ABSTRACT Uncertainty as to how we should articulate empirical data and normative reasoning seems to underlie most difficulties regarding the ‘empirical turn’ in bioethics. This article examines three different ways in which we could understand ‘empirical turn’. Using real facts in normative reasoning is trivial and would not represent a ‘turn’. Becoming an empirical discipline through a shift to the social and neurosciences would be a turn away from normative thinking, which we should not take. Conducting empirical research to inform (...) normative reasoning is the usual meaning given to the term ‘empirical turn’. In this sense, however, the turn is incomplete. Bioethics has imported methodological tools from empirical disciplines, but too often it has not imported the standards to which researchers in these disciplines are held. Integrating empirical and normative approaches also represents true added difficulties. Addressing these issues from the standpoint of debates on the fact‐value distinction can cloud very real methodological concerns by displacing the debate to a level of abstraction where they need not be apparent. Ideally, empirical research in bioethics should meet standards for empirical and normative validity similar to those used in the source disciplines for these methods, and articulate these aspects clearly and appropriately. More modestly, criteria to ensure that none of these standards are completely left aside would improve the quality of empirical bioethics research and partly clear the air of critiques addressing its theoretical justification, when its rigour in the particularly difficult context of interdisciplinarity is what should be at stake. Bioethical research has tended to focus on theoretical discussion of the principles on which the analysis of ethical issues in biomedicine should be based. But this discussion often seems remote from biomedical practice where researchers and physicians confront ethical problems. On the other hand, published empirical research on the ethical reasoning of health care professionals offer only descriptions of how physicians and nurses actually reason ethically. The question remains whether these descriptions have any normative implications for nurses and physicians? In (...) this article, we illustrate an approach that integrates empirical research into the formulation of normative ethical principles using the moral-philosophical method of Wide Reflective Equilibrium (WRE). The research method discussed in this article was developed in connection with the project ‘Bioethics in Theory and Practice’. The purpose of this project is to investigate ethical reasoning in biomedical practice in Denmark empirically. In this article, we take the research method as our point of departure, but we exclusively discuss the theoretical framework of the method, not its empirical results. We argue that the descriptive phenomenological hermeneutical method developed by Lindseth and Norberg (2004) and Pedersen (1999) can be combined with the theory of WRE to arrive at a decision procedure and thus a foundation for the formulation of normative ethical principles. This could provide health care professionals and biomedical researchers with normative principles about how to analyse, reason and act in ethically difficult situations in their practice. We also show how to use existing bioethical principles as inspiration for interpreting the empirical findings of qualitative studies. An extension of intuitionism to empirical discourse, a project most seriously taken up by Dummett and Tennant, requires an empirical negation whose strength lies somewhere between classical negation (‘It is unwarranted that. . . ’) and intuitionistic negation (‘It is refutable that. . . ’). I put forward one plausible candidate that compares favorably to some others that have been propounded in the literature. A tableau calculus is presented and shown to be strongly complete.

Empires and nation-states are not opposed or distinct forms of polity but closely linked forms. Pre-modern empire existed without any contrasting form of polity we might call a nation-state. Rather, they contrasted with non-national state forms such as city-states, small kingdoms and mobile, nomadic polities. These in turn were in constant interaction with any neighbouring empire or empires, perhaps becoming the core of an empire themselves, perhaps taking over all or part of an existing empire, perhaps maintaining some autonomy by (...) virtue of remoteness or lack of attractiveness, perhaps by balancing opposed empires against each other. Empires did not have a national core, and non-empires were not national. By contrast, modern empires have always had a clearly designated nation-state core and a physically separate set of non-national peripheries. This has been crucial to ensuring that when formal empire is ended, both the imperial core and the former colonies are defined as nation-states. But ex-imperial nation-states and ex-colonial nation-states are really two kinds of states. Much contemporary confusion about the prospect for a world order of nation-states revolves round the failure to make that basic distinction. (shrink)

I show that extant attempts to capture and generalize empirical adequacy in terms of partial structures fail. Indeed, the motivations for the generalizations in the partial structures approach are better met by the generalizations via approximation sets developed in “Generalizing Empirical Adequacy I”. Approximation sets also generalize partial structures.

