While Specific Informed Consent has been the established standard for obtaining consent for medical research for many years, it does not appear suitable for large-scale biobank and health data research. Thus, alternative forms of consent have been suggested, based on a variety of ethical background assumptions. This article identifies five main ethical perspectives at stake. Even though Tiered Consent, Dynamic Consent and Meta Consent are designed to the demands of the self-determination perspective as well as the perspective of research as (...) a public good, they are still also criticized from both perspectives. In addition, criticisms based on concerns of justice, participation and democratic deliberation, and relational concerns have been levelled at each of the models. As all of these perspectives have valid points to make, the task at hand lies in balancing these ethical perspectives. What constitutes an adequate balancing depends on contextual factors. These factors include digital infrastructure and digital literacy, data safety regulation, good scientific and clinical practice, transparent debates on ethically relevant features of research, social inequalities, anti-discrimination laws and practices, trust in health care institutions and recognition of patient preferences, and consensus on unethical research. We argue that the role of context in determining acceptable models of consent puts the ethical importance of models of consent into perspective. Since altering contextual factors can help to live up to the ethical concerns at stake in debates about models of consent, opting for such a shift of focus comes without ethical loss. (shrink)

In recent work, E. J. Lowe presents an essence-based account of our knowledge of metaphysical modality that he claims to be superior to its main competitors. I argue that knowledge of essences alone, without knowledge of a suitable bridge principle, is insufficient for knowing that something is metaphysically necessary or metaphysically possible. Yet given Lowe's other theoretical commitments, he cannot account for our knowledge of the needed bridge principle, and so his essence-based modal epistemology remains incomplete. In addition to that, (...) Lowe's account implies a psychologically unrealistic reconstruction of how we ordinarily acquire knowledge of metaphysical modalities. The discussion of Lowe's suggestive essence-based account is also intended as a case study that illustrates a more general problem in the epistemology of modality: the great difficulty of explaining our modal knowledge in terms of a single overtly nonmodal kind of knowledge. The failure of Lowe's account suggests that such a sweeping reductive explanation of our modal knowledge might simply not be available. This should be good news for those philosophers who champion less reductive or more pluralistic accounts of our modal knowledge. (shrink)

Given the rich diversity of research fields usually ascribed to chemistry in a broad sense, the present paper tries to dig our characteristic parts of chemistry that can be conceptually distinguished from interdisciplinary, applied, and specialized subfields of chemistry, and that may be called chemistry in a very narrow sense, or 'the chemical core of chemistry'. Unlike historical, ontological, and 'anti-reductive' approaches, I use a conceptual approach together with some methodological implications that allow to develop step by step a kind (...) of cognitive architecture for chemistry, which basically contains: (1) systematic chemical knowledge on the experimental level; (2) clarification of chemical species; (3) chemical classification systems; (4) theoretical foundation through the chemical theory of structural formulas. Diese Studie greift die klassische philosophische Frage nach den Grenzen unseres Wissens auf und analysiert kritisch aktuell diskutierte Argumente, welche die Begrenztheit unseres Wissens erweisen sollen. Im Zentrum stehen dabei drei Argumentationsansätze: Zunächst geht es um Komplexitätsgrenzen des Wissens, wie sie G. Chaitin mit seiner algorithmischen Informationstheorie aufzeigen will. Dann wird auf Präzisionsgrenzen des Wissens eingegangen, die sich aus der epistemischen Theorie der Vagheit (T. Williamson u.a.) ergeben. Schließlich werden Grenzen unserer Selbsterkenntnis erörtert. Dabei geht es um verschiedene Argumente für (...) die Unerforschlichkeit des menschlichen Geistes bzw. für die Unlösbarkeit des Leib-Seele-Problems, wie sie von C. McGinn oder im Rahmen der erkenntnistheoretischen Deutung von K. Gödels Unvollständigkeitssätzen vorgeschlagen wurden. Während diese Ansätze Fragen aufwerfen sollen, deren Antworten uns kognitiv unzugänglich sind, verteidigt das Buch eine alternative Sicht, die derjenigen des späten Wittgenstein ähnelt: In den meisten Fällen handelt es sich aufgrund semantischer Unbestimmtheit nur um scheinbare Fragen in dem Sinne, dass wir sie einfach deshalb nicht beantworten können, weil sie keine Antworten besitzen. One way of coping with agreement of features in French is to perform two parallel computations, one in the free pregroup of syntactic types, the other in that of feature types. Technically speaking, this amounts to working in the direct product of two free pregroups.

