Hans-Georg Gadamer is one of the leading philosophers in the world today. This book offers a fresh analysis of the account of Peripatetic ethics in Cicero's On Ends 5, which goes back to the first-century BCE philosopher Antiochus of Ascalon. Georgia Tsouni challenges previous characterisations of Antiochus' philosophical project as 'eclectic' and shows how his reconstruction of the ethics of the 'Old Academy' demonstrates a careful attempt to update the ancient heritage, and predominantly the views of Aristotle and the Peripatos, in the light of contemporary Stoic-led debates. This results in both (...) a hermeneutically complex and a philosophically exciting reading of the old tradition. The fifth volume in the Fundamentals of Philosophy Series, Debating Sex and Gender by Georgia Warnke is a concise yet in-depth introduction to contemporary feminist thought on sex and gender.

An expanding policy framework aimed at monitoring alcohol consumption during pregnancy has emerged. The primary justification is prevention of harm from what is termed ‘prenatal alcohol exposure’ (PAE), by enabling more extensive diagnosis of the disability labelled fetal alcohol spectrum disorder (FASD). Here we focus on proposals to include biomarkers as a PAE ‘screening tool’, specifically those found in meconium (the first newborn excrement), which are discussed as an ‘objective’ measure of PAE.We ask the overarching question, ‘Can routine screening of (...) meconium to establish PAE be ethically or legally justified’, and we answer, ‘No’. To reach this conclusion, we discuss three areas. First, we consider the reasons why meconium screening should not be deemed ‘typical’ within the scope of accepted screening tools. We argue that given the aim and necessary timing of the screen, it cannot achieve what it promises. Second, we outline why patient autonomy and consent are not properly accounted for and cannot be reconciled with the ‘routinisation’ of the proposed ‘screening’. Last, we outline why the benefit of such a screen is not clear, focusing on the significance of trust in healthcare professionals (HCP) for the best interests of the future child and pregnant woman.While recognising the adverse effects of heavy alcohol consumption during pregnancy, we emphasise the case for robust ethical, legal and social considerations and the central need for trust between HCP and patients in maternity care. We conclude the permissibility of meconium screening has not been proven, and it is not justified. (shrink)

At the start of his account of hermeneutic experience, Gadamer quotes Heidegger: “Our first, last and constant task is never to allow our fore-having, fore-sight and fore-conception to be presented to us by fancies and popular conceptions, but rather to make the scientific theme secure by working out these fore-structures in terms of the things themselves.” Heidegger’s “fore-structures” reflect our practical pre-understanding and ongoing engagement with our world or “the things themselves.” Yet, if so, how can we work these fore-structures (...) out in terms of them? Gadamer claims to take his answer to this question from Heidegger and to appeal, like him, to the hermeneutic circle. However, I argue that Gadamer takes the question more seriously than Heidegger does by supplementing recourse to the hermeneutic circle with an appeal to dialogue. I also explore concerns about this supplement. Gadamer conceives of understanding as a dialogue in which we test our fore-meanings against those of others and come to a consensus with others about a subject matter (Sache). Yet, dialogue can just as easily reinforce or even exaggerate our fore-meanings as test them For its part, consensus is as easily to be feared as sought. (shrink)

This paper is devoted to an exploration of the implications for the theory of pre-lexical syntax as developed by McCawley, and for syntactic theories in general, of an analysis of English emphatic conjunctions along the lines of Green . Among the conclusions are: The underlying representation of sentences must be much more abstract than has even been imagined previously, referring, in some as yet undiscovered way, to assumptions of the speaker about the real world, in order to account for the (...) grammatical occurrence of both terms of suppletive lexical items in otherwise identical surface strings with corresponding differences in meaning. A grammatical theory which purports to be capable of relating the sentences of a language to what they mean in a systematic way must be capable of referring directly to relevant assumptions made by the speaker of any given utterance at the time of utterance. So-called 'contrastive stress' is only one of the phenomena whose ultimate explanation depends on direct reference to such assumptions. Transformational grammars, which explicitly claim to be capable of relating in a systematic way the sentences of a language and what they mean, must be capable of referring to the sub-lexical, semantic structure of sentences, and furthermore, must be capable of doing so at an indefinite number of points in their derivation. This means that the semantic representation of a sentence must be available for reference at every stage in the derivation of the sentence. (shrink)

