Różnorodność doktryn rodzi rozmaite problemy praktyczne. Dla filozofii polityki podstawowy jest dylemat: jak w warunkach wielości nie dających się ze sobą pogodzić teorii, wyznawanych przez obywateli i tworzone przez nich grupy, uzyskać i utrzymać stabilność państwa. Spróbuję rozwiązać go w ramach kategorii wypracowanych przez liberalizm polityczny Johna Rawlsa.

Celem niniejszego artykułu jest prezentacja najnowszego liberalnego projektu rozstrzygnięcia dylematu statusu prawdy w polityce. Tylko tyle i aż tyle, bowiem jest to próba wprowadzenia na polski rynek idei liberalnych odpowiedzi na rodzime wyzwania, palące problemy. Przy tak ambitnym dążeniu należy przedstawić poglądy największego z wielkich liberałów współczesnych – Johna Rawlsa. Jego dzieło na tzw. Zachodzie nikogo nie pozostawia obojętnym, jest źródłem inspiracji czy to w postaci apologetycznej interpretacji czy krytycznej recepcji, będącej często początkiem formułowania własnego stanowiska. Dzisiaj, prawie czterdzieści lat (...) po opublikowaniu jego pierwszej książki, nadal właściwie nie sposób rozprawiać o polityce nie znając i nie podziwiając osiągnięcia Rawlsa. (shrink)

John Rawls w ostatnim okresie swojej twórczości, zwanym liberalizmem politycznym, zaproponował zastosowanie w praktyce politycznej demokracji liberalnej zasady tolerancji względem filozofii. Jak mamy rozumieć owo zalecenie?

In the individual, social, and political dimensions, the shaping of the liberal tradition has met up with and will continue to meet up with the presence of the Roman Catholic Church with its own philosophy. Yet has this always led to sharp conflict between Catholicism and liberalism? Has the social thinking of the Church evolved in its assessment of the liberal tradition and vice versa? Have there been points in common in the two systems of thinking? In contrast, where have (...) sparks appeared? Does Catholicism support the stability of liberal democracy? A response to these questions comprises the primary aim of the work at hand. Herein is a presentation and appraisal of one of the most interesting and continually lively clashes, accompanied by a portrayal of both Catholicism and liberalism. Analysis will be conducted at the level of social philosophy, through incidental political practice, and from the historical perspective – all of which together will enable illustration of the dynamic relationship between Catholicism and liberalism. Due to the scope of liberalism, the analysis of the Catholicism-liberalism relationship will be limited solely to the philosophy of politics and of economics. Such a restricted social philosophy involves the following issues: the genesis, essence, and characteristics of social policy; its ultimate justification or lack thereof; the relationship between the political society and its members; the types of structured political communities; the genesis, nature and duties of political authorities; the definition of the law, its foundations and limitations; the essence and properties of economic life; types of ownership; and, finally, the relations taking place between politics and economics. The problem inherent in an encounter between the social thinking of the Roman Catholic Church and liberalism appear to be especially meaningful in the context of the Polish discourse regarding the new order, its theoretical bases and institutions, projects for the realization of individual freedom, and the superiority or inferiority of values in today’s pluralistic universe. This matter is of great consequence and significance – not only intellectually but above all practically – and manifests itself in political, economic, and cultural life. Nonetheless, for decades now, Polish research into this issue has been entangled in occasional conflicts of a worldview and political nature. In turn, there is a lack of understanding and objective theoretical reflection on the subject. In fact, there are no publications which attempt to understand liberalism and assess the validity of the accusations against it. The vast amount of literature devoted to this problem most frequently opens, right from