We introduce a path-based measure of convexity to be used in assessing the compactness of legislative districts. Our measure is the probability that a district will contain the shortest path between a randomly selected pair of its' points. The measure is defined relative to exogenous political boundaries and population distributions.

Morality, Rules, and Consequences: A Critical Reader explores for students and researchers the relationship between consequentialist theory and moral rules. Most of the chapters focus on rule consequentialism or on the distinction between act and rule versions of consequentialism. Late in 1990, the Center for the Study of Ethics in the Professions at Illinois Institute of Technology (lIT) received a grant of more than $200,000 from the National Science Foundation to try a campus-wide approach to integrating professional ethics into its technical curriculum.! Enough has now been accomplished to draw some tentative conclusions. I am the grant's principal investigator. In this paper, I shall describe what we at lIT did, what we learned, and what others, especially philosophers, can learn (...) from us. Dual-track assessment directs research ethics committees to assess the risks of research interventions based on the unclear distinction between therapeutic and non-therapeutic interventions. The net risks test, in contrast, relies on the clinically familiar method of assessing the risks and benefits of interventions in comparison to the available alternatives and also focuses attention of the RECs on the central challenge of protecting research participants.Research guidelines around the world recognise that clinical research is ethical only when the risks to participants are (...) reasonable.1 Appropriate implementation of this requirement is vital to protecting research participants and allowing research to proceed when it poses acceptable risks. Unfortunately, as the US National Bioethics Advisory Commission notes: “current regulations do not further elaborate how risks and potential benefits are to be assessed, and little additional guidance is available to IRBs.”1The NBAC, as well as numerous commentators, recommend that research ethics committees , ethics review committees and institutional review boards should adopt what may be called dual-track risk assessment.2–5 Yet, dual-track assessment unnecessarily divides research interventions into two different categories before assessing their risks and relies on the unclear distinction between therapeutic and non-therapeutic interventions. As a result, dual-track assessment provides RECs with confusing guidance and has the potential to block valuable research that poses acceptable risks. This paper describes one alternative, the net risks test, and argues that this approach offers a better method for assessing research risks, one that puts RECs in a position to protect participants without blocking appropriate research studies.BACKGROUNDClinical research exposes participants to interventions and procedures to gather systematic data that may be used to improve overall health and well-being. It was reviewed, accepted and published. Sokal immediately confessed that the whole article was a hoax - a cunningly worded paper designed to expose and parody the style of extreme postmodernist criticism of science. The story became front-page news around the world and triggered fierce and wide-ranging controversy. We seek to change the conversation about brain death by highlighting the distinction between brain death as a biological concept versus brain death as a legal status. The fact that brain death does not cohere with any biologically plausible definition of death has been known for decades. Nevertheless, this fact has not threatened the acceptance of brain death as a legal status that permits individuals to be treated as if they are dead. The similarities between “legally dead” and “legally blind” (...) demonstrate how we may legitimately choose bright-line legal definitions that do not cohere with biological reality. Not only does this distinction bring conceptual coherence to the conversation about brain death, but it has practical implications as well. Once brain death is recognized as a social construction not grounded in biological reality, we create the possibility of changing the social construction in ways that may better serve both organ donors and recipients alike. SokalAlas, the truth is out: my article, “Transgressing the Boundaries: Toward a Transformative Hermeneutics of Quantum Gravity,” which appeared in the spring/summer 1996 issue of the cultural-studies journal Social Text, is a parody. 