Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. In this paper, we argue that lesbian couples who wish to have children who are genetically related to both of them should be allowed access to mitochondrial replacement techniques (MRTs). First, we provide a brief explanation of mitochondrial diseases and MRTs. We then present the reasons why MRTs are not, by nature, therapeutic. The upshot of the view that MRTs are non-therapeutic techniques is that their therapeutic potential cannot be invoked for restricting their use only to those cases where a (...) mitochondrial DNA disease could be ‘cured’. We then argue that a positive case for MRTs is justified by an appeal to reproductive freedom, and that the criteria to access these techniques should hence be extended to include lesbian couples who wish to share genetic parenthood. Finally, we consider a potential objection to our argument: that the desire to have genetically related kin is not a morally sufficient reason to allow lesbian couples to access MRTs. (shrink)

This study delved into the Senior High School Technical-Vocational-Livelihood (TVL) track in Bohol Province for the 2022-2023 school year, aiming to evaluate policy implementation, recognize barriers, and propose interventions. Employing a mixed-method approach, integrating quantitative-descriptive surveys and qualitative-descriptive research methods as recommended by Creswell and Plano Clark (2017), the findings unveiled a predominantly positive perception of policy implementation across various dimensions of the TVL track. These encompass curriculum development, teacher training, resource allocation, industry partnerships, assessment and evaluation, student support services, (...) monitoring and quality assurance, policy adaptation and improvement, stakeholder engagement, legal framework and compliance, data collection and analysis, and inclusivity and equity. Despite variations among teachers and administrators, a general commitment to policy implementation emerged. The study identified barriers in curriculum and instruction, readiness and preparedness, resource limitations, and teaching and learning, emphasizing evidence-based strategies and interdisciplinary approaches to surmount challenges. It underscores the crucial role of research and policy development in elevating the quality and efficacy of TVL education. (shrink)

In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. Neste artigo apresentamos, de forma concisa e em português, alguns elementos-chave dos principais debates contemporâneos na filosofia da memória. Nosso principal objetivo é tornar essas discussões mais acessíveis aos leitores de língua portuguesa, fornecendo uma atualização importante para esforços anteriores (Sant’Anna & Michaelian, 2019a). Começamos introduzindo a noção de viagem no tempo mental, a qual estabelece a base empírica para a metodologia empregada em trabalhos recentes, antes de apresentar dois debates centrais. Primeiro, o debate entre causalistas e simulacionistas sobre a (...) teoria da lembrança filosoficamente correta (§2). Segundo, o debate entre continuístas e descontinuístas sobre a relação entre lembrança episódica e certas formas de imaginação (em particular, o pensamento episódico acerca do futuro) (§3). Na segunda parte do artigo, apresentamos e exploramos dois tópicos de discussão crescente: a natureza do sentimento de passado característico da memória episódica (§4) e questões de meta-nível relativas ao próprio caráter das controvérsias exploradas na primeira parte do artigo (§5). Several objections against the morality of researching or employing mitochondrial replacement techniques have been advanced recently. In this paper, I examine three of these objections and show that they are found wanting. First I examine whether mitochondrial replacement techniques, research and clinical practice, should not be carried out because of possible harms to egg donors. Next I assess whether mitochondrial replacement techniques should be banned because they could affect the study of genealogical ancestry. Finally, I examine the claim that mitochondrial (...) replacement techniques are not transferring mitochondrial DNA but nuclear DNA, and that this should be prohibited on ethical grounds. (shrink)

News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

Cultural diversity is an inescapable reality and a concern in many businesses where it can often raise ethical questions and dilemmas. This paper aims to offer suggestions to certain problems facing managers in dealing with cultural diversity through the inspiration of Thomas Aquinas. Although he may be perceived as a voice from the distant past, we can still find in his writings helpful and original ideas and criteria. He welcomes cultural differences as a part of the perfection of the universe. (...) His systemic approach leads one to place the problem in its proper context, and to reflect on it from the perspective of virtue ethics, with a central role for practical wisdom and giving primacy to neighborly love and natural moral law. Rather than a set of rigid standards with no consideration of diversity Aquinas focuses on the common human ground, which allows for the indispensable dialogue between different positions. When dealing with practical questions, the problem is one of finding the right balance between general principle and cultural specifics, tolerance, and dialogue, always guided by practical wisdom. In this way, Aquinas’ approach is neither rigid ethical universalism with no consideration for diversity nor moral relativism with no place for any transcultural and absolute morals. (shrink)