the start, with arguments stemming from either a Marxist or Catholic apologetics. The liberal credo is not identified with the philosophy of politics, but rather the theory of pro-capitalist economics. This, as a result, not only misrepresents the crux of liberalism, but also narrows the catalogue of responses by the Church on this very topic – starting with the encyclical Rerum novarum (1891) by Pope Leo XIII. In order to resolve this problem, the analysis will be rooted in the broader philosophical and historical context. In other words, it will look into liberalism on the one hand, and into those Church documents in which that institution first spoke of liberalism on the other. The discussions and deliberations contained within this volume are laid out in an introduction, four chapters, and a conclusion. The introduction includes the theoretical bases and methodological assumptions of this work, taking into account the principles of philosophical reflection and analysis. The fundamental chapters present the evolution of an attitude towards liberalism in the social teachings of the Roman Catholic Church – from Pius VI to John Paul II – taking under consideration the key moments and figures in the development of liberalism (e.g., John Locke, John Stuart Mills, John Rawls). In this time period four stages of a Catholic reference to liberalism will be distinguished. The first three constitute: 1) animosity and condemnation (from Pius VI to Pius IX), 2) criticism accompanied by tolerance (from Leo XIII to Pius XII, and 3) criticism accompanied by limited concord (from John XXIII to Paul VI). Today, and with increasing frequency, voices are heard speaking of the teachings of John Paul II as marking a new caesura in the Catholic-liberalism relationship. Hence it is worth re-evaluating and re-analyzing if such opinions are justified. The volume closes with a conclusion comprising an attempt to answer the following questions. Are Catholic accusations addressed at liberalism correct or not? Has liberalism turned out to be a philosophy open to criticism and capable of modification as the weak points in liberal theory and practice are disclosed? Can Catholic values enrich the liberal political order? Can Catholic moral-religious norms, introduced into the realm of political responsibilities, endanger the foundations of the liberal system? Reviewing the evolution of Catholicism as well as liberalism, has Catholicism found its place amidst the pluralistic harmony of liberal democracy? Kształtowanie się tradycji liberalnej napotykało i będzie napotykać na promowaną przez Kościół rzymskokatolicki filozofię, zarówno w wymiarze indywidualnym, społecznym, jak i politycznym. Czy zawsze prowadziło to do ostrego sporu między katolicyzmem a liberalizmem? Czy społeczna myśl Kościoła ewoluowała w swojej ocenie tradycji liberalnej i vice versa? Czy w obu systemach myślowych istniały punkty wspólne? Czego dotyczyły ogniska zapalne? Czy katolicyzm wspiera stabilność liberalnej demokracji? Te pytania sprawiły, że głównym celem niniejszej pracy jest prezentacja i ocena jednego z najbardziej interesujących i wciąż aktualnych sporów, a pośrednio przedstawienie dwóch filozofii – katolicyzmu i liberalizmu. Analiza tego sporu prowadzona jest na płaszczyźnie filozofii społecznej, incydentalnie – praktyki politycznej w ujęciu historycznym, co umożliwia ukazanie dynamiki relacji między katolicyzmem i liberalizmem. Z powodu zakresu liberalizmu w analizie relacji katolicyzm – liberalizm praca ta ogranicza się jedynie do filozofii polityki i filozofii gospodarki. Tak okrojona filozofia społeczna interesuje się następującymi problemami: genezą, istotą i cechami społeczności politycznej, jej ostatecznym uzasadnieniem lub brakiem takowego oraz relacjami między społeczeństwem politycznym a jego członkami, typami ustrukturyzowania wspólnoty politycznej, genezą, naturą i zadaniami władzy politycznej, definicją prawa, jego podstawą i ograniczeniami, istotą i właściwościami życia gospodarczego, rodzajami własności, stosunkami zachodzącymi między polityką a ekonomią. Problem spotkania myśli społecznej