islam comme si le moment de la bonne pensée n'est pas le leur. On peut leur donner raison. L'histoire ne bégaie pas toujours. Elle est parfois infidèle. Telle est malheureusement l'histoire de l'Islam. Une histoire d'hybridation et parfois d'infidélité au texte. Apparue comme une religion de salut et de raison, son image est ternie aujourd'hui par ceux qui, au prix du glaive, substituent la modernisation de la pensée islamique à une islamisation violente de la modernité. Al-Ḥasan ar-Raṣṣāṣ (d. 1188 C.E.) was one of the most prominent representatives of the emerging reception of Basran Muʿtazilism in 12th century Yemen. He composed highly sophisticated works on ontology, causality and the specific theory of attributes that has become known as the theory of "states" (aḥwāl). He is therefore a rare case of a Muʿtazilī thinker who left a comprehensive and systematised account of his natural philosophy. Jan Thiele's study makes extensive use of hitherto unexplored manuscripts, thereby providing new (...) insight into a largely unknown chapter of Zaydī and Muslim doctrinal history. Focusing on the later Muʿtazila, this book conveys a nuanced understanding of diachronic developments in the school's teachings in order to refine a rather static perception that prevails in modern scholarship. Al-Ḥasan ar-Raṣṣāṣ (st. 1188) war einer der einflussreichsten Vertreter der im 12. Jahrhundert einsetzenden Rezeption der Basraer Muʿtazila im Jemen. Er verfasste ausgefeilte Werke zur Ontologie, Kausalit t und zu jener Attributenlehre, die als Theorie der "Zust nde" (aḥwāl) bekannt ist. Somit ist er einer der seltenen muʿtazilitischen Denker, der eine umfassende Systematisierung seiner Naturphilosophie hinterlassen hat. Jan Thieles Studie beruht weitestgehend auf unerforschten Handschriften und gibt dadurch neue Einsichten in ein nahezu unbekanntes Kapitel zayditischer und muslimischer Geistesgeschichte. In this paper, I argue that morality might bear on belief in at least two conceptually distinct ways. The first is that morality might bear on belief by bearing on questions of justification. The claim that it does is the doctrine of moral encroachment. The second, is that morality might bear on belief given the central role belief plays in mediating and thereby constituting our relationships with one another. The claim that it does is the doctrine of doxastic wronging. Though (...) conceptually distinct, the two doctrines overlap in important ways. Recent historiography of 19th century biology supports the revision of two traditional doctrines about the history of biology. First, the most important and widespread biological debate around the time of Darwin was not evolution versus creation, but biological functionalism versus structuralism. Second, the idealist and typological structuralist theories of the time were not particularly anti-evolutionary. Typological theories provided argumentation and evidence that was crucial to the refutation of Natural Theological creationism. The contrast between functionalist and structuralist approaches to biology continues (...) today, and the historical misunderstanding of 19th century typological biology may be one of its effects. This historical case can shed light on current controversies regarding the relevance of developmental biology to evolution. (shrink)

Two centuries after Carl von Clausewitz wrote On War, it lines the shelves of military colleges around the world and even showed up in an Al Qaeda hideout. Though it has shaped much of the common parlance on the subject, On War is perceived by many as a “metaphysical fog,” widely known but hardly read. In War as Paradox, Youri Cormier lifts the fog on this iconic work by explaining its philosophical underpinnings. Building up a genealogy of dialectical war theory (...) and integrating Hegel with Clausewitz as a co-founders of the method, Cormier uncovers a common logic that shaped the fighting doctrines and ethics of modern war. He explains how Hegel and Clausewitz converged on method, but nonetheless arrived at opposite ethics and military doctrines. Ultimately, Cormier seeks out the limits to dialectical war theory and explores the greater paradoxes the method reveals: can so-called “rational” theories of war hold up under the pressures of irrational propositions, such as lone-wolf attacks, the circular logic of a “war to end all wars,” or the apparent folly of mutually assured destruction? Since the Second World War, commentators have described war as obsolete. War as Paradox argues that dialectical war theory may be the key to understanding why, despite this, it continues. (shrink)

The study deals with the matter of three of the most puzzling doctrines of Baruch Spinoza’s system, the so-called ‘final doctrines’, which are intuitive knowledge, intellectual love of God, and the eternity of the (human) mind. Contrary to many commentators, but also in concordance with many others, this account strives to affirm the utmost importance of these doctrines to Spinoza’s system as a whole, but mostly to his ethical theory. Focusing specifically on the cultivation of the human mind, the paper (...) offers partial analyses of the central notions of these doctrines and their conceptual contexts. It is argued that the cultivation of the human mind, i.e., its determination to its perfect activity, should be considered as Spinoza’s ultimate ethical goal, and that the mind truly only advances to this goal by means of these cognitive, affective, and intellectual transformations of thinking. Recent scholarship has drawn attention to John Rawls’s concern with stability—a concern that, as Rawls himself notes, motivated Part III of A Theory of Justice and some of the more important changes of his political turn. For Rawls, the possibility of achieving ‘stability for the right reasons’ depends on citizens possessing sufficient moral motivation. I argue, however, that the moral psychology Rawls develops to show how such motivation would be cultivated and sustained does not cohere with his specific descriptions of (...) ‘pluralist ’ doctrines. Considering Rawls’s claims that ‘most’ citizens—both in contemporary liberal democracies and in the well-ordered society—possess such doctrines, this incompatibility threatens to undermine his stability arguments. Despite the enormous importance of pluralist doctrines and the potential difficulties they pose for Rawls’s project, remarkably little attention has been paid to them. By critically examining these difficulties, the article begins to address this oversight. (shrink)

In his last works, John Rawls explicitly argued for an overlapping consensus on a family of reasonable liberal political conceptions of justice, rather than just one. This ‘Deep Version’ of political liberalism opens up new questions about the relationship between citizens’ political conceptions, from which they must draw and offer public reasons in their political advocacy, and their comprehensive doctrines. These questions centre on whether a reasonable citizen’s choice of political conception can be influenced by her comprehensive doctrine. In this (...) paper I present two models of the relationship, which give contrasting answers to these questions, and defend the model that is more permissive with regard to the influence of comprehensive doctrines. This has important implications for our understanding of Rawlsian political liberalism, and reduces the force of objections that have been offered by theorists sympathetic to religion. (shrink)

To create a programming environment for contract dispute resolution, we propose an extension of assumption-based argumentation into modular assumption-based argumentation in which different modules of argumentation representing different knowledge bases for reasoning about beliefs and facts and for representation and reasoning with the legal doctrines could be built and assembled together. A distinct novel feature of modular argumentation in compare with other modular logic-based systems like Prolog is that it allows references to different semantics in the same module at the (...) same time, a feature critically important for application of argumentation in legal domains like contract dispute resolution where the outcomes of court cases often depend on whether credulous or skeptical modes of reasoning were applied by the contract parties. We apply the new framework to model the doctrines of contract breach and mutual mistake. (shrink)