1 Clearly I owe the editors and readers of Social Text, as well as the wider intellectual community, a non-parodic explanation of my motives and my true views. One (...) of my goals here is to make a small contribution toward a dialogue on the Left between humanists and natural scientists—“two cultures” which, contrary to some optimistic pronouncements (mostly by the former group), are probably farther apart in mentality than at any time in the past fifty years.Like the genre it is meant to satirize—myriad exemplars of which can be found in its reference list—my article is a mélange of truths, half-truths, quarter-truths, falsehoods, non sequiturs, and syntactically correct sentences that have no meaning whatsoever. (Sadly, there are only a handful of the latter: I tried hard to produce them, but I found that, save for rare bursts of inspiration, I just didn’t have the knack.) Moral distress is a well-documented phenomenon for health care providers (HCPs). Exploring HCPs’ perceptions of participation in moral distress interventions using qualitative and quantitative methods enhances understanding of intervention effectiveness. The purpose of this study was to measure and describe the impact of a two-phased intervention on participants’ moral distress. Using a cross-over design, the project aimed to determine if the intervention would decrease moral distress, enhance moral agency, and improve perceptions about the work environment. We used quantitative instruments and (...) explored participants’ perceptions of the intervention using semi-structured interviews. Participants were from inpatient settings, within three major hospitals of a large, urban healthcare system in the Midwest, United States. Participants included nurses (80.6%) and other clinical care providers. Using generalized linear mixed modeling we assessed the change in each of the outcome variables over time controlling for groups. Interviews were audiotaped and professionally transcribed. The written narratives were coded into themes. The change in scores on study instruments trended in the desired direction however did not meet statistical significance. Qualitative interviews revealed that intervention effectiveness was derived from a combination of learning benefits, psychological benefits, and building community that promoted moral agency. Findings demonstrate a clear link between moral distress and moral agency and suggest that Facilitated Ethics Conversations can enhance the work environment. Findings provide insight for developing evidenced-based approaches to address moral distress of hospital nurses. (shrink)

The long (...) overdue appearance in English translation of this important work is a welcome addition to the Nietzsche literature and, although dated in some respects, it remains an important work that warrants careful attention. As Richard Schacht notes in his foreword, the original publication of this work was a significant event in the history of Nietzsche studies in Germany. Coming ten years after the publication of Heidegger's massive two-volume Nietzsche, Müller-Lauter's book "provided a much-needed counterweight" to Heidegger's idiosyncratic treatment (ix). Aside from proferring a significant rejoinder to the Heideggerian interpretation, Müller-Lauter also responds to a vast array of German Nietzsche scholars, some well-known (K. Löwith, K. Jaspers, E. Fink, K. Schlechta), but many much less familiar. As such, this book is an important piece of historical scholarship, offering the contemporary English-speaking reader an interesting picture of German scholarship on Nietzsche before Heidegger's work took center stage as the dominant (unfortunately, some would say only) German work worth engaging.But Müller-Lauter's book is not just of historical interest; it offers a powerful and profound reading of Nietzsche's corpus focused on the question of contradiction, both the contradictions readers find amidst Nietzsche's various works and Nietzsche's own philosophy of contradiction, namely, that contradictoriness is in some sense constitutive of the world. For Müller-Lauter, contradiction, the unresolvable conflict between essentially antithetical perspectives, grounds Nietzsche's philosophizing in wills to power. Emphasizing the plurality of conflicting wills to power, Müller-Lauter offers in successive chapters interpretations of Nietzsche's views on history as the "concrete occurrences" of these conflicting wills to power; nihilism as the process by which an organized system of forces (physical, social, intellectual, cultural) disintegrates into an antagonistic multiplicity of competing wills; morality as demanding truths that, once discovered, it can neither face nor accept, fleeing instead into a fictitious world of its own creation; Christian truthfulness as a destruction of truth that presents a "multiplicity of mutually opposing untruths" (72). All of these interpretations are shown to rest upon a contradiction at the heart of Nietzsche's own account of will to power, namely, that the strong will to power both affirms the multiplicity of perspectives and yet imposes its perspective as absolute.This is the paradox of the overman, a paradox Müller-Lauter addresses in his final chapter on "the doctrine of eternal recurrence." Not surprisingly, the eternal recurrence reveals itself to be essentially contradictory. But this contradiction is not self-refuting; rather "since the eternal recurrence is only as a thought and a doctrine, its meaning remains