En el presente artículo se quiere tratar la importancia que tiene la elaboración del ZEE (Zonificación Ecológica Económica) dentro de un territorio, en este caso la posibilidad de aplicación para la Provincia del Cusco – Perú, donde tratamos de resaltar desde un punto de vista teórico y fundamentado por investigadores, la importancia que tienen los trabajos a escala local, es decir la priorización de trabajos a nivel de microzonificación que permiten mayor detalle de aspectos sociales, económicos y ambientales de una (...) comunidad y que conlleve a la ejecución de proyectos específicos de relevancia local. Se detallan conceptos como ordenamiento territorial, desarrollo sostenible, las escalas y sus enfoques, el propio ZEE y su normativa, sus resultados e impacto en el país; la situación actual del mismo para la Provincia del Cusco y las razones de su poca aplicación como instrumento de planificación. The article intends to present Nancy Fraser’s main criticism of Judith Butler’s thought, around the issue of the agency capacity of political subjects, taking sides in defending Butler’s thought. It is argued that Fraser fails to understand how Butler conceives an idea of power based on Michel Foucault, whose very functioning demands another understanding not only of what a subject is, but also of what we can call political action. Thus showing how Butler constructs a gender theory based on the (...) concept of performativity and with the influences of Foucault and Derrida, we argue that the author conceives an idea of radical intersectionality, from which power becomes diffuse and positive and the political agency is understood within the flaws and fissures operated by the functioning of power itself. El jesuita morisco P. Ignacio de las Casas colaboró en la traducción de algunos de los libros plúmbeos encontrados en Granada a fines del siglo XVI. Inicialmente se manifestó partidario de su autenticidad, pero pronto se convenció de que eran una falsificación. Desarrolló entonces una activa lucha para conseguir que la Iglesia evitara su divulgación. En el artículo se pasa revista a su intervención como traductor y a los argumentos que utilizó para criticar la doctrina de los libros plúmbeos. El (...) P. Las Casas, además de señalar la presencia de elementos islámicos, ve en ellos claras muestras de antiguas herejías antitrinitarias. In this paper I propose to conceive of forgiveness as a process of eliminating punitive reactive attitudes, which makes up part of the offended person’s willingness to reestablish a certain type of reciprocal relationship with the offender. Distinguishing among types of reciprocity allows us to realize that forgiveness is a more varied phenomenon than is usually assumed in the philosophical literature, as well as to understand why the dispute concerning the gratuitousnessconditionality of forgiveness is meaningless.

El artículo presenta, reconstruye y contextualiza la discusión filosófica a la cual Michel Henry somete el planteamiento de Martin Heidegger acerca de la disposición afectiva (Befindlichkeit). Henry toma como hilo conductor el concepto de cooriginariedad (Gleichursprünglichkeit) entre las estructuras existenciales. Sostendremos que la lectura de Henry no solo afecta a una herramienta metodológica central de Ser y tiempo; también nos aproxima, con una economía filosófica nada desdeñable, al núcleo argumentativo de la obra principal de Heidegger, núcleo que se entreteje a (...) partir de las estrechas relaciones que guardan ontología, fenomenología y analítica existencial. Sin embargo, el planteamiento de Henry ha sido encasillado dentro del «giro teológico» de la fenomenología. Con lo cual será necesario mostrar que la crítica a Heidegger puede sostenerse con independencia de la deriva teológica de la filosofía henriniana. (shrink)

Legal philosophers share the same phenomenology of legal practice. Yet, they differ in its explanation. For normativists, descriptivists got it wrong and vice versa. This controversy between normativists and descriptivists will be called “the methodological problem” in legal theory. Normativists such as Dworkin and Perry argue that descriptivists need evaluation. By contrast, descriptivists such as Coleman argue that normativists need the methods of descriptivism such as conceptual analysis and therefore might be committed to descriptivism. The paper shows that the responses (...) of Perry and Coleman to the methodological problem are not free from difficulties. The article also advances a reinterpretation of normativism in terms of two tenets: 1. the semantic sting argument, and 2. the ametaphysical thesis argument. If the latter argument is sound, normativism is unavoidable, because if there cannot be an external point of view or Archimedean perspective, then we can only resort to our moral convictions or substantive claims. The first tenet has been criticized in previous work and the paper focuses on a criticism of the second tenet. (shrink)

