In this paper, I take up the conciliatory-steadfast debate occurring within social epistemology in regards to the phenomenon of peer disagreement. I will argue, because the conciliatory perspective al-lows us to understand argumentation pragmatically—as a method of problem-solving within a community rather than as a method for obtaining the truth—that in most cases, we should not simply agree to disagree.

Moral judgments attempt to describe a reality that does not exist, so they are all false. This troubling view is known as the moral error theory. Christopher Cowie defends it against the most compelling counter-argument, the argument from analogy: Cowie shows that moral error theory does not compromise the practice of making epistemic judgments.

This article proposes a conceptual mapping to outline salient properties and relations that allow for a knowledge transfer from the well-established greenwashing phenomenon to the more recent machinewashing. We account for relevant dissimilarities, indicating where conceptual boundaries may be drawn. Guided by a “reasoning by analogy” approach, the article addresses the structural analogy and machinewashing idiosyncrasies leading to a novel and theoretically informed model of machinewashing. Consequently, machinewashing is defined as a strategy that organizations adopt to engage in (...) misleading behavior about ethical Artificial Intelligence /algorithmic systems. Machinewashing involves misleading information about ethical AI communicated or omitted via words, visuals, or the underlying algorithm of AI itself. Furthermore, and going beyond greenwashing, machinewashing may be used for symbolic actions such as lobbying and prevention of stricter regulation. By outlining diverse theoretical foundations of the established greenwashing domain and their relation to specific research questions, the article proposes a machinewashing model and a set of theory-related research questions on the macro, meso, and micro-level for future machinewashing research. We conclude by stressing limitations and by outlining practical implications for organizations and policymakers. (shrink)

This paper offers a qualified defense of a historically popular view that I call sentimental perceptualism. At a first pass, sentimental perceptualism says that emotions play a role in grounding evaluative knowledge analogous to the role perceptions play in grounding empirical knowledge. Recently, András Szigeti and Michael Brady have independently developed an important set of objections to this theory. The objections have a common structure: they begin by conceding that emotions have some important epistemic role to play, but then go (...) on to argue that understanding how emotions play that role means that there must be some alternative, emotion-independent route to obtaining knowledge of value. If there has to be such an emotion-independent route, then the perceptual analogy breaks down in a significant way. In this paper, I argue that the right ways for sentimental perceptualists to respond to each of these objections are revealed by thinking through how analogous objections applied to perception and the empirical domain would be answered. Although Szigeti's and Brady's objections should not persuade sentimental perceptualists to give up their view, the objections do put important constraints on what a form of the view has to be like in order to do exciting metaethical work. 'Autonomy' is originally a political notion. In this chapter, I argue that the political theory Kant defended while he was writing the _Groundwork_ sheds light on the difficulties that are commonly associated with his account of moral autonomy. I argue that Kant's account of the two-tiered structure of political legislation, in his _Feyerabend Lectures on Natural Law_, parallels his distinction between two levels of moral legislation, and that this helps to explain why Kant could regard the notion of 'autonomy' as (...) apt to express the principle of morality---at least in the mid 1780s. There is a long tradition comparing moral knowledge to mathematical knowledge. In this paper, I discuss apparent similarities and differences between knowledge in the two areas, realistically conceived. I argue that many of these are only apparent, while others are less philosophically significant than might be thought. The picture that emerges is surprising. There are definitely differences between epistemological arguments in the two areas. However, these differences, if anything, increase the plausibility of moral realism as compared to mathematical realism. It (...) is hard to see how one might argue, on epistemological grounds, for moral antirealism while maintaining commitment to mathematical realism. But it may be possible to do the opposite. The reasoning process of analogy is characterized by a strict interdependence between a process of abstraction of a common feature and the transfer of an attribute of the Analogue to the Primary Subject. The first reasoning step is regarded as an abstraction of a generic characteristic that is relevant for the attribution of the predicate. The abstracted feature can be considered from a logic-semantic perspective as a functional genus, in the sense that it is contextually essential for the attribution (...) of the predicate, i.e. that is pragmatically fundamental (i.e. relevant) for the predica-tion, or rather the achievement of the communicative intention. While the transfer of the predicate from the Analogue to the analogical genus and from the genus to the Primary Subject is guaranteed by the maxims (or rules of inference) governing the genus-species relation, the connection between the genus and the predicate can be complex, characterized by various types of reasoning patterns. The relevance relation can hide implicit arguments, such as an implicit argument from classification , an evaluation based on values, consequences or rules, a causal relation, or an argument from practical reasoning. This paper explores the notion that business calls for an adversarial ethic, akin to that of sport. On this view, because of their competitive structure, both sport and business call for behaviours that are contrary to ‘ordinary morality’, and yet are ultimately justified because of the goods they facilitate. I develop three objections to this analogy. Firstly, there is an important qualitative difference between harms risked voluntarily and harms risked involuntarily. Secondly, the goods achieved by adversarial relationships in sport (...) go beyond the function of sport, i.e. to entertain audiences. Thirdly, the most plausible account of the athlete’s motivational development starts with their love of the sport, which can explain a commitment to the sporting ethics in a way that is not paralleled in business. I close by drawing attention to the ways in which an Aristotelian conception of business ethics may be able to accommodate these objections. (shrink)

