However diverse and even conflicting definitions of world literature may be, there is a consensus in previous scholarship about circulation as a key defining feature. Being circulation modeled and (in)validated by a corpus of statutes, rules, and regulations, the absence of a law-oriented approach to world literature appears completely contradictory. This essay is a first step toward a more sustained treatment of world literature and law. Here I claim that in the late 1830s the history of world literature as mastered (...) by the West started to change as a consequence of the first two international copyright laws in the world––the Prussian Statute of 11 June 1837 and the British Act of 31 July 1838. The Prussian law is discussed in relation to the evolution of the Collection of British Authors of the German firm Tauchnitz between 1841 and 1847 by paying special attention to the case of American writers. The British law, in turn, is discussed in relation to French piracies of works printed in the UK by focusing on Frances Trollope’s Domestic Manners of the Americans (1832). Both laws sowed the seeds of the 1886 Berne Convention, whereby a vast transcontinental geography with a population of over five hundred million people was created for the legal circulation of literary works. The Feminist Movement, born from gender violence intensified by the Narco War and entrenched cultural norms, is a response to these issues. Borderland women have raised their voices through protests on Women's International Day, advocating for legal reforms like nationwide abortion legalization and using social media to spotlight (...) these tragic realities. Despite facing violence and adversity, Juarense women persist in their unwavering pursuit of societal change. Si, pour Heidegger, Nietzsche représente le dernier penseur de la métaphysique, ce n’est pas seulement en raison de son appartenance à la conceptualité de l’onto-théologie ni des limites intrinsèques à sa tâche d’un renversement du platonisme. La lecture des traités et des cahiers posthumes concernant la pensée de l’ Ereignis précise la critique heideggérienne et la complète par l’opposition totale à la tentative d’un élevage ( Züchtung ) de l’être humain supérieur. En effet, Heidegger voit dans la notion d’élevage la (...) fixation voire la radicalisation, à l’époque de la fabrication ( Machenschaft ), de la définition métaphysique de l’être humain comme animal rationale. Contre la Züchtung nietzschéenne, il pense la possibilité d’une préparation ( Vorbereitung ) du Da-sein, comme la plus haute transformation de l’essence humaine. Ce sont les rapports de ces deux notions, l’élevage tel qu’il apparaît dans la critique heideggerienne de Nietzsche, et le concept qu’il lui oppose, la préparation, que nous analysons dans cet article, en exposant non seulement la manière dont l’un répond à l’autre, mais également les limites de ce couple de concepts. Par là, nous cherchons d’une part à mieux comprendre la place de Nietzsche dans le projet de l’histoire de l’Être, et, d’autre part, à déterminer la portée de son dépassement. (shrink)

Currently, millions of minors are being inoculated against SARS-CoV-2 in many countries in the world. Ethical concerns about clinical research involving children have barely been addressed in the literature, despite the fact that the paediatric population is particularly vulnerable within this context. Children should be included in the research plans for COVID-19 vaccines. Nevertheless, it is necessary to critically assess to what extent clinical trials are being conducted according to methodological and ethical criteria that allow us to conclude that the (...) results are valid and, in consequence, how far the vaccination plans for children are scientifically justified.The principal aim of this article is to analyse critically the process of clinical research on COVID-19 vaccines involving children, highlighting the ethical concerns that arise, including the need to stratify the results from older adolescents separately for analysis before proceeding, if further research is warranted, in descending age order. The development of COVID-19 vaccines is examined, with a special look at the participation of children throughout their clinical development, including a review of the clinical trials registered in three international databases. We also offer some additional considerations about the inclusion of minors in vaccination plans. Finally, we conclude with some recommendations, with particular emphasis on the following ethical duties: research in children should be carried out only once the relevant research in adults has previously been conducted; issues that concern children’s needs and rights should be specifically addressed; and, therefore, the highest standards of ethical and scientific quality should be met. In this paper we analyse utterances that, without explicitly constituting hate speech, nevertheless convey a hateful message. For example, in the headline “Iraqi Refugee is convicted in Germany of raping and murdering teenage girl”, the presence of “Iraqi refugee” does not seem arbitrary. To the contrary, it is responsible for inviting a racist inference against Iraqi refugees. We defend that these inferences cannot be described as slurs, ethnic or social terms used as insults, dogwhistles or conversational implicatures. Rather, we propose (...) that these inferences are insinuations, specifically provocative insinuations, as no conversational response seems effective at blocking them. (shrink)

