The connection between fear, law and the state is a topic that is given particular attention in times of social insecurity. Some approximations are explored here under the notion of fear constitutions. We are equal in fear of one another, which is why fear can be understood as a condition of modern constitutions. However, the social contract does not lead to freedom from fear, but rather fear shifts; the legal subjects remain subjects of fear, in relation to one another, but (...) in particular towards that multiple artificial person which the state comes to embody as it takes on a life of its own. The degree of fear varies with the degree of unpredictability and indeterminacy of executive action. State measures against terrorism or against the pandemic are often an unpredictable response to an unknown danger and are therefore at the same time both an expression of fear and its trigger. It would be helpful if there was a clear distinction between sensible and unreasonable, functional and dysfunctional forms of fear. Freud tried to provide criteria with his concept of neurotic fear, a concept that has been taken up in political and legal philosophy. However, the concept is obscure and cannot be used without normative specifications. (shrink)

Der Sinn der Rede von Zweck und Wittel wird bestimmt als Angabe von Argumentationsstrategien, dies in Abhebung von inhaltlicher Begründung. Kritisiert wird die Bindung des Zweckbegriffs an die Wirkung von Handlungen, die Meinung, Zweck und Mittel seien verschiedene Arten von Gegenständen, die mangelnde Differenzierung zwischen Zweck und Ziel. Den Abschluß bildet eine Analyse des Begriffs der Zweckrationalität.

In _The History of the Race Idea: From Ray to Carus,_ Eric Voegelin places the rise of the race idea in the context of the development of modern philosophy. The history of the race idea, according to Voegelin, begins with the postChristian orientation toward a natural system of living forms. In the late seventeenth century, philosophy set about a new task--to oppose the devaluation of man's physical nature. By the middle of the eighteenth century the effort of philosophy was to (...) place man, with his variety of physical manifestations throughout the world, within a systemic order of nature. Voegelin perceives the problem of race as the epitome of the difficulties presented by this new theoretical approach. Part I covers the development of race theories from the English naturalist John Ray to Blumenbach and Kant. Voegelin, anticipating fairly recent genetic insights, explains that human beings must be seen as one speciesdifferent races must not be interpreted as emerging from separate species. In Part II, Voegelin discusses the evolution of the concepts of the body, the organism, and the person. The finite image of the person as a body-mind unit in which body is equal to mind in value provides the basis for Carl Gustav Carus' theory of race, the first significant racial ideology, in Voegelin's estimation. Voegelin's complex analysis levels a scathing critique at Nazi pretensions. He writes: "Compared to its classical form, the current condition of race theory is one of decay.... [T]hese men, with no eyes for the brilliance of the German spirit, want to interfere in human relations and ultimately presume to explicate the German nation to us and to the world--an undertaking with evil consequences.... [The] great thinkers of the past would have been orrified at somebody finding in himself all the traits of the Nordic race with the help of a book on anthropology and then imagining himself to be somebody special who does not have to do anything else. "Let us now take a look at contemporary race theory--we will see an image of destruction.... It is a nightmare to think that we should recognize the people whom we follow and whom we allow to come near us not by their looks, their words, and their gestures, but by their cranial index." Ultimately, Voegelin dismisses any attempt to reduce the human being--his existence, appearance, or actionsto a lower level: "Man as mind-body and historical substance cannot be 1explained' by an element that is less than man himself.". In what follows, I will concentrate on the type of temporality which structures Wittgenstein's method of a perspicuous representation, or of a synoptic overview (übersichtliche Darstellung). I will argue that the temporal order which applies to (giving) a perspicuous representation is best to be described as retroactivity, deferred action or afterwardness (Nachträglichkeit), a concept which calls into question the ordinary conception of time as a linear and irreversible process as well as of a clear break between present and past. First, (...) I will turn to Sigmund Freud and the way he developed the concept of Nachträglichkeit or retroactivity in some of his case-studies. The basic idea here is that the meaning or content of a past experience is constituted by repeating it in a different or disguised way. I will then argue that the relation between a perspicuous representation and what is made perspicuous is best interpreted as a relation of Nachträglichkeit. This interpretation also accounts for the involvement of the subject in the object made perspicuous—as it is stressed by Wittgenstein and illustrated by his discursive method. (shrink)

A "philosophy of the republic," as developed in this volume's (...) contributions, shows that the current "dominance of the democratic" falls short of accounting for the independent significance to the republican self-organisation of state and society. For years, attempts at ensuring the social sustainability of digital solutions have focused on ensuring that they are perceived as helpful and easy to use. A smooth and seamless work experience has been the goal to strive for. Based on document analysis and interviews with 15 stakeholders, we trace the setting up of a data infrastructure in Danish General Practice that had achieved just this goal – only to end in a scandal and subsequent loss of public support. The ease (...) of data access made it possible for data to be extracted, exchanged and used by new actors and for new purposes – without those producing the data fully realizing the expansion of the infrastructure. We suggest that the case has wider relevance for a still more data-intensive healthcare sector and a growing data economy: when those who produce the data are not made aware of new uses of data, it makes it more difficult to resolve potential conflicts along the way. In the Danish case, conflicting views on legitimate data use led to the collapse of the infrastructure. Therefore, while seamlessness may be a solution to the old problem of a poor fit between user and technology, this celebrated virtue may also involve new problems relating to social instability. As digital solutions tend to be integrated still more seamlessly in still more of our activities, we need to develop political mechanisms to define and protect the rights and obligations of both data suppliers and users in order to ensure the long-term sustainability of digital infrastructures. Aristoteles’ Traktat De anima untersucht die Natur der Seele. Unter ›Seele‹ ist dabei jedoch nicht das subjektive Zentrum unseres mentalen Lebens zu verstehen, sondern dasjenige Prinzip, dessen Vorhandensein lebendige von leblosen Körpern unterscheidet. Es umfasst alle Formen des Lebendigen, also pflanzliches, tierisches und menschliches Leben. Ziel der Schrift ist es, die Seele zu definieren, d.h. zu erklären, was es für diese Formen des Lebendigen jeweils heißt, lebendig zu sein. Diskutiert werden: der vegetative Selbsterhalt, Wahrnehmung, menschliches Denken sowie die Ortsbewegung der (...) Lebewesen. De anima gehört zu den faszinierendsten, philosophisch lohnendsten, aber auch schwierigeren Schriften des Aristoteles. Die zweisprachige Studienausgabe bietet eine vollständige Neu­übersetzung. Benutzt wird die Edition des griechischen Textes von Aurelius Förster (Budapest 1912), von der sich die heutzutage sehr verbreitete Ausgabe von W. D. Ross textkritisch hat leiten lassen (OCT 1956 und 1971). Sie ist auch durch die späteren Ausgaben von Siwek (Rom 1965) und Jannone (Paris 1966) nicht ersetzt. Eine Einleitung führt in die Grundlagen und Voraussetzungen der aristotelischen Seelenlehre ein und gibt einen Überblick über den Gedankengang der Schrift. Der Kommentarteil ist so knapp wie möglich gehalten. Im Anhang sind ein Glossar und ein Verzeichnis der Abweichungen von der Ausgabe von Ross beigefügt. (shrink)
