Many current Marxist debates point to a crisis of imagination as a challenge to emancipatory thoughts and actions. The naturalisation of the capitalist mode of production within the production of subjectivity is among the chief reasons behind this state of affairs. This article contributes to the debate by focusing on the notion of imagination, marked by a deep ambivalence capable of both naturalising and denaturalising social relations constitutive of the established order. Such an understanding of imagination is constructed from within (...) the framework of historical materialism, and it draws on Spinoza and Marx, taking advantage of the similarities between the two with respect to the constitution of the subject. From this stems an investigation into the imagination as a material force that partakes both in subjection and liberation. This is further demonstrated in regard to juridical forms of subjectivation and the possibility of subverting these forms through imagination. (shrink)

A la vanguardia del debate clásico sobre la justificación del castigo, algunas variantes del republicanismo penal sugieren que tal fundamento debe buscarse en una relación anterior al crimen: en una relación política. Afirman que podemos castigarnos porque pertenecemos, en conciudadanía, a una misma comunidad política. Pero entonces aparece necesariamente la pregunta sobre cómo se justifica el castigo a personas extranjeras. Con referencias al caso argentino, este artículo discute con las explicaciones teóricas ensayadas por Duff y las alternativas de Zedner, Yaffe (...) y Chehtman. El debate, así planteado, parece dirimirse entre fundar la respuesta punitiva en la comunidad entre personas ciudadanas dejando sin orientación normativa a las diversas formas de castigo de las no-ciudadanas o renunciar a una justificación relacional del castigo para todos. Para escapar del dilema, planteo que quienes entiendan que la legitimidad del castigo debe buscarse en algún tipo de relación política preexistente deben redefinir esa relación para que pueda dar cuenta de los diferentes vínculos que nos unen a quienes cohabitamos un mismo territorio político. En lugar de descartar a la membresía política como justificación del reproche penal, sostengo que se puede renunciar a que esa membresía constituya la única justificación posible. Finalmente propongo dos pautas para que una teoría de la justificación del castigo pueda dar cuenta de los diferentes criterios de atribución de la ley penal: el nivel de dependencia y el nivel de participación. ABSTRACTThis paper explores the impact of the philosophical structure of Leone Ebreo’s Dialoghi d’amore on the construction of Tullia d’Aragona’s Dialogo della infinità di amore. Analysing both the explicit references to and the indirect citations of Leone’s Dialoghi, I aim to demonstrate how the reinterpretation of some fundamental topics of this work – such as the re-evaluation of the sensual aspect of human love and the distinction between honest and vulgar love – lies at the heart of Tullia’s dialogue. The (...) article also intends to shed light on the complex role of Benedetto Varchi in the elaboration of these issues by d’Aragona, who for the final revision of her text could have relied – as she did for her poems – on his collaboration. The primary aim of this article is to present the rule of law universalism as a relevant theoretical and socio-political issue that critical legal thought needs to contend with. In order to do so, this issue is described through a Marxist theoretical framework, which aids in identifying the consequences of this universalism. Furthermore, the Marxist theoretical framework is suggested as a countermeasure that allows for going beyond it. The rule of law universalism is analysed as a process connected to establishing (...) hegemony and status quo that affects both the way the law is thought of and practiced. The post-communist context serves in fleshing out some of these consequences. Although the transition is not the main subject of inquiry, it is a starting point to a set of philosophical questions directed towards the rule of law universalism, mainly regarding historical embeddedness and socio-political dependency of the rule of law. The transitional context illustrates the tension between the rule of law treated as a generalized blueprint and the reality it is introduced to. The method of approach to this tension argued for in this paper is Marxian theorization of concept as an interplay between concrete and abstract that underlies historical materialism. This movement within concept is juxtaposed to the universalism. The philosophical investigations are followed by findings from Marxist legal theory that pinpoint the importance of concrete interventions into the legal theory that abate its ever-growing abstractness. In particular, the import of knowledges and practices divorced from the capitalist system is brought into focus. The paper concludes with a brief assessment of the possibility of overturning the rule of law universalism and a discussion on the emancipatory potential of law. (shrink)

