Resumen: Las dificultades para ser escuchado del menor extranjero en cualquier procedimiento que le afecte ponen de relieve las deficiencias generales existentes en nuestro ordenamiento jurídico para hacer efectivos los derechos de los que son titulares las personas menores de edad, sean extranjeras o no. Se analiza en primer lugar el artículo 12 de la Convención de los Derechos del niño, las condiciones imprescindibles para para hacer efectivo el derecho a ser escuchado y la conexión que existe entre ese derecho (...) y la consideración primordial de su interés superior. A continuación se hace un repaso de la regulación española de los procedimientos de repatriación de menores extranjeros no acompañados a la luz del interés superior del menor y su derecho a ser escuchado. Abstract: The current challenges that migrant children face to have their right to be heard fulfilled and respected, put in evidence the general deficiencies of our legal system ensuring the effective enjoyment of children rights, irrespective if the children in question are migrant or not. At the outset, article12 of the Convention on the Rights of the Child and its content is analysed, including the essential requirements for an effective implementation and enjoyment of the right to be heard and its linkages with the best interest of the child as the primary consideration. An analysis of the Spanish regulations under the return procedures for unaccompanied foreignchildren is also provided in light of the respect of the best interests of the child and their right to be heard. The pandemic caused by the COVID 19 Virus creates an unprecedented situation of global confinement altering the development of competition and sports training at all levels of participation and in all sports, including rhythmic gymnastics (RG). To avoid possible effects of physical, technical and psychological detraining, coaches looked for home training alternatives. The objectives of the study were to know how rhythmic gymnastics training developed during the lockdown period (the conditions, type of training, performance monitoring means, and determinants of gymnasts’ (...) participation) and to provide recommendations for a possible future lockdown. Three hundred and two RG coaches from twenty-six different countries throughout the five continents and four professional levels took part in the study: national team (28), international (26), national (172) and regional (75). The data collection tool was a questionnaire consisting of 39 closed questions structured in three dimensions: identification data of the coaches, training data during confinement and gymnast participation data. The independent variable was the gymnasts’ performance levels and the dependent variables organized in four categories: the technical media used to conduct and monitor the training sessions, the type of training done, the mechanisms for monitoring training performance and the aspects that determined participation. Most coaches kept their gymnasts training during confinement, although 76.5% confirm abandonment of any of their gymnasts. The main means used were real-time video conferencing, although at the lower practice levels the media stand out in deferred time. The contents of the training were mainly body technique, physical preparation and body difficulties. For performance monitoring, challenges, physical, and technical tests were predominant. The determinants for the development of training in the confinement vary depending on the level of the gymnasts, connectivity and electronic resources at the highest level, and the availability of spaces and social distancing at lower levels. For future lockdowns, it is necessary to review the content of the trainings, as well as the performance evaluation and the means necessary for it. (shrink)

If homo sapiens, understood as the evolution of the current human being, was characterized by a cerebral advance and a much more evolved communicative capacity than its ancestors, then it is not conceivable that the origin of writing as the maximum exponent of homo sapiens’need for communication did not improve until many thousands of years later. The fact that the first linguistic system perfected and agreed upon by an entire society dates from 3,500 years ago does not prove that this (...) is the origin of writing. Writing, as the origin of the word itself indicates (both in Spanish and English), implies an attempt to communicate in writing and does not require a sophisticated and mature language with a developed grammar, phonetics, or semantics. No matter how rough, clumsy, crude, sparse, scanty, and incomprehensible these early written manifestations may have been, they are samples of writing. Taking into account this starting point, which is not new, the present study suggests a new classification of the origin of writing up to the present day. As long as no more ancient writing endeavors appear, the first attempts at written communication date back to about 40,000 years ago. From then until now, three periods have developed from the linguistic point of view: proto-writing, emergent writing, and maturity. These periods match the cognitive development of human beings with respect to their historical achievements of globalization. (shrink)