Kościoła katolickiego z liberalizmem wydaje się szczególnie znaczący również w kontekście polskich dyskusji o tworzącym się ładzie, jego teoretycznych podstawach i instytucjach, projekcie realizacji indywidualnej wolności oraz wyższości i niższości wartości w dzisiejszym, pluralistycznym uniwersum. Problem ten ma olbrzymie znaczenie nie tylko intelektualne, ale przede wszystkim praktyczne, objawiające się na poziomie życia politycznego, ekonomicznego i kulturowego. Jednak od wielu dziesięcioleci polskie studia nad tym zagadnieniem są uwikłane w doraźne konflikty o charakterze światopoglądowym i politycznym, natomiast brakuje rozumiejącej i obiektywnej refleksji teoretycznej na ten temat. Właściwie nie ma publikacji próbujących zrozumieć liberalizm i ocenić zasadność stawianych mu zarzutów. Ogrom literatury poświęcony temu problemowi najczęściej zawiera prace już na wstępie wychodzące z pozycji apologetycznie marksistowskich czy katolickich. Utożsamia się w nich credo liberalizmu nie z filozofią polityki, lecz z teorią ekonomii prokapitalistycznej, co nie tylko zakłamuje istotę liberalizmu, lecz także zawęża katalog wypowiedzi Kościoła na jego temat, rozpoczynając je od encykliki Rerum novarum (1891) Leona XIII. Aby sprawę wyjaśnić w niniejszej książce, analiza jest umieszczona w szerszym kontekście filozoficznym i historycznym, czyli „ma wgląd”, z jednej strony w liberalizm, z drugiej – w dokumenty Kościoła, w których on po raz pierwszy zabrał głos w sprawie liberalizmu. Rozważania zawarte w niniejszej pracy podzielone są na wstęp, cztery rozdziały i zakończenie. We wstępie prezentuję podłoże teoretyczne i założenia metodologiczne rozprawy, przestrzegając zasad refleksji i analizy filozoficznej. Rozdziały przedstawiają ewolucję stosunku do liberalizmu w społecznej nauce Kościoła rzymskokatolickiego, od czasów Piusa VI do Jana Pawła II, z uwzględnieniem ważniejszych momentów rozwoju myśli liberalnej (John Locke, John Stuart Mill, John Rawls). Bez wątpienia w historii filozofii polityki istnieją pytania, które mają pozaczasowy charakter, jednym z nich jest pytanie o to, czym jest polityka. Nie oznacza to jednak, że filozofia polityki to jedna tradycja powiązanych ze sobą idei, która rozpoczęła się w starożytnej Grecji i trwa do dziś. Istnieją bowiem w jej ramach pytania związane z duchem czasów i określoną kulturą. Także odpowiedzi na odwieczne pytania zależą od problemów danej kultury i epoki, od tez nurtu filozoficznego, z którym identyfikuje się dany (...) myśliciel czy od ogólnego trendu filozoficznego panującego w danej epoce. Nie wszystkie są tak samo dobre dla określonego kontekstu historyczno-kulturowego. Niniejszy artykuł próbuje to wykazać, na trzech proponowanych współcześnie modelach polityki. Wybrani zostali autorzy, którzy są związani z odmiennymi szkołami filozofii polityki, którzy wskazali nowe drogi myślenia i badania, których można uznać za jednych z najczęściej komentowanych filozofów w drugiej połowie ubiegłego wieku, a także i obecnie, albowiem stali się punktami odniesienia, źródłem inspiracji czy krytycznej recepcji. Sprawiedliwość należy do najważniejszych i zawsze aktualnych problemów życia społeczno-politycznego. Dotyczy każdego z nas. Nikomu bowiem nie jest obojętne, jak jest traktowany przez prawo i władzę, jak są dzielone korzyści wynikające ze społecznej współpracy. Sprawiedliwość mobilizuje nas do społecznego zaangażowania i solidarności, ze względu na nią wciągamy się w obywatelskie nieposłuszeństwo czy decydujemy się na emigrację. Odwołania do niej pojawiają się zarówno w okrzykach burzycieli, jak i obrońców starego porządku. Nie jesteśmy jednak pierwszymi, którzy stawiają pytania o sprawiedliwość. Mają one (...) długą i bogatą tradycję. Od starożytności filozofowie twierdzą, że sprawiedliwość jest podstawową cnotą społeczną. Stąd, aby dobrze i krytycznie myśleć i mówić o sprawiedliwości czy realizować sprawiedliwą politykę, należy skonfrontować swoje myślenie z refleksją filozoficzną. Oczywiście wśród filozofów nie ma i nie będzie zgody w odpowiedziach na pytanie: czym jest sprawiedliwość i jak stworzyć ustrój, w którym będzie ona funkcjonować w sposób odczuwalny dla wszystkich? Taka natura filozofii, że prawda odsłania się w sporze. We współczesnej filozofii polityki dominuje pięć stanowisk w kwestii sprawiedliwości: dwa liberalne, libertarianistyczne, komunitarystyczne i feministyczne. Moim celem jest prezentacja tych poglądów . (shrink)