La vigilancia tecnológica, que comienza como un mecanismo empresarial de captación y fidelización clientelar, ha conocido un desarrollo tecnológico tal que, junto a la obtención masiva de datos producidos de forma inconsciente y su tratamiento por la inteligencia artificial, ha permitido la anticipación de las tendencias y la supervisión constante de los deseos e intereses de los usuarios. La integración de vigilancia y consumo ha supuesto que esta lógica del mercado pueda ser entregada a la gubernamentalidad, transformando la racionalidad disciplinaria (...) estática en múltiples dinámicas de observación de una población móvil pero controlable en términos biopolíticos, de modo que el deseo y la libertad se convierten así en dimensiones activas de una economía política actual. Se ofrecen algunos ejemplos de este auténtico panoptismo digital, como puede comprobarse con el uso de navegadores, las aplicaciones financieras, la hipersegmentación de nichos de consumo o el internet de las cosas. Por último, se analiza el tránsito de esta vigilancia hacia una lógica de gobierno basada en la predeterminación de los intereses: es el paso del panoptismo a la gubernamentalidad. (shrink)

O diálogo Teeteto sempre ocupou lugar de destaque, compreendido geralmente como pertencente à fase mais madura de Platão. Uma inquietação, quase nunca analisada a fundo, está na conversa entre Euclides de Mégara e seu companheiro Térpsion que abre o Teeteto, caracterizando-o como um escrito pertencente ao filósofo megárico, cuja tradição de ensino era denunciada por sua dialética erística. Por que então Euclides, autor do Teeteto? Nossa hipótese pretende, em vista da filosofia formulada pelo socrático de Mégara, demonstrar que Platão procurou (...) reproduzir em proveito próprio o método euclidiano, orientado por uma escrita que põe ao centro a questão da fixidez almejada pela epistéme como uma questão de discurso, apenas resolvida no âmbito das ações. As refutações das opiniões de Teeteto se tornam a demonstração negativa da impossibilidade de o lógos fixar aquilo que procede do acontecimento educativo da verdade, positivamente indicado pela arte da maiêutica e pelo modelo divino descrito na digressão. Sob essa perspectiva, o louvor à memória de Teeteto, que abre o texto platônico, aparecerá como uma homenagem a Sócrates, através da moldura do texto megárico que nos situa diante do valor inescapável do discurso dialógico como instrumento educativo. The megarian frame in Plato’s Theaetetus Abstract: The Theaetetus has always occupied a prominent place, generally understood as belonging to Plato's more mature period. A concern is found, almost never analyzed in depth, in the conversation between Euclid of Megara and his companion Terpsion that opens Theaetetus, characterizing it as a writing belonging to the Megarian philosopher, whose teaching was denounced as eristic dialectic. Why then Euclid, author of Theaetetus? Our hypothesis intends, in view of the elaborated philosophy by the Socratic of Megara, to demonstrate that Plato sought to reproduce the Euclidean method for his own benefit, guided by a writing that puts at the center the issue of fixity desired by the episteme as a matter of discourse, only surpassed within the scope of actions. The refutations of Theaetetus' opinions become the negative demonstration of the impossibility of logos to fix what proceeds from the educational event of truth, positively indicated by the art of maieutics and by the divine model described in the digression. From this perspective, the praise to Theaetetus' memory, which opens the Platonic text, will appear too as a homage to Socrates, through the framework of the Megarian text that situates us before the inescapable value of dialogic discourse as an educational instrument. El cuadro megárico del Teeteto de Platón Resumen: El diálogo de Teeteto ha ocupado siempre un lugar destacado, generalmente entendido como perteneciente a la fase más madura de Platón. Una inquietud, casi nunca analizada en profundidad, se encuentra en la conversación entre Euclides de Megara y su compañero Terpsion que abre el Teeteto, caracterizándolo como un escrito perteneciente al filósofo megárico, cuya tradición docente fue denunciada por su dialéctica erística. ¿Por qué entonces Euclides, autor de Teeteto? Nuestra hipótesis pretende, a la luz de la filosofía formulada por el socrático de Mégara, demostrar que Platón buscó reproducir el método euclidiano en beneficio propio, guiado por una escritura que pone en el centro la cuestión de la fijeza deseada por la episteme, como una cuestión de discurso que sólo se resuelve en el ámbito de las acciones. Las refutaciones de las opiniones de Teeteto se convierten en la demostración negativa de la imposibilidad del logos de fijar lo que procede del acontecimiento educativo de la verdad, señalada positivamente por el arte de la mayéutica y por el modelo divino descrito en la digresión. Desde esta perspectiva, el elogio de la memoria de Teeteto, que abre el texto platónico, aparecerá como un homenaje a Sócrates, en el marco del texto megárico que nos sitúa ante el valor ineludible del discurso dialógico como instrumento educativo. El impacto generado por Vigilar y castigar no ha dejado de crecer desde su aparición en 1975. En este artículo se abordan las estrategias de investigación que subyacen a su análisis de la prisión, la cual pasó en poco tiempo de ser un elemento marginal de la penalidad a constituir la forma privilegiada de castigo. La hipótesis de Foucault es que su rápida aceptación por parte del sistema jurídico se debe a la generalización previa de las disciplinas esparcidas por todo (...) el cuerpo social. El problema estriba en que una hipótesis como esta, pese a su evidente originalidad, alberga sin embargo un defecto constitutivo en el análisis propuesto, al no explicitar las precondiciones que hicieron posible dicho proceso. El propósito del artículo es identificarlas en el análisis de Marx en torno a la acumulación originaria. De esa manera, destacamos los elementos de agregación y complementación, así como las posibles disputas entre ambos autores, logrando postular cómo se enmarca la microfísica del poder en la generalización de la forma mercancía y el dominio del capital. Studying cartoons about the economic crisis and focusing on a pair of scissors as a symbol, I prove how they first turn into unambiguous metaphor for the economic crisis and then experience an evolution in order to adapt to new communication contexts. Along these processes, they undergo more complex changes such as coadaptation and speciation. This has allowed for the scissors meme as a symbol of economic cutbacks to permeate society, and for its metaphorical use to occupy many disparate communication (...) scenarios, unlike other symbolic elements that were also used, but turned out to be less cognitively efficient and therefore offered fewer evolutionary possibilities. Set of articles, fruits of research by anthropologists, focused on the health area. First work of its kind in the country, which deepens mental health issues, cosmological view of specific groups, relationships between body, mind and culture and healing issues seen from the perspective of various popular religions. The work contrasts with the efforts of health scholars to approach anthropological approaches, so that it becomes an instrument for understanding the health / disease phenomenon and its complex articulation processes.

