In this issue of JCE, Douglas Diekema argues that the best interest standard (BIS) has been misemployed to serve two materially different functions. On the one hand, clinicians and parents use the BIS to recommend and to make treatment decisions on behalf of children. On the other hand, clinicians and state authorities use the BIS to determine when the government should interfere with parental decision-making authority. Diekema concedes that the BIS is appropriately used to “guide” parents in making medical treatment (...) decisions for their children. But he argues that the BIS is inappropriately used as a “limiting” standard to determine when to override those decisions. Specifically, Diekema contends that the BIS “does not represent the best means for determining when one must turn to the state to limit parental action.” He argues that this limiting function should be served by the harm principle instead of by the BIS.I contend that we should not reassign the BIS’s limiting function to the harm principle. In this article I make two arguments to support my position. First, the BIS has effectively served, and can serve, both guiding and limiting functions. Second, the harm principle would be an inadequate substitute. It cannot serve the limiting function as well as the more robust BIS. (shrink)

Arguing that every scientific concept and theory—including his own—is culturally conditioned, Fleck was appreciably ahead of his time. And as Kuhn observes in his foreword, "Though much has occurred since its publication, it remains a brilliant and largely unexploited resource." There is a deep tension between liberalism and retributivism. On the face of it, one cannot coherently believe liberalism about the fundamental purpose of the state and retributivism about the basic end of legal punishment, given widely held and well-motivated or what I call ‘standard’ conceptions of these views. My aims in this article are to differentiate the types of conflict between liberalism and retributivism, to identify the strongest and most problematic type of conflict between them, to demonstrate that existing (...) strategies in the literature that might be invoked to resolve this conflict fail, and to present a new, conclusive way to resolve it. The solution lies in changing the standard conception of liberalism, which change, I argue, is warranted on independent grounds. Liberalism, up to now, has been conceived in a way that fails to best capture liberal intuitions. Upon improving our understanding of what liberal purposes essentially are, it becomes clear that retributive punishment is not merely logically consistent with them, but also partially constitutive of them. Henry Richardson has recently published the first book ever devoted to ancillary care obligations, which roughly concern what medical researchers are morally required to provide to participants beyond what safety requires. In it Richardson notes that he has presented the ‘only fully elaborated view out there’ on this topic, which he calls the ‘partial-entrustment model’. In this article, I provide a new theory of ancillary care obligations, one that is grounded on ideals of communion salient in the African philosophical tradition (...) and is intended to rival and surpass Richardson’s model, which is a function of Western considerations of autonomy. Many philosophers and laypeople have the following two intuitions about legal punishment: the state has a pro tanto moral reason to punish all those guilty of breaking a just law and to do so in proportion to their guilt. Accepting that there can be overriding considerations not to punish all the guilty in proportion to their guilt, many philosophers still consider it a strike against any theory if it does not imply that there is always a supportive moral reason to (...) do so. In this paper, I demonstrate that censure theory accounts for these intuitions much better than any other theory, including forms of retributivism such as desert theory and fairness theory, and explain why censure theory is able to do so. I critically discuss contemporary work in African, i.e., sub-Saharan, political philosophy that has been written in English. I begin by providing an overview of the profession and discussing the aptness of focusing on African political philosophy as a distinct topic. Next, I highlight discussions that should be of interest to a political philosopher working anywhere in the world, focusing on ideas characteristic of the sub-Saharan region that are under-appreciated not merely for the purpose of comparative ethics, but also for substantive (...) ethical argumentation. In particular, I take up fascinating and underexplored approaches to political power, civil liberties and economic goods that are characteristic of this tradition. (shrink)