Autorka porządkując sposoby rozumienia i opisywania tej dyscypliny dąży do umieszczenia filozofii polityki w całości myślenia filozoficznego (filozofia polityki jako metafizyka polityki, etyka polityczna czy refleksja metafizyczno-normatywna, filozofia polityki a filozofia społeczna), określenia jej przedmiotu (filozofia polityki sensu largo i sensu stricto) i problematyki (holizm – indywidualizm, elitaryzm – egalitaryzm, pesymizm – optymizm, racjonalizm – antyracjonalizm, monizm – pluralizm). Myśliciele polskiego romantyzmu, tworzący tzw. Filozofię czynu (A. Cieszkowski, B. Trentowski i J. M. Hoene-Wroński), powrócili de facto do koncepcji polityki wypracowanej już przez Arystotelesa, który sądził, że polityka jako część filozofii spełnia dwojakie funkcje: 1) poznawczą, gdy formułuje model doskonałego społeczeństwa, i 2) instrumentalną, gdy podaje wskazówki na temat działalności sprzyjającej utrzymaniu doskonałego ustroju. Myśliciele polscy uświadamiali sobie dobrze zarówno funkcję poznawczą i instrumentalną polityki. B. Trentowski sprecyzował te funkcje dobitnie. Funkcje poznawcze pełni filozofia polityki, która ustala cele (...) polityki. Natomiast funkcje instrumentalne polityki Trentowski rozszerzył i wzbogacił. Wyróżnił bowiem wiedzę o strategii politycznej, która ma określać metody, dzięki którym narody mogą się zbliżać do doskonałego ustroju, oraz cybernetykę jako sztukę politycznego sterowania masami i osiągania skutecznych zmian politycznych. Koncepcja cybernetyki jako umiejętności sterowania sprawami państwowymi stanowi ważny i oryginalny wkład polskiego romantyzmu do filozofii politycznej. (shrink)

The Last Gift is an observational HIV cure-related research study conducted with people with HIV at the end of life (EOL) at the University of California San Diego. Participants agree to voluntarily donate blood and other biospecimens while living and their bodies for a rapid research autopsy postmortem to better understand HIV reservoir dynamics throughout the entire body. The Last Gift study was initiated in 2017. Since then, 30 volunteers were enrolled who are either (1) terminally ill with a concomitant (...) condition and have a prognosis of 6 months or less or (2) chronically ill with multiple comorbidities and nearing the EOL.Multiple ethical and logistical challenges have been revealed during this time; here, we share our lessons learnt and ethical analysis. Issues relevant to healthcare research include surrogate informed consent, personal and professional boundaries, challenges posed conducting research in a pandemic, and clinician burnout and emotional support. Issues more specific to EOL and postmortem research include dual roles of clinical care and research teams, communication between research personnel and clinical teams, legally required versus rapid research autopsy, identification of next of kin/loved ones and issues of inclusion. Issues specific to the Last Gift include logistics of body donation and rapid research autopsy, and disposition of the body as a study benefit.We recommend EOL research teams to have clear provisions around surrogate informed consent, rotate personnel to maintain boundaries, limit direct contact with staff associated with clinical care and have a clear plan for legally required versus research autopsies, among other recommendations. The conflict between perfectionism and the neutrality of a liberal state is one of the burning issues of contemporary liberalism and political philosophy as a whole. The paper examines the roots of the perfectionist as well as neutralistic thinking, which are found in the philosophies of Immaneul Kant and John Rawls respectively. Through the reconsideration of the latter the character of the conflict can also be redefined. The aim of the paper is to show the basic difference between (...) the above mentioned conceptions, which in the long run appears to be an anthropological one. (shrink)