After the ‘empirical turn’ in bioethics, few specific approaches have been developed for doing clinical ethics research in close connection with clinical decision-making on a daily basis. In this paper we describe the ‘committed researcher’ approach to research in clinical ethics that we have developed over the years. After comparing it to two similar research methodological approaches, the ‘embedded researcher’ and ‘deliberative engagement’, we highlight its main features: it is patient-oriented, it is implemented by collegial and multidisciplinary teams, it uses (...) an ethical grid to build the interview guide, and it is geared towards bringing the results to bear on the public debate surrounding the issue at stake. Finally, we position our methodological approach with respect to the ‘is vs. ought’ distinction. We argue that our ‘commitment researcher’ approach to clinical ethics research takes concerned people’s life-building values as the main data, and compares them to the larger normative framework underlying the medical practice at stake. Empirical-ethical research constitutes a relatively new field which integrates socio-empirical research and normative analysis. As direct inferences from descriptive data to normative conclusions are problematic, an ethical framework is needed to determine the relevance of the empirical data for normative argument. While issues of normative-empirical collaboration and questions of empirical methodology have been widely discussed in the literature, the normative methodology of empirical-ethical research has seldom been addressed. In this article, Emil Sætra examines how teachers and students construct and experience aims and goods in classroom discussions of controversial issues. This study is situated within the emerging tradition of empirical ethics, and the research strategy comprised two main steps. First, Sætra used interview data to analyze, via the experiences of teachers and students, the following two empirical questions: (1) What goods normatively constitute educative discussions of controversial issues? (2) How are these goods constructed in time and space? Second, (...) in the concluding discussion, Sætra makes explicit some normative implications of the empirical findings and discusses theses in relation to previous research. In brief, what emerges from the conjoined experiences of teachers and students is the notion that practice comprises multiple aims and drives. Moreover, because aims and drives are multiple, decisions regarding priorities will sometimes have to be made, and teachers may be subject to conflicting expectations. This means that practitioners must be able to make reflective judgments about what comprises acceptable ends, what projects should be undertaken to achieve those ends, and what actions ought to be performed as part of those projects. Empirical research can aid ethical reflection in bioethics by identifying issues, by seeing how they are currently resolved, and by assessing the consequences of these current resolutions. This potential can be misused when the ethical issues in question are fundamentally non-consequentialist or when they are consequentialist but the empirical research fails to address the important consequences. An example of the former problem is some recent studies about bad consequences resulting from commercialized living kidney donor programs. These consequences could be avoided, (...) but the crucial non-consequentialist ethical issues about exploitation and commercialization would still remain. Examples of the latter problem are provided by recent studies of the allocation of ICU beds and of physician deception, where important consequences were not adequately studied. (shrink)

Whether empirical givenness has the reliability that foundationalists expect is a point about which some philosophers are highly skeptical. Sellars took the doctrine of givenness as a “myth,” denying the existence of immediate perceptual experience. The arguments in contemporary Western epistemology are concentrated on whether sensory experience has conceptual contents, and whether there is any logical relationship between perceptions and beliefs. In fact, once the elements of words and conceptions in empirical perception are affirmed, the logical relationship between perceptual experience (...) and empirical belief is also affirmed. This relationship takes place through perceptual experience acting as evidence for beliefs. The real problem lies in how one should distinguish between the different relationships with perception of singular beliefs and of universal beliefs, and in how singular beliefs can provide justification for universal beliefs. Situationists contend that virtue ethics is empirically inadequate. However, it is my contention that there is much confusion over what “empirical adequacy” or “empirical inadequacy” actually means in this context. My aim in this paper is to clarify the meanings of empirical adequacy in order to see to what extent virtue ethics might fail to meet this standard. I argue that the situationists frequently misconstrue the empirical commitments of virtue ethics. More importantly, depending on what we mean by empirical adequacy, (...) either virtue ethics has no need to be empirically adequate or where it does have such a need, the psychological evidence fails to show that it is empirically inadequate. What is the status of empirical contributions to bioethics, especially to clinical bioethics? Where is the empirical approach discussed in bioethics related to the ongoing debate about principlism versus casuistry? Can we consider an integrative model of research in medical ethics and which empirical methodology could then be valuable, the quantitative or the qualitative? These issues will be addressed in the first, theoretical part of the paper. The concept of the “embedded researcher” presented in this article was stimulated by the (...) two questions, (1) how can we safeguard that our research will yield valid and meaningful results to practice? and (2), how can we convince clinical colleagues that medical ethics offers relevant contributions to the analysis and solution of problems? One tentative answer has been our effort to elaborate a coherent methodological research approach in the field of end-of-life issues integrating qualitative and quantitative as well as casuistic methodologies. This development is characterized in the second part describing the ECOPE Study (short title)“Ethical Conditions Of Passive Euthanasia.” The achievements and limitations of the suggested approach of the “embedded researcher” are discussed referring to 3 examples of our joint studies about ethical issues concerning(1) critical decision-making in neonatology(2) limitation of treatment in intensive care(3) problems with doctor-patient conversation at the end of life in oncologyConclusions from our studies are put to discussion in the final part of the paper about how to further develop research in the field of end-of-life care and, maybe,clinical bioethics as a whole. Despite the burgeoning of publications in nursing ethics, only more recently has empirical evidence on nursing ethics been published. How nursing ethics can be empirically studied as well as enriched by empirical data will be the focus of this paper. Two empirical studies will be briefly presented and their contribution to ethics discussed. The first one is a quantitative research project about nurses' ethical behavior in daily practice. Using an adapted version of Kohlberg's theory of moral development, this study tried (...) to describe and explore nurses' responses to ethical dilemmas in daily nursing practice. The second study attempted to describe the specificity of residential palliative care. A qualitative approach was used to explore and describe the processes that take place on an inpatient palliative care unit, and the experiences of patients, relatives and palliative care team members. The analysis of the value of both research projects for ethics underlines the power of empirical understanding in the relationship between research and ethics. The need for integration of both qualitative and quantitative research methodologies is argued. (shrink)

