In modal subordination, a modal sentence is interpreted relative to a hypothetical scenario introduced in an earlier sentence. In this paper, I argue that this phenomenon reflects the fact that the interpretation of modals is an ANAPHORIC process. Modal morphemes introduce sets of possible worlds, representing alternative hypothetical scenarios, as entities into the discourse model. Their interpretation depends on evoking sets of worlds recording described and reference scenarios, and relating such sets to one another using familiar notions of restricted, preferential (...) quantification. This proposal relies on an extended model of environments in dynamic semantics to keep track of associations between possible worlds and ordinary individuals; it assumes that modal meanings and other lexical meanings encapsulate quantification over possible worlds. These two innovations are required in order for modals to refer to sets of possible worlds directly as static objects in place of the inherently dynamic objects—quite different from the referents of pronouns and tenses—used in previous accounts. The simpler proposal that results offers better empirical coverage and suggests a new parallel between modal and temporal interpretation. (shrink)

Proponents of the value ladenness of science rely primarily on arguments from underdetermination or inductive risk, which share the premise that we should only consider values where the evidence runs out or leaves uncertainty; they adopt a criterion of lexical priority of evidence over values. The motivation behind lexical priority is to avoid reaching conclusions on the basis of wishful thinking rather than good evidence. This is a real concern, however, that giving lexical priority to evidential considerations over values is (...) a mistake and unnecessary for avoiding the wishful thinking. The knowledge account of assertion holds that it is improper to assert that p unless the speaker knows that p. This paper argues against the knowledge account of assertion; there is no general norm that the speaker must know what she asserts. I argue that there are cases in which it can be entirely proper to assert something that you do not know. In addition, it is possible to explain the cases that motivate the knowledge account by postulating a general (...) norm that assertions would be true, combined with conversational norms that govern all speech acts. A theory on which proper assertions must be true explains the data better than a theory on which proper assertions must be known to be true. (shrink)

Spinoza’s remarks on the exemplar or model of human nature, while few and brief, have far-reaching consequences for his ethics. While commentators have offered a variety of interpretations of the model and its implications, there has been near unanimous agreement on one point, that the identity of the model is the free man, described from E4P66S to E4P73. Since the free man is completely self-determining and, thus, perfectly free and rational, this reading indicates that Spinoza’s ethics sets exceptionally high goals, (...) aiming to make us purely active beings. While this conclusion has been embraced in some quarters—particularly by those who see his ethics as aiming to make us like God—it has also been criticized as intolerant of human weakness and vulnerability. Most work on this subject has been concerned to explain what it means for the free man to serve as the model. This is a difficult task, since Spinoza pointedly claims that it is impossible for human beings to become completely self-determining and, thus, free men. Consequently, it is unclear what implications his claims about the free man have for us, ordinary humans. This paper takes a different approach: I will show that reading the free man as the model of human nature, while intuitively appealing, does not stand up to close scrutiny. The argument for this claim has two prongs: the first asserts that there is not sufficient textual evidence to establish that Spinoza intended the free man to serve as the model; the second asserts that this reading is impossible to reconcile with Spinoza’s other philosophical commitments. In particular, Spinoza holds that we pursue the model of human nature, as well as the general ethical goals of attaining our good and perfection, under the guidance of reason. It would be inconsistent with this claim for Spinoza’s ethics to be founded upon attaining a goal that reason reveals as unattainable and, even, confused. In addition to this negative thesis, I will also defend a positive one: the model of human nature should rather be understood as representing the greatest possible perfection of our nature as it is revealed by reason. The free man meanwhile should be understood as working toward a different goal, determining what is good and bad in the emotions. In making this claim, we offer a very different picture of Spinoza’s ethical goals, for reason shows that our nature is conatus, which is a finite mode and, as such, necessarily determined by and passive with respect to other finite modes. Consequently, a model derived from reason will represent the perfection of this nature as passive to some extent. In this way, I provide a picture of Spinoza’s ethics that takes a more sympathetic view of human weakness and vulnerability. (shrink)

