This paper examines the situation of rurally rooted cross-border migrant workers from Myanmar during the Covid-19 pandemic. It looks at the circumstances of the migrants prior to the global health emergency, before exploring possibilities for a post-pandemic future for this stratum of the working people by raising critical questions addressed to agrarian movements. It does this by focusing on the nature and dynamics of the nexus of land and labour in the context of production and social reproduction, a view that (...) in the context of rurally rooted cross-border migrant workers necessarily requires interrelated perspectives on labour, agrarian, and food justice struggles. This requires a rethinking of the role of land, not as a factor in either production or social reproduction, but as a central component in both spheres simultaneously. The question is not ‘whether’ it is necessary and desirable to forge multi-class coalitions and struggles against external capital, while not losing sight of the exploitative relations within rural communities and the household; rather, the question is ‘how’ to achieve this. It will require a messy recursive process, going back and forth between theoretical exploration and practical politics. (shrink)

While contemporary debates about agrarian transformations that include topics like the persistence of family farms, agrarian capital accumulation, and simple reproduction squeeze remain vibrant, discussions about the increasingly significant role of migrant wage labour, which further complicates these processes, remain limited. In this paper, we argue that the process of capitalist accumulation in some sections of the agrarian and food system sectors in southern China is able to proceed despite recurring pressures — especially labour shortages in the rural economy caused (...) by domestic rural–urban migration — because of the availability of migrant workers from neighbouring countries such as Myanmar. This development dynamic can be better understood through the lens of interrelated connections between land and labour and production and social reproduction across China and Myanmar. We highlighted the role of two land-related labour flows in the agrarian transformation in southern China–Myanmar regions. We argue that various social classes and groups across China and Myanmar are tied to land, wage work and capital accumulation and, in turn, their productive and social reproductive tasks are directly and indirectly linked to one another. If we are to understand agrarian transformation in settings like this, then methodologically, we will have to adopt an interconnected approach in order to bring the pieces of the puzzle together. Most behavioral decision research takes place in carefully controlled laboratory settings, and examination of relationships between performance and specific real-world decision outcomes is rare. One prior study shows that people who perform better on hypothetical decision tasks, assessed using the Adult Decision-Making Competence (A-DMC) measure, also tend to experience better real-world decision outcomes, as reported on the Decision Outcomes Inventory (DOI). The DOI score reflects avoidance of outcomes that could result from poor decisions, ranging from serious (e.g., bankruptcy) to minor (...) (e.g., blisters from sunburn). The present analyses go beyond the initial work, which focused on the overall DOI score, by analyzing the relationships between specific decision outcomes and A-DMC performance. Most outcomes are significantly more likely among people with lower A-DMC scores, even after taking into account two variables expected to produce worse real-world decision outcomes: younger age and lower socio-economic status. We discuss the usefulness of DOI as a measure of successful real-world decision making. (shrink)

In the law, a ‘person’ is essentially the subject of rights and obligations, while a thing may be owned as property. Da análise deste, e dos dois mitos aí contidos, esperase por sua vez que estes nos possam fornecer fortes indícios não só do quadro histórico-mitológico que está por detrás de (...) toda a filosofia idealista, mas também da possibilidade de que destes mitos nasçam os primeiros frémitos da primeiríssima filosofia de Schelling. :This essay undertakes two tasks: first, to describe the differing mens rea requirements for accomplice liability of both Anglo-American common law and the American Law Institute's Model Penal Code; and second, to recommend how the mens rea requirements of both of these two sources of criminal law in America should be amended so as to satisfy the goals of clarity and consistency and so as to more closely conform the criminal law to the requirements of moral blameworthiness. Three "pure models" (...) of the mens rea requirements for complicity are distinguished, based on the three theories of liability conventionally distinguished in the general part of Anglo-American criminal law. One of these, the vicarious responsibility model, is put aside initially because of both its descriptive inaccuracy and its normative undesirability. The analysis proceeds using the other two models: that of the mens rea requirements for principal liability for completed crimes, and that of the mens rea requirements for attempt liability. Both the common law and the Model Penal Code are seen as complicated admixtures of these two models, the common law being too narrow in the scope of its threatened liability and the Model Penal Code being both too broad and too opaque in its demands for accomplice liability. The normative recommendation of the paper is to adopt the model for the mens rea of complicity that treats it as a form of principal liability, recognizing that the overbreadth of liability resulting from adoption of that model would have to be redressed by adopting a "shopkeeper's privilege" as an affirmative defense separate from any mens rea requirement. La conscience, par laquelle nous sommes présents au monde, emprunte à notre corps la triple forme des dimensions spatiales que Descartes appelait „longum, latum et profundum” ; la diversité de ces dimensions est due à la manière plus ou moins intégrale dont l'être humain s'engage dans cette présence. I. En effet, l'engagement peut se limiter à la connaissance contemplative, c.