This paper shall look briefly into the treatment of some topics related to scepticism in general in works by Barhebraeus, the famous Syrian Orthodox polymath and theologian (1226–1286). He addresses scepticism both directly by a discussion of sensory and intellectual fallacies or sceptical scenarios as well as indirectly by the definition of knowledge and the role of intuitive knowledge regarding primary notions and logical principles, which have an impact on establishing secure knowledge. Despite writing in Syriac, his dealing with the (...) matter is heavily indebted to Arabic sources, primarily contemporary post‐Avicennan authors, and here especially Fakhr al‐Dīn al‐Rāzī (1149–1209) and Naṣīr al‐Dīn al‐Tūṣī (1201–1274) but also Avicenna (980–1037) himself, although Barhebraeus adds a decisively Christian note in some instances. The Syriac tradition, therefore, should not be neglected when dealing with medieval scepticism. (shrink)

In contrast to Axelrod’s advice “don’t be envious” it is argued that the emotion of envy may enhance cooperation. TIT FOR TAT does exhibit a certain degree of envy. But, it does so in inconsistent ways. Two variants of TIT FOR TAT are introduced and their strategic properties are analyzed. Both generate the very same actual play as TIT FOR TAT in a computer tournament without noise. However, if noise is introduced they display some greater degree of stability. This is (...) due to the fact that they form, in a prisoner’s dilemma supergame with suitable parameters, an equilibrium with themselves that is subgame perfect or (in case of the first strategy) close to subgame perfect. It is additionally argued that these strategies are exceptionally clear and comprehensible to others in that they conform to well known real live behavior patterns. (shrink)

This book starts from a first general observation: there are very diverse ways to frame and convey scientific knowledge in texts. It then analyzes texts on mathematics, astronomy, medicine and life sciences, produced in various parts of the globe and in different time periods, and examines the reasons behind the segmentation of texts and the consequences of such textual divisions. How can historians and philosophers of science approach this diversity, and what is at stake in dealing with it? The book (...) addresses these questions, adopting a specific approach to do so. In order to shed light on the diversity of organizational patterns and rhetorical strategies in scientific texts, and to question the rationale behind the choices made to present such texts in one particular way, it focuses on the issue of text segmentation, offering answers to questions such as: What was the meaning of segmenting texts into paragraphs, chapters, sections and clusters? Was segmentation used to delimit self-contained units, or to mark breaks in the physical appearance of a text in order to aid reading and memorizing, or to cope with the constraints of the material supports? While Gödel’s first theorem remains valid under substitution of various provability predicates, Gödel’s second theorem does not. This is one reason to label G1 as “extensional” but to call G2 “intensional.” Although this asymmetry between G1 and G2 is known for long, no satisfying account of G2’s intensionality has been put forward. After briefly reviewing the discussion so far, the paper presents a new analysis based on two observations. First, the underestimated role of provable closure under modus. Provable closure under (...) modus ponens—usually listed as the second derivability condition—or similar requirements, do not get much attention since their proof isn’t perceived as much of challenge. Closer inspection shows, however, that the requirement of provable closure under modus ponens interacts differently with different formalized proof predicates and has thus a direct bearing on the discussion of G2’s intensionality. Second, in order to establish the co-extensionality of various proof predicates and hence the extensionality of G1, the role informal consistency assumption play goes largely unnoticed and unanalyzed. Closer inspection shows, however, that if such informal consistency assumptions are being made precise, the former distinction between G1 and G2 becomes blurry and G2’s intensionality can be made go away. Both observation then support the thesis that the traditional extensional/intensional distinction is not as robust as the received view believed it to be. (shrink)