I argue that a variety of influential accounts of self-knowledge are flawed by the assumption that all immediate, authoritative knowledge of our own present mental states is of one basic kind. I claim, on the contrary, that a satisfactory account of self-knowledge must recognize at least two fundamentally different kinds of self-knowledge: an active kind through which we know our own judgments, and a passive kind through which we know our sensations. I show that the former kind of self-knowledge is (...) in an important sense fundamental, since it is intimately connected with the very capacity for rational reflection, and since it must be present in any creature that understands the first-person pronoun. We use the interpretation of vague scalar predicates like small as an illustration of how systematic semantic models of dialogue context enable the derivation of useful, fine-grained utterance interpretations from radically underspeci- fied semantic forms. Because dialogue context suffices to determine salient alternative scales and relevant distinctions along these scales, we can infer implicit standards of comparison for vague scalar predicates through completely general pragmatics, yet closely constrain the intended meaning to within a natural range.

My primary purpose in this paper is to sketch a theory of doxastic oughts that achieves a satisfying middle ground between the extremes of rejecting epistemic deontology because one thinks beliefs are not within our direct voluntary control and rejecting doxastic involuntarism because one thinks that some doxastic oughts must be true. The key will be appreciating the obvious fact that not all true oughts require direct voluntary control. I will construct my account as an attempt to surpass other accounts (...) (especially those due to Feldman and Kornblith) in this vein. The new idea (in a telegraphic slogan) is that doxastic oughts are what Sellars called “rules of criticism,” which are logically distinct from but also interestingly connected to “rules of action.” The distinction provides a way to understand the phrase ‘ought to believe’ which is consistent with both doxastic involuntarism and epistemic deontology; the connection provides a novel way to incorporate a believer’s epistemic community into our understanding of the scope of epistemic obligations. While many political theorists have focused on the question of whether states have a duty to grant citizenship to noncitizens, this article examines the issues associated with the state’s withdrawal of citizenship. Denationalization powers have recently emerged as a controversial political issue in a number of liberal states, making their ethical scrutiny important. I begin by considering the historical practice of banishment and how denationalization power emerged and became consolidated in the United Kingdom and the United States in the first (...) half of the twentieth century. I then discuss the nature of liberal objections to the power. My focus next shifts to the United Kingdom’s Nationality, Immigration and Asylum Act of 2002, which attempted to create a “liberal” denationalization power. In the final section of the article, I discuss whether the Act successfully addresses liberal concerns and in so doing shed light on the possibility of reconciling liberal principles with conditional citizenship. Most ethics guidelines for distributing scarce medical resources during the coronavirus pandemic seek to save the most lives and the most life‐years. A patient’s prognosis is determined using a SOFA or MSOFA score to measure likelihood of survival to discharge, as well as a consideration of relevant comorbidities and their effects on likelihood of survival up to one or five years. Although some guidelines use age as a tiebreaker when two patients’ prognoses are identical, others refuse to consider age for (...) fear of discriminating against the elderly. In this paper, I argue that age is directly relevant for maximizing health benefits, so current ethics guidelines are wrongly excluding or deemphasizing life‐stage in their triage algorithms. Research on COVID‐19 has shown that age is a risk factor in adverse outcomes, independent of comorbidities. And limiting a consideration of life‐years to only one or five years past discharge does not maximize health benefits. Therefore, based on their own stated values, triage algorithms for coronavirus patients ought to include life‐stage as a primary consideration, along with the SOFA score and comorbidities, rather than excluding it or using it merely as a tiebreaker. This is not discriminatory because patients ought to have equal opportunity to experience life‐stages. The equitable enforcement of that right justifies unequal treatment based on age in cases when there is a scarcity of life‐saving resources. A consideration of life‐stage would thus allow healthcare workers to responsibly steward public resources in order to maximize lives and life‐years saved. (shrink)

In this paper I am going to argue that two commonly held views about perceptual experience are incompatible and that one must be given up. The first is the view that the five senses are to be distinguished by appeal to the kind of experiences involved in perception; the second is the view.

