A recent book about Agricola's conquest of Scotland presents a Scottish historian's take on a subject that has been dominated by archaeologists: the whereabouts of Mons Graupius, the scene of Agricola's final battle. Unfortunately, in confidently locating it in Perthshire, author James Fraser builds his case on shaky foundations.

Marx did not approach the state in answer to some such broad and abstract philosophical question as: What is the state? Nor did he offer a full sociological or historical or analytic account of state institutions and functions, and there are hence clear and substantial dangers in extrapolating to all or most conditions an account which is, in large part, specific to bourgeois society. Failing a comprehensive and formal treatise on politics and the state, Marx's own discussion consists of a (...) number of scattered and not altogether consistent general observations and some detailed investigation of the role and character of the state in particular historical situations. It seems sensible, then, to begin an elucidation of his account of the state with a comment on the nature of his interest in the subject. Why did he need a theory of the state? First published in 1973, this was the first detailed comparative analysis of the writings of Karl Marx and John Stuart Mill. it contains a full, careful and sympathetic account of their respective social doctrines, and concludes with a critical comparative evaluation of the two thinkers.

The human major histocompatibility complex (MHC), on the short arm of chromosome 6, represents one of the most extensively characterised regions of the human genome. This ∼4 Mb segment of DNA contains genes encoding the polymorphic MHC class I and class II molecules which are involved in antigen presentation during an immune response. Recently the whole of the MHC has been cloned in cosmids and/or yeast artificial chromosomes (YACs) and large portions have been characterised for the presence of novel genes. (...) Many unrelated genes, both housekeeping and tissue specific, have been identified and the gene density in some regions is now approaching one gene every few kilobases. Some of the novel genes encode proteins involved in the intracellular processing and transport of antigens that are presented by MHC class I molecules. Others, however, have no obvious role in the immune response. The MHC is located in the chromosome band 6p21.3 which is a Giemsa (G)‐light band. The detection of such a large number of functional genes (at least 70) in this region is compatible with the idea that both housekeeping and tissue‐specific genes are localised predominantly in G‐light bands. Background Several jurisdictions, including Singapore, Australia, New Zealand and most recently Ireland, have a public interest or public good criterion for granting waivers of consent in biomedical research using secondary health data or tissue. However, the concept of the public interest is not well defined in this context, which creates difficulties for institutions, institutional review boards and regulators trying to implement the criterion. Main text This paper clarifies how the public interest criterion can be defensibly deployed. We first explain the (...) ethical basis for requiring waivers to only be granted to studies meeting the public interest criterion, then explore how further criteria may be set to determine the extent to which a given study can legitimately claim to be in the public interest. We propose an approach that does not attempt to measure magnitude of benefit directly, but rather takes into account metrics that are more straightforward to apply. To ensure consistent and justifiable interpretation, research institutions and IRBs should also incorporate procedural features such as transparency and public engagement in determining which studies satisfy the public interest requirement. Conclusion The requirement of public interest for consent waivers in secondary biomedical research should be guided by well-defined criteria for systematic evaluation. Such a criteria and its application need to be periodically subject to intra-committee and intra-institution review, reflection, deliberation and amendment. (shrink)

David Gauthier thinks agents facing a prisoner's dilemma ('pd') should find it rational to dispose themselves to co-operate with those inclined to reciprocate (i.e., to acquire a constrained maximizer--'cm'--disposition), and to co-operate with other 'cmers'. Richmond Campbell argues that since dominance reasoning shows it remains to the agent's advantage to defect, his co-operation is only rational if cm "determines" him to co-operate, forcing him not to cheat. I argue that if cm "forces" the agent to co-operate, he is not (...) acting at all, never mind rationally. Thus, neither author has shown that co-operation is rational action in a pd. (shrink)

An epistemological how-possible question asks how knowledge, or knowledge of some specific kind, is possible. The main contention of Duncan Pritchard‟s stimulating comments is that what I call „explanatory minimalism‟ appears to offer us just what we are seeking when we ask such a question. This looks like a problem for me given that I defend a version of explanatory anti-minimalism. Pritchard outlines a version of minimalism inspired by the writings of John McDowell and does not find it obvious (...) that this position is lacking in any relevant respect. Nor do I. My minimalism is moderate rather than extreme but Pritchard‟s objections to anti-minimalism are objections to extreme anti-minimalism. Indeed, his comments do not seem to me to have any direct bearing on what I take to be the fundamental disagreement between minimalism and anti-minimalism. (shrink)