Our aims are to articulate some core philosophical positions characteristic of Traditional African Religion and to argue that they merit consideration as monotheist rivals to standard interpretations of the Judeo-Christian-Islamic tradition. In particular, we address the topics of how God’s nature is conceived, how God’s will is meant to bear on human decision making, where one continues to exist upon the death of one’s body, and how long one is able to exist without a body. For each of these topics, (...) we note how Traditional African Religion posits claims that clash with mainstream Judaism, Christianity, and Islam and that, being prima facie plausible, indicate the need for systematic cross-cultural philosophical debate. In this article I draw on resources from the African philosophical tradition to construct a theory of human rights grounded on dignity that presents a challenge to the globally dominant, autonomy-based approach. Whereas the latter conceives of human rights violations as degradations of our rational nature, the former does so in terms of degradations of our relational nature, specifically, our capacity to be party to harmonious or friendly relationships. Although I have in the past presented the basics of the Afro-relational (...) approach, in this article I defend it from objections and also go on the offensive by arguing that understanding the human rights violations of torture and rape to be (roughly) behavior that treats innocent parties in an extremely discordant or unfriendly way is, if not more plausible than standard Kantian understandings, then at least a promising alternative to them. A communitarian perspective, which is characteristic of African normative thought, accords some kind of primacy to society or a group, whereas human rights are by definition duties that others have to treat individuals in certain ways, even when not doing so would be better for others. Is there any place for human rights in an Afro-communitarian political and legal philosophy, and, if so, what is it? I seek to answer these questions, in part by critically exploring one of the most (...) influential theoretical works on human rights in a sub-Saharan setting, namely, Claude Ake’s ‘The African Context of Human Rights’. Ake famously maintains that a typically Western approach to rights is inappropriate in the sub-Saharan region, in two major respects. First, Ake contends that although a human rights legal framework might be suitable for an ‘individualistic’ society, it is not for one of the sort common among traditional black peoples, for whom group rights are alone apt. Second, Ake maintains that, insofar as rights are relevant, rights to socio-economic goods are of much more importance in an African context than rights to civil liberties, due process and the like. Using Ake’s article as a foil, I draw on values salient in sub-Saharan moral worldviews to construct a unified philosophy of rights that not only provides reason to doubt his two claims, but also offers a promising way to reconcile a communitarian framework with a robust prizing of human rights alongside ones that are more collectively oriented. I consider whether a vitalist axiology, widely accepted in the African philosophical tradition, especially among religionists, can make adequate sense of evil, understood as what is bad in itself. I provide an important reason for thinking that it cannot, which African philosophers of religion and ethicists have yet to address. The reason is that a vitalist approach must construe evil as the reduction or other lack of vitality, while some evil conditions, such as cancer or torture, cannot be adequately understood (...) in those terms. Some bad states consist of the presence of an undesirable condition and not merely the absence of a desirable condition such as vitality. After replying to some responses on behalf of vitalism, I conclude that it cannot fully account for why evil might be a problem for God’s existence or for how to understand the quality of human life, and I also sketch some other avenues African philosophers might take that are more promising. Strategies for reducing the effect of climate change have regularly been made without experimental foundations and adequate information on farmers’ vulnerability to climate change in the study area. Thus, integrated farmers’ vulnerability assessment approach was employed by classifying socioeconomic and biophysical indicators of vulnerability into adaptive capacity, sensitivity and exposure to determine (...) the farmers’ vulnerability to climate change. This is based on the Intergovernmental Panel on Climate Change’s definition of vulnerability. The study adopted a survey design and the method utilized for the study was questionnaire administered to 400 households in the study area. The results indicate that the farmers’ vulnerability was low in zone A with a mean index of 2.86, very low in zone B with a mean index of 3.74, and high in zone C with a mean index of 1.95. It is recommended that measures should be taken to integrate climate change adaptation into Niger State development process. These measures should include improvement in adoption of good agricultural practices. (shrink)

seek to answer questions about work-based education (WBE) that have been rarely posed, ethical ones such as: Is there reason to believe that WBE would tend to make better people (as opposed to make people better off)? That is, can we reasonably expect characteristic WBE learners to exhibit good character to a greater degree relative to non-WBE ones? On a social level, would systematic use of WBE noticeably promote justice, say, by effecting the right sort of reparation to those who (...) have suffered from colonialism or exploitation? I begin to answer these questions first by presenting an overview of traditional black African societies, noting that WBE has been the dominant mode of learning in them. Then, to show that WBE has relevance for contemporary societies, I articulate a communitarian moral theory grounded in mores that have been salient among sub-Saharan peoples, differentiating it from the Western theories more familiar to international readers and motivating them to take it seriously as relevant to moral enquiry in today’s world. Next, I apply this Afro-communitarianism to WBE, enquiring into its prospects for fostering individual character and social justice, particularly in the Global South. (shrink)