The explanation versus understanding debate was important to the philosophy of the social sciences from the time of Dilthey and Weber through the work of Popper and Hempel. In recent years, with the development of interpretive approaches in hermeneutics, phenomenology, and language analysis, the problematic has become absolutely central. The broad literature to which it has given rise, while still split along "analytic" versus "continental" lines, shows increasing signs of a reunification in philosophy. G. H. von Wright's important book, Explanation (...) and Understanding, originally published in 1971, is a good example of this trend.In Understanding and Explanation, Karl-Otto Apel takes von Wright's work as a point of departure for a rigorous, penetrating analysis of the issues involved. After reviewing the failure of earlier discussions to resolve these issues, Apel develops his own approach in light of the turn from logico-semantic to pragmatic analysis of language in post-Wittgensteinian philosophy. In doing so, he constructs bridges that reach back to themes and positions of the German tradition of the Geisteswissenschaften, but from strikingly new angles.Karl-Otto Apel holds the chair for social philosophy at the University of Frankfurt. Social and political theorists have traced in detail how individuals come to possess gender, sex and racial identities. This book examines the nature of these identities. Georgia Warnke argues that identities, in general, are interpretations and, as such, have more in common with textual understanding than we commonly acknowledge. A racial, sexed or gendered understanding of who we and others are is neither exhaustive of the 'meanings' we can be said to have nor uniquely correct. We are neither always, (...) or only, black or white, men or women or males or females. Rather, all identities have a restricted scope and can lead to injustices and contradictions when they are employed beyond that scope. In concluding her argument, Warnke considers the legal and policy implications that follow for affirmative action, childbearing leave, the position of gays in the military and marriage between same-sex partners. In this book, one of Italy's most important and original contemporary philosophers considers the status of art in the modern era. He takes seriously Hegel's claim that art has exhausted its spiritual vocation, that it is no longer through art that Spirit principally comes to knowledge of itself. He argues, however, that Hegel by no means proclaimed the "death of art" but proclaimed rather the indefinite continuation of art in what Hegel called a "self-annulling" mode. With astonishing breadth and originality, (...) the author probes the meaning, aesthetics, and historical consequences of that self-annulment. In essence, he argues that the birth of modern aesthetics is the result of a series of schisms—between artist and spectator, genius and taste, and form and matter, for example—that are manifestations of the deeper, self-negating yet self-perpetuating movement of irony. Through this concept of self-annulment, the author offers an imaginative reinterpretation of the history of aesthetic theory from Kant to Heidegger, and he opens up original perspectives on such phenomena as the rise of the modern museum, the link between art and terror, the natural affinity between "good taste" and its perversion, and kitsch as the inevitable destiny of art in the modern era. The final chapter offers a dazzling interpretation of Dürer's _Melancholia_ in the terms that the book has articulated as its own. _The Man Without Content_ will naturally interest those who already prize Agamben's work, but it will also make his name relevant to a whole new audience—those involved with art, art history, the history of aesthetics, and popular culture. Violence against women is a growing health problem, especially when perpetrated in intimate relationships. Despite increasing attention, there is little comparative evidence on the different types of violence involved and there is a paucity of research on sexual femicides. This study examines cases of violence against women in northern Italy, focusing on sexual and non-sexual femicides and comparing them with rape that does not result in femicides. The sample included 500 women who were victims of sexual and non-sexual femicides, and (...) of rape. Results show sexual femicides mostly involved unknown victims or women who were prostitutes. Sexual femicidal offenders used improper weapons to kill their victims, acted in secluded locations, and fled the crime scene; their crime was more likely the result of predatory intentions, with antisociality and sexual deviance being the most significant factors related to this type of femicide. The criminal and violent pattern that characterized sexual femicides in this study shared significant similarities with the pattern of violence involved in rape. Rape victims were in fact mostly unknown, or involved in a brief relationship with their killer. When the victim was known it was more likely that the abuse occurred at home and in front of the woman’s children. Rapists were often under the effect of alcohol or drugs. Non-sexual femicides mainly involved known victims, and they were more often committed in the context of domestic disputes. It was not seldom that the long relationship between the victim and perpetrator was likely to be characterized by contentiousness, suggesting that the woman was often victim of an oppressive climate of emotional tension and domination. Morbid jealousy contributed to aggravating the tone of a controlling relationship. Non-sexual femicides bore more similarities to cases of rape within the pattern of intimate partner violence. Findings are discussed in terms of their implications for prevention and intervention. (shrink)

John Stuart Mill’s famous “harm principle” has been popular in the limitation of freedoms within human rights jurisprudence. It has been used formally in court cases and also informally in legal argumentation and conversation. Shortly, it is described as a very simple principle that amounts to the notion that persons are at liberty to do what they want as long as their actions do not harm any other person or society in general. This article questions whether it is legitimate to (...) use the harm principle in cases concerning the limitation of religious freedom within education. For example, can the exemption of a learner from sex education be denied based on the argument that such an exemption will cause harm? In order to answer this question, the meaning, origin and use of the harm principle are investigated. This article also discusses four main criticisms against the use of this principle in general and in cases of religious freedom of learners in education. (shrink)