In this article I defend what I call a ‘particularist approach to arguments by analogy.’ Particularism is opposed to generalism, which is the thesis that arguments by analogy require a universal principle that covers cases compared and guarantees the conclusion. Particularism rejects this claim and holds that arguments by analogy operate on particular cases. I elaborate on two ideas that support this position. On the one hand, I contend that an analogy can be seen as a (...) parallelism of argumentative relationships, drawing on the distinction between similarity and analogy (Gentner 1983) and on the meta-argumentative account of arguments by analogy (Woods and Hudak 1989). On the other hand, I argue that universal principles are not necessary neither for the analysis nor the evaluation of arguments by analogy (Govier 1989) and that, rather than being a requirement, they can be seen as by-products of good analogies. While rules and exemplars are usually viewed as opposites, this paper argues that they form end points of the same distribution. By representing both rules and exemplars as (partial) trees, we can take into account the fluid middle ground between the two extremes. This insight is the starting point for a new theory of language learning that is based on the following idea: If a language learner does not know which phrase‐structure trees should be assigned to initial sentences, s/he allows (...) (implicitly) for all possible trees and lets linguistic experience decide which is the “best” tree for each sentence. The best tree is obtained by maximizing “structural analogy” between a sentence and previous sentences, which is formalized by the most probable shortest combination of subtrees from all trees of previous sentences. Corpus‐based experiments with this model on the Penn Treebank and the Childes database indicate that it can learn both exemplar‐based and rule‐based aspects of language, ranging from phrasal verbs to auxiliary fronting. By having learned the syntactic structures of sentences, we have also learned the grammar implicit in these structures, which can in turn be used to produce new sentences. We show that our model mimicks children’s language development from item‐based constructions to abstract constructions, and that the model can simulate some of the errors made by children in producing complex questions. The role of analogy appears in surprisingly different areas of the first Critique. On the one hand, Kant considered the concept to have a specific enough meaning to entitle the principle concerned with causation an analogy; on the other hand we can find Kant referring to analogy in various parts of the Transcendental Dialectic in a seemingly different manner. Whereas in the Transcendental Analytic, Kant takes some time to provide a detailed (if not clear) account of the (...) meaning of the term ‘analogy’ and his reasons for his employment of it, in the Transcendental Dialectic on the other hand, Kant’s employment of the term seems far less technical. It would seem on the face of it, that Kant has two senses of ‘analogy’: one technical sense reserved for those constitutive principles of the understanding as laid out in the Analytic, and another casual and commonplace use of the term. This picture, although it contains elements of truth, is ultimately misleading. I argue for three claims in this paper. Firstly, I suggest that there can be found in the first Critique a unified conception of analogy. Secondly, I argue that Kant self-consciously differentiated his employment of analogy from the employment that can be found in many early modern philosophers, e.g. Locke. Thirdly, I will tentatively suggest that this interpretation of analogy can aid us in addressing certain contentious areas of transcendental idealism, most notably the account of causation. (shrink)