El propósito de este trabajo es el de analizar semiótica, estructural, estética e históricamente las caricaturas divulgadas en una de las mayores publicaciones de la prensa afín al Partido Comunista de España en México, esto es, "España Popular" (fundada en 1940 con el nombre de "España Popular: semanario al servicio del pueblo español"). Para ello, se tomará como punto de partida metodológico las dos tareas principales que Piero Polidoro otorga a la semiótica visual: La primera es explicar qué es y (...) cómo funciona el lenguaje visual: ¿cómo hacemos para reconocer el significado de una imagen, cuán rico es este significado, cómo se combina con otros? La segunda tarea, directamente unida a la primera, es la de estructurar los textos visuales (un cuadro, una fotografía, un cómic, una marca corporativa) para comprender qué y cómo consiguen comunicar (2016: 11-12). En consecuencia, se van a examinar las caricaturas como textos visuales y como representaciones del mundo (o de un mundo basado, hasta cierto punto, en los principios ideológicos y propagandísticos del marxismo). Del mismo modo, este análisis prestará especial atención a las técnicas discursivas que subyacen en esas caricaturas para persuadir al lector-observador a inferir/hacer (o no) determinadas cosas bajo estructuras narrativas basadas en la seducción, la intimidación, la manipulación y la provocación. Y es que las caricaturas —frente a las fotos y a otro tipo de imágenes de ese periódico del exilio— despliegan una sutil labor propagandística (no siempre visible a primera vista por no contener consignas moscovitas y por usar un humor satírico catártico). En cualquier caso, las caricaturas son una buena representación de los instrumentos de poder (y de contrapoder) generados en momentos históricos clave como el franquismo, la Segunda Guerra Mundial y la Guerra Fría. In this study, a hybrid model based on intelligent techniques is developed to predict the active power generated in a bioclimatic house by a low power wind turbine. Contrary to other researches that predict the generated power taking into account the speed and the direction of the wind, the model developed in this paper only uses the speed of the wind, measured mainly in a weather station from the government meteorological agency (MeteoGalicia). The wind speed is measured at different heights, (...) against the usual measurements in others researches, which uses the wind speed and the direction measured in a weather station on the wind turbine nacelle. The prediction is performed 30 minutes ahead, what ensures that the Building Management System knows the energy generated by the low power wind turbine 30 minutes before, and it can adapt the consumption of different equipment in the house to optimize the power use. The main objective is to allow the Building Management System to optimize the uses of energy, taking into account the predicted amount of energy that will be produced and the energy consumed in the house. The developed model uses a hybrid topology with four clusters to improve the prediction, achieving an error lower than 6.5% for Mean Absolute Error measured in a final test. To perform this test, part of the original dataset was isolated from the beginning of the training process to check the model with a dataset that is not used before, simulating the model as it is receiving new data. IntroductionRheumatologists are the primary healthcare professionals responsible for patients with rheumatic diseases and should acquire medical ethical competencies, such as the informed consent process (ICP). The objective clinical structured examination is a valuable tool for assessing clinical competencies. We report the performance of 90 rheumatologist trainees participating in a station designed to evaluate the ICP during the 2018 and 2019 national accreditations.MethodsThe station was validated and represented a medical encounter in which the rheumatologist informed a patient with systemic lupus erythematosus (...) with clinically active nephritis about renal biopsy. A trained patient–actor and an evaluator were instructed to assess ICP skills (with a focus on kidney biopsy benefits, how the biopsy is done and potential complications) in obtaining formal informed consent, delivering bad news and overall communication with patients. The evaluator used a tailored checklist and form.ResultsCandidate performance varied with ICP content and was superior for potential benefit information (achieved by 98.9% of the candidates) but significantly reduced for potential complications (37.8%) and biopsy description (42.2%). Only 17.8% of the candidates mentioned the legal perspective of ICP. Death (as a potential complication) was omitted by the majority of the candidates (93.3%); after the patient–actor challenged candidates, only 57.1% of them gave a clear and positive answer. Evaluators frequently rated candidate communications skills as superior (≥80%), but ≥1 negative aspect was identified in 69% of the candidates.ConclusionsEthical competencies are mandatory for professional rheumatologists. It seems necessary to include an ethics competency framework in the curriculum throughout the rheumatology residency. (shrink)

