G. A. Cohen's critique of Rawls's defence of economic incentives echoes some of J. S. Mill's insights on the subject. Some of Cohen's arguments, however, clash not only with those of Rawls but also with each other as well as with Mill's. A similar charge, however, may be made against Rawls. This article has conciliatory ambitions. It suggests reconciling each author with himself, as well as with each other, by focusing onthe worthof liberty. This paper evaluates Mill’s arguments favoring a society with an economy dominated by “a principle of individual property” over alternatives dominated by the common ownership of the conditions of life and wealth. Mill’s strategy for addressing the problem of property consists in conducting a comparison of competing systems of ownership (capitalism, socialism or communism) on the criterion of which best distributes wealth to the individual. Mill applies this criterion in the evaluation of these systems in light of (...) three considerations: (1) their feasibility in a highly developed society, (2) their efficiency and likelihood of continuing improvement in comparison to competing systems, and (3) their consistency with and conduciveness to individual liberty. This paper investigates Mill’s arguments regarding the application of these and related considerations to the arguments of socialist and communist theorists with whose views he was familiar and, in varying degrees, sympathetic. As argued here, the arguments Mill employs are not, on his own terms and especially with respect to liberty, adequate to justify his general contention that given the inadequate moral and intellectual development of citizens, it is better to gamble on a private property economy than a socialist alternative. The U.S. Constitution employs a utilitarian view in authorizing Congress to establish patents and copyrights. Let us refer to this way of justifying copyright as the Incentives Argument, or more extensively, the Incentives Argument for Intellectual Property Rights. While seemingly straightforward, the Incentives Argument has been widely criticized in philosophical literature on intellectual property. Scholars have come to prefer Neo-Lockean labor-desert accounts, grounding intellectual property rights in the author's natural ownership claims over his creations. Neo-Lockean accounts are (...) thought to avoid some of the problems classically associated with utilitarian arguments, such as vulnerability to empirical evidence and an inability to make sense of rights or duties morally prior to consequential considerations. Fortunately, many criticisms articulated by opponents of the Incentives Argument can be answered by a strategic retreat to the version of utilitarianism found in the work of John Stuart Mill. I argue that not only does a Millian account of the Incentives Argument prove less vulnerable to oft-cited criticisms, but also allows for a more robust account of how the audience benefits from a proliferation of creative works. Mill's focus on the importance of critical self-development allows for a deeper analysis of how creative works benefit members of the audience as individuals and as a community. Within a Millian framework, viewing the audience as mere passive consumers of media fails to take into account the impact of expressive acts on an individual's critical self-development. Instead, one must see members of the audience as active participants in the creation of meaning and the common culture. Construing the community that receives creative works as an Active Audience alters the landscape of copyright, and the Incentives Argument, making balancing the desires of creators and the desires of audience members a key priority. This article examines John Stuart Mill’s influential proposal of how to tax wealth transfers. According to Mill, every person should be free to bequeath but not to receive bequest. Mill proposed an upper limit on how much each person could receive from wealth transfers. We discuss three objections against this proposal. The nonseparability objection holds that it is not possible to separate the freedom to give from the freedom to receive. The objection from private property holds that (...) private property includes an unlimited right to dispose of one’s assets and that this right is violated under Mill’s scheme. The objection from incentives holds that Mill’s scheme would have negative effects on people’s willingness to work and save. We argue that these objections can be met and that taxing bequeathed wealth according to Mill’s scheme is more just and more efficient compared to systems that rely less on wealth transfer taxation. John Stuart Mill commented on the relationship between equality and liberty in general terms, and he also discussed the relationships between equality and four more concrete social goals: equality vs. diversity and individual spontaneity, equality vs. freedom of trade and entrepreneurial activity, equality vs. economic incentives for workpeople, and equality vs. welfare. In his more general statements he wrote off potential conflicts between equality and liberty, claiming that only those liberties that can be enjoyed by all are real (...) liberties—or at least they are the only ones worth defending. However, in several of his more concrete discussions he gave higher priority to various liberty-related goals than to equality. This seeming contradiction can be resolved if we assume that he distinguished between valuing a liberty per se and valuing it as a means to achieve something else. (shrink)

In this Article, I propose a novel law and economics explanation of a deeply puzzling aspect of business organization in market economies. Why are virtually all firms organized as capital-managed and -owned (capitalist) enterprises rather than as labor-managed and -owned cooperatives? Over 150 years ago, J.S. Mill predicted that efficiency and other advantages would eventually make worker cooperatives predominant over capitalist firms. Mill was right about the advantages but wrong about the results. The standard explanation is that capitalist (...) enterprise is more efficient. Empirical research, however, overwhelmingly contradicts this. But employees almost never even attempt to organize worker cooperatives. I critique the explanations of the three leading analysts of the subject (N. Scott Arnold, Henry Hansmann, and Gregory Dow), all of whom offer are different transactions cost accounts, as logically defective and empirically inadequate. I then propose an explanation that has been oddly neglected in the literature, that the rarity of cooperatives is explained by the collective action problem identified by writers such as Mancur Olson. Labor management is a public good that generates the n-person prisoner’s dilemma which gives rational actors the incentive to create it in suboptimal (or no) amounts. I support this by reference to the empirical facts about the origin of existing cooperatives and show that this explanation requires no strong version of a questionable rational choice theory. This explanation is supplemented by the mere exposure or familiarity effect derived from social and cognitive psychology, which turns on the fact that labor managed firms are rare, in part because of the public goods problem, thus unfamiliar, which makes them less attractive and thus more likely to be rare. My account points advocates of labor management towards solutions such as institutional changes in incentives, which, however, themselves involve public goods issues. (shrink)

The defects of any form of government may be either negative or positive. It is negatively defective if it does not concentrate in the hands of the authorities power sufficient to fulfil the necessary offices of a government; or if it does not sufficiently develop by exercise the active capacities and social feelings of the individual citizens. On neither of these points is it necessary that much should be said at this stage of our inquiry.

