This essay examines how rape of women and girls by male soldiers works as a martial weapon. Continuities with other torture and terrorism and with civilian rape are suggested. The inadequacy of past philosophical treatments of the enslavement of war captives is briefly discussed. Social strategies are suggested for responding and a concluding fantasy offered, not entirely social, of a strategy to change the meanings of rape to undermine its use as a martial weapon.

ZusammenfassungDie Uterustransplantation ermöglicht Frauen mit einer absoluten uterinen Infertilität eine Schwangerschaft mit biologisch eigenem Kind. Das neuartige experimentelle Verfahren wirft eine Reihe von ethischen Fragen auf. Ziel dieses Artikels ist es, relevante ethische Problemkonstellationen im Kontext der Uterustransplantation überblickshaft darzulegen und kritisch zu diskutieren. Als systematischer Rahmen der Darstellung dienen die vier Prinzipien der Medizinethik Autonomie, Nicht-Schaden, Wohltun und Gerechtigkeit nach Beauchamp und Childress. Nach eingehender ethischer Betrachtung plädieren die Autorinnen mit Blick auf die Akkumulation schwerwiegender ethischer Probleme für die (...) Notwendigkeit einer grundlegenden und umfassenden ethischen Debatte über Uterustransplantation. The paper emphasizes the inadequacy of formal semantics, the classical paradigm in semantics, in treating contextual dependence. Some phenomena of contextual dependence threaten one central assumption of the classical paradigm, namely the idea that linguistic expressions have a fixed meaning, and utterances have truth conditions well defined. It is possible to individuate three forms of contextual dependence: the one affecting pure indexicals, the one affecting demonstratives and "contextual expressions", and the one affecting all linguistic expressions. The third type of dependence (...) is top-down: context, and not only linguistic material, shows which variables must be instantiated, relying on context itself. The generalization of underdetermination to all linguistic expressions is in fact a kind of metadependence: the mode of dependence itself depends on context. (shrink)

Contextualism is a view about meaning, semantic content and truth-conditions, bearing significant consequences for the characterisation of explicit and implicit content, the decoding/inferring distinction and the semantics/pragmatics interface. According to the traditional perspective in semantics (called "literalism" or "semantic minimalism"), it is possible to attribute truth-conditions to a sentence independently of any context of utterance, i.e. in virtue of its meaning alone. We must then distinguish between the proposition literally expressed by a sentence ("what is said" by the sentence, its (...) literal truth-conditions) and the implicit meaning of the sentence ("what is implicated" by a speaker uttering the sentence). Over the past forty years, however, an increasing number of linguists and philosophers have begun to underline the phenomenon of semantic underdetermination: the encoded meaning of the sentence employed by a speaker underdetermines the proposition explicitly expressed by an utterance of that sentence. According to the extreme version of this perspective – labelled "radical contextualism" - no sentence of a natural language expresses a complete proposition, or has fixed truth-conditions, even when unambiguous and devoid of indexicals. A sentence expresses a proposition only when completed and enriched with pragmatic constituents that do not correspond to any syntactic element of the sentence and yet are part of its semantic interpretation. More broadly, "contextualism" may be used to refer to a family of views which includes moderate contextualism (also called "indexicalism"), radical contextualism and non-indexical contextualism – and which contrasts with semantic minimalism. Galen’s elemental mixture of fire, air, water and earth (and of the corresponding primary qualities, hot, cold, dry and wet) is primarily a physical process, in which primary elements mix and give rise to all compounded physical bodies, inanimate and animate. As such, the concrete, physical process of mixture is an essential basis for a thorough understanding of Galen’s physical system. In this article I pursued a twofold aim. First, I showed Galen’s syncretic approach while expounding his theory of mixture (...) (insofar as he attributes that theory equally to ‘Hippocrates’, Aristotle and the Stoics) and illustrated the reasons behind this approach. Second, and more importantly, I addressed Galen’s epistemological position concerning mixture’s constituents and answered the question of whether, according to Galen, are the qualities alone, conceived more Aristotelico as conceptually distinct from the body itself, to mix or if Galen viewed mixture, as the Stoics did, as a coextension of bodies. As we argue, Galen assigns the epistemological status of πιθανόν to the Aristotelian and Peripatetic doctrines. This indicates that, to a certain extent, he joins this historical debate and is more closely aligned with Aristotle and the Peripatetics than with the Stoics. By resorting to what is πιθανόν Galen obtains two results: (1) does not expose himself to accusations of dogmatism but, at the same time and in his method, enters the ongoing controversy about qualities and bodies without taking a definitive position, and (2) he preserves his syncretic theoretical structure which finds its linchpin in the defence of a medical-cum-philosophical continuism. In this paper, I argue that Marx's central concern, consistent throughout his works, is to challenge and overcome hierarchical oppositions, which he considers as the core of modern, capitalist societies and the cause of alienation. The young Marx critiques the hierarchical idealism/materialism opposition. In this opposition, idealism abstracts from and reduces all material elements to the mind (or spirit), and materialism abstracts from and reduces all mental abstractions to the body (or matter). The mature Marx sophisticates this critique with his (...) theory of the commodity fetish. The commodity fetish abstracts the exchange-value (the mind) from the commodity's use-value (the body). Although Marx aims to challenge capitalism by abolishing the hierarchical relation among binary oppositions, I show that in his early and later writings on the working-class woman, he reinforces hierarchical binaries, pointing at the gendered unconscious structure of capitalism. Nature experiences usually lead to restorative effects, such as positive affective states and reduced stress. Even watching nature compared to urban images, which are known to differ in several image properties that are processed at early stages, can lead to such effects. One potential pathway explaining how the visual input alone evokes restoration is that image properties processed at early stages in the visual system evoke positive associations. To study these automatic bottom-up processes and the role of lower-level visual processing (...) involved in the restoring effects of nature, we conducted two studies. First, we analyzed nature and urban stimuli for a comprehensive set of image properties. Second, we investigated implicit associations in a dichotomous set of nature and urban images in three domains, namely, valence, mood, and stress restoration. To examine the role of lower-level processing in these associations, we also used stimuli that lacked the spatial information but retained certain image properties of the original photographs. While original nature images were associated with “good,” “positive mood,” and “restoration,” urban images were associated with “bad” and “stress.” The results also showed that image properties differ between our nature and urban images and that they contribute to the implicit associations with valence, although spatial information and therefore recognition of the environment remained necessary for positive associations. Moreover, lower-level processed image properties seem to play no or only minor roles for associations with mood and stress restoration. (shrink)