This study aims to examine how interdisciplinary urban interventions within architectural education can effectively address social justice issues. Motivated by the growing need for inclusive and equitable urban spaces, this research explores the potential of collaborative design and participatory research methods to foster social awareness and community engagement. Focusing on student-led projects in cities such as Houston, San Diego, and Amsterdam, this study addresses social justice challenges across themes like Art Activism, Tactical Urbanism, environmental justice, and gender equity. Using case (...) study analysis, digital mapping, and poster creation as core methodologies, the research demonstrates the value of multi-scalar, interdisciplinary approaches in tackling complex urban problems. The key findings highlight that integrating these approaches into architectural education promotes critical engagement with social justice issues, equipping students with practical skills for future professional challenges. The implications suggest that expanding this framework to diverse urban contexts could enhance its impact, offering a foundation for further studies on interdisciplinary design as a tool for urban equity. In this paper we present a new categorical approach which attempts to provide an original understanding of QM. Our logos categorical approach attempts to consider the main features of the quantum formalism as the standpoint to develop a conceptual representation that explains what the theory is really talking about —rather than as problems that need to be bypassed in order to allow a restoration of a classical “common sense” understanding of what there is. In particular, we discuss a solution to (...) Kochen-Specker contextuality through the generalization of the meaning of global valuation. This idea has been already addressed by the so called topos approach to QM —originally proposed by Isham, Butterfiled and D ̈oring— in terms of sieve-valued valuations. The logos approach to QM presents a different solution in terms of the notion of intensive valuation. This new solution stresses an ontological reading of the quantum formalism and the need to restore an objective conceptual representation and understanding of quantum physical reality. (shrink)