Influential moral theories in the contemporary West face problems making sense of the conflict between the interests of animals and people’s interests in culture. They have trouble explaining either the existence of strong direct duties to animals or the importance of people’s right to culture (and frequently both). In this chapter I aim to advance a relational ethic, grounded on the African philosophical tradition, that offers a promising alternative. I contend that duties toward animals and rights to culture are potentially (...) conflicting normative branches springing from the common root of a demand to prize communal relationship. In addition to showing that communion makes good sense of the strength of some direct duties to animals and the moral significance of culture, I argue that it accounts well for how to understand the way in which they can clash and how to address it practically. I examine John Rawls' objection to libertarianism that it permits economic shares to be distributed in a morally arbitrary way. This argument was dropped largely for two reasons. First, talk of "arbitrariness" has been vague and associated with implausible views about moral desert, collective assets, and noumenal selves. Second, several criticisms which Robert Nozick made 25 years ago have gone unanswered. In this essay, I reconstruct the arbitrariness argument, giving it a new, Kantian interpretation, and I show that the new (...) version is intuitively plausible and avoids Nozick's major objections. In my view, postmodernism, as a cluster of bold epistemological claims, foundered on the rocks of contemporary science. Many postmodern positions about knowledge have conflicted with views of science that are extraordinarily difficult to doubt, which in this short article (composed to honour Educational Philosophy and Theory's 50th anniversary), I point out and argue holds a lesson about how to undertake the philosophy of education.

I critically discuss respects in which conceptions of community have featured in African moral-political philosophy over the past 40 years or so. Some of the discussion is in the vein of intellectual history, recounting key theoretical moves for those unfamiliar with the field. However, my discussion is also opinionated, noting prima facie weaknesses with certain positions and presenting others as more promising, particularly relative to prominent Western competitors. There are a variety of forms that African communitarianism has taken and could (...) take in respect of moral status, good character, and just policy, and my aims include arguing that some are more plausible than others and should give more individualist thinkers in Euro-American traditions pause. In this article, I expound and assess two theories of meaning in life informed by the indigenous sub-Saharan African philosophical tradition. According to one principle, a life is more meaningful, the more it promotes community with other human persons. According to the other principle, a life is more meaningful, the more it promotes vitality in oneself and others. I argue that, at least upon some refinement, both of these African conceptions of meaning merit global consideration from philosophers, but that the (...) vitality approach is more promising than the community one for capturing a wider array of intuitions about what confers meaning on a life. I further argue, however, that there are objections that apply with comparable force to both theories; neither one does a good job of entailing that and explaining why certain types of reason and progress can make a life more meaningful. Although these objections are characteristic of a ‘modern’ western outlook, I maintain that they are difficult for contemporary African philosophers to ignore and consider some ways they might respond to the objections. This chapter supposes that certain bads are necessary for substantial goods, and poses the question of how one ought to react emotionally to such bads. In recent work, Robert Adams is naturally read as contending that one ought to exhibit positive emotions such as gladness towards certain ‘necessary evils’. A rationale he suggests for this view is that love for a person, which involves viewing the beloved as good, requires being glad about what is necessary for her to exist, even (...) if it is something bad such as a war that should be hated considered apart from being required for her existence. I critically discuss this argument, aiming to enrich understanding of the implications of the normativity of love for proper emotions towards necessary evil. (shrink)

In Menkiti’s Moral Man, Oritsegbubemi Oyowe aims to provide a sympathetic interpretation of the works of Ifeanyi Menkiti as they address personhood, community, and other facets of morality. In my contribution I maintain that, while Oyowe’s Menkiti is more plausible than the way Menkiti has often been read, there are still respects in which the account of personhood advanced invites criticism. One criticism is that it is implausible to think that personhood is constituted by others recognizing one as a person. (...) Instead, insofar as community constitutes one’s personhood, it is insofar as one lived up to norms of interpersonal morality. A second criticism is that there are intuitively some dimensions of personhood that are not constituted by the community or other-regard at all. In particular, I argue that there are moral duties to oneself that exist and that are not well captured by any sensible understanding of the view that community alone constitutes personhood, such that part of what it is to be a full person is to treat oneself in certain ways. In sum, personhood, while admittedly social, is not as social as Oyowe’s Menkiti believes. (shrink)

