This paper contributes to the growing discussion about how to mitigate pharmaceutical pollution, which is a threat to human, animal, and environmental health as well as a potential driver of antimicrobial resistance. It identifies market approval of pharmaceuticals as one of the most powerful ways to shape producer behavior and highlights that applying this tool raises ethical issues given that it might impact patients’ access to medicines. The paper identifies seven different policy options that progressively give environmental considerations increased priority (...) in the approval process, identifies ethically relevant interests affected by such policies, and makes explicit tensions and necessary tradeoffs between these interests. While arguing that the current European regulation gives insufficient weight to environmental considerations, the paper highlights concerns with the strongest policy options, on the grounds that these may very well endanger patients’ access to effective medication. The aim of the present contribution is to defend a specific version of moderate skeptical invariantism, which I call Practical Skeptical Invariantism (PSI). The view is a form of skepticism to the extent that it denies knowledge of many facts that we ordinarily think or claim to know. It is moderate to the extent that it is supposed to be compatible with a quite weak, non-radical form of skepticism. According to this view, the threshold on evidential support required for knowledge (...) should be partially fixed by the practical circumstances of the subject: someone is in a position to know a proposition p only if she would be rational to act as if p even if the practical stakes on p were maximally high. I consider and address what I take to be the most pressing problem for the view, namely, that the view can’t avoid a collapse into a radical form of skepticism. Moreover, I propose a positive argument for this view. The argument relies on the claim that judgments in high stakes are generally more reliable than in low stakes. (shrink)

The notion of maximal greatness is arguably part of the very concept of God: something greater than God is not even possible. But how should we understand this notion? The aim of this paper is to provide a Śaivist answer to this question by analyzing the form of theism advocated in the Pratyabhijñā tradition. First, I extract a model of divine greatness, the Hierarchical Model, from Nagasawa’s work "Maximal God". According to the Hierarchical Model, God is that than which nothing (...) could be greater by virtue of being better suited than all other beings in relation to certain great-making properties (§1). I then offer an analysis of the form of theism advocated in the Pratyabhijñā tradition by discussing passages from the works of Somānanda, the founder of the Pratyabhijñā school, and of Utpaladeva, the most prominent of Somānanda’s disciples. I argue that the Pratyabhijñā theist cannot account for divine greatness in terms of the Hierarchical Model. My argument is that the Hierarchical Model requires a comparison between God and other beings that cannot be made with the Pratyabhijñā God (§2). Finally, I develop an original alternative model, the Unlimited Nature Model, that accounts for God’s maximal greatness in a way that suits Pratyabhijñā’s theism. According to the Unlimited Nature Model, the nature of all ordinary beings is metaphysically limited as a result of realizing only a small portion of the potential of what could be, and God is maximally great because only he has a completely unlimited nature (§3). Objectivism is the view that how an agent ought to act depends on all kinds of facts, regardless of the agent’s epistemic position with respect to them. One of the most important challenges to this view is constituted by certain cases involving specific conditions of uncertainty—so-called three-options cases. In these cases it seems overwhelmingly plausible that an agent ought to do what is recommendable given her limited perspective, even though the agent knows that this is not objectively the best course (...) of action. The standard objectivist response to this challenge relies on a distinction between what one ought to do and what would be blameworthy or unreasonable to do. This response is affected by several problems. In this paper I introduce and defend an alternative objectivist response to the challenge. My proposal admits that in the relevant cases the agent ought to do what is recommendable given her perspective, but maintains that this diagnosis of the cases is fully compatible with objectivism. I argue that this proposal has several advantages over alternative accounts of the cases. (shrink)

Assisted reproductive technologies have greatly increased our control over reproductive choices, leading some bioethicists to argue that we face unprecedented moral obligations towards progeny. Several models attempting to balance the principle of procreative autonomy with these obligations have been proposed. The least demanding is the minimal threshold model (MTM), according to which every reproductive choice is permissible, except creating children whose lives will not be worth living. Hence, as long as the future child is likely to have a life worth (...) living, prospective parents may be allowed to use preimplantation genetic diagnosis (PGD) to select embryos with genetic diseases or disabilities. Assuming a consequentialist person‐affecting view of morality, this paper investigates whether the MTM is an appropriate tool to guide procreative decisions given the continuous development of reproductive genetic technologies. In particular, I consider germline genome editing (GGE) and I argue that its application in human reproduction, unlike PGD, should be conceived as person‐affecting towards future progeny. I claim that even if we assume the plausibility of the MTM within PGD, we are committed to accepting that a greater moral obligation towards progeny should guide procreative decisions if GGE were available. In this case, the MTM should no longer be considered an appropriate instrument to guide procreative choices. Finally, I investigate when we face this greater moral obligation, concluding that it applies only when prospective parents have already engaged in the in vitro fertilization process. (shrink)