In Amerindian ontologies, hallucinations or visions, rather than being dismissed as delusions or symbolic constructs, are recognized as means of perceptual access to physical reality. Lowland South American shamans claim to be able to diagnose and treat infectious diseases, and to assess the status of wildlife resources through interactions with pathogenic agents perceived in visions. This essay examines some perceptual capabilities that shamans might be employing to explore their physical reality. The structure of the eye affords a form of microscopy (...) of retinal structures and of objects flowing within them, including cells and microbial agents during systemic infection. Lowland South American shamanic practices involve optical and physiological conditions that optimize entoptic microscopy. Images of those visions display the characteristic features of shadow formation, confirming their microscopic origin. This phenomenological access to the microscopic world and similarities with the panorama depicted by current microbiology indicate the commensurability of these forms of knowledge. (shrink)

This paper discusses why the work of Eduardo Nicol, still not translated and mostly unknown outside of the Hispanic context, deserves more attention, for two main reasons. First, the novelty of his meditations concerning phenomenology, following the steps of Husserl and Heidegger, but taking a different turn. Furthermore, several scholars have noted how his phenomenological project intertwines with the anthropological question, fostering a new approach to the question concerning “who are we?”. Our aim is to explore how Nicol, while setting (...) foot in the founders of phenomenology, departs from previous interpretations of its method, to advance a new dialectical phenomenology that could contribute to the actual debates on anthropological phenomenology. In order to do so, we will first examine how his vision of the phenomenological task involves an historical interpretation of metaphysics and a critique of two fundamental concepts: the transcendental reduction (Husserl) and the thesis of an “occultation of being” (Heidegger). A careful reading of Nicol’s philosophy would allow us to go a step further and explain how, according to him, phenomenology should become an analysis of the dialectical presence between being/beings. Finally, we will show that the answer to the question “who are we?” is to be found inside this dialectic, in what Nicol identifies as the historical phenomenon of expression, encouraging a new dialogue with other phenomenologies of the body⸺and beyond. Estas y otras propuestas tienen como objetivo mejorar la participación pública; reducir la vulnerabilidad de los sistemas democráticos representativos; aumentar la responsabilidad de los políticos; o simplemente ofrecer a los ciudadanos un mayor control y escrutinio de las acciones y decisiones políticas. Resumen Este artículo estudia la transformación de las bases del escepticismo antiguo en el pensamiento agustiniano; para presentar el proceso se parte de la crisis que supuso la ruptura con experiencia maniquea, se distingue su preocupación y consideración sobre el modo y los límites del conocimiento y se analiza la función de la imagen mítica de Proteo en Contra Académicos; esta imagen permite ponderar la capacidad de la representación mítica como contrafuerte del carácter discursivo del saber humano. Mediante este recurso, (...) san Agustín afirma que la razón no puede quedar aislada de otros modos complementarios de comprensión, hace propio el núcleo de la actitud escéptica y amplía la noción de racionalidad para la filosofía cristiana.This paper studies the transformation of the foundations of ancient skepticism in Augustinian thought; to present the process we start from the crisis that led to the break with Manichaean experience, we distinguished their concern and consideration about the mode and limits of knowledge and analyzed the function of Proteo's mythical image in Contra academicos; this image allows us to weigh the capacity of mythical representation as a buttress of the discursive character of human knowledge. Through this resource, St. Augustine affirms that reason cannot be isolated from other complementary modes of understanding, appropriates the core of the skeptical attitude and broadens the notion of rationality for Christian philosophy. Na sequência, analisa os elementos que configuram sua teoria política, tais como: liberdade, (...) açáo, pluralidade e espaço público, os quais, articulados entre si, permitem a formaçáo de um conceito de cidadania baseado na real participaçáo dos cidadáos na organizaçáo política de uma comunidade, em contrapartida a um conceito meramente formal de cidadania. Para, finalmente, abordar o sistema de conselho, instância em que a cidadania é compreendida como açáo vivenciada no espaço público, favorecendo, assim, a possibilidade de efetivaçáo dos direitos humanos, exercidos como dignidade política dos cidadáos. The capability approach is gaining momentum as a theory of corporate responsibility and business ethics at a time when the UN Guiding Principles have become a most important framework. A novel approach is now emerging that seeks to understand and specify human rights obligations of businesses within the framework provided by the capability approach. This article partially examines the triad corporate responsibility–human rights–capability approach by exploring the relationship between human rights and capabilities. Thus, it offers conceptual and practical implications for (...) a human rights perspective on corporate responsibility. The bulk of our thesis focuses on studying Nussbaum’s and Sen’s claim that human rights are entitlements to capabilities by means of a discussion of the notion of human dignity. In particular, we show the capability approach’s ability to dissipate theoretical and practical challenges posed by the notion of dignity. This article does not offer a detailed explanation of the implications of our investigation for human rights responsibilities of business. However, an outline of its potential contribution toward unfolding those obligations, conceptually and practically, is provided. (shrink)