An experimenting society is one in which policy-relevant knowledge is created. It is then critically assessed and communicated in real-life or natural settings, with the aim of discovering new forms of public action to improve the problem-solving capacities of society. This latest volume of the distinguished Policy Studies Review Annual series probes, evaluates, and augments the work of Donald T. Campbell on an experimental societies. A basic assumption of this volume is that Campbell's perspective supplies a useful way (...) to address increasingly complex and seemingly unmanageable problems facing the United States and other postindustrial societies. The moral and professional anguish experienced by the medical student in response to the request is a fundamental sentiment that needs to be retained within the ethos of the medical community. Especially as laws on professional assistance in dying undergo increasing liberalization, society should not want its physicians (or its prospective physicians) to either be so callous, so lacking in compassion that they would dismiss such a patient request out-of-hand, or to be so cavalierly accustomed to acquiescing in such requests (...) that it simply becomes a routine pattern. Either approach on its own betrays the moral integrity of medicine. We instead want those professionals who are present to us in our dying to express both care and respect, to display both compassion and dignity for the dying person, even when, as in this circumstance, these core values come into conflict. In such a situation, moral anguish protects both the professional and the patient, not to mention society, from callous paternalism and/or callous indifference. (shrink)

The aim of this book is “to point how far the Arabian philosophers succeeded in their attempt to integrate the Semitic and Muslim conception of revelation with Greek wisdom.” The problem is precisely that which confronted the Catholic theologians of the 13th century. The animalist population has swelled since they introduced their thesis – we are animals – within the personal identity debate a few decades ago. Now they’re a dominant force in the debate. However, more recently, their thesis has fallen prey to attacks. For example, I [Duncan, Matt. 2021. “Animalism is Either False or Uninteresting (Perhaps Both).” American Philosophical Quarterly 58 (no. 2): 187–200.] argue that, depending on how it is understood, animalism is either false or uninteresting. If it is (...) merely the thesis that we are identical to animals (‘Animalism Light’), then it is uninteresting, because it doesn’t address the philosophical question it was supposed to address. If, instead, it is a stronger thesis – i.e., that we are essentially or fundamentally animals (‘Robust Animalism’) – then it is false. Even more recently, Andrew M. Bailey, Allison Krile Thornton, and Peter van Elswyk [2021. “Why Animalism Matters.” Philosophical Studies 178 (9): 2929–2942.] attempt to defend animalism against each of my two claims. They argue that Animalism Light holds considerable interest and that Robust Animalism can be defended against my arguments. In this article, I contribute to this exchange by defending my claims about animalism against Bailey et al.’s criticisms. (shrink)

Mill’s socialism and democratic theory have led some scholars to accuse him of trying to eliminate conflict from political life. Whereas Graeme Duncan has averred that Mill’s socialism aims to institute a completely harmonious society, James Fitzjames Stephen has contended that Millian democracy sought to evacuate conflict from political discussion. This article reconstructs both critiques and argues they are imprecise. Even if disputes motivated by redistribution of material goods would no longer exist in an egalitarian society, conflicts driven (...) by resentment over social reputation would keep the flame of conflict burning in a Millian socialist community. Moreover, a close reading of Considerations on Representative Government shows that Mill knew that no amount of political discussion is able to make conflicting opinions disappear. According to him, conflict is unavoidable in democratic politics because citizens analyse political issues from different social perspectives. Mill’s goal was not to eliminate conflict, but rather to regulate it in such a way as to bring about its attendant benefits, namely, progress and self-development. (shrink)

This paper explores the Australian community’s reaction to the deportation of unvaccinated tennis star, Novak Djokovic, in the lead up to the 2022 Australian Open. The analysis interprets the community’s hostile reaction to Djokovic by understanding community as both a structural and dynamic concept and, even more so, how fluid, evolving macro influences of community or group identification can intensify the demands of individuals to compromise for the common good based on ingrained expectations of the community. To do this, Norbert (...) Elias’ concepts of figurations and ‘we-they’ group identities are used to help highlight the link between structural and dynamic theories of community and identity. This study also outlines how ‘what is fair’ lies in pre-existing community rules and conventions being influenced by often momentary factors that impact and often change forms of group identity. These changes can be temporary or long-lasting and are driven by macro influences such as COVID-19 that can intensify existing community tensions. Throughout the analysis, it becomes clear that community’s response to Djokovic was not only fair, but a logical manifestation of community. (shrink)

Controversy often follows when patents are obtained in a pioneering area of technology. Patent filing activity in the field of regenerative medicine and in relation to stem cells in particular has not escaped opprobrium, although it is instructive to compare the nature of the debates that are taking place over the patenting of stem cells in the US and Europe. In the US, debate over the early patent applications made by the Wisconsin Alumni Research Foundation has been intense2, but at (...) least it appears to have been grounded firmly in patent law principles. In Europe, the debate has skewed away from the basic patent law tenets of novelty, inventiveness and industrial utility and has entered something of a twilight zone, with the European Patent Office serving as a diffident forum for difficult moral and ethical arguments about the destruction of human embryos and the commercial exploitation of human life. Grounded on an almost sociological view of the 'progress of society', Hume's is perhaps the most European of all the classic narrative histories of Britain. Moreover it embraces far more than the merely political, and it was Adam Smith who pointed (...) out that Hume was the first historian to deduce political effects from commercial and industrial causes.