insurmountably split into a duality" (121) reflected in two ultimately incompatible types of overman. There is, on the one hand, the "powerful overman" who sees the entirety of what is as necessary for his own existence; to affirm eternal [End Page 453] recurrence is to understand everything that has been as a necessary series of events that ends with himself at its apex. But there is also the "wise overman," who understands the totality of what has been and is as necessary for his having arrived at the present moment in which he transcends himself and becomes other. Where the meaning of the powerful overman's affirmation of eternal recurrence resides in his appearance as the being who is dominant, the meaning of the wise overman's affirmation lies in understanding and accepting what has been as the precondition for both what he presently is and what he can become. We present asecond-personalaccount of corporate moral agency. This approach is in contrast to thefirst-personalapproach adopted in much of the existing literature, which concentrates on the corporation’s ability to identify moral reasons for itself. Our account treats relationships and communications as the fundamental building blocks of moral agency. The second-personal account rests on a framework developed by Darwall. Its central requirement is that corporations be capable of recognizing the authority relations that they have with other moral agents. We discuss the relevance (...) of corporate affect, corporate communications, and corporate culture to the second-personal account. The second-personal account yields a new way to specify first-personal criteria for moral agency, and it generates fresh insights into the reasons those criteria matter. Schrift and Shannon SullivanThe articles in this special issue of the Journal of Speculative Philosophy were selected from revised versions of papers that were originally presented at the sixtieth annual meeting of the Society for Phenomenology and Existential Philosophy (SPEP) at Texas A&M University in College Station, Texas October 13–15, 2022.Michael Hardt of Duke University and Patricia Pisters of the University of Amsterdam gave the SPEP (...) 2022 Plenary Addresses, and we are grateful to be able to include their plenary papers in this special issue. Hardt's paper, "The Politics of Articulation and Strategic Multiplicities," treated SPEP members to an early peek at his newest book, The Subversive 70s (Oxford University Press, 2023). In this work, Hardt digs into the powerful resources for social movements that activists and theorists from the 1970s developed. As he argues, in many ways those activists and thinkers were ahead of their times—and also ahead of ours—in understanding how to analyze interwoven multiplicities of power and how to articulate and organize liberation struggles based on those multiplicities. Hardt brilliantly demonstrates how analyzing the progressive and revolutionary social [End Page 237] movements of the '70s can help us not only understand the roots of contemporary social and political struggles but also reclaim critical resources for those struggles.Patricia Pisters's paper, "Thinking with Fire: Elemental Philosophy and Media Technology," draws upon Gaston Bachelard's "fire complexes" to address a variety of pyrotechnical images appearing in contemporary cinema. Noting that elemental philosophy is on the rise in media studies and elsewhere, not least because of current environmental crises, fire is particularly engaging for its metaphorical, "matterphorical," and technological associations. While acknowledging fire as a material medium—cooking, heating, burning, etc.—Pisters's primary focus in her paper is on fire as an immaterial medium, and it is here that she turns to Bachelard's constellation of fire complexes—the Empedocles, Prometheus, and Novalis Complexes—to which she adds her own fourth complex, the Sita Complex. With these complexes, she provides readings of four cinematic productions that elucidate the annihilating, transgressive, sexual, and purifying qualities of fire, and she suggests that these entangled fire complexes present different kinds of combustive knowledge in which the element of fire manifests itself as material phenomenon of nature, the engine for modern life, and immaterial affective reverie of destruction, transgression, and sexuality.The other articles in this special issue have been organized according to five broad groupings. The first grouping, "On Latin American Philosophy," brings together three papers that engage Latin American philosophy, particularly as found in Mexican, Columbian, and Venezuelan history and political movements. In "Radicalizing Localization: Notes on Santiago Castro-Gómez's Genealogies of Coloniality," Julian Rios Acuña argues that Columbian philosopher Santiago Castro-Gómez develops a radical method of localization. This method allows Castro-Gómez to transform Foucauldian genealogy into genealogies of coloniality that grapple with the complexities of extreme violence produced by colonialism. In "Stefan