Children created through mitochondrial replacement techniques (MRTs) are commonly presented as possessing 50% of their mother’s nuclear DNA, 50% of their father’s nuclear DNA and the mitochondrial DNA of an egg donor. This lab-engineered genetic composition has prompted two questions: Do children who are the product of an MRT procedure have threegeneticparents? And, do MRT egg donors have parental responsibilities for the children created? In this paper, I address the second question and in doing so I also address the first (...) one. First, I present a brief account of mitochondrial diseases and MRTs. Second, I examine how MRTs affect the numerical identity of eggs and zygotes. Third, I investigate two genetic accounts of parenthood and MRT egg donation. Fourth, I explore three causal accounts of parenthood and MRT egg donation. My conclusion is that, under the appropriate circumstances, MRT egg donors are parentally responsible for the children created under genetic accounts of parenthood and under causal accounts of parenthood. Mitochondrial replacement techniques (MRTs) are a new group of biotechnologies that aim to aid women whose eggs have disease-causing deleteriously mutated mitochondria to have genetically related healthy children. These techniques have also been used to aid women with poor oocyte quality and poor embryonic development, to have genetically related children. Remarkably, MRTs create humans with DNA from three sources: nuclear DNA from the intending mother and father, and mitochondrial DNA from the egg donor. In a recent publication Françoise Baylis argued (...) that MRTs are detrimental for genealogical research via mitochondrial DNA because they would obscure the lines of individual descent. In this paper, I argue that MRTs do not obscure genealogical research, but rather that MRT-conceived children can have two mitochondrial lineages. I argue for this position by showing that MRTs are reproductive in nature and, thus, they create genealogy. (shrink)

In this paper we attempt to discuss what has Kochen-Specker theorem to say about physical invariance and quantum individuality. In particular, we will discuss the impossibility of making reference to objective physical properties within the orthodox formalism of quantum mechanics. Through an analysis of the meaning of physical invariance and quantum contextuality we will derive a Corollary to KS theorem that proves that a vector in Hilbert space cannot be interpreted coherently as an object possessing physical properties. As a consequence, (...) the notion of quantum object can be only defined in terms of nomological properties. We conclude the paper by analyzing the consequences of this Corollary to KS theorem for the ongoing debate about quantum individuality. (shrink)

Este trabajo intenta dar contenido a los derechos de la naturaleza desde los pensamientos filosóficos de los pueblos indígenas, así como desde la interacción o encuentro entre diversas formas de conocimiento; en especial el de la Amazonía y el kichwa; pretendiendo construir otro saber-poder con el que se propone una crítica al dominante. Para ello el trabajo se estructura en tres partes: crítica, reconstrucción y aplicabilidad. La crítica consiste en un diagnóstico teórico desde la aproximación al fundamento filosófico dicotómico que (...) separa el ser humano de la naturaleza cosificándola evidenciando como esta dicotomía atraviesa los estudios disciplinares y transdisciplinares sobre sus derechos. La reconstrucción se elaborará desde la meta-física dusseliana y, finalmente, se intentará demostrar las implicaciones de la aplicación fáctica de esta propuesta, relacionada con: aprender, aprehender y desaprender a través de una perspectiva transdisciplinar y analéctica capaz de abarcar personas, plantas, animales, agua, piedras, etc. como un todo en armonía. The aim of this paper is to critically examine David Shaw, Wybo Dondorp, and Guido de Wert’s arguments in favour of the procurement of human organs from human/nonhuman-primate chimeras, specifically from great-ape/human chimeras. My main claim is that their arguments fail and are in need of substantial revision. To prove this I first introduce the topic, and then reconstruct Shaw et al.’s position and arguments. Next, I show that Shaw et al.: (1) failed to properly apply the subsidiarity and proportionality (...) principles; (2) neglected species overlapping cases in their ethical assessment; (3) ignored the ethics literature on borderline persons; and (4) misunderstood McMahan’s two-tiered moral theory. These mistakes render an important part of their conclusions either false or problematic to the point that they would no longer endorse them. Finally I will briefly mention a possible multipolar solution to the human organ shortage problem that would reduce the need for chimeras’ organs. (shrink)