The specific role of empeiria in Aristotle’s ethics has received much less attention than its role in his epistemology, despite the fact that Aristotle explicitly stresses the importance of empeiria as a requirement for the receptivity to ethical arguments and as a source for the formation of phronêsis.1 Thus, while empeiria is an integral part of all explanations that scholars give of the Aristotelian account of the acquisition of technê and epistêmê, it is usually not prominent in explanations of the (...) acquisition of phronêsis.2 The abundant mentions of empeiria in Aristotle’s ethical treatises are often eclipsed in the secondary literature... The present paper expounds Karl Jaspers’ thought about Europe, its past, its peculiarity and its destiny. The drastic changes of the modern society and the collapse of the Second World War offer the philosopher the chance to think over the causes of the dramatic crisis of the European spirit and, at the same time, to pinpoint the reasons of a possibile restart. The European thought is put in connection with the ideas of history, possibility and humanity, so that its core (...) can be translated in an endless process of becoming-a-man. Considered that the rebuilding of Europe has to grow on the basis of a new conscience of the Europen identity, Jaspers reassesses also the role of politics and philosophy in order to sketch a political and cultural project putting in the middle the idea of the human-being-to-do. Open peer commentary on the article “A Critique of Barbieri’s Code Biology” by Alexander V. Kravchenko.: Kravchenko encourages language science to approach languaging as “a species-specific semiotic activity that has a biological function.” Languaging as a form of social agency is broader than semiosis but not necessarily “above” it nor driven by biological function. By focusing on participation and becoming, the enactive approach to linguistic bodies offers conceptual resources to bridge human and non-human sense-making without resorting to codes.

Previous research has found that funding disparities are driven by applications’ final impact scores and that only a portion of the black/white funding gap can be explained by bibliometrics and topic choice. Using National Institutes of Health R01 applications for council years 2014–2016, we examine assigned reviewers’ preliminary overall impact and criterion scores to evaluate whether racial disparities in impact scores can be explained by application and applicant characteristics. We hypothesize that differences in commensuration—the process of combining criterion scores into (...) overall impact scores—disadvantage black applicants. Using multilevel models and matching on key variables including career stage, gender, and area of science, we find little evidence for racial disparities emerging in the process of combining preliminary criterion scores into preliminary overall impact scores. Instead, preliminary criterion scores fully account for racial disparities—yet do not explain all of the variability—in preliminary overall impact scores. (shrink)

In what ways and how far does virtue shield someone against suffering evils? In other words, how do non-moral evils affect the lives of virtuous people and to what extent can someone endure evils while staying happy? The central purpose of this chapter is to answer these questions by exploring what Aristotle has to say about the effects of evils in human well-being in general and his treatment of extreme misfortunes.

Technological shifts within the video game industry have enabled many games to evolve into platforms for repeated expenditure, rather than a one-time purchase product. Monetising a game as a service is challenging, and there is concern that some monetisation strategies may constitute unfair or exploitative practices which are not adequately covered by existing law. We asked 1104 players of video games to describe a time when they had been exposed to transactions which were perceived to be misleading, aggressive or unfair. (...) We found 35 separate techniques over eight domains: game dynamics designed to drive spending, product not meeting expectations, monetisation of basic quality of life, predatory advertising, in-game currency, pay to win, general presence of microtransactions and other. Notably, several of these reported practices seem to not align with existing UK consumer protection regulations. We discuss this potential misalignment, as well as the implications of identifying what players believe to be problematic monetisation techniques. (shrink)