This book continues and revises the ideas of justice as fairness that John Rawls presented in _A Theory of Justice_ but changes its philosophical interpretation in a fundamental way. That previous work assumed what Rawls calls a "well-ordered society," one that is stable and relatively homogenous in its basic moral beliefs and in which there is broad agreement about what constitutes the good life. Yet in modern democratic society a plurality of incompatible and irreconcilable doctrines--religious, philosophical, and (...) moral--coexist within the framework of democratic institutions. Using the principles of John Rawls' theory of justice, this book offers an alternative political vision; one which describes a mode of governance that will enable communities to implement a sustainable and socially just future. Rawls described a theory of justice that not only describes the sort of society in which anyone would like to live but that any society can create a society based on just institutions. While philosophers have demonstrated that Rawls's theory can provide (...) a framework for the discussion of questions of environmental justice, the problem for many philosophical theories is that discussions of sustainable development open the need to address questions of ecological interdependence, historical inequality in past resource use and the recognition that we cannot afford to ignore the limitations of growth. These ideas do not fit in comfortably in standard discourse about theories of justice. In contrast, this book frames the discussion of global justice in terms of environmental sustainability. The author argues that these ideas can be used to develop a coherent political theory which reconciles cosmopolitan arguments and the non-cosmopolitan or nationalist arguments concerning social and environmental justice. On this occasion I wish to elaborate further the conception of distributive justice that I have already sketched elsewhere. This conception derives from the ideal of social justice implicit in the two principles proposed in the essay “Justice as Fairness.” These discussions need to be supplemented in at least two ways. For one thing, the two parts of the second principle are ambiguous: in each part a crucial phrase admits of two interpretations. The two principles read as follows: first, each (...) person is to have an equal right to the most extensive basic liberty compatible with a similar liberty for others; and second, social and economic inequalities are to be arranged so that they are both (a) reasonably expected to be to everyone's advantage, and (b) attached to positions and offices equally open to all. The two ambiguous phrases in the second principle are “everyone's advantage” in part (a) and “equally open to all” in part (b). I shall consider these ambiguities and the several interpretations of the two principles to which they give rise. I shall leave aside any difficulties with the first principle and assume that its sense is the same throughout and clear enough for our purposes. (shrink)

Philippe van Parijs (2003) has argued that an egalitarian ethos cannot be part of a post- Political Liberalism Rawlsian view of justice, because the demands of political justice are confined to principles for institutions of the basic structure alone. This paper argues, by contrast, that certain principles for individual conduct—including a principle requiring relatively advantaged individuals to sometimes make their economic choices with the aim of maximising the prospects of the least advantaged—are an integral part of a Rawlsian political conception (...) of justice. Bu kavramlarla beraber Rawls'un adalete bakış açısı teorik bir temele dayanır. Bu temel çerçevesinde oluşan adalet düşüncesi, bütün bireyler için geçerli bir düzen oluşturur. Düzen Rawls’un ortaya koyduğu belirleyiciler ve toplum içerisindeki bireyler tarafından oluşturur. Rawls bu anlamda adalete, toplum sözleşmesine benzer bir bakış açısıyla yaklaşmıştır.
