Three Canadian institutional animal care and use committees were observed over a 1-year period to investigate animal ethical evaluation. While each protocol was evaluated, the observer collected information about the final decision, the type of protocol, and the category of invasiveness. The observer also wrote down verbatim all verbal interventions, which were coded according to the following categories: scientific, technical, politics, human analog, reduction, refinement, and replacement. The data revealed that only 16% of the comments were devoted to the 3 (...) explicit ethical categories and that most of the comments were technical. However, the analysis revealed that ethical concerns were implicit in both scientific and technical comments; either ethical norms had been translated into scientific and technical language, or some of the scientific and technical comments had an impact on the ethical treatment of animals. The results are discussed in relation to previous nonobservational research that identified potential pitfalls and bias in animal ethical evaluation. (shrink)

Freud, Psychoanalysis and Symbolism offers an innovative general theory of symbolism, derived from Freud's psychoanalytic theory and relocated within mainstream scientific psychology. It is the first systematic investigation of the development of Freud's treatment of symbolism throughout his published works, and discovers in those writings a broad theory which is far superior to the widely accepted, narrow, 'official' view. Agnes Petocz argues that the treatment of symbolism must begin with the identification and clarification of a set of logical constraints and (...) psychological requirements which any general theory of symbolism must respect, and that these requirements have been neglected by existing accounts across a number of disciplines. Her newly proposed 'Freudian broad' theory of symbolism, by contrast, does meet these requirements, but only after it has been rehabilitated within a revised psychoanalytic context, encompassing major changes to our understanding of the concepts of unconscious and repression and the role of language. This radical analysis of the role and importance of historiography interprets the philosophy and theory of history on the basis of historicity as a human condition. The book examins the norms and methods of historiography from a philosophical point of view, but rejects generalisations tht the philosophy of history can provide all the answers to contemporary problems. Instead it outlines a feasible theory of history which is still radical enough to apply to all social structures.

[Comment] We believe that climate winners have a part to play in redressing the inequalities brought about by climate change—indeed, we think some of their winnings are not legitimate because they were unearned, lucky windfalls. But the matter must be considered carefully. First, we do not claim that all climate gains are illegitimate, meaning that climate justice does not warrant confiscating all climate gains wholesale. Next, and perhaps somewhat unintuitively (at first), we argue that some of the illegitimate gains should (...) be transferred to polluters—that is the unintuitive part—while the rest should be used to compensate those harmed by climate change. This article argues that, notwithstanding views to the contrary, Frédéric Bastiat (Bayonne, 1801; Rome, 1850) was indeed a man of science. Thus, in several of his essays he showed that political economy can attain a level of scientific rigor comparable in many respects to that of the natural sciences. Subscribing to the principle of methodological individualism, he offered some persuasive explanations for why people believe in a multitude of things. After examining science as Bastiat conceived it, we shall look at (...) two important examples, mechanization and rational voting. (shrink)

El debate académico sobre el significado político de los derechos humanos ha puesto el acento en su dimensión negativa o privada, olvidando la dimensión positiva o pública que despliegan en el proceso de integración de una sociedad política determinada, como la democrática. El artículo rescata la dimensión política de los derechos humanos como un elemento constitutivo clave de la sociedad democrática. La hipótesis de que parte es que los derechos humanos otorgan carta de naturalidad a una lucha real a favor (...) de la libertad política y contra la opresión que encuentra su materialización histórica en la sociedad democrática y su negación en la sociedad totalitaria. Para desarrollar el argumento, recurre a la teoría de Claude Lefort, quien asocia el discurso de los derechos humanos con una concepción general de la sociedad que se realiza históricamente en la sociedad democrática. This article presents the themes addressed during the closing talk of an international study session on the work of trainee instructors in vocational higher education programs. The talk discussed professional development in internships, stances and actions in guiding and evaluating trainees, measures for working with and accommodating trainees with disabilities, and the issues and challenges involved in the work of trainee instructors.