El presente artículo de revisión analiza las convergencias y diferencias entre el pensamiento complejo y laecología de saberes con el propósito de explorar posibilidades de complementación y sinergias en el marco de una epistemología crítica. Para tal efecto se ha realizado una revisión bibliográfica apoyada por los métodos deductivo y hermenéutico. Para la caracterización del pensamiento complejo se ha revisado la obra de Edgar Morin y otros autores como Boaventura de Sousa Santos. De la revisión se concluye que tanto el (...) pensamiento complejo como la ecología de saberes tienen similitudes pues comparten en mayor o menor medida los principios de sistemas organizados, dialogicidad, recursividad y retroactividad. Además, son explícitos en superar la distinción sujeto-objeto para pasar a una relación sujeto-sujeto. Ambas propuestas constituyen alternativas al pensamiento científico hegemónico y ponen el valor el pluralismo cognitivo y la justicia cognitiva. La principal diferencia es que la ecología de saberes tiene una apuesta más explícita por los conocimientos de los movimientos sociales en sus luchas de resistencia frente a las diversas formas del colonialismo vigente, que tienen correlato con un sistema económico que privilegia el mercado a la vida. En tal sentido es posible reconocer en la ecología de saberes un carácter más político. Ambas propuestas, aunque con diferencia de grados, se erigen como alternativas transformadoras de la realidad social. (shrink)

El artículo expone una dificultad inviscerada en el método del representante más emblemático del racionalismo epistémico y ontológico de la modernidad: Baruj de Spinoza. La propuesta apunta a la aserción de que la renovación del método con la intención de depurarlo para permitir su máximo rendimiento es incapaz de reparar en su propio límite: mientras está oculto se lo proyecta como auténtica ganancia en orden a una averiguación sobre la trascendencia lograda (¿o no?) por el conocer. Podrá apreciarse que dicho (...) límite no detectado importa la dificultad más prominente para una metafísica realista como la de Spinoza que, precisamente en cuanto puede reconocerse realista, ha otorgado gran atención al método. El presente trabajo pretende realizar una lectura del Tratado de la Reforma del Entendimiento �Tractatus de intelectus emendatione (1662)� alrededor de la cual girará la referencia al pensamiento textual que el Sefardí ha vertido en otras obras de su autoría. ¿Cuáles son los criterios para establecer qué es lo que toca aquí y ahora? ¿Cómo se las arregla la prudencia para dirigir nuestra acción? ¿Cómo valorar la acción ejecutada y reconocernos en ella? El artículo presenta estas y otras cuestiones que plantean problemas en tomo al obrar humano. La relación que me interesa tratar es la que mantiene unidos tres conceptos:retórica, memoria y prudencia. Propongo su articulación y sostengo que esta misma ofrece una herramienta hermenéutica apropiada en aquello que llamamos (...) buenas acciones. Porque el modo como permite relatar lo que nos pasa cuando vivimos y actuamos es aquel en el que podemos reconocernos de una manera más plena. (shrink)

This article tries to show the ambivalence of the hegelian idea of Europe. On the one hand, Hegel has always appeared as too eurocentric, even for his time. But, on the other hand, he´s still a thinker who investigates very deeply the traits of the European identity, of its historical roots and of its formative process.

Bare conditionals, I argue, exhibit Conditional Duality in that when they appear in downward entailing environments they differ from bare conditionals elsewhere in having existential rather than universal force. Two recalcitrant phenomena are shown to find a new explanation under this thesis: bare conditionals under only, and bare conditionals in the scope of negative nominal quantifiers, or what has come to be known as Higginbotham’s puzzle. I also consider how bare conditionals behave when embedded under negation, arguing that such conditionals (...) often involve denial negation. One important conclusion that emerges from the discussion is that an account of bare conditionals that validates Conditional Excluded Middle is not warranted. By limiting the scope of the strict analysis Conditional Duality is also a way of maintaining such an account. (shrink)