Aus ihrer Anwendung folgen die Begriffe des Guten und Bösen.

In "Demonstratives" Kaplan claims that the occurrence of a demonstrative must be supplemented by an act of demonstration, like a pointing (a feature of the objective context). Conversely in "After-thoughts" Kaplan argues that the occurrence of a demonstrative must be supplemented by a directing intention (a feature of the intentional con-text). I present the two theories in competition and try to identify the constraints an intention must satisfy in order to have semantic rele-vance. My claim is that the analysis of (...) demonstrative reference pro-vides a reliable test for our intuitions on the relation between objective and intentional context. I argue that the speaker's intentions can play a semantic role only if they satisfy an Availability Constraint: an inten-tion must be made available or communicated to the addressee, and for that purpose the speaker can exploit any feature of the objective con-text. This thesis implies the reconciliation between "Demonstratives" and "Afterthoughts". (shrink)

This article argues that the abundance of Greek figures and scenarios in Kittler’s recent work points to a shift in his oeuvre, which, however, does not represent a radical break with his ‘hardware studies’. At the turn of the 21st century, Kittler champions an emphatic notion of culture as a necessary supplement to science and technology. This conceptual marriage mediates grand historical narratives of cultural identity. Specifically, Kittler’s texts provide us with narratives of Greek origin which serve to re-capture collective (...) identities in the age of globalization. On the explicit level, this identity is predominantly European, but the search has national components as well. With his turn to culture, the organizing trope of 19th-century German nationalism, Kittler has also embraced the legacy of German philhellenism, which articulated national identities through the theme of ‘elective affinity’. Kittler’s Greece occupies the very structural place it had in 19th-century German philhellenism: It stands in for both the foundation of European civilization and its virtual better self, a realm of sensual culture untainted by modern capitalism and Empire. Most of the figures inhabiting this realm are familiar from 19th-century discourse as well, but these discursive loops are fueled by contemporary feedback. Kittler’s Greek narratives have developed out of postwar academic discourses and connect to other post-unification Greek fantasies. (shrink)