Can Hart's non-cognitivism be reconciled with his rejection of the predictive and sanction-based explanations of law? This paper analyses Hart's notion of the internal point of view and focuses on the notion of acceptance of a rule along the lines of a non-cognitivist understanding of intentional actions. It is argued that a non-cognitivist analysis of acceptance of rules is incomplete and parasitic on a more basic or primary model of acceptance that does not involve mental states. This basic or primary (...) model of acceptance explains actions in terms of other actions and in terms of reasons for actions that are both presented as good-making characteristics and transparent to the agent. If Hart's internal point of view is able to work as the key argument to reject predictive and sanction-based explanations of law, it needs to make the outward approach of intentional action basic or primary rather than rely on an inward approach such as the one advanced by non-cognitivism. This study investigates the effects on organization’s financial performances of, first, the extent to which the organizations are involved in controversial business activities, and second, their level of social performance. These companies can be considered non-socially responsible given the harmful nature of the activities they are involved in. Managers of these companies may still have incentives to pursue socially responsible actions if they believe that engaging on those actions will help them to achieve legitimacy and improve investors’ perception about them. (...) We develop a comprehensive methodology to investigate these corporate social performance (CSP)-related effects in a complex but specific setting. To this end, we analyze a sample of 202 US firms for the period 2005–2008 using a novel method in this area: partial least squares. Our results indicate that, contrary to the general findings in prior literature, companies involved in controversial business activities which engage in CSP do not directly reduce the negative perception that stakeholders have about them. Instead, we found evidence of a positive mediation effect of CSP on financial market-based performance through innovation. (shrink)

Luigi Pareyson is an italian existencialist philosopher, the unknown master of Umberto Eco and Gianni Vattimo. This not very well known philosopher has a consistent anthropology, which carries out its consecuences in his aesthetics and hermeneutics. Consecuently, he also considers philosophy as a permanent dialogue between each person with truth and other persons. This is the future of philosophy, he says.

Judges and lawyers believe that international law, customary law, and legal systems such as the Third Reich or apartheid law in South Africa are law. But how do we explain the fact that there is one concept of law when there are different conceptions of law with a variety of different features? Finnis, inspired by the Aristotelian notion of central case, adumbrates the idea that the concept of law might be unified by a primary concept which is the concept of (...) “law as practical reason”; that is, law conceived from an ethical perspective. He advances two arguments to defend his methodology: the conceptual and the functional. Contra Finnis, the paper shows that neither the conceptual nor the functional argument can successfully support the view that “law as practical reason” is the central case of the concept of law. The study clarifies the Aristotelian notion of central case and illustrates the mistaken application of this notion to the concept of law. However, we also argue that Finnis's insight–the idea that all the different conceptions of law might be unified for the purposes of theoretical research–is fundamental and appealing. This paper aims to reconstruct Finnis's insight through the model of core resemblance. The result is that the different conceptions of law can be unified by resemblance to the concept of “law as practical reason,” though there is no identity among the different conceptions of law. This essay reviews the documents of the pontifical magisterium of the Church from the encyclical Mater et magistra (1961) to the exhortation Evangelii gaudium (2013), in order to show the Church’s historical commitment to the defense of the environment. It then argues that Laudato si’ elevates the theological status of the environmental crisis to that of a new social issue, much as Leo XIII did for the industrial crisis with his encyclical letter Rerum novarum (1891).