This paper argues for a reinterpretation of the skill analogy in virtue ethics. It argues that the skill analogy should not be understood as proposing that being virtuous is analogous to possessing a practical skill but, rather, as proposing that being virtuous is analogous to being a good occupant of a skill-involving role. The paper argues for this by engaging with various standard objections to the analogy, two recent defences of it, and Aristotle’s treatment of it in (...) developing his account of virtue in the Nicomachean Ethics. It aims to show that neither virtue nor the skill analogy is correctly understood without recourse to the notion of a role and that once we have recourse to that notion, many objections to the analogy are met. First, that to understand analogy in St. Thomas Aquinas, one must distinguish two logically distinct concepts he inherited from Aristotle: one a kind of likeness between things, the other a kind of relation between linguistic functions. Second, that analogy (in both of these senses) plays a relatively small role in Aquinas's treatment of divine naming, compared to the realist semantic framework in which questions about divine naming are formulated and resolved, and on (...) which the coherence of the doctrine of divine simplicity—which is what gives rise to the questions of divine naming in the first place—depends. An analogy is sometimes drawn between the proper treatment of conscientious objectors in healthcare and in military contexts. In this paper, I consider an aspect of this analogy that has not, to my knowledge, been considered in debates about conscientious objection in healthcare. In the USA and elsewhere, tribunals have been tasked with the responsibility of recommending particular forms of alternative service for conscientious objectors. Military conscripts who have a conscientious objection to active military service, and whose objections (...) are deemed acceptable, are required either to serve the military in a non-combat role, or assigned some form of community service that does not contribute to the effectiveness of the military. I argue that consideration of the role that military tribunals have played in determining the appropriate form of alternative service for conscripts who are conscientious objectors can help us to understand how conscientious objectors in healthcare ought to be treated. Additionally, I show that it helps us to address the vexed issue of whether or not conscientious objectors who refuse to provide a service requested by a patient should be required to refer that patient to another healthcare professional. The COVID-19 pandemic has created unusually challenging and dangerous workplace conditions for key workers. This has prompted calls for key workers to receive a variety of special benefits over and above their normal pay. Here, we consider whether two such benefits are justified: a no-fault compensation scheme for harm caused by an epidemic and hazard pay for the risks and burdens of working during an epidemic. Both forms of benefit are often made available to members of the armed forces for (...) the harms, risks and burdens that come with military service. We argue from analogy that these benefits also ought to be provided to key workers during an epidemic because, like the military, key workers face unavoidable harms, risks and burdens in providing essential public good. The amount of compensation should be proportional to the harm suffered and the amount of hazard pay should be proportional to the risk and burden endured. Therefore, key workers should receive the same amount of compensation and hazard pay as the military where the harms, risks and burdens are equivalent. In the UK, a form of no-fault compensation has recently been made available to the surviving families of key workers who suffer fatal COVID-19 infections. According to our argument, however, it is insufficient because it offers less to key workers than is made available to the families of armed services personnel killed on duty. (shrink)

This paper deals with a specific version of metaethical moral relativism, known as “speaker-relativism”. It starts by explaining the position, focussing on the views of two prominent contemporary relativists, Gilbert Harman and James Dreier. Both authors draw an analogy between ethics and modern physics: just as Einstein showed that judgments about time or mass were always relative to a specific frame of reference, Dreier and Harman argue that “absolutist” judgments about moral rightness or wrongness need to be reinterpreted as (...) relative to some particular moral system. They also claim that this analogy allows us to salvage ordinary moral talk. I consider a number of possible objections to their argument, beginning with one, concerning the possibility of moral disagreement, which I think can be successfully answered, and then presenting two criticisms that I take to be more problematic for the relativist. I argue that despite its initial appeal, Harman and Dreier’s suggestion regarding our use of moral language seems to be a source of confusion in certain cases of moral disagreement, and does not appear able to preserve specifically moral normativity – which leads me to conclude that it is best viewed as a variant of an error theory about morality, rather than as the distinct metaethical position it purports to be. This paper discusses Avicenna’s concept of ambiguity/analogy and argues that while Avicenna doesn’t mention it explicitly there is an analogy of the predication of being between creatures and God, the Necessary of Existence. A consequence of this analogical predication is that for Avicenna, like Aquinas, God does not fall under the subject of metaphysics common being or being qua being. If the predication were univocal as some scholars contend such as Timothy Noone and Olga Lizzini, then God would (...) fall under the subject of metaphysics, common being as he does according to Ramon Guerrero and John Wippel. This paper has three parts. First, it discusses the comparison between Avicenna and Aristotle on pros hen equivocation/analogy. Second, it discusses the texts within Avicenna which suggest an analogical predication and which can reasonably be seen as establishing a transcendental predication between God and creatures. Finally, it develops the consequences of Avicenna’s view for the relationship between God and the subject of metaphysics common being or being qua being and argues that God does not fall under common being. A theory of analogy must describe how the meaning of an analogy is derived from the meanings of its parts. In the structure‐mapping theory, the interpretation rules are characterized as implicit rules for mapping knowledge about a base domain into a target domain. Two important features of the theory are (a) the rules depend only on syntactic properties of the knowledge representation, and not on the specific content of the domains; and (b) the theoretical framework allows analogies to (...) be distinguished cleanly from literal similarity statements, applications of abstractions, and other kinds of comparisons.Two mapping principles are described: (a) Relations between objects, rather than attributes of objects, are mapped from base to target; and (b) The particular relations mapped are determined by systematicity, as defined by the existence of higher‐order relations. In this essay I examine Kant's analogy with life from §65 of the Critique of the power of Judgment. I argue that this analogy is central for understanding his notion of a natural end, for his account of the formative power of organisms in the third Critique, and for situating Kant's account of this power in relation to the Lebenskräfte of the vitalists.