Attending to diverse practices of everyday living and doing—of form, style, and scenography—in Rancière’s writings, Panagia characterizes Rancière as a sentimental thinker for whom the aesthetic is indistinguishable from the political. Rather than providing prescriptions for political judgment and action, Rancière focuses on how sensibilities and perceptions constitute dynamic relations between persons and the worlds they create. Panagia traces this approach (...) by examining Rancière’s modernist sensibilities, his theory of radical mediation, the influence of Gustave Flaubert on Rancière’s literary voice, and how Rancière juxtaposes seemingly incompatible objects and phenomena to create moments of sensorial disorientation. This approach is not limited to the two figures you invoke in your question. The linguistic turn also has two stages of development that, from my experience, have been more noticeable in France than in the United States. The first phase, then, emerged with Lévi-Strauss and his structural approach to social relations founded on a linguistic model of relationality, subsequently reprised in Lacan's psychoanalytic notion that "the unconscious is structured like a language" that, in its turn, conjoins the energetic mental processes Freud discusses to linguistic practices. The primacy of "the linguistic" thus granted language all the properties of the Freudian unconscious [End Page 113] along with those of a Marxist notion of infrastructure. The Saussurian opposition between langue and parole provided a privileged status to a linguistic model whose role was that of a general law that unconsciously structures the behavior of individuals and societies. It is on the basis of these parameters that the structuralist moment of the linguistic turn was constituted. At one and the same time, the analysis of speech acts became first and foremost a "symptomatic" analysis of those procedures of misrecognition that linguistically structured both the behavior of individuals and social relations. In a recent paper (Okasha, Mind 120:83–115, 2011), Samir Okasha uses Arrow’s theorem to raise a challenge for the rationality of theory choice. He argues that, as soon as one accepts the plausibility of the assumptions leading to Arrow’s theorem, one is compelled to conclude that there are no adequate theory choice algorithms. Okasha offers a partial way out of this predicament by diagnosing the source of Arrow’s theorem and using his diagnosis to deploy an approach that circumvents it. In (...) this paper I explain why, although Okasha is right to emphasise that Arrow’s result is the effect of an informational problem, he is not right to locate this problem at the level of the informational input of a theory choice rule. While prior research suggests a link between mindfulness and ethical decision-making, most of the evidence for this link is correlational and refers to self-focused ethical behaviors. The paucity of experimental evidence, coupled with a lack of clarity on what mechanisms underlie the effect, limits our understanding of whether and how mindfulness might foster other-focused ethical behaviors. In this research, we hypothesize that state mindfulness might promote other-focused ethical behaviors by increasing resourcefulness, which we define as a perceived state of resource (...) abundance. Across four experimental studies, we report causal evidence for the effects of state mindfulness instantiated through brief mindful meditation exercises on other-focused ethical behaviors, including choice of fair-trade products, charitable giving, and volunteering. Resourcefulness mediates the effects of mindfulness on other-focused ethical behaviors. Our work answers the call for more experimental research on mindfulness and its important implications for ethical decision-making. (shrink)

Baker claims to provide an example of mathematical explanation of an empirical phenomenon which leads to ontological commitment to mathematical objects. This is meant to show that the positing of mathematical entities is necessary for satisfactory scientific explanations and thus that the application of mathematics to science can be used, at least in some cases, to support mathematical realism. In this paper I show that the example of explanation Baker considers can actually be given without postulating mathematical objects and thus (...) cannot be used by the mathematical realist. I also show that, despite this, mathematics keeps playing an important methodological role in the explanation and does not reduce to a merely computational or descriptive framework. (shrink)