The article presents the sources and definitions of the concepts «system» and «lifeworld», emphasizing how the colonization of the lifeworld by the system appears as a pathological process, in the presence of which a critical stance must be maintained. Facing the increase of the systemic complexity, it is necessary to ensure the symbolic reproduction of the lifeworld through communicative action. Although we share with Habermas the meaning of his critique of the colonization, we present some objections to the dichotomous opposition (...) of both spheres, inasmuch as it confers the economical and administrative systems with an ontological status that ultimately safeguards them from any possible critique. Desde la perspectiva de las ciencias jurídicas y, en particular, del derecho internacional ambiental, la presente intervención aborda la emergencia de un Derecho internacional contemporáneo y acude a las ideas del cosmopolitismo blando y la vertiente normativa del constitucionalismo global, como debates filosóficos-jurídicos que podrían cimentar un terreno fértil, un sustrato material, para incidir en las fuentes formales de creación de normas internacionales para enfrentar los problemas globales ambientales. En ese sentido, hace mención a la emergencia y reconocimiento del derecho (...) humano al ambiente sano y saludable como un derecho humano autónomo y exigible, desde su vertiente sustantiva y procesal, lo que puede vislumbrase como el embrión de una ciudadanía global ambiental. El presente artículo se propone indagar en la praxis de extrañamiento que lleva acabo Gómez de la Serna en El Rastro (1914), praxis que será esencial de cara a comprender uno de los vectores fundamentales de la (ulterior) objetología surrealista. Dicha praxis comprende al menos ocho prácticas o posibilidades de deshacer que afectan al Límite (que discrimina y jerarquiza), al Futuro (ingenuo y dictatorial), a la familiaridad hogareña burguesa (que encarcela y amodorra), a la funcionalidad utilitaria (que banaliza), a la (...) idealidad falsa (de los prestigios de la ciudad), a la propiedad (de nuestras cosas), a uno mismo (praxis de desasimiento), y al propio texto. Estas prácticas configuran un extrañamiento masivo, aunque sereno, con una clara proyección de trascendencia poética, existencial y metafísica. (shrink)

Apresenta dois capítulos que buscam tratar do Candomblé e os processos de autoidentificação e orientação das relações pessoas e orixás.

In this paper we consider the notion of quantum entanglement from the perspective of the logos categorical approach [26, 27]. Firstly, we will argue that the widespread distinctions, on the one hand, between pure states and mixed states, and on the other, between separable states and entangled states, are completely superfluous when considering the orthodox mathematical formalism of QM. We will then argue that the introduction of these distinctions within the theory of quanta is due to another two completely unjustified (...) metaphysical presuppositions, namely, the idea that there is a “collapse” of quantum states when being measured and the idea that QM talks about “elementary particles”. At distance from these distinctions and taking the logos approach as a standpoint, we will propose an objective formal account of the notion of entanglement in terms of potential coding which introduces the necessary distinction between intensive relations and effective relations. We will also discuss how this new definition of entanglement provides an anschaulich content to this —supposedly “spooky”— quantum relational feature. (shrink)

In this paper I explore some of the moral issues that could emerge from the creation of human–nonhuman chimeras capable of human gamete production and human pregnancy. First I explore whether there is a cogent argument against the creation of HNH-chimeras that could produce human gametes. I conclude that so far there is none, and that in fact there is at least one good moral reason for producing such types of creatures. Afterwards I explore some of the moral problems that (...) could emerge from the fact that a HNH-chimera could become pregnant with a human conceptus. I focus on two sets of problems: problems that would arise by virtue of the fact that a human is gestated by a nonhuman creature, and problems that would emerge from the fact that such pregnancies could affect the health of the HNH-chimera. Background: The first wave of the COVID-19 pandemic caused a shortage of qualified nurses in Spain. As a result, the government authorized the hiring of senior students. Objectives: To explore the ethical dilemmas and ethical conflicts experienced by final-year nursing students who worked during the first outbreak of the COVID-19 pandemic in Spain. Research design: A qualitative exploratory study was conducted using purposive sampling. Semi-structured interviews were carried out using a question guide. Interviews took place via a private video chat (...) room platform. A thematic, inductive analysis was performed of the information gathered. Participants and research context: Eighteen nursing students were recruited from two universities of Madrid, aged between 18 and 65 years old, enrolled in the fourth year of nursing studies and who were hired under a relief contract for health professionals during the pandemic. Ethical considerations: The present study was carried out in accordance with the Declaration of Helsinki, and the study was approved by the Local Ethics Committee of Universidad Rey Juan Carlos. Results: Three specific themes emerged: (a) coping with patient triage, (b) difficulties in providing end-of-life care, and (c) coping with patient death. Nursing students participated in the process of patient selection for resource allocation and ICU bed occupancy. They were shown how to care for patients who were not admitted to the ICU, in their last moments and were faced with the difficulties of applying end-of-life care. Finally, the nursing students were confronted with the death of their patients, in overwhelming numbers and under adverse conditions. Conclusions: These findings can help shed light on the ethical dilemmas and ethical conflicts faced by novice nursing students, incorporated into the workforce during the COVID-19 pandemic. Moreover, it was described that students may normalize the death due to the exhaustion and overwhelmed routine. (shrink)