Gandler's Renewal of Critical Theory from Latin America," Jake M. Bartholomew argues for a version of Critical Theory that is not bound by Europe but also remains true to its first-generation Marxist roots. Relocating to Mexico and advocating for Mexican philosophers, German-born philosopher Stefan Gandler shows how Latin American philosophy can enrich Critical Theory, providing more than can the second and third generations of Critical Theory because of its ability to analyze capitalism from outside the economic perspectives of the Global North. In "Two Versions of the Mestizo [End Page 238] Model: Toward a Theory of Anti-Blackness in Latin American Thought," Miguel Gualdron Ramirez criticizes the anti-Blackness that he sees at the heart of mestizo models of latinidad, or lo latinoamericano. Focusing on the concepts of liberation offered by Venezuelan theorist and politician Simón Bolívar and Mexican philosopher José de Vasconcelos, Ramirez reveals the exclusion and erasure of Black bodies, lives, and histories that ground their versions of Latinx identity and Latin American history. Aggleton & Brown suggest that whereas familiarity is computed in perirhinal cortex, the hippocampus contributes to recollection. This account raises issues about the definition of amnesia, clarifies confusion about dual-process models of recognition, and sits comfortably with accounts of hippocampal function from outside the amnesia literature. The model can – and should – be tested. Some preliminary data suggest that it may need changes.

In this paper, I discuss the Agrégation de Philosophie—the French national examination that certifies philosophy teachers for both lycée and university instruction—in terms of the role it has played in the intellectual formation of all French philosophers and, as a corollary, its impact on developments in 20th-century French philosophy. Following a recounting of the history and structure of the examination, I discuss how the examination reveals that a thorough grounding in the history of philosophy, especially pre-1800 philosophy, is a necessary (...) condition for employment as an instructor of philosophy. After discussing the connections between the examination and the teaching activities of the Sorbonne’s Department of Philosophy, I analyze the content of the exam, showing how it offers important insights into the French philosophical tradition and how it differs from the English language and German philosophical traditions. I conclude by examining in detail the appearances of Comte, Plotinus, and Nietzsche on the examination, showing how their appearances correlate with publication trends as well as the careers of influential philosophers. This article examines the role of dissection in the teaching of secondary biology and environmental science, within the context of the development of attitudes toward animals. Retrospective data concerning their experience in high school with dissection for 191 undergraduate education students are described, and their reported use of alternatives to invasive animal study are evaluated in relation to specific educational objectives in secondary science. It was found that most students were required to perform dissections, that many but not most experienced (...) negative and stable emotional reactions, and that teachers employed limited alternatives to dissection in their classes. The implications of this for secondary science teaching and for teacher education are discussed. (shrink)

The second half of the 19th Century saw a revolution in both European politics and philosophy. Philosophical fervour reflected political fervour. Five great critics dominated the European intellectual scene: Ludwig Feuerbach, Karl Marx, Soren Kierkegaard, Fyodor Dostoevsky, and Friedrich Nietzsche. "Nineteenth-Century Philosophy" assesses the response of each of these leading figures to Hegelian philosophy - the dominant paradigm of the time - to the shifting political landscape of Europe and the United States, and also to the emerging critique of modernity (...) itself. Both individually and collectively, these thinkers succeeded in revolutionizing theology, philosophy, psychology, and politics. The period also saw the emergence of new schools of thought and new disciplinary thinking. The volume covers the birth of sociology and the social sciences, the development of French spiritualism, the beginning of American pragmatism, the rise of science and mathematics, and the maturation of hermeneutics and phenomenology. ABSTRACT Following the publication of Derrida's Given Time, a great deal of philosophical attention was devoted to gifts and gift exchange as well as Marcel Mauss's Essay on the Gift. But after a certain formalization of the possible/impossible aporia of the gift, interest in Mauss's Essay among philosophers has largely disappeared. I return to Mauss's Essay and in particular to its moral, economic, and political conclusions to argue that Mauss makes several observations that relate directly to the current political dysfunction (...) of the U.S. government.