Discussions of reproducibility are casting doubts on the credibility of experimental outcomes in the life sciences. Although experimental evolution is not typically included in these discussions, this field is also subject to low reproducibility, partly because of the inherent contingencies affecting the evolutionary process. A received view in experimental studies more generally is that standardization (i.e., rigorous homogenization of experimental conditions) is a solution to some issues of significance and internal validity. However, this solution hides several difficulties, including a reduction (...) of external validity and reproducibility. After explaining the meaning of these two notions in the context of experimental evolution, we import from the fields of animal research and ecology and suggests that systematic heterogenization of experimental factors could prove a promising alternative. We also incorporate into our analysis some philosophical reflections on the nature and diversity of research objectives in experimental evolution. (shrink)

Within this paper we consider a model of Nash bargaining with incomplete information. In particular, we focus on fee games, which are a natural generalization of side payment games in the context of incomplete information. For a specific class of fee games we provide two axiomatic approaches in order to establish the Expected Contract Value, which is a version of the Nash bargaining solution.

According to the view that humans are conscious automata, the experience of conscious will is illusory. Epistemic theories of causation, however, make room for causal will, planned behavior, and moral action.

This paper seeks to examine the relation between Kant’s aesthetic theory and the philosophy of Enlightenment. My study will focus on two central aspects from the Critique of Judgment: In connection with the Analytic of the Sublime, I will argue that Kant’s discussion of the concept enabled the development of the opinion that experiencing the specifically modern artistic beauty works as a means to equip us with an awareness of ourselves as beings equipped with reason. The second aspect I want (...) to discuss is that of the aesthetic ideas. I will show that in the Third Critique, the idea of experiencing artistic beauty functions as a compensation for the pressure of rationality that sets in together with modernity in the 18th century. In social dilemmas, expectations of reciprocity can lead to fully determined cooperation concurrent with the illusion of choice. The choice of the dominant alternative (i.e., defection) may be construed as being free and rational, but only at the cost of being incompatible with a behavioral science claiming to be deterministic.

The mother sacrificing herself while rescuing someone else's child is a red herring. Neither behaviorism nor cognitivism can explain it. Unlike behaviorism, however, the cognitive process of projection can explain cooperation in one-shot social dilemmas.

Grammar can be formulated as a kind of substructural propositional logic. In support of this claim, we survey bare Gentzen style deductive systems and two kinds of non-commutative linear logic: intuitionistic and compact bilinear logic. We also glance at their categorical refinements.

The old controversy between Legal Positivism and Natural Justice turns out to be fruitless, if we comprehend law as a phenomenon of culture. Then, law is neither mere will nor mere reason. Law, as it is understood in the Western tradition, is rather a contingent system of rules which guides decisions (politics, on the other hand, are guided by aims). Culture, as it is conceived since the age of Enlightenment, can be described as “what results from autonomy”. Law being a (...) valuable phenomenon of culture (Kulturgut), two questions arise. (1) Is there any need for law? It depends on society’s demand for liberty. (2) What does the law need? Law requires autonomy, i.e., the right to enjoy its own culture.Resumen:La antigua controversia entre el positivismo jurídico y la justicia natural resulta estéril si comprendemos al derecho como un fenómeno de la cultura. Consecuentemente, el derecho no es mera voluntad, ni tampoco razón pura. El derecho, como se entiende en la tradición occidental, es más bien un sistema contingente de reglas para la decisión (la política, en cambio, se guía por objetivos). La cultura, tal como es concebida des- de la época de la Ilustración, puede describirse como “aquello que es resultado de la autonomía”. Der Beitrag kommt zuerst auf den Ursprung des Begriffs des Supererogatorischen zu sprechen. Er erörtert die Entwicklung des Gegensatzspaars praeceptum und consilium in der Antike und im Mittelalter. Der Begriff des Supererogatorischen und in seiner Folge der des consilium wird in der Reformation verworfen. An die Stelle der Unterscheidung von praeceptum und consilium tritt die Unterscheidung von vollkommenen und unvollkommenen Pflichten. Diese letztere Unterscheidung findet sich schon in der Antike. Nach der Reformation wird sie wiederbelebt. Die Kritik der Differenz von (...) vollkommenen und unvollkommenen Pflichten führt schließlich, über die Unterscheidung von verdienstlichen und schuldigen Pflichten, zu Kants Unterscheidung von juridischen und ethischen Gesetzen. In einer gewissen Weise läßt Kants Moralphilosophie Raum für supererogatorisches Verhalten. Eine verbreitete Kant-Interpretation bezieht den Begriff des Supererogatorischen auf das Ganze der ethischen Gesetze, und dann hat supererogatorisches Verhalten keinen Platz mehr. Für Kant bezieht sich der Begriff des Supererogatorischen dagegen auf das Ganze der juridischen Gesetze, mit Bezug auf die die Erfüllung der unvollkommenen Pflichten gegen andere supererogatorischen Charakter hat. Im Positivismus des 19. Jahrhunderts gehen die alten Unterscheidungen verloren. Die Neubelebung der Diskussion über den Begriff des Supererogatorischen im 20. Jahrhundert deutet auf eine Wende hin.