Climate ethics has been concerned with polluter pays, beneficiary pays and ability to pay principles, all of which consider climate change as a single negative externality. This paper considers it as a constellation of externalities, positive and negative, with different associated demands of justice. This is important because explicitly considering positive externalities has not to our knowledge been done in the climate ethics literature. Specifically, it is argued that those who enjoy passive gains from climate change owe gains not to (...) the net losers, but to the emitters, just as the emitters owe compensation to the net losers for the negative externality. This is defended by appeal to theoretical virtues and to the social benefits of generating positive externalities, even when those positive externalities are coupled with far greater negative externalities. We call this the Polluter Pays, Then Receives ('PPTR', or 'Peter') Principle. This principle is then applied at two levels in the context of Canada. [Open access]. (shrink)

Many views define the concept of automaticity in terms of a number of features, but they differ with regard to the features they put most emphasis on, as well as with regard to the coherence they assume among the features. One contemporary account is the gradual and decompositional view, which proposes to investigate each automaticity feature separately and determine the degree to which it is present. In this chapter, we engage in a detailed analysis of the most important features in (...) order to examine whether they can indeed be regarded as gradual, and whether they can be conceptually and logically separated. This paper seeks to determine the extent to which individuals with borderline personality disorders can be held morally responsible for a particular subset of their actions: disproportionate anger, aggressions and displays of temper. The rationale for focusing on these aspects lies in their widespread acknowledgment in the literature and their plausible primary association with blame directed at BPD patients. BPD individuals are indeed typically perceived as “difficult patients” (Sulzer 2015, Bodner et al. 2011), significantly more so than schizophrenic or depressive (...) patients (Markam 2003). The “responsibility question” for patients with BPD has already been raised (Martin 2010, Zachar & Potter 2009, Bray 2003), but this paper tackles it from a novel perspective. First, I narrow down the category of things for which the responsibility question is specific to individual with BPD. After that, I argue that some of the diagnosis criteria of BPD such as emotional instability or impulsivity might serve as excusing factors targeting the “control condition” on moral responsibility. Second, this paper also considers another widely accepted condition on moral responsibility: the epistemic condition. The view defended in the paper is that the answer to the responsibility question for individuals with BPD, concerning both the control condition and the epistemic condition, hinges on an understanding of their epistemic profile. In this paper, I take scientific models to be epistemic representations of their target systems. I define an epistemic representation to be a tool for gaining information about its target system and argue that a vehicle’s capacity to provide specific information about its target system—its informativeness—is an essential feature of this kind of representation. I draw an analogy to our ordinary notion of interpretation to show that a user’s aim of faithfully representing the target system is necessary for securing this (...) feature. (shrink)

Aspiration by Agnes Callard locates standing assumptions in the theory of rationality, moral psychology and autonomy that preclude the possibility of working to acquire new values. The book also explains what changes need to be made if we are to make room for this form of agency, which I call aspiration.