Doch auch in Raumen begrenzter Staatlichkeit wird regiert, haufig unter Beteiligung privater Akteure und internationaler Organisationen. Der Band untersucht, ob und wie unter diesen Bedingungen legitimes Regieren moglich ist und wem die Verantwortung zukommt, Menschenrechte und demokratische Teilhabe zu gewahrleisten. Der erste Teil des Bandes fragt begrifflich nach den normativen Implikationen von Staatlichkeit. Hieran anschlieaend untersucht der zweite Teil menschenrechts- und gerechtigkeitstheoretische Fragen, (...) die sich aus begrenzter Staatlichkeit und dem Wirken nicht-staatlicher Governance-Akteure ergeben. Die Beitrage des dritten Teils erkunden, welche Implikation begrenzte Staatlichkeit fur das Ideal kollektiver Selbstbestimmung hat. Faith in the sense of trust in God is discussed as a somewhat extreme case of trust. Trust in general is understood as an emotional attitude and determined by the way a trusting person perceives the world and the person trusted. Interpersonal trust as the most common form of trust is characterized by connectedness - the trusted person is perceived as acting according to norms, values or goals shared by the trusting person - and by a participant attitude in the (...) sense of Strawson. Trust in God differs essentially from ordinary interpersonal trust, as the asymmetrical relationship between God and a faithful person does not allow for sharing a normative basis of conduct in the strict sense of „sharing“. Therefore, trust in God is ‚categorical‘ in character: the faithful person acknowledges God’s will as the ultimate and binding standard of normative value. Whatever happens, the faithful person perceives it as an expression of God’s will, and, thus, as ‚good‘. (shrink)

Haben alle Personen und nur Personen ein Recht auf Leben? Diese in der Philosophie vorherrschende Ansicht wird hier im Zuge einer Auseinandersetzung unter anderem mit Robert Spaemann und Peter Singer bestritten. Argumentiert wird für ein inklusives Verständnis des Lebensrechts, das auch viele nichtmenschliche Tiere einschließt. Abschließend werden Konsequenzen für das Menschenrecht auf Leben angedeutet.

Kommunikation kann als eine besondere Form der strategischen Interaktion verstanden werden. Die Spieltheorie stellt ein formales Instrumentarium zur Analyse strategischer Probleme zur Verfügung. Einige Grundkonzepte der Spieltheorie werden vorgestellt, und ihre Anwendung auf Probleme der Kommunikation an einfachen Modellen vom Typ des Signalspiels illustriert. Es wird argumentiert, dass Kommunikation durch ein typisches Dilemma individueller Rationalität gefährdet sein kann. Obwohl eine korrekte Anwendung von Regeln, die die Verwendung eines verfügbaren Zeichens festlegen, für alle Akteure vorteilhaft wäre, gelingt es rationalen Akteuren unter (...) bestimmten Bedingungen nicht, die Regeln zu befolgen und entsprechende Konventionen zu etablieren. Für moderne Handlungskontexte erweist sich der klassische Verantwortungsbegriff als inadäquat. Ein alternatives Konzept der Verantwortung, das auf der Humeschen Theorie der künstlichen Tugenden basiert, wird entwickelt und an einem einfachen Koordinationsspiel illustriert. Verantwortung wird dabei als das Resultat eines sozialen Zuschreibungsprozesses bestimmt. Menschen, denen Verantwortung zugeschrieben wird, erfüllen eine Funktion als Bezugspunkt sozialer Koordination. Es wird argumentiert, dass eine solche Konzeption gegenüber der klassischen ein feineres und angemesseneres Verständnis des Verhältnisses von kausaler Urheberschaft und Verantwortung vermittelt. Einige Schlussfolgerungen mit Blick (...) auf die Eigenschaften, die Personen in verantwortlichen Positionen haben sollten, werden gezogen. Gefordert sind: Autonomie, Integrität und Kompetenz. Robert Elsie ist derzeit einer der profiliertesten und vielseitigsten Albanienkenner. Dem an griechischer Kultur interessierten Leser wird seine Übersetzung der Gedichte von Konstantin Kavafis bekannt sein; seine albanologischen Monographien, die dem Byzantinisten wohl weniger vertraut sind (besonders Dictionary of Albanian Literature. Westport-New York-London 1986; History of Albanian Literature. 2 Bde. Boulder-New York 1995; Handbuch zur albanischen Volkskultur. Wiesbaden 2002), zählen zu den Standardwerken der Balkankunde. Elsie interessiert sich epochenübergreifend für albanische Kultur. Neben seiner fachwissenschaftlichen Tätigkeit hat er zahlreiche Übersetzungen albanischer (...) Literatur vorgelegt; und in den Rahmen seiner Übersetzungen von Albanica ist auch der zu besprechende Band zu stellen. Der Titel „Frühes Albanien“ ist für den mit der Epocheneinteilung in der balkanischen Volksgeschichte weniger Vertrauten auf den ersten Blick irreführend, umspannen die von Elsie vorgelegten Quellen doch den Zeitraum vom 11. bis an das Ende des 17. Jahrhunderts. Die Diskussion, wann in der Geschichte des albanischen Volkes das Mittelalter endet, wird offen und kontrovers geführt. Elsie setzt es an die Wende zum 18. Jahrhundert; andere Gelehrte sehen erst in den Anfängen einer Nationalbewegung im zweiten Drittel des 19. Jahrhunderts das Anbrechen einer neuen Epoche. (shrink)