I am referring to the interdisciplinary research group Histopia, which has its base in Madrid́s (...) Autónoma University, is comprised of twenty-seven researchers from different institutions, and is coordinated by historian Juan Pro. As the name Histopia suggests, it was founded by historians. From the beginning there have been people from other fields, such as political science, architecture, cultural studies, and art history. The aim was always understanding utopianism beyond the study of texts, and centering research in everything that utopianism produces, such as social movements, political programs, and urban programs. In this sense, a premise was to understand utopias not as a footnote in history or a series of eccentric events, but as a guiding force that drives a [End Page 510] history. This placing of utopianism in history was clearly announced in the grouṕs website:Histopia seeks to go beyond the philological approach that predominates in Utopian Studies and to historicize the study of contemporary utopias and dystopias, showing how they respond to the contexts in which they arise, since they reflect the problems and frustrations of a society as well as the aspirations for change it contains, and the conditions of possibility that a particular cultural and emotional framework offers for developing them.1Together with this focus on history, which departs from the more text-centered traditions of an important part of utopian studies, the other main particularity of Histopia is its decentralizing of utopian studies towards the Spanish-speaking world. And to this end, the group also founded the Transatlantic Network for the Study of Utopias, which was created in 2015 to put in communication over 250 researchers, most of them from Latin America, but also from other places such as Australia or Japan.2The Spanish statés research funding programs have provided the bureaucratic framework and the material resources for the research group since 2015. Together with seminars, conferences, or workshops, the resulting publications have been linked with utopian literature, with dystopia, and with a focus on viewing history through the lens of utopia. One of the most recent endeavors has been a radically collective one, articulating a Dictionary of Utopian Places written by a multitude of authors.3 Histopia has also initiated several projects with schools, for the most part ongoing, and there have been many attempts to disseminate its work through radio and video projects. And since its founding, Histopia has tried reaching out beyond the Academy—an effort that is finally gaining success. In 2021 the international conference Intentional Communities: Concrete Utopias in History was extremely fruitful: we saw involved participation both in various interventions, and through activities such as streaming. Participants included people and organizations from social movements and from intentional communities.I want to argue here that the very formation of Histopia was a logical development from certain political triggers—and in particular, the so-called 15M Movement, a series of anti-austerity protests and direct-democracy initiatives that ignited antigovernment activism throughout Spain from 2011 on, culminating in the occupation of urban spaces (“encampments”) and in very large political assemblies. This conceptual paper explores the theoretical possibilities of posthumanism and presents ecologies of repair as a heuristic device to explore the association modes of different entities, which, when confronted with the effects of human-induced destructive events, seek to repair the damage and transform the conditions of coexistence of various life forms. The central idea is that severe socio-environmental crisis caused by an intensification of industrial activity are conducive to observing new sociomaterial configurations and affective dispositions that, through the reorganization of (...) practices of resistance, remediation, and mutual care, are oriented to generating reparative and/or transformative processes from damaged ecologies and communities. Crises constitute true ontological experimentation processes where the presence of other-than-human natures, and of artifacts or devices that participate in reparative actions, become visible. A post-human approach to nature allows us to use languages and methodologies that do not restrict the emergence of assemblages under the assumption of theira prioriontological separation, but rather examine their reparative potential based on the efficacy of situated relationships. Methodologically, transdisciplinarity is relevant, with ethnography and other engaged methods applied over units of observation and experience called socio-geo-ecologies. The relevant attributes of these socio-geo-ecologies, beyond the individual, community, or institutional aspects, are the specific geological characteristics that make possible an entanglement of interdependent relationships between human and non-human agents. The aim of this paper is to analyze the idea of general resurrection of the dead at the end of times in the synoptic Gospels. We intend to clarify whether this concept can be interpreted as a transposition of the parallel belief contained in some intertestamental writings, or if the singularity of the religious experience expressed in the synoptic Gospels establishes an inexorable moment of discontinuity with the previous apocalyptic framework, making it impossible to understand this doctrine on the sole (...) basis of its Jewish precedents. In order to accomplish our goal, we shall first study the general resurrection of the dead in the Q source, the references to this notion in the gospel of Mark, and its meaning in both Matthew and Luke. We will exclude from our treatment all the topics related with the resurrection of Jesus, and we will be focused on the explicit mentions of the doctrine of the resurrection of the dead as such. Since implicit beliefs are always difficult to assess, especially in the context of eschatological ideas, in which vagueness and absence of a systematic effort of exposition often prevail, we will not allude to other synoptic passages which have been regarded as potential expressions of the doctrine of the resurrection of the dead at the end of times.