This paper is about the role of self-knowledge in the cognitive life of a virtuous knower. The main idea is that it is hard to know ourselves because introspection is an unreliable epistemic source, and reason can be a source of insidious forms of self-deception. Nevertheless, our epistemic situation is such that an epistemically responsible agent must be constantly looking for a better understanding of her own character traits and beliefs, under the risk of jeopardizing her own status as a (...) knower, ruining her own intellectual life. Human eggs for basic, fertility and stem-cell research are in short supply. Many experiments that require their use cannot be carried out at present, and, therefore, the benefits that could emerge from these are either delayed or never materialise. This state of affairs is problematic for scientists and patients worldwide, and it is a matter that needs our attention. Recent advances in chimera research have opened the possibility of creating human/non-human animal chimeras intended for human gamete production (chimeras-IHGP). In this (...) paper, I examine four arguments against the creation of such chimeras and prove that all of them are found wanting. I conclude by showing that there is a strong moral reason for scientists to pursue this research avenue. (shrink)

Direct realists about episodic memory claim that a rememberer has direct contact with a past event. However, how is it possible to be acquainted with an event that ceased to exist? That is the so-called cotemporality problem. The standard solution, proposed by Sven Bernecker, is to distinguish between the occurrence of an event and the existence of an event: an event ceases to occur without ceasing to exist. That is the eternalist solution for the cotemporality problem. Nevertheless, some philosophers of (...) memory claim that the adoption of an eternalist metaphysics of time would be too high a metaphysical price to pay to hold direct realist intuitions about memory. Although I agree with these critics, I will make two claims. First, that this kind of common sense argument is far from decisive. Second, that Bernecker’s proposal remains the best solution to the cotemporality problem. (shrink)

In recent decades, investigation of brain injuries associated with amnesia allowed progress in the philosophy and science of memory, but it also paved the way for the hubris of assuming that memory is an exclusively neural phenomenon. Nonetheless, there are methodological and conceptual reasons preventing a reduction of the ecological and contextual phenomenon of memory to a neural phenomenon, since memory is the observed action of an individual before being the simple output of a brain (or, at least, so we (...) will argue), and there is no good reason to suppose that it is necessary to postulate a more basic reality to memory lying behind the mere individual actions. The text addresses Foucault’s critical understanding of neoliberalism as a new contemporary governmentality strategy for the conduction of people’s lives. A major aspect of Foucault’s analysis of neoliberalism relies on his understanding of the neoliberal homo oeconomicus as dependent on subjectivation processes related to self-assumed values and standards oriented by the competitive economic market. Our hypothesis is that governmentality, critique and subjectivation are the core notions that shaped Foucault’s understanding of neoliberalism and form the legacy of his seminal analysis. Contrary (...) to critics who affirm that Foucault flirted or even became fascinated with neoliberalism, we argue that he offered critical tools for its understanding in a critique that is not to be confused with denunciation, however. Accordingly, we discuss Foucault’s conception of critique and relate his analysis of neoliberalism to his notions of governmentality and subjectivation. Finally, we briefly point out how some contemporary critics of the neoliberal order have appropriated and developed Foucault’s conceptual tools in their own understanding of it. We conclude that although Foucault did not propose a comprehensive theory of neoliberalism, he offered important critical insights for the understanding of it in our times. (shrink)