SANDEL, Michael: The Tyranny of Merit. What’s Become of the Common Good?

We investigate two main sources of information inaccuracies in demand information sharing along the supply chain. Firstly, we perform a systematic literature review on inaccuracy in demand information sharing and its impact on supply chain dynamics. Secondly, we model several SC settings using system dynamics and assess the impact of such information inaccuracies on SC performance. More specifically, we study the impact of four factors using three SC dynamic performance indicators. The results suggest that demand error has a negative impact (...) on SC performance, which is exacerbated by the magnitude of the error and by low demand variability scenarios. In contrast, demand delay produces a nonlinear behavior in the supply chain response, being influenced by the supply chain configuration. (shrink)

La Constitución que entró en vigencia en 1991, encontró su fuente de inspiración en la igualdad y la libertad como valores jurídico-políticos para alcanzar la justicia, de ahí, que en materia de participación política traiga el concepto de democracia participativa dentro de su normatividad. Sin embargo, la realidad social colombiana, sobre todo (...) en materia de participación política, está muy lejos de ser una aproximación a los ideales redactados en el texto constitucional. La democracia representativa sigue siendo la regla general; ahora bien, existen algunos avances en ciertos aspectos producto del debate permanente sobre los contenidos de la Carta, y en concordancia con el concepto de democracia participativa, los cuales, producen reformas que se realizan mediante actos legislativos, que es el mecanismo que trae la propia Constitución para ser reformada; también mediante este mismo medio, se han dado pasos en contravía del espíritu inicial de la Carta Constitucional de 1991. For more than three decades, Integrative Social Contracts Theory (ISCT) has been lauded as a business ethics theory particularly well suited to the international arena, especially because of its alleged ability to reconcile respect for cultural idiosyncrasies and normative teeth. However, this theory has also faced various objections, many of which its authors have responded to with varying degrees of satisfaction. As a contribution to this debate, this article provides a unifying rationale for many of those objections by exploring their (...) rooting in the Separation thesis. It submits that this fact negatively impacts the theory with three major challenges, namely: significant limitations to correctly frame moral issues and situations; poor identification of hypernorms; and insufficient theoretical grounding of hypernorms. This critique highlights the need for the entanglement of the normative and the empirical in business ethics theorizing. (shrink)