La competencia léxica como parte de la competencia comunicativa contempla una serie de elementos entre los cuales el dominio de la valencia léxica constituye uno de los factores que permite distinguir los hablantes nativos de un idioma de aquellas personas que lo estudian como idioma extranjero o segunda lengua. Este artículo expone algunas consideraciones metodológicas para la implementación de un folleto sobre valencia léxica en Inglés con Fines Médicos para el perfeccionamiento del tecnolecto de los estudiantes de 5to año de (...) la carrera de Medicina, elaborado a partir de las necesidades cognoscitivas expresadas por parte de alumnos y profesores. El folleto facilita la adquisición y práctica de términos que enriquecen el tecnolecto; de esta forma se contribuye a un aprendizaje contextualizado, rápido y más eficaz por parte de los estudiantes. Además del carácter práctico de la propuesta, su fundamentación teórica puede servir de referencia para la elaboración de otros folletos. Lexical competence, as part of communicative competence, takes into account a series of elements among which mastering lexical valence is one of the factors allowing to distinguish native language speakers from people who study a foreign or a second language. The article presents methodological considerations for the implementation of a booklet on lexical valence in English for Medical Purposes which, developed from students and professors' cognitive needs, aims to improve fifth year medical students' technolect. It makes terms enriching technolect easier to practice and to acquire; therefore contributing to a contextualized, fast and more efficient learning by students. Apart from the practical character of the proposal, its theoretical basis can be used as reference for the development of other booklets. (shrink)

Ibn al-Sid al-Batalyawsi ( Badajoz 444/1052- Valencia 521/1127) es conocido básicamente por su actividad en el camppo de la gramática y la lexicografía, y por sus incursiones en la filosofía. También destacó en la ciencia del hadiz, inte-resándose además por cuestiones jurídicas y teológicas. Su obra se ha conserva-do prácticamente completa. Es valorada positivamente por los biográfos y el interés que ha despertado entre los investigadores modernos ha dado lugar a un buen número de ediciones críticas y estudios. Cuando un (...) investigador se acerca por primera vez a la figura de Ibn al-Sid comprueba, sin embargo, que los datos disponibles acerca de su vida son escasos y, en ocasiones, de difícil aprovechamiento, y piensa que probablemente a ello se deba la ausencia de un estudio monográfico sobre su trayectoria vital. Con este artículo se pretende llenar ese vacío. Mediante un examen detenido de las fuentes biográficas se pasa revista a los orígenes, formación, campos de actuación, discípulos y obras de Ibn al-Sid al-Batalyawsi. Asimismo se intenta fijar la cronología de sus múltiples desplazamientos e indagar en sus motivaciones, para terminar haciendo una valoración de su contribución general a la cultura de al-Andalus. La de Ibn al-Sid fue una vida a caballo entre dos épocas durante las cuales el poeta y secretario real, que viaja de taifa en taifa en busca de acomodo, tiene que adaptarse, no sin dificultades, a un nuevo contexto político y cultural, tras la conquista almorávid. Este artículo retoma la cuestión de los orígenes genealógicos del jurista mālikí y teólogo aš‘arí Ibn Rušd al-Ŷadd (m. 520/1126) —al que no hay que confundir con su famoso nieto, Ibn Rušd al-Ḥafīd o Averroes (m. 595/1198). Se aportan nuevas evidencias en apoyo de los argumentos presentados en mi “Explicit Cruelty, Implicit Compassion: Judaism, Forced Conversion and the Genealogy of the Banū Rushd” aparecido en Journal of Medieval Iberian Studies (2010), trabajo en el que examinaba la genealogía de la familia (...) a la luz del trato dado a los dimmíes por parte de los almohades, de la caída en desgracia con ellos de Averroes y su posterior confinamiento en Lucena. One of the main challenges for computational legal research is drawing up innovative heuristics to derive actionable knowledge from legal documents. While a large part of the research has been so far devoted to the extraction of purely legal information, less attention has been paid to seeking out in the texts the clues of more complex entities: legally relevant facts whose detection requires to link and interpret, as a unified whole, legal information and results of empirical analyses. This paper presents (...) an ongoing research that points in this direction, trying to devise new ways to support public prosecutors in assessing the dangerousness of individuals and groups under investigation, an activity that precisely relies on the cross-sectional evaluation of legal and empirical data. A knowledge mining strategy will be outlined that lines up, into a single metaheuristic model, information extraction, network-based inference, machine learning and visual analytics. We will focus, in particular, on the integration of graph-based inference and machine learning methods used both to support classification tasks and to explore new forms of man-machine cooperation. Experiments made involving public prosecutors from the Italian Anti-Mafia Investigation Directorate and using data from real investigations have not only shown the potentialities of our approach but also offered an opportunity to reflect on the role we could assign to AI when thinking about the future of legal science and practice.