Reasoning, reading and language arts program designed to help children develop cognitive skills in a sequenced yet cumulative manner.

Some meditative experiences are reported to involve a change in the meditator’s sense of self. For instance, some practitioners of body-scan meditation report a felt dissolution of bodily boundaries and a corresponding change in their bodily sense of self. In ‘pure-consciousness-events’ some subjects report a sense of self as pure consciousness, while others report a loss of the sense of self. In this chapter, I use recent philosophical and empirical work on the phenomenal self and the variability of self-experience to (...) explore possible connections with particular types of meditative experience. In particular, I differentiate minimal subjectivity from the more complex and plastic phenomena of self-identification, self-location, and a strong first-person perspective. I discuss how certain reported meditative experiences transform key aspects of phenomenal self-experience, such as phenomenal (dis-)identification with the body, agency, spatial location, and the phenomenal field. I then discuss philosophical implications for the study of consciousness, the self, and meditation. (shrink)

If there is one doctrine distinctively associated with legal positivism, it is the separability of law and morality. Both in opposition to classical natural-law thinkers and in response to more recent theorists such as Ronald Dworkin and Lon Fuller, positivists have endeavored to impugn any number of ostensibly necessary connections between the legal domain and the moral domain. Such is the prevailing view of legal positivism among people familiar with jurisprudence. During the past couple of decades, however, that prevailing view (...) has come into question among some estimable legal positivists. In particular, Joseph Raz and his followers have queried the importance and the very tenability of an insistence on the separability of law and morality. The present article maintains that the traditional view of legal positivism is correct and that the recent skepticism about it on the part of some positivists is unfounded. When the notion of the disjoinability of law and morality is understood properly as a large array of theses, it proves to be resistant to the challenges that have been mounted against it. (shrink)

Under Any Sky: Contemporary Readings of George Santayana is a testament to the cross-cultural relevance of the work of one of the leading intellectuals of the twentieth century, George Santayana. A list of geographic origins of the twenty-two contributions contained in this volume indicates the transatlantic cultural diversity of scholarly representation: scholars variously hailing from Canada, Germany, Italy, Spain, Poland, Slovakia, and Switzerland, and from the United States, representing three of its major regions. The authors explore the major plots of (...) Santayana's thinking, including materialistic Platonism in ontology, skepticism in epistemology, rationality in social philosophy, naturalism in aesthetics, piety in materialism, and literary and poetic expression as a means to cosmic understanding. After a preface by Professor John Lachs, and an editorial introduction, the book is divided into three respective thematic parts: I. Ontology and Naturalism; II. Culture, Society, America; and III. Aesthetics, Poetry, and Spirit. Before each thematic section brief introductions of the section papers is provided to accommodate specific scholarly interests. The authors entrust the present volume to readers appreciative of the philosophic catholicity of the subject's work, invoking the book title which is taken from the preface of Santayana's mature system of philosophy, Scepticism and Animal Faith: "In the past or in the future, my language and my borrowed knowledge would have been different, but under whatever sky I had been born, since it is the same sky, I should have had the same philosophy". It is quite likely that parents will soon be able to use genetic engineering to select the sex of their child by directly manipulating the sex of an embryo. Some might think that this method would be a more ethical method of sex selection than present technologies such as preimplantation genetic diagnosis (PGD) because, unlike PGD, it does not need to create and destroy “wrong gendered” embryos. This paper argues that those who object to present technologies on the grounds that (...) the embryo is a person are unlikely to be persuaded by this proposal, though for different reasons. (shrink)