Can a state seek to promote a thick conception of the good (such as fostering a kind of meaning or excellence in people's lives) without treating its citizens disrespectfully? The predominant answer among friends of the principle of respect for persons is "no." The most powerful Kantian objection to non-liberalism or perfectionism is the claim that citizens who do not share the state's conception of the good would be wronged in that the state would treat a certain way of life (...) as more important than its citizens' capacities to choose their own ways of life. I sketch a new non-liberal principle for political decision-making and show that, unlike other forms of non-liberalism, it is not vulnerable to this major respect-based objection. 'Open perfectionism' is the view that state enforcement of a conception of the good favoured by the majority is permissible if and only if the minority has the substantial ability to avoid the territory in which the conception of the good is enforced. I argue that it is a realistic possibility for some non-liberal states to provide a fair opportunity to their dissenters to avoid the imposition of non-liberal policies and that the Kantian liberal's central complaint would not apply to non-liberal states if they were to provide such an opportunity. The principle of respect for persons grounds the most influential argument for liberalism, and so showing that open perfectionism is consistent with liberal intuitions about free choice promises to help to transcend the long-standing conflict between non-liberalism and Kantian liberalism. This issue’s “Legal Briefing” column covers recent legal developments involving voluntarily stopping eating and drinking (VSED). Over the past decade, clinicians and bioethicists have increasingly recognized VSED as a medically and ethically appropriate means to hasten death. Most recently, in September 2013, the National Hospice and Palliative Care Organization (NHPCO) called on its 2,000 member hospices to develop policies and guidelines addressing VSED. And VSED is getting more attention not only in healthcare communities, but also in the general public. For (...) example, VSED was recently highlighted on the front page of the New York Times and in other national and local media. Nevertheless, despite the growing interest in VSED, there remains little onpoint legal authority and only sparse bioethics literature analyzing its legality. This article aims to fill this gap. Specifically, we focus on new legislative, regulatory, and judicial acts that clarify the permissibility of VSED. We categorize these legal developments into the following seven categories: 1. Concomitant with the rise of rationalizing accountability in higher education has been an increase in theoretical reflection about the forms accountability has taken and the ones it should take. The literature is now peppered by a wide array of distinctions (e.g. internal/external, inward/ outward, vertical/horizontal, upward/downward, professional/public, political/economic, soft/ hard, positive/negative), to the point that when people speak of ‘accountability’ they risk speaking past one another, having some of these distinctions in mind and not others. Furthermore, often these distinctions are (...) vague and cross-cut each other in ways that are as yet unclear. The field could benefit from having a comprehensive framework in which to place these distinctions and to view their relations. My aim in this article is to provide an analytical tool by which to classify important debate about what accountability in higher education has been and ought to be. Beyond organizing such debate, this schema will serve the purposes of revealing ambiguities in terms, conflations of ideas, assumptions that warrant questioning, and gaps in present research agendas. In this chapter I articulate and defend a basic principle capturing the underlying structure of an attractive sort of national reconciliation that accounts for a wide array of disparate judgments about the subject. There are extant theories of national reconciliation in the literature, most of which are informed by Kantian, liberal-democratic and similar perspectives. In contrast to these, I spell out a theory grounded on a comparatively underexplored sub-Saharan ethic. My foremost aim is to demonstrate how African ideals about communal (...) relationship, still largely unfamiliar to an international audience, do a promising job of providing a unified foundation for the roles of truth-telling, apology, forgiveness, compensation, amnesty and related practices often associated with national reconciliation. For the more than a decade, I have advanced an account of what makes persons, animals, and other beings entitled to moral treatment for their own sake that is informed by characteristically African ideas about dignity, a great chain of being, and community. Roughly according to this account, a being has a greater moral status, the more it is capable of communing (as a subject) or of us communing with it (as an object). I have mainly argued that this characteristically (...) African and relational approach to moral status is a better account than salient Western approaches, especially individualist views associated with utilitarianism and Kantianism. Over the years, several commentators have raised criticisms of my approach, including that it objectionably: entails that we may rightly dominate mentally incapacitated human beings; prioritizes mentally incapacitated human beings over animals with similar cognitive abilities without sufficient justification; entails that intelligent aliens lack moral status; cannot make sense of our duties towards the dead; and is unable to account for the standing of species as distinct from their members. In this chapter I provide a comprehensive response to these and related objections, defending the initial account as an attractive way to understand what makes a being matter morally for non-instrumental reasons. Elsewhere I have contended that if a God-centred account of meaning in life were true, it would not be because meaning comes from fulfilling God’s purpose for us. Specifically, I have argued that this ‘purpose theory’ of life’s meaning cannot be the correct God-based view since God would have to be atemporal, immutable, and simple for meaning to logically depend on His existence, and since such a being lacking extension could not be purposive. Jacob Affolter has developed a fresh account (...) of the kind of purpose that is necessary for meaning in life, has argued that a God without extension could ground it, and has also provided some tentative reason to believe that only such a God could do so. I respond in three ways: by questioning whether the sort of purpose Affolter thinks is necessary for meaning in fact is; by arguing that an extensionless God could not ground it; and by indicating the way that a purely physical world could.