In this chapter I problematize Beauvoir's analogical analyses in The Second Sex, arguing that her utilization of the race/gender analogy omits the experiences and oppressions of Black women. Furthermore, taking into account select secondary literature that emphasizes these issues, I argue that several of Beauvoir's white feminist defenders and critics share in common their non‐engagement with Black feminist literature on Beauvoir. Put another way, Black feminists who explicitly take up Beauvoir in their writings have remained largely unacknowledged in the (...) secondary literature on Beauvoir by white feminists. As a corrective to this erasure, I highlight the scholarly contributions of Black feminists including Loraine Hansberry, Chikwenye Ogunyemi, Deborah King, Oyeronke Oyewumi, and bell hooks. (shrink)

This essay is a response to John Milbank’s comparison of Kant and Aquinas’ theories of analogy in ‘A Critique of the Theology of Right’. A critique of Milbank’s essay forms the point of departure for my reconstruction of Kant’s actual theory of analogy. I show that the usual focus on the Prolegomena for this end is insufficient; in fact, the full extent of Kant’s theory of analogy only becomes clear in the Critique of Judgment. I also consider (...) the significance of the Analogies of Experience in the Critique of Pure Reason. In conclusion, I draw on the work of Michel Guérin to designate Kantian analogy, ‘post-established harmony’. (shrink)

The central role played by Darwin's analogy between selection under domestication and that under nature has been adequately appreciated, but I have indicated how important the domesticated organisms also were to other elements of Darwin's theory of evolution-his recognition of “the constant principle of change,” for instance, of the imperfection of adaptation, and of the extent of variation in nature. The further development of his theory and its presentation to the public likewise hinged on frequent reference to domesticates.We have (...) seen that Darwin's reliance on the analogy between domesticated varieties and wild species was a bold and original step, in light of contemporary views on the nature of domesticates. However, as Darwin undoubtedly foresaw, his reliance on the analogy created difficulties as well as solving problems, and these began with his Malthusian codiscoverer of the principle of natural selection, Alfred Russel Wallace. Wallace's paper “On the Tendency of Varieties to Depart Indefinitely from the Original Type,” presented to the Linnean Scoiety along with the first public unveiling of Darwin's theory, states: We see, then, that no inferences as to varieties in a state of nature can be deduced from the observation of those occurring among domestic animals. The two are so much opposed to each other in every circumstance of their existence, that what applies to the one is almost sure not to apply to the other. Domestic animals are abnormal, irregular, artificial; they are subject to varieties which never occur and never can occur in a state of nature.62Much has been made of the similarity of views of Darwin and Wallace, but this quotation surely reveals how utterly different their views were on what to Darwin was an important matter. Several critics of the Origin saw Darwin's reliance on the domesticates as his Achilles heel. As Young has pointed out, Samuel Wilberforce included the following passage in his attack on the Origin: Nor must we pass over unnoticed the transference of the argument from the domesticated to the untamed animals. Assuming that man as the selector can do much in a limited time, Mr. Darwin argues that Nature, a more powerful, a more continuous power, working over vastly extended ranges of time, can do more. But why should Nature, so uniform and persistent in all her operations, tend in this instance to change? Why should she become a selector of varieties?63Another critic, Fleeming Jenkin, found the analogy a weakness in Darwin's theory because of the limited extent of variation in any one direction in domestic animals and plants.64 We have already seen that Darwin had confided a similar view to his notebook thirty years earlier, but changed his mind as a result of his profound study of domesticates. De Beer's reference to “an English country gentleman's knowledge of domestic plants and animals and their breeding”65 fails totally to recognize the originality and depth of Darwin's knowledge of domesticates.Why did Darwin, against the currents of his time, rely so heavily on mankind's experience with domesticated organisms to shape his theory about species in nature? On reason is that only with domesticates was an approach that came close to experimental verification possible. Darwin fully realized the inadequacies of the experiment, as is emphasized by his repeated contrasting of selection under nature and selection by man. Yet the extensive experience and data of plant and animal breeders offered the only reliable base against which Darwin could continually challenge his views. As he wrote in the introduction to Variation, with domestication, “man ... may be said to have been trying an experiment on a gigantic scale.”66 Given Darwin's high opinion of the quantitative work of Malthus and Quetelet (as emphasized by Schweber),67 and his unremitting efforts to secure data by which to test his theories, it was inevitable that he should attach high significance to domesticated varieties. John Tyndall, in his Belfast address of 1874, said: “The strength of the doctrine of Evolution consists, not in experimental demonstration (for the subject is hardly accessible to this mode of proof), but in its general harmony with scientific thought.”68 Darwin would have agreed with the latter thought, but I think he would have challenged the preceding one on the grounds that long experience with domesticated varieties did provide an element of experimental demonstration. It gave him confidence in his theory, and he used his vast knowledge of artificial selection boldly and creatively. (shrink)