-à-d., la connaissance qui ne passe pas aux actes. L'appareil imaginaire qui sert de symbole pour exprimer cette conscience d'autrui et du (...) monde, est emprunté aux gestes peu engagés des mains et des bras, au mouvement horizontal des yeux, le reste du corps étant plus ou moins impassible. Cette manière d'être présent constitue la dimension horizontale de la largeur, dimension qui correspond avec la largeur du corps, des bras étendus, de l'horizon. L'engagement devient plus intégral quand je fais l'effort de redresser mon corps, quand je me lève pour me mettre au travail et pour surmonter les difficultés qu'implique toute réalisation technique : ici, la présence au monde n'est plus seulement connaissance elle devient, dans et par le travail, emploi des moyens et maîtrise du monde. Par cette présence plus engagée et plus complexe, la conscience constitue une seconde dimension, celle de la hauteur qui vient s'ajouter à la largeur. L'effort que je dois faire pour acquérir ou créer une valeur est comparé avec l'effort à réaliser quand je redresse mon corps ; on compare la valeur du travail et l'effort de se lever. La quantité d'argent qui représente la valeur du travail ou d'un objet est un salaire ou un prix qui „monte” ; il permet de „monter” sur l'échelle sociale, de „subordonner” autrui. Cependant, l'être de la contemplation et de l'emploi des moyens est tel que ceux-ci ne trouvent pas leur sens en eux-mêmes ; ils renvoient à la présence qui entraîne la complexité totale de la personne humaine, au sens que l'homme cherche par la totalité de son engagement. L'attention à la vie, l'inclination vers le bien qui nous attire constitue une troisième dimension, celle du lointain. Le geste du corps qui représente cette attention est la marche en avant ; il est entamé par la „conversion”, le geste de l'homme qui détourne la face de ce qu'il déteste, pour la diriger vers ce qui l'attire il se prolonge dans le rapprochement, le mouvement qui fait disparaître les distances. II. La réflexion sur la structure respective des ces dimensions peut nous aider à mieux entrevoir le sens et la structure du langage humain. En effet, celui-ci est un comportement, un ensemble structuré de mouvements corporels : les modifications du visage, les mouvements du bras, la ligne des attitudes corporelles sont les gestes par lesquels l'intériorité, la transcendance ou l'intentionalité de l'homme se fait être-avecautrui. Le langage n'est pas seulement moyen de communication ; il est encore accès à l'intériorité et à la transcendance d'autrui. On devient homme en apprenant à structurer les mouvements corporels qui constituent le langage. III. Ceci ne veut pas dire qu'en analysant le langage on explore la totalité de l'être humain. La vie elle-même, dans laquelle les dimensions corporelles trouvent leur origine et à la laquelle elles doivent leur constitution, ne parvient jamais à exprimer dans le langage la totalité de ce qu'elle est. Most analysts agree that democratic theorists have not offered a persuasive answer to the question of how the boundaries of a demos, a democratic people, should legitimately be defined. Some contend that boundaries should be maintained in ways that preserve sufficient sense of common identity to sustain support for redistributive policies. Many others endorse the “principle of all affected interests,” but it has been widely criticized as unrealistically destructive of too many existing community boundaries. This essay argues for an alternative (...) “principle of constituted identities.” It holds that, subject to certain important qualifications, modern constitutional democracies, at least, are morally obligated to extend the option of full membership to all those whose identities have been substantially constituted through such regimes’ coercive policies. Consequentialists insist there is no rational basis for distinguishing between determinate victims and indeterminate victims. Whether it's a child drowning at our feet or needy communities abroad, our reason to help is the same. Experimental data indicate, however, that we regularly make such distinctions. In this article, I show that there are indeed persuasive normative grounds for preserving this distinction. When potential beneficiaries are determinate, they have a special claim on us grounded in fairness. RESUMO Seguindo a elevação de outros dons naturais do espírito humano a categorias ou princípios estéticos, o que ocorreria gradualmente durante o século XVIII, o génio e as suas várias problemáticas tornam-se uma das mais prementes questões na agenda filosófica da época. Entre outros, a questão assume particular relevância na filosofia de Immanuel Kant, e isso não apenas na sua obra publicada, mas também na sua actividade como Professor. O presente texto propõe-se abordar a questão do génio nas lições de (...) antropologia do filósofo, e, tomando isto como ensejo, cumprir dois objectivos centrais: em primeiro lugar, traçar uma brevíssima história do conceito desde o século XVII até Kant, a fim de perceber que emprego desta faria o filósofo, e como ele próprio se associa ou dissocia desta. Segundo, compreender o modo como, dada a sua percepção histórica do termo, a teoria do génio em Kant trilha um curso singular, distinto em relação ao dos seus contemporâneos, e que faz com que o génio ostente uma posição central no seio da sua própria teoria; pois, na visão de Kant, o génio não só desempenha um importante papel como mediador das faculdades do ânimo humano, como é ainda peça indispensável na boa proporção entre estes e na insuspeitada produção de conhecimento por isto gerada. ABSTRACT Following the ascension of other natural gifts of the human spirit to the condition of categories or aesthetic principles, which would occur gradually during the 18th century, the topic of genius and its various issues becomes one of the most important questions in the philosophical agenda of the time. Among others, the question assumes particular relevance in Immanuel Kant's philosophy, not only in his published work, but also in his activity as a professor. The following text intends to approach the question of genius in the philosopher's Lectures on Anthropology, and taking the latter into account, to fulfil two central objectives: first, to etch a brief history of the concept from the 17th century until Kant, so as to realize what use Kant would make of this evolution, and how he himself associates or dissociates from it. Secondly, we intend to understand how Kant's theory of genius describes its own singular course, different from the ones of his contemporaries, and renders the genius a central piece within his own theory; for, in Kant's view, the genius not only plays an important role as mediator of the faculties of the spirit, but it is also an indispensable factor in the proportion between the latter, and in the unsuspected production of knowledge thus generated.