_Legitimate Differences_ challenges the usual portrayal of current debates over thorny social issues including abortion, pornography, affirmative action, and surrogate mothering as _moral_ debates. How can it be said that our debates oppose principles of life to those of liberty, principles of liberty to those of equality, principles of equality to those of fairness, and principles of fairness to those of integrity, when we as Americans share all these principles? Debates over such issues are not, Georgia Warnke argues, moral (...) debates over which principles we should adopt. Rather, they are interpretive debates over the meanings of principles we already possess. Warnke traces the structure of these debates with reference to the work of Jane Austen, Hans-Georg Gadamer, Jürgen Habermas, and Bernard Williams. In separate chapters on surrogate mothering, affirmative action, abortion, and pornography she articulates new understandings of the meanings of some of our principles and shows the equal legitimacy of some different interpretations of the meanings of others. Finally, she suggests that the orientation of American public policy ought to be directed less at finding single canonical interpretations of our principles than at accommodating different legitimate understandings of them. The perspective offered by _Legitimate Differences_ should have a significantly beneficial effect on public discussions. (shrink)

Linguistic predictions may be generated from and evaluated against a representation of events and referents described in the discourse. Compatible with this idea, recent work shows that predictions about novel noun phrases include their definiteness. In the current follow-up study, we ask whether people engage similar prediction-related processes for definite and indefinite referents. This question is relevant for linguistic theories that imply a processing difference between definite and indefinite noun phrases, typically because definiteness is thought to require a uniquely identifiable (...) referent in the discourse. We addressed this question in an event-related potential (ERP) study (N = 48) with preregistration of data acquisition, preprocessing, and Bayesian analysis. Participants read Dutch mini-stories with a definite or indefinite novel noun phrase (e.g., “het/een huis,” the/a house), wherein (in)definiteness of the article was either expected or unexpected and the noun was always strongly expected. Unexpected articles elicited enhanced N400s, but unexpectedly indefinite articles also elicited a positive ERP effect at frontal channels compared to expectedly indefinite articles. We tentatively link this effect to an antiuniqueness violation, which may force people to introduce a new referent over and above the already anticipated one. Interestingly, expectedly definite nouns elicited larger N400s than unexpectedly definite nouns (replicating a previous surprising finding) and indefinite nouns. Although the exact nature of these noun effects remains unknown, expectedly definite nouns may have triggered the strongest semantic activation because they alone refer to specific and concrete referents. In sum, results from both the articles and nouns clearly demonstrate that definiteness marking has a rapid effect on processing, counter to recent claims regarding definiteness processing. (shrink)

RESUMO A série Black Mirror, transmitida entre 2011 e 2023 pela Netflix, tornou-se um fenômeno de mídia e seus episódios mostraram formas de interação homem-máquina (terminologia também referida como humano-computador). O nome da série se refere ao fato de que, quando uma tela é desligada, ela se torna um espelho negro que reflete a imagem do usuário. Este artigo1 tem como objetivo analisar os efeitos da interação homem-máquina nas organizações produtivas apresentadas em Black Mirror. Esta pesquisa utilizou a análise do (...) discurso, principalmente a partir das contribuições de Mikhail Bakhtin. O método consistiu em três etapas que contaram com a colaboração de estudantes de graduação e pós-graduação em Engenharia de Produção, integrando ensino e pesquisa e desenvolvendo o senso crítico dos pesquisadores-iniciantes. Os resultados indicam que, nas organizações apresentadas na série Black Mirror, há uma transição do conceito de fatores humanos para fatores ciborgues, bem como o uso da interação homem-máquina para promover o controle social. Hans-Georg Gadamer's philosophical hermeneutics - one of the seminal philosophies of the 20th century - has had a profound influence on a wide array of fields, including classical philology, theology, the philosophy of the social sciences, literary theory, philosophy of law, critical social theory and the philosophy of art. This collection expands on some of these areas and takes his hermeneutics into yet new fields including narrative medicine, biotechnology, the politics of memory, the philosophy of place and the non-verbal language (...) of the body. And, building on Gadamer's well-known discussions with Heidegger, Habermas and Derrida, Inheriting Gadamer sets him in dialogue with Mahatma Gandhi, Christine Korsgaard, Charles Mills and others. In these ways, the volume holds fast to a Gadamerian virtue: cultivating our important philosophical traditions while embracing the constant need to re-think their meaning in new circumstances and in relation to new knowledge.