A obra de Max Weber abarca um amplo arco de disciplinas, expedientes metodológicos e problemas, que sempre manifestaram força para se interpretar o Brasil. Contudo, para se entender o weberianismo que aqui se formou, não podemos cobrar, dos que o impulsionaram e o desdobraram em diversas direções, uma fidelidade ingênua ou puritana à matriz construída por Weber. Não queremos usar aqui a metáfora da antropofagia, já tão recoberta de significados emblemáticos. Mas a verdade é que o pensamento nacional, produzido fora (...) e dentro das universidades, sempre devorou o pensamento de Max Weber, sem – e esse é um extraordinário mérito – se preocupar como ele teria de ser digerido junto ao material ao qual ele tinha que ser imiscuído. Por isso, sempre será interminável e indecidível a discussão sobre se determinado pensamento expressa bem ou de modo inapropriado os propósitos de Max Weber. Por outro lado, do ponto de vista da compreensão da nossa singularidade, é irrecusável que, pelas necessidades de discutirmos assuntos e temas tipicamente nossos, o pensamento weberiano teve de ser reinventado no Brasil, tendo-lhe sido agregadas perspectivas e inovações originais que somente por nossas mãos e nossos olhos poderiam ter sido construídas. Os impactos e absorções da modernidade em território tão diversificado como o nosso, ou as aderências e recusas aos aspectos políticos, econômicos e culturais da globalização, também formam o quadro das preocupações recentes que retratam a apreensão do pensamento de Weber entre nós. Esse livro documenta, portanto, esse fato, a saber, de que a interpretação da obra de Weber já ganhou uma dimensão singular no Brasil, de tal forma que, por desregrados desdobramentos, já se tornou inseparável de muitos modos significativos de se interpretar a nossa realidade. To this end, we seek to understand the challenging task of ethics in an era predominantly dominated by science and technology. Then, in a second moment, we analyze the role of the fear heuristic in understanding the ethics of responsibility in Hans Jonas as an indispensable condition for the preservation and protection of life in the common home.

A luta por reconhecimento é uma das questões centrais do debate político contemporâneo. Diversos pensadores transformaram esta temática no centro de suas reflexões. No entanto, este debate tem suas origens na obra do pensador Maquiavel. A perspectiva política de Maquiavel, que envolve a questão do reconhecimento, foi fundamental no debate travado entre os pensadores contratualistas como Hobbes, Locke e Rousseau. Assim, como para Maquiavel, o tema da luta por reconhecimento é fundamental para Rousseau. É inegável a influência de Maquiavel sobre (...) os contratualistas, incluindo o pensador genebrino e seu pensamento em torno da luta por reconhecimento. Neste sentido, Rousseau se encontra no conjunto dos leitores de Maquiavel. Desta forma, o texto se debruça sobre o tema da luta pelo reconhecimento na obra de Maquiavel e os reflexos que se desdobram na obra de Rousseau. (shrink)