In all western countries health care budgets are under considerable constraint and therefore a reflection process has started on how to gain the most health benefit for the population within limited resource boundaries. The field of ethics of resource allocation has evolved only recently in order to bring some objectivity and rationality in the discussion. In this article it is argued that priority setting is the prerequisite of ethical resource allocation and that for purposes of operationalization, instruments such as need (...) assessment and health technology assessment (HTA) are essential worktools for making more rational decisions. Thresholds (deduced from the need assessment and HTA) are - within this context - guiding but not binding principles. -/- Discussion of theoretical concepts of not only priority setting, need assessment and HTA complemented by practical examples for showing the challenges and the need, but also the chances of a more explicit and transparent policy of resource allocation in health care. Results: Priority setting in health care is based on the values of equity, justice and solidarity. Health packages decisions are determined from medical need (the severity of the condition) and/or the appropriateness of medical interventions (their cost-effectiveness). With growing awareness that originally effective and cost-effective services and programmes are eventually provided inappropriately, the focus is shifting towards the organisational aspects of provision and application. Therefore, need assessment is based on the distinction of health care needs from demand, supply, or actual care. Additionally HTA provides the evidence on health care interventions in a way that it becomes obvious who benefits from an intervention and who definitely does not benefit, but eventually is harmed. -/- Health services research on effective and cost-effective interventions and research/monitoring of performance that the effective and cost-effective services are provided appropriately are of increasing importance for guiding the decision-making process on priority setting and need assessment. Effective healthcare for all is sustainable, if we start to put expenditures in perspective and focus health policies and research strategies on managing expectations through patient information and a more realistic notion of medical advancements and, on the other hand, on encouraging need-based and cost-effective innovations. The present research was designed to investigate the absolute and relative levels of ethical convictions of executive search consultants, or "headhunters", in regard of their search practices. Executive search consultants were defined as trained specialists who helped client organizations identify and evaluate the suitability of job candidates for top, senior, and middle-level management and executive positions. Despite frequent reports of unethical search practices in the media, results based on a sample of 184 headhunters and non-headhunter executives showed that headhunters were (...) inclined to adhere stringently to a selected set of ethical values, both in absolute terms and in comparison with the expectations of non-headhunter executives. The differences had implications not only for the integrity and continued existence of the headhunting profession, but also for the ethical development of new executive search consultants. This article presents some culture and social influences in the construction of Brazilian identity in the hypermodern society of big cities. For that I’ll analyze the advertising world that represents this contemporanea society. I’ll describe some results of my doctorate thesis defended in May of 2007 with I pointed out the thematic and strategies of publicity persuasions more appeared in the more consumed magazines in Brazil in 2005, mainly the emotional strategies of publicity that are frequently used in this country (...) which I related them to the hypermodern values. Now I point out some reflexions to understand possible social relationships caused from those identities that appear in advertisings. The social media influence the ways of living, so they represent important material to study and comprehend the problems of contemporaneous social relationships. (shrink)

Este estudo pretende discutir as relações existentes entre mídia e educação, analisando as políticas públicas que influenciaram a criação da TV Pendrive, identificando a percepção dos professores acerca da mesma. Justifica-se pelo fato de que no ano de 2007 o governo federal criou o Programa Nacional de Tecnologia Educacional (ProInfo), com o objetivo de informatizar o ensino, buscando promover uma educação com maior qualidade. Nesse contexto, a Secretaria de Estado da Educação do Paraná, com vistas à inclusão e ao acesso (...) de alunos e professores da rede pública estadual às novas tecnologias, criou o projeto TV Pendrive. Para a concretização desse estudo, foram realizadas pesquisas e análises bibliográficas, bem como um levantamento com professores da educação básica pública estadual da cidade de Londrina/PR, visando a identificar a percepção dos mesmos em relação à TV Pendrive. Como resultado, constatou-se que as políticas públicas, especialmente as voltadas à educação, parecem ser implantadas pelo governo sem a anuência dos educadores. (shrink)

The essay focuses on human self-understanding as it arises from out of the experience of nature—the experience of a relatedness to nature that is at once a belonging in nature. At stake, then, is not a conceptual approach to the question of nature but rather the emergence of the human within the embrace of what presents itself as a mystery irreducible to the human, inhuman in the sense of other-than-human. The experience of nature “hiding itself” gave rise to the longing (...) for mastery as well as to a celebration of the mystery in its wonder and beauty. The juxtaposition of Giordano Bruno's cosmological vision and Renaissance painting illuminates this latter perspective, disclosing mystery not so much as that which would lie beyond appearances, but as that which inhabits appearances and in them becomes manifest as such. Probably during the years at the Academy, Aristotle wrote a work known as Περὶ τἀγαθοῦ, on the good, exposing Plato’s teachings on the principles. Various sources confirm that Plato gave public lectures on the theme of the good, most notably Aristoxenus of Tarentum, who would in turn become Aristotle’s student. In his treatise on harmony, Aristoxenus recalls that, while many would gather to listen to Plato, they would leave dismayed since, instead of hearing about the good in the quotidian sense (...) of the term, they would be subjected to speeches on mathematics and geometry, culminating with the statement of the identity of the good and the one. The testimony is worth quoting, despite the ritual reservations surrounding Aristoxenus’ reports, especially those about Plato. (shrink)

"On the Way to a Metaphysics of Freedom: Kant's Idea to accomplish the Kopernicanic Shift by the Experiment of the Reason with itself." 1) Kant's Kopernicanic shift is read as an attempt to solve a main problem of the rationalistic tradition on metaphysics (Leibniz-Wolff; Spinoza): Adopting a method developed in analogy to the successful revolutions within the mathematical and the natural sciences, he tries to find a criterion for an uncontradictional concept of a future metaphysics. We analyze his method, goals (...) and achievements. 2) Contrasting Kant's concept of freedom as the grounding dimension of his meta-physical theory with the post-Kantian systems (Fichte, Schelling, Hegel)--the conclusions are: Only by the distinction between the noumenal and the phenomenal sphere, Kant is able a) To reconciliate the rational ideas of the absolute (rooting the postulate of freedom) with the permanent revision of our natural and scientific access to the world; b) To find a new foundation for the three main topics of a future 'metaphysica specialis'; (in modern terms): the body-mind discussion; freedom as the basis of morality and God (within the horizon of a 'theologic negativa').