Two of the major arguments against performance-enhancing drugs (PEDs), appealing to fairness and the protection of athletes’ health, have serious flaws. First, there is no relevant moral distinction between the use of PEDs and the use of other performance enhancers that introduce unfairness and that we accept nonetheless. Second, prohibiting PEDs for athletes’ own good ignores the fact that adult athletes are constantly making tradeoffs to improve performance and pursue excellence, including sacrificing their health. We should not paternalistically impose our (...) values on them. On the other side, arguments to allow ‘safe’ PEDs provide no normative criterion to determine the acceptable level of risk, thus begging the question. The reasonable athlete argument solves both sets of problems: it justifies a ban on some performance-enhancing drugs based on health and fairness, while avoiding paternalism, and it also establishes a non-arbitrary standard to determine which drugs ought to be allowed. First, if unsafe PEDs were allowed, some athletes would refuse to take them out of concern for their health. This is a reasonable decision even though it would put them at a competitive disadvantage against athletes who choose to use unsafe PEDs. It would be unfair for clean athletes to suffer a competitive disadvantage for acting reasonably. Therefore, PEDs that pose significant health risks should be prohibited for all athletes. Second, it would be unreasonable for athletes to refuse, on principle, relatively safe and effective PEDs, so a blanket prohibition is also unjustified. Which drugs and which doses to allow should be determined not by athletes’ actual choices but by the hypothetical choices of the reasonable athlete. The resulting sport-specific drug policy would carve a justifiable middle path between complete prohibition and complete permission. (shrink)

The present paper contributes to the analysis and understanding of post-traumatic stress disorder from the perspective of Husserlian phenomenology. The particular approach taken integrates the experience of a ptsd trigger into Husserl’s descriptive framework of noematic constitution. By analyzing the constituent makeup of a particular object that acts as a trigger for ptsd symptoms, a descriptive account of how an ordinary noematic correlate becomes a pathological traumatic correlate is provided. This is done in three steps. First, the traumatic correlate is (...) shown to emerge by way of a judgment. Then, the role of the Ego will be examined to identify the point where the intentional relation between sufferer and traumatic correlate becomes pathological. Third, a phenomenological description of belief characteristics indicates the mechanism by which this pathology is maintained. I conclude by showing the connection between a phenomenological account of ptsd triggers and the current therapeutic practice of prolonged exposure therapy. (shrink)

One less obvious impact of legal bilingualism in a postcolonial jurisdiction like Hong Kong is an increasing trend of unrepresented litigants. Since their lack of legal knowledge often places them at a disadvantage and poses numerous problems in court, the government has established the resource centre for unrepresented litigants to offer them information about legal procedure. This paper evaluates the usefulness of the Chinese official reference materials at the centre in equipping laymen for civil litigation. As a first point of (...) contact between unrepresented litigants and the law, these leaflets have a direct impact on the users’ understanding of litigation procedures and their courtroom performance. This paper argues that the leaflets suffer from two major problems: incomprehensibility of language and lack of structure. Problems involved in include inconsistency in terminology, problematic translation, and language complexity arising from the use of odd collocation, unusual words, difficult legal terminology and confusing parts of speech; whereas in , information is found to be scattered and disorganised. To improve readability, the paper suggests using plain language, and providing checklists of documents, and a legal glossary. Cross-jurisdiction practices will be examined to show how unrepresented litigants’ access to justice may be facilitated. (shrink)

I outline the early Heidegger's views on mood and emotion, and then relate his central claims to some recent finding in neuropsychology. These findings complement Heidegger in a number of important ways. More specifically, I suggest that, in order to make sense of certain neurological conditions that traditional assumptions concerning the mind are constitutionally incapable of accommodating, something very like Heidegger's account of mood and emotion needs to be adopted as an interpretive framework. I conclude by supporting Heidegger's insistence that (...) the sciences constitute a derivative means of disclosing the world and our place within it, as opposed to an ontologically and epistemologically privileged domain of inquiry.