Her account seems able to answer the question of whether reproduction takes place, and who reproduces, when we employ biotechnologies that bear little to no resemblance to naturally occurring human sexual reproduction. Piotrowska's account also seems to increase our understanding of biological individuality and seems to be compatible with the theory of evolution via natural selection. In this paper, I do two things. First, I show that Piotrowska's account is found wanting, (...) because it is extensionally inadequate. In this article we assume that the kantian a priori juridical-political theory can be reconstructed according to the a priori synthetic satisfiability proof theory, initially declared in Kritik der reinen Vernunft and extended to practical domain in Kritik der praktischen Vernunft. In particular, it is assumed that the aim to prove that synthetic judgments, such as “this object of external usage is mine”, can a priori invigorate in private law and public law in general – from the determination of their (...) possibility conditions in the executable actions domain by the free human agent – was carried out in Metaphysische Anfangsgründe der Rechtslehre. In what concerns the demonstration of the effectiveness of the law a priori synthetic judgments Kantian theory, i.e., to decide which juridical proposals actually invigorate or not, accepted that this work was not treated on a systematic way by the philosopher Königsberg. There are fragments, spread through many works. Therefore, the task to be developed in this article, aiming to present a field of effectiveness to the law doctrine, is to organize (synthetically) Kant´s statements about politics as a law doctrine exercise, according to the proof theory problems from the a priori synthetic proposals in general. Esse texto procura estabelecer a conexão entre o opúsculo “Sobre o primeiro fundamento da distinção de direções no espaço” (GUGR), de 1768, e a Crítica da razão pura (KrV), de 1781, procurando evidenciar que há um programa de pesquisa de Kant sobre a estrutura do espaço que principia com as reflexões estabelecidas a partir das contrapartidas incongruentes. Para defender esse argumento, há uma grande dificuldade, pois Kant não se reporta às contrapartidas incongruentes no texto da primeira crítica. São vários os (...) comentadores que se reportam a esse fato para minorar a importância do texto de 1768 para a constituição da estética teórica. Para caracterizar a importância das contrapartidas incongruentes para o pensamento crítico, procuraremos examinar uma tese do espaço exposta nos Prolegômenos a toda a metafísica futura (Prol), de 1783, que é a de que somente o todo é fundamento de possibilidade das partes. Se os Prolegômenos fazem o caminho invertido, o do método analítico, e a Crítica da razão pura percorre o caminho sintético, quais seriam, nesse caso, as condições de possibilidade de uma estética que deveria ser construída a priori? Ao analisar essa questão, procuraremos mostrar que a sua solução depende das contrapartidas incongruentes nos Prolegômenos, e que ela é igualmente decisiva para a construção da Estética Transcendental. Infinitude and mereology in the construction of Kant’s theoretical aesthetics Abstract: The aim of this text is to establish the connection between the 1768 essay “Concerning the ultimate ground of the differentiation of directions in space” (GUGR) and the 1781 Critique of Pure Reason (KrV), seeking to show that Kant has a research program regarding the structure of space that begins with reflections established from incongruent counterparts. There is considerable difficulty in defending this argument, because Kant does not refer to incongruent counterparts in the text of the first critique. Several commentators have referred to this fact to downplay the importance of the 1768 text for constituting theoretical aesthetics. To characterize the importance of incongruent counterparts for critical thinking, we examine a thesis on space presented in the Prolegomena To Any Future Metaphysics (Prol), of 1783, which is that only the whole is the ground for the possibility of the parts. If the Prolegomena take the opposite route, that of the analytical method, and the Critique of Pure Reason follows the synthetic route, what, in this case, would be the conditions for the possibility of an aesthetic that should be constructed a priori? In analyzing this question, we seek to show that its solution depends on the incongruent counterparts in the Prolegomena, and that it is equally decisive for constructing Transcendental Aesthetics. Infinitud y mereología en la construcción de la estética teórica de Kant Resumen: El presente texto busca establecer la conéxion entre el opúsculo “Sobre el fundamento primero de la diferencia entre las regiones del espacio” (GUGR), de 1768, y la Crítica de la razón pura (KrV), de 1781, intentando evidenciar que hay un programa de investigación de Kant sobre la estructura del espacio que empieza con las reflexiones establecidas a partir de las contrapartidas incongruentes. Para defender ese argumento, hay una gran dificultad, pues Kant no se reporta a las contrapartidas incongruentes en el texto de la primera crítica. Son varios los comentadores que se reportan a ese hecho para minimizar la importancia del texto de 1768 para la constitución de la estética teórica. Para caracterizar la importancia de las contrapartidas incongruentes para el pensamiento crítico, procuraremos examinar una tesis del espacio expuesta en los Prolegómenos a toda metafísica futura (Prol), de 1783, que es de que solamente el todo es fundamento de posibilidad de las partes. O presente artigo pretende analisar a crítica de Arthur Schopenhauer à postulação da liberdade da vontade como a condição de possibilidade da imputabilidade jurídica. Segundo o filósofo, uma vontade intelectualmente determinável, e não uma vontade incondicionada, é que seria o verdadeiro elemento viabilizador da imputação estatal, com a conclusão de que é com o potencial de modificação do agente, e não com a culpabilidade que a sociedade e o Estado devem se preocupar. Isso significa que, no entender de Schopenhauer, uma (...) concepção alternativa e determinista como a sua, ao contrário do que normalmente se diz, não compromete a imputabilidade, antes, potencializa-a, razão pela qual não há o que temer.