This essay provides an overview of the working mechanisms of abductive reasoning and discusses the possible applications of this logic tool in comparative law research. Indeed, abductive reasoning pertains to the role of explanatory reasoning in formulating hypotheses and, as commonly utilised in contemporary literature of social sciences, in verifying those ideas. Comparative thinking is a logic process of the human mind that employs a particular set of logic and epistemic tools to manage and process data. Arguing that comparative law (...) has not conceptualised a precise and consistent method but only a set of practical guidelines to guide the research process of scholars, this study claims that observation of socio-legal phenomena and theory formation are not only inherently linked in comparative law research but also already theory-driven through an abductive logic process. In this sense, the scholar of comparative law does not rely exclusively on the logic instruments of the traditional legal practitioner but can deepen the potentialities of an abductive logic of discovery and justification already scrutinised by the other human and social sciences. While it is not desirable for the science of comparative law to adopt a single rigid method for research but to maintain a methodological flexibility open to interdisciplinarity, it must question the logic of discovery and justification of its results in a manner similar to that of the other social sciences of which it is a full member. Accordingly, it is assumed that the logic set of tools of comparative law can be enriched by developing the potentialities of the structure of abductive reasoning. (shrink)

Certain mathematical problems prove very hard to solve because some of their intuitive features have not been assimilated or cannot be assimilated by the available mathematical resources. This state of affairs triggers an interesting dynamic whereby the introduction of novel conceptual resources converts the intuitive features into further mathematical determinations in light of which a solution to the original problem is made accessible. In lieu of an abstract, here is a brief excerpt of the content:Let Us Be Human:Primo Levi and Ludwig WittgensteinDavide SpartiThe demolition of a man is difficult, almost as much as creating one.— Primo Levi1The modest but also remarkable ambition of Primo Levi's most important book Se questo è un uomo is "to provide material for a quiet [pacato] study of certain aspects of the human soul [animo umano]."2 More precisely, its ethical core (and its title) concerns itself with the (...) loss of our humanity, with the inexorable destruction of what is human.3 The book describes such patterns of dehumanizing through a number of mechanisms operating in the concentration camps of Auschwitz–Birkenau, where Levi was deported. By showing how the Nazis viewed the camp inmates as completely disconnected from their own lives, Levi bears witness to the Nazis' restricted willingness to grant humanity, to their denial of the internal relation which ties them to the inmates. Since the book offers insights for those who ask themselves "what is it to be human?" (and what remains of the human in extreme situations?), its main philosophical issue is whether or not something admits being seen as human.4Wittgenstein describes the attitudes we adopt in reacting to other creatures by analyzing the grammar of "seeing something as something:" only of a living human being, he famously adds, can we say: he [End Page 444] or she has a soul (see also PI, § 281).5 That the human body stands as one of the criteria for the ascription of psychological predicates—that human beings are endowed with an expressive power that neither statues nor animals possess; that human beings around us exert by their very presence a power which belongs uniquely to them—is suggested by the fact that even when we fantasize about living chairs or tables, for example in cartoons, we tend to lend human features to such animated furniture. So, according to Wittgenstein there is a conceptual connection between psychological predicates and certain kinds of human expression. But, one must add, this connection is achieved only through use, and is given only within the context of a form of life. The context of a shared form of life is needed because without it those forms of expressive behavior would not be intelligible: only if I am prepared to regard the object before me as a human being will I smile back and even talk to it. A living body is hence not enough: what is needed is a role through which such expressions are performed and have a point.In a similar vein, Levi shows the extent to which our experience of something as human depends on our relation to it—on the quality of our stance towards it. If it makes sense to speak of seeing somebody as a human being, it is because we can imagine individuals who lack or lose such a capacity or willingness. And it is precisely within the context of the concentration camp that what admits being seen as human changes drastically.In this essay I will draw lines of connection between Levi and Wittgenstein by relying on Stanley Cavell's crucial notions of avoidance and acknowledgment. After showing how such notions play a role in Wittgenstein's remarks on the so called "other mind" problem, I will turn to Levi and show how his remarks on the denial of the human in the concentration camp supplement Wittgenstein's grammatical remarks and can also be fruitfully read using the categories of avoidance and acknowledgment.6Although Wittgenstein does offer some remarks on Nazism, was personally engaged in protecting his family after the annexation of Austria, and mentions the Russian gulags in conversation with Rhees, he was never concerned with any empirical analysis of specific, let alone extreme, human situations. In light of this, it is clear that life in the concentration camp cannot be grasped and explained by simply relying on a few Wittgensteinian categories. However, the points Levi raises, as I will show in the conclusion, reveal an analogy with some of the [End Page 445] questions that worried Wittgenstein. This paper examines the ethological notion of ritualization from the perspective of zoosemiotic studies. Instead of moving within the horizon of traditional semiotic approaches to this phenomenon, my aim is to propose an alternative attempt of modelling based on the linguistic and semiotic concepts of context and contextuality. At the same time, the paper identifies ritualization as a case of exaptation, suggesting the extension of the context-based model within evolutionary biology and the agenda of its semiotic description, namely biosemiotics. Believing in free will may arise from a biological need for control. People induced to disbelieve in free will show impulsive and antisocial tendencies, suggesting a reduction of the willingness to exert self-control. We investigated whether undermining free will affects two aspects of self-control: intentional inhibition and perceived self-control. We exposed participants either to anti-free will or to neutral messages. The two groups then performed a task that required self-control to inhibit a prepotent response. No-free will participants showed less intentional (...) inhibitions than controls, suggesting a reduction of self-control. We assessed perceived self-control by asking participants whether the response resulted from a deliberate intention or from an impulsive reaction. Perceived self-control was lower in the no-free will group than in control group. Our findings show that undermining free will can degrade self-control and provide insights into how disbelieving in free will leads to antisocial tendencies. (shrink)