We deal with situations incongruent with our automatic response tendencies much better right after having done so on a previous trial than after having reacted to a congruent trial. The nature of the mechanisms responsible for these sequential congruency effects is currently a hot topic of debate. According to the conflict monitoring model these effects depend on the adjustment of control triggered by the detection of conflict on the preceding situation. We tested whether these conflict monitoring processes can operate implicitly (...) in an implicit learning procedure, modulating the expression of knowledge of which participants are not aware. We reanalyze recently published data, and present an experiment with a probabilistic sequence learning procedure, both showing consistent effects of implicit sequence learning. Despite being implicit, the expression of learning was reduced or completely eliminated right after trials incongruent with the learned sequence, thus showing that sequential congruency effects can be obtained even when the source of congruency itself remains implicit. Ethical debate exists on the effect of gender diversity of the top management teams on organizations. This study aims to contribute to this debate by analyzing the effects of gender diversity of TMTs on the relationship between knowledge combination capability and organizations’ innovative performance. We use a sample of 205 small- and medium-sized enterprises belonging to the sector of Spanish technology-based firms. Our results indicate that gender diversity positively moderates the relationship between knowledge combination capability and innovation performance. Implications for (...) theory and practice are discussed—among them, ways to contribute to more equal gender distribution and to the benefits of gender diversity in top management positions. The Ibero-American Conference is a forum for dialogue, consultation and cooperation in which the observance of human rights is an essential principle. These rights are an area of action of the Ibero-American system. The instruments adopted by the Conference and other Ibero-American instances provide political and legal indications in the field of human rights that must be developed through initiatives, actions, programmes and agendas of cooperation. Social rights deserve special attention at the Ibero-American Summits. All this should have an influence (...) on the positions of the Inter-American Court of Human Rights, particularly when it deals with cases in which are affected economic, social and cultural rights, as it has been done in the wake of recent judgments on the matter. The work of the Ibero-American system in the fields of migration and culture will be of particular interest to the Inter-American Court in determining the content and scope of the rights recognized and protected in the inter-American system. This empirical study explores the characteristics and degree of implementation of so-called ethics hotlines in transnational companies (TNCs), which allow employees to present allegations of wrongdoing and ethical dilemmas, as well as to report concerns. Ethics hotlines have not received much attention in literature; therefore, this paper aims to fill that gap. Through the analysis of conduct/ethics codes and the compliance programs of the top 150 transnational companies ranked by the United Nations Conference on Trade and Development (UNCTAD) ( 2007 (...) ), we carry out a descriptive and taxonomic study of these companies’ ethics hotlines. We analyze: (1) the basic characteristics of the mechanism, (2) the degree of exigency and the provision of safeguards, (3) the matters reported and the systems for reporting, and (4) the relationships between hotlines and economic characteristics of the firm. Our study compares financial and nonfinancial TNCs as well as North American and European TNCs. Our results show that many firms (especially from North America) have established these procedures. We also find some disparities between European and North American ethics hotlines that suggest differences in the orientation of the procedures. (shrink)

En el panorama creativo del siglo XXI abundan las producciones apocalípticas, muchas veces protagonizadas por vampiros y zombis. En algunas de ellas, se elaboran toda una serie de resignificaciones religiosas, vinculando el cristianismo con el vampirismo y lo zombi. En este contexto, la figura de María Magdalena aparece, en ocasiones, reformulada con importantes connotaciones feministas. Así sucede tanto en la película Jesucristo Cazavampiros (Lee Demarbre, Jesuschrist Vampire Hunter, 2001) como en el cortometraje Zombie Jesus (Carla Siegle, 2014). Ambas producciones, a (...) las que se unen otras para demostrar que las mismas no son una excepción, presentan un conocimiento tanto de las Escrituras como de los estudios procedentes de la teología feminista, aspectos que configuran el foco principal de atención en el presente estudio. This paper analyses the principles of stable cooperation for stochastic games. Starting from the non-cooperative version of a discounted, non zero-sum stochastic game, we build its cooperative form and find the cooperative solution. We then analyse the conditions under which this solution is stable. Principles of stability include subgame consistency, strategic stability and irrational behaviour proof of the cooperative solution. We finally discuss the existence of a stable cooperative solution, and consider a type of stochastic games for which the cooperative (...) solution is found and the principles of stable cooperation are checked. The starting point of this study is the concept of the “world-opening instance” one of the most carefully created concepts in philosophical reflection, from the predominance of the being, via consciousness, to a singular mode of experience which finds its support in finiteness and dispossession . The main points of the article are the analysis of the fragile itinerary of subjectivity, the study of Da-seinas the limit of the substantialist ontology, and the experience of negativity as an appropriate form for (...) illuminating the manifestation of the self. The article highlights the contrast between this and the experience of the “you”, proposed by Gadamer and by Habermas theory of communicative action. (shrink)