Objections to the use of historical case studies for philosophical ends fall into two categories. Methodological objections claim that historical accounts and their uses by philosophers are subject to various biases. We argue that these challenges are not special; they also apply to other epistemic practices. Metaphysical objections, on the other hand, claim that historical case studies are intrinsically unsuited to serve as evidence for philosophical claims, even when carefully constructed and used, and so constitute a distinct class of challenge. (...) We show that attention to what makes for a canonical case can address these problems. A case study is canonical with respect to a particular philosophical aim when the features relevant to that aim provide a reasonably complete causal account of the results of the historical process under investigation. We show how to establish canonicity by evaluating relevant contingencies using two prominent examples from the history of science: Eddington’s confirmation of Einstein’s theory of general relativity using his data from the 1919 eclipse and Watson and Crick’s determination of the structure of DNA. Contract theories may be a useful analytical tool for understanding and explaining contract, as well as for facilitating orientation in a complex and often fragmented legal regulation. The article presents main understandings of contract in various European jurisdictions: contract as free assumption of obligation, contract as a bargain based on the idea of consideration, contract as free assumption of obligation based on sufficient causa. The article inquires as to how universal those theories are, what are the recent trends in the (...) development of European contract law, what philosophy of contract underlies the soft law instruments, such as UNIDROIT Principles of International Commercial Contracts or Principles of European Contract Law (PECL), what is the stance of the Draft Common Frame of Reference (DCFR) in regard to the concept of contract. Under the law of Lithuania the definition of contract comprises elements found in several European countries, but it is argued that the new Lithuanian Civil Code has not received any model in its pure form. However it seems that the prevailing view understands contract as juridical act, as freely assumed obligation and meeting of parties’ intentions with the aim to create legal effects. Following the position of soft law instruments in regard to the elements of the contract, Lithuanian law (at least in its statutory form) does not have any explicit additional requirements, such as consideration or causa. Bien que les approches basées sur les déficits soient encore prédominantes en formation à l’enseignement, on reconnaît de plus en plus l’apport potentiel des approches basées sur les forces, afin de développer une identité professionnelle positive. Conséquemment, nous avons expérimenté une activité innovante d’écriture réflexive, basée sur la psychologie positive, auprès de 50 stagiaires en enseignement préscolaire/primaire au Québec. L’analyse de ces empreintes offre de dégager divers aspects constitutifs de l’identité professionnelle des stagiaires, de décrire l’évolution du processus de construction (...) identitaire, ce qui permet d’apprécier la contribution de ce type d’activité pour rendre ce processus plus explicite. The acquisition of complex motor, cognitive, and social skills, like playing a musical instrument or mastering sports or a language, is generally associated with implicit skill learning . Although it is a general view that SL is most effective in childhood, and such skills are best acquired if learning starts early, this idea has rarely been tested by systematic empirical studies on the developmental pathways of SL from childhood to old age. In this paper, we challenge the view that childhood (...) and early school years are the prime time for skill learning by tracking age-related changes in performance in three different paradigms of SL. We collected data from participants between 7 and 87 years for a Serial Reaction Time Task testing the learning of motor sequences, an Artificial Grammar Learning task testing the extraction of regularities from auditory sequences, and Probabilistic Category Learning in the Weather Prediction task , a non-sequential categorization task. Results on all three tasks show that adolescence and adulthood are the most efficient periods for skill learning, since instead of becoming less and less effective with age, SL improves from childhood into adulthood and then later declines with aging. Sometimes we engage in a pursuit before we can fully access its value. When we embark upon, for example, the project of coming to appreciate classical music, we make a foray into a new domain of value. The chapter introduces a new kind of reason—a proleptic reason—to rationalize such large-scale transformative pursuits. The proleptic reasoner is aware of the defect in her appreciation of some value, and feels the need to improve. It is explained that the work done by proleptic (...) reasons cannot be done by more familiar kinds of reasons. The implications of proleptic rationality for reasons-internalism are considered. Internalists hold that what I have reason to do can be arrived at by a procedurally rational extrapolation from my current desires. However, because the act of learning some new form of valuation cannot be analyzed as satisfying the values one already has, proleptic reasons are not internal. (shrink)

Au début du XXIe siècle, qu'en est-il de la compréhension de la réalité du Monde Chinois? Pourquoi l'analyse de l'antiquité chinoise est-elle essentielle à cette perspective? Une connaissance réelle de la culture chinoise offre au lecteur l'accès aux débats internes, aux tensions entre les points de vue. Pourquoi évoquer la Grèce, la rationalité et non Delphes et la Pythie et pour la Chine, le mandat du ciel et non la mesure des angles d'un triangle? Depuis Marc Bloch, le sens de (...) l'histoire ne s'inscrit-il pas entre les " explications légendaires " et " les premiers essais d'interprétation rationaliste "? Il existe une dimension critique dans la culture chinoise. Ne serait-il pas plus créatif de comprendre comment tel fait ou telle question a été compris, discuté, voire réfuté au lieu de privilégier un consensus obligé? Pour explorer cette dimension critique, il faut lire les textes de la Chine ancienne qui n'appartiennent pas au corpus officiel et en chercher le sens. (shrink)