This paper offers an original interpretation of the Daodejing 道德經 as containing a distinctive account of creation. In my reading, the Daodejing envisions the creation of the cosmos by Dao (1) as a movement from the absence of phenomenal forms to phenomenal forms and (2) as a movement from nothingness to existence. I interpret creation as a unique metaphysical operation that explains how (1) and (2) are possible. The paper is organized into two sections. First, I introduce the distinctions between (...) the lack and presence of phenomenal forms (§1.1) and between nothingness and existence (§1.2), using them to map the distinction between Dao and the created world. Then, I propose my account of the Daodejing’s metaphysics of creation (§2.1) and elaborate on its connection with the previously drawn distinctions while answering a potential objection (§2.2). I conclude with some considerations about the connections between the Daodejing’s view of creation and its soteriology. (shrink)

According to intentionalism, the phenomenal character of experience is one and the same as the intentional content of experience. This view has a problem with moods (anxiety, depression, elation, irritation, gloominess, grumpiness, etc.). Mood experiences certainly have phenomenal character, but do not exhibit directedness, i.e., do not appear intentional. Standardly, intentionalists have re-described moods’ undirectedness in terms of directedness towards everything or the whole world (e.g., Crane, 1998; Seager, 1999). This move offers the intentionalist a way out, but is quite (...) unsatisfying. More recently, Angela Mendelovici (2013a, b) has suggested something that looks more interesting and promising: instead of re-describing moods’ phenomenology, she accepts its undirectedness at face value and tries to explain it in intentionalist terms. In this paper, I focus on and criticize Mendelovici’s proposal. As I will show, despite its prima facie virtues, the view is poorly motivated. For, contrary to what Mendelovici argues, introspection does not support her proposal—arguably, it provides some evidence against it. So, the problem that intentionalism has with moods is not solved, but is still there. (shrink)

The so-called transparency of experience (TE) is the intuition that, in introspecting one’s own experience, one is only aware of certain properties (like colors, shapes, etc.) as features of (apparently) mind-independent objects. TE is quite popular among philosophers of mind and has traditionally been used to motivate Representationalism, i.e., the view that phenomenal character is in some strong way dependent on intentionality. However, more recently, others have appealed to TE to go the opposite way and support the phenomenal intentionality view (...) (PIV), according to which intentionality is in some strong way dependent on phenomenal character. If this line of argument succeeds, then not only TE does not speak in favor of Representationalism, but it actually speaks against it, contrary to the philosophical common-sense of the last two decades. Moreover, the representationalist project of naturalizing phenomenal character turns out to be seriously undermined on the same intuitive grounds that were supposed to make it plausible. In this paper, I reconstruct and discuss the line of argument from TE to PIV and argue that our introspective intuitions (TE) do not push us in the direction of PIV. On the contrary, the line of argument from TE to PIV is (at best) simply too weak to force us to conclude that intentionality depends on phenomenal character in the sense required for PIV to be true. A recent view in contemporary epistemology holds that practical reasoning is governed by an epistemic norm. Evidence for the existence of this norm is provided by the ways in which we assess our actions and reasoning on the basis of whether certain epistemic conditions are satisfied. Philosophers disagree on what this norm is—whether it is knowledge, justified belief or something else. Nobody however challenges the claim that practical reasoning is governed by such a norm. I argue that assuming the existence (...) of an epistemic norm of practical reasoning is neither the only nor the best way to accommodate the available data. I introduce and defend an alternative account that avoids the assumption. According to this account, the relevant epistemic assessments of action and reasoning are instrumental assessments relative to the regulation conditions of a non-epistemic norm. (shrink)