This article evaluates the legality of Operation Iraqi Freedom, the March 2003 attack on Iraq. The author rejects assertions that Security Council Resolution 1441 (2002), standing alone, contained a mandate to employ force; on the contrary, the Resolution was only adopted on the understanding that it did not. The law of self-defense, including its ?preemptive? variant, similarly provided no legal basis for the action because the degree of Iraqi support to terrorism was insufficient and the threat of use of weapons (...) of mass destruction was not imminent. With regard to humanitarian intervention, the suffering inflicted by the Saddam Hussein's regime did not rise to a level allowing intervention. Moreover, international law does not permit forceful regime change except when authorized by the Security Council. However, the author argues that material breach of the 1991 cease-fire in Security Council Resolution 687 released the US and UK from their obligation to refrain from hostilities, thereby reactivating the use of force authorization in Security Council Resolution 678 (1990). This latter justification was the sole official legal justification offered for Operation Iraqi Freedom. (shrink)

A central challenge common to democratic processes is the inability of citizens to reach agreement on any given matter. Most frequently these disagreements are settled by vote, victory going to the majority. But majority rule is a fairly recent technique. Traditionally decisions were made by some form of non-opposition. This paper describes several versions of that decision-making technique and then shows how mediation methods, also known as “ADR”, can replicate these traditional ways of overcoming disagreement. Carl Schmitt (1888–1985), Professor für Staats- und Völkerrecht, bewegt nach wie vor die Gemüter. Die Reaktion auf seine Schriften, Handlungen und Ausstrahlungen ist vielfältig; die Spanne reicht von entrüsteten, für die er der Teufel in Person bleibt, über viele Zwischenstufen bis zu jenen Lesern, die ihn für einen der subtilsten, noch keineswegs ausgeloteten Geistern dieses Jahrhunderts halten. Sein Leben lang war Carl Schmitt ein passionierter Schreiber von Briefen. Meist handelte es sich um handschriftlich verfasste, die für den Schreibenden (...) die Fortsetzung eines konkreten Gespräches mit anderen Mitteln war. Das macht das authentische und die Spontanität der Schmitt-Briefe aus. Als erste Edition einer umfangreichen Korrespondenz wird in dem Buch die Korrespondenz zwischen Carl Schmitt und Armin Mohler veröffentlicht. Der Briefwechsel umfasst die Zeit von 1947 bis 1980 und enthält 280 Briefe und Karten von Carl Schmitt an Armin Mohler. Von dem Briefpartner und Herausgeber wird in der Regel aus den eigenen Briefen nur auszugsweise zitiert, sofern es für das von Carl Schmitt Geschriebene notwendig ist. Armin Mohler (1920 bis 2003), ist einer der bekanntesten rechtskonservativen Schriftsteller, Kritiker und Historiker in Deutschland. Sein Handbuch zur Konservativen Revolution ist ein Standardwerk. In der Zeit des Briefwechsels war Mohler von 1949 bis 1953 Sekretär Ernst Jüngers, danach Korrespondent großer Zeitungen in Paris und von 1964 an Geschäftsführer der Carl Friedrich von Siemens Stiftung, in der er sehr beachtete Symposien zu aktuellen wissenschaftlichen Themen organisierte. Der Briefwechsel ist für die Deutung Carl Schmitts in der Nachkriegszeit in seinem Sauerländer "Exil" grundlegend, gleichzeitig enthält er pointierte Schlaglichter auf das politische und kulturelle Geschehen der frühen und mittleren Bundesrepublik sowie auf Werk und Leben von Ernst Jünger. The famous pithy aphorisms that Carl Schmitt used to open his major works - 'the sovereign is he who decides on the exception', 'the concept of the state presupposes the concept of the political', etc. - have become a part of the common discourse of contemporary scholarship on politics and the law. The theoretical framework that animates these slogans, however, has remained somewhat opaque. It has often been (...) argued that there is no such framework, that Schmitt was a situational thinker whose works are best understood as interventions in concrete political debates that do not add up to a grand theoretical vision.