El presente artículo tiene como objetivo mostrar, a través de los textos confucianos y de sus intérpretes, cuál ha sido la posición de la mujer en la filosofía china clásica. Se analizará el papel que en las Analectas de Confucio, en los textos rituales, en el “Clásico de Poesía” y en Mencio juega la mujer, así como las interpretaciones que sobre estos pasajes, en ocasiones demasiado escuetos para posicionarse claramente sobre ellos, han realizado los comentaristas, desde la Antigüedad hasta finales (...) de la Época Imperial. Un examen atento mostrará que el confucianismo, a pesar de no preocuparse excesivamente de la cuestión, supo desafiar la “concience collective” y resaltar el papel de la mujer en la historia y en la sociedad. Finalmente, a través de una breve comparación con lo que la filosofía clásica occidental tiene que decir sobre la cuestión del género, se concluirá con unas observaciones sobre el papel del confucianismo en las sociedades modernas asiáticas y su relevancia para la formación de un discurso feminista autóctono. El texto trata del acceso fenomenológico a la muerte. El punto de partida de la reflexión está constituido por la descripción de la muerte que hace Bernhard Welte como un momento en el cual el ser humano alcanza su totalidad. Así, cuando se considera a una persona fallecida, experimentamos una transfiguración en su imagen, de tal modo que el momento de la muerte puede ser calificado como un instante numinoso y sacro. Si se compara esta descripción con el análisis que (...) Martin Heidegger ofrece en Ser y tiempo, constatamos diferentes accesos. Heidegger intenta mostrar que la muerte no puede ser definida por la vía del trato con la muerte de otra persona, sino solo describiendo la relación individual con la propia muerte. Finalmente, el texto discute el concepto que Eugen Fink ofrece de la muerte, el cual tiene dos aspectos: la dimensión solitaria (la propia muerte) y su dimensión social (la muerte de los otros). Ambas dimensiones se complementan. The paper deals with the phenomenological approach to death. The starting point of the reflection is Bernhard Welte’s description of death as a moment in which a human being achieves his wholeness. Thus, when regarding a dead person, we experience a transfiguration in his/her image in such a way that the moment of death can be spoken about as a numinous and sacred instant. Comparing this description with Martin Heidegger’s analysis in Being and Time, we see a different approach. Heidegger attempts to show that death cannot be defined by dealing with the death of another person, but only by describing the individual’s relationship to his/her own death. Finally the text discusses Eugen Fink’s notion of death, which has two aspects: the solitary dimension (one’s own death) and its social dimension (the death of others). A pesar de los reparos de algunos especialistas, Avicena es un punto de referencia insoslayable en la historia de la intencionalidad. Este trabajo se propone determinar la manera en que el intelecto toma posición con respecto a la realidad de los objetos con los que se relaciona. Abordamos la relación intencional centrando nuestra atención en el nexo entre lógica y ontología y enfatizando el papel que juegan la conceptualización y la estimación en la determinación de lo que es real y (...) existente efectivamente. La exploración de la estructura intencional nos lleva a identificar la relevancia de la doctrina de las esencias como presupuesto fundamental para la conceptualización y la verdad. La importancia de la teoría de la intencionalidad de Avicena radica en la descripción tanto de la referencia al objeto de conocimiento, como un proceso que avanza de lo conocido a lo desconocido, cuyas diversas fases conforman el itinerario de las esencias. Desde este punto de vista, la realidad y la existencia son accidentes que le acaecen a las esencias. Las capacidades del alma que hacen posible la referencia intencional son la estimativa, la conceptualización y el asentimiento. Asimismo, identificamos algunos puntos de convergencia entre las doctrinas de las esencias de Avicena y de Husserl. (shrink)

En Ideas I, la fenomenología se presenta como “idealismo trascendental”. Esta investigación muestra que cinco años antes, en 1908, Husserl accedió a la formulación del “idealismo trascendental”, pero desde una vía diferente a la de Ideas I. En 1913 y hasta 1921, el fundador de la fenomenología retoma y desarrolla la fundamentación inicial del “idealismo trascendental”. Presentamos los rasgos fundamentales de esta “demostración” del “idealismo trascendental” y ponderamos hasta qué punto se abre la posibilidad de un “trascendentalismo metodológico”, camino hacia (...) una filosofía trascendental no-idealista. The text addresses Foucault’s critical understanding of neoliberalism as a new contemporary governmentality strategy for the conduction of people’s lives. A major aspect of Foucault’s analysis of neoliberalism relies on his understanding of the neoliberal homo oeconomicus as dependent on subjectivation processes related to self-assumed values and standards oriented by the competitive economic market. Our hypothesis is that governmentality, critique and subjectivation are the core notions that shaped Foucault’s understanding of neoliberalism and form the legacy of his seminal analysis. Contrary (...) to critics who affirm that Foucault flirted or even became fascinated with neoliberalism, we argue that he offered critical tools for its understanding in a critique that is not to be confused with denunciation, however. Accordingly, we discuss Foucault’s conception of critique and relate his analysis of neoliberalism to his notions of governmentality and subjectivation. Finally, we briefly point out how some contemporary critics of the neoliberal order have appropriated and developed Foucault’s conceptual tools in their own understanding of it. We conclude that although Foucault did not propose a comprehensive theory of neoliberalism, he offered important critical insights for the understanding of it in our times. (shrink)