I introduce and defend a view about knowledge that I call Moderate Skeptical Invariantism. According to this view, a subject knows p only if she is practically certain that p, where practical certainty is defined as the confidence a rational subject would have to have for her to believe that p and act on p no matter the stakes. I do not provide a definitive case for this view, but I argue that it has several explanatory advantages over alternative views (...) and I show how it can avoid two pressing problems commonly addressed to similar approaches. The present joint contribution offers a tentative comprehensive re-interpretation of Pāṇini’s rule A 2.3.46, and shows how that rule teaches the application of the nominative ending without making use of the notion of “subject,” a notion that belongs to other grammatical systems, but not to Pāṇini’s. We discuss the controversial domain of some segments of its wording by attempting to adhere to Pāṇini’s framework and his usus scribendi. In particular, we read the first constituent of the compound prātipadikārtha­ liṅgaparimāṇavacana­ as (...) a genitive depending on a dvandva made up of three constituents, i.e., artha­, liṅga­, and parimāṇavacana­, and we take parimāṇa­ as denoting a quantity that, combining with vacana­, is substantially equivalent to the concept of grammatical number in modern linguistics. We finally show that our reading of A 2.3.46 is able to generate the nominative endings affixed to the subject and predicate of a nominal sentence: as a consequence, nominal sentences might actually not have been neglected by Pāṇini. John Dewey’s theory of education, despite having become a reference point for the pedagogical sciences, has been subjected to much criticism. One of the most significant attacks came from Jerome Bruner, who questioned Dewey’s principles as set forth in his “My Pedagogic Creed”.1 Bruner chose that book for criticism because it foreshadowed much of the later writing on education by the American philosopher, and he assessed the five articles of faith contained therein against the background of the deep changes that (...) had occurred in conceptions of society, social institutions, and man. In this paper, we aim at rethinking the concept of obesity in a way that better captures the connection between underlying medical aspects, on the one hand, and an individual’s developmental history, on the other. Our proposal rests on the idea that obesity is not to be understood as a phenotypic trait or character; rather, obesity represents one of the many possible states of a more complex phenotypic trait that we call ‘energy metabolism.’ We argue that this apparently simple conceptual (...) shift can help solve important theoretical misconceptions regarding the genetics, epigenetics, and development of obesity. In addition, we show that our proposal can be fruitfully paired with the concept of developmental channeling of a trait, which connects to the study of the plasticity and canalization of complex traits. Finally, we discuss the potential impact of our approach on the assessment, treatment, and social narratives of obesity. (shrink)

In this paper we show that axiomatic extensions of H. Wansing’s connexive logic $$\textsf{C}$$ ( $$\textsf{C}^{\perp }$$ ) are algebraizable (in the sense of J.W. Blok and D. Pigozzi) with respect to sub-varieties of $$\textsf{C}$$ ( $$\textsf{C}^{\perp }$$ )-algebras. We develop the structure theory of $$\textsf{C}$$ ( $$\textsf{C}^{\perp }$$ )-algebras, and we prove their representability in terms of twist-like constructions over implicative lattices (Heyting algebras). As a consequence, we further clarify the relationship between the aforementioned classes. Finally, taking advantage of (...) the above machinery, we provide some preliminary remarks on the lattice of axiomatic extensions of $$\textsf{C}$$ ( $$\textsf{C}^{\perp }$$ ) as well as on some properties of their equivalent algebraic semantics. Particular attention is paid to the logic of partial Boolean σ\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\sigma $$\end{document}-algebras, to characterizations of PBAs embeddable into Boolean (σ\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$\sigma $$\end{document}-)algebras, and their representation as self-adjoint idempotent (...) elements of partial commutative algebras with involution. Also, applications to the theory of orthomodular posets as well as Czelakowski’s theory of partial Boolean algebras in a broader sense will be discussed.