Mill predicted that "[t]he Liberty is likely to survive longer than anything else that I have written...because the conjunction of [Harriet Taylor’s] mind with mine has rendered it a kind of philosophic text-book of a single truth, which the changes progressively taking place in modern society tend to bring out in ever greater relief." The nature, extent and validity of the modern institution of private ownership remains a major source of contention between libertarian, liberal and socialist positions in political theory. The thesis contributes to current debates by ways of an analysis of historically significant theories of property, viewed in connection with their underlying conceptions of the person. ;The dissertation consists of three parts. Part One is an exposition of J. Locke's natural rights theory, together with Hegel's criticism of it. Chapter One argues that (...) Locke's famous labor theory of property presupposes an essentially "acquisitive" conception of the person. Chapter Two analyzes Hegel's transformation of Locke's basic model within the framework of an argument no longer derived from the paradigm of natural rights; Hegel introduces instead his notion of the historical and cultural achievements of "Geist". Hegel's theory presupposes, we argue, an essentially "purposeful" self. Property is viewed no longer as an incentive to labor, but now primarily as an instrument for the realization of distinctive human capacities. ;Part Two presents Marx's critique of Hegel's conception of ownership. Chapter Three sets forth the early normative critique: in the realm of labor the acquisitive self remains primary in Hegel's theory. Marx, in turn, proposes that the criterion of "care" for the development of human capacities be introduced within the economic realm. We conclude that Marx's theory remains utopian given that it lacks an adequate conception of other-directed, socialist motivation. At the same time, we argue that Rawls's scepticism in regard to the possibility of socialist ownership remains unfounded, by way of drawing on yet a third model of personality and labor: that derived from the traditional female realm of child-care. We conclude that Rawls's theory, when taken in conjunction with our analysis of "reproductive labor", presents us with a new conception of socialist property arrangements which is at once highly feasible. Mill on Liberty was first published in 1983 and has become a classic of Mill commentary. The second edition reproduces the text of the first in full, and in paperback for the first time. David Chalmers calls the problem of explaining why physical processes give rise to conscious phenomenal experience the ‘hard problem’ of consciousness. He argues convincingly that no reductive account of consciousness can solve it and offers instead a non-reductive account which takes consciousness as fundamental. This paper argues that a theory of the sort Chalmers proposes cannot hope to solve the hard problem of consciousness precisely because it takes the relation between physical processes and consciousness as fundamental rather than explicable. The (...) hard problem of consciousness is, for reasons Chalmers himself gives, insoluble. Its insolubility does not, however, impugn the naturalistic respectability of consciousness. (shrink)

R. McCulloch, George Grote and John Austin. A prolific writer, Mill is remembered mainly as Bentham's chief disciple; for his influence on the radicals and in particular his son John Stuart Mill, the prominent utilitarian thinker. J.S. Mill's deep interest in French intellectual, political, and social affairs began in 1820 when, in his fourteenth year, he went to France to live for a year with the family of Sir Samuel Bentham. French became his second language, and France his second home, where he died and was buried in 1873. His interest in history began even earlier when, as a child of seven, he tried to imitate his father's labours on the History of British India; though (...) he never wrote a history in his maturity, study of the past remained a passion and helped shape the philosophy of history that informed his views of society and ethics. His intense interest in contemporary French politics also led him to seek connections between historical developments and present trends, both seen by his from a Radical perspective approproate to what he believed to be an age of transition. The English historians of France, including Walter Scott and Thomas Carlyle, as well as the French, some of whom were themselves political figures, are judged by their historical methods, but those methods are seen as having practical effects in shaping as well as revealing the mind of the times. This volume brings together for the first time the essays, running from 1826 to 1849, that meld these abiding interests. They give as well insights into Mill's personal aspirations, his developing view of comparative politics and sociology, his concern for freedom, and his feminism. During these years Mill worked on a published his System of Logic, Book VI of which shows in condensed form the results of the speculations here developed; reading these essays with that work, which made his reputation as a philosopher, enables one to see the effects of romanticism on analytic thought in a way not as clearly evident even in Mill's Autobiography. Independently important, then, the essays in this volume also enable us to interpret anew the practical and theoretical concerns fundamental to his formative years and maturity. John C. Mill was a progressive thinker whose views on gender and race were well in advance of his times. But although he rejected both the natural or innate superiority of men over women and of whites over blacks, and attributed their differences to their different circumstances, his proposals for social and political changes seem be contrast sharply in the two cases. He argued for “perfect equality” between men and women, including the extension of the suffrage to women and the elimination (...) of the near absolute power of husbands over their wives. On the other hand, Mill justified British imperial rule in India, maintaining that despotism was an appropriate form of government for “barbarians”, provided it was the most effective means of raising them to a higher stage of development where they were capable of ruling themselves.