A proposed empirical criterion for task susceptibility to introspective awareness distinguishes cognitive processes of which one cannot be aware from those of which one can be aware. The empirical criterion for task susceptibility to awareness effects proposes that there are tasks which cannot be affected by awareness of the rules constituting the tasks. These criteria were applied to research programmes in rule-learning in which past studies in the area of learning without awareness were included as well as current research in (...) implicit learning. The principal question addressed in these studies is whether or not rule-learning can occur without awareness. An historical review showed that rule-learning occurred in tasks which were both susceptible and insusceptible to introspective awareness and to awareness effects. Accordingly, it has been proposed that rather than attempt to decide theoretically and empirically between the opposing hypotheses—that of “cognitive learning” on the one hand, which assumes that awareness is a necessary condition for rule-learning, and that of “automatic learning” on the other, which assumes direct, automatic and unconscious processes—efforts should rather be directed toward developing a theoretical approach which is based on both conscious and unconscious processes. However, an approach of this kind encounters severe problems, such as the generation of contradictory predictions, which result from the employment of several incongruent and irreconcilable models of explanation. Psychiatry presents a unique array of difficult ethical questions. However, a major challenge is to approach psychiatry in a way that does justice to the real ethical issues. Recently there has been a growing body of research in empirical psychiatric ethics, and an increased interest in how empirical and philosophical methods can be combined. It is often thought that epistemic relations between experience and belief make it possible for our beliefs to be about or "directed towards" the empirical world. I focus on an influential attempt by John McDowell to defend a view along these lines. According to McDowell, unless experiences are the sorts of things that can be our reasons for holding beliefs, our beliefs would not be "answerable" to the facts they purportedly represent, and so would lack all empirical content. I argue (...) that there is no intelligible conception of what it is for beliefs to be answerable to the facts that supports McDowell's claim that our empirical beliefs must be justified by experience. Empirical research in education needs to be revitalised. However, there are some misunderstandings to solve: I) experts must refrain from expropriating the teachers from any possibility of voicing about scientific research that matters; II) considering scientific evidence as incontrovertible fact is erroneous; III) believing that the only research worth being conducted at school is that that delivers certainty and political/ethical impartiality is the last misconception. A couple of obstacles to counter these misunderstandings subsists: I) the teacher training, which does not (...) equip teachers to comprehend and conduct scientific research; II) the practices of accountability of scientific production in academic institutions pushing researchers to publish low-quality/interest studies. In this context, Citizen Science (involvement of non-researchers in interactions with researchers as equals) can be a promising resolving direction. (shrink)

Empirical agreement is often used as an important criterion when assessing the validity of scientific models. However, it is by no means a sufficient criterion as a model can be so adjusted as to fit available data even though it is based on hypotheses whose plausibility is known to be questionable. Our aim in this paper is to investigate into the uses of empirical agreement within the process of model validation.

Based on a theoretical exploration in a previous article, this paper empirically analyzes which issues of SD are taken into account by corporations and stakeholders in what way, and to what extent the concept of sustainable development (SD) can be achieved through stakeholder relations management (SRM) on the corporate level. An important basis for this empirical analysis is a referential framework, which specifies 14 issues of SD. In a first empirical step, the literature-based framework has been operationalized for the business (...) world by analyzing sustainability reports. In a second empirical step, the operationalized framework served as the basis for a survey of selected MNCs. The analyses of the sustainability reports and the survey show how MNCs deal with particular issues of SD and what role they perceive particular stakeholders play. A key conclusion of the article is that SRM indeed promotes SD, but that it is no alternative to predictable government regulation. (shrink)

The problem of fair machine learning has drawn much attention over the last few years and the bulk of offered solutions are, in principle, empirical. However, algorithmic fairness also raises important conceptual issues that would fail to be addressed if one relies entirely on empirical considerations. Herein, I will argue that the current debate has developed an empirical framework that has brought important contributions to the development of algorithmic decision-making, such as new techniques to discover and prevent discrimination, additional assessment (...) criteria, and analyses of the interaction between fairness and predictive accuracy. However, the same framework has also suggested higher-order issues regarding the translation of fairness into metrics and quantifiable trade-offs. Although the tools which have been developed so far are essential to address discrimination encoded in data and algorithms, their integration into society elicits key questions such as: What kind of assumptions and decisions underlies the empirical framework? How do the results of the empirical approach penetrate public debate? What kind of reflection and deliberation should stakeholders have over available fairness metrics? I will outline the empirical approach to fair machine learning, i.e. how the problem is framed and addressed, and suggest that there are important non-empirical issues that should be tackled. While this work will focus on the problem of algorithmic fairness, the lesson can extend to other conceptual problems in the analysis of algorithmic decision-making such as privacy and explainability. This