Peter Singer's argument against ‘speciesism’ has served as the theoretical foundation for the modern animal rights movement. His argument is that the wrongs we do to animals are analogous to those committed against marginalized humans; that if we are opposed to one, then we should also be opposed to the other. Despite the argument's popularity, those historically oppressed groups to whom animals are compared have been critical of it, perceiving the analogy as dehumanizing. Animal activists have struggled to understand (...) this criticism, arguing that the analogy is only dehumanizing if one believes animals to be inferior in the first place – which is exactly what they dispute. What they fail to realize, I argue, is that the disagreement cannot be reduced to a difference in what one chooses to value. It is, instead, fundamentally conceptual. To be likened to an ‘Animal’ is something different for they who have never been regarded as ‘fully human’ in the first place. It is only after animal activists appreciate this – the singular character of human oppression, how it differs conceptually from the injustice that animals can be subject to – that the building of alliances and the work of collaboration can begin in earnest. The aim of this critical note is to discuss Heraclitus' use of analogy as a pattern of thought not only with argumentative value but also ontological and epistemological status. Heraclitus' analogy is of two kinds and is expressed in the use of the adverbs ὥσπερ ("as") and ὅκωσπερ ("just as"). The first is used as an explanatory device, while the second denotes the ontological homogeneity of logos. Analogy reveals not only the inherent opposition of logos in each (...) single thing, but also the interdependent common interrelation between things. (shrink)

Skeptical theism has as its foundation the thesis that if God permits evil, his reasons for doing so will likely be beyond our ken. The only defense given for this thesis is the Parent Analogy. There is in the literature only one defense of this use of the Parent Analogy and it has never been confronted. I examine it and expose serious flaws, thus exposing a crack in the very foundation of skeptical theism.

Is the science of moral cognition usefully modelled on aspects of Universal Grammar? Are human beings born with an innate 'moral grammar' that causes them to analyse human action in terms of its moral structure, with just as little awareness as they analyse human speech in terms of its grammatical structure? Questions like these have been at the forefront of moral psychology ever since John Mikhail revived them in his influential work on the linguistic analogy and its implications for (...) jurisprudence and moral theory. In this seminal book, Mikhail offers a careful and sustained analysis of the moral grammar hypothesis, showing how some of John Rawls' original ideas about the linguistic analogy, together with famous thought experiments like the trolley problem, can be used to improve our understanding of moral and legal judgement. In this paper, I do three things. First, I say what I mean by a ‘companions in guilt’ argument in meta-ethics. Second, I distinguish between two kinds of argument within this family, which I call ‘arguments by entailment’ and ‘arguments by analogy’. Third, I explore the prospects for companions in guilt arguments by analogy. During the course of this discussion, I identify a distinctive variety of argument, which I call ‘arguments by absorption’. I argue that this variety of (...) argument inherits some of the weaknesses of standard arguments by analogy and entailment without obviously adding to their strength. (shrink)

I identify one neglected source of support for a Kripkean reading of Wittgenstein’s Philosophical Investigations: the analogy between rules and epistemic grounds and the existence of a Kripkean anti-privacy argument about epistemic grounds in On Certainty. This latter argument supports Kripke’s claims that the basic anti-privacy argument in the Investigations (a) poses a question about the distinguishability of certain first-person attributions with identical assertability conditions, (b) concludes that distinguishability is provided by third-person evaluability, and (c) is a general argument, (...) not one about a specific kind of alleged rules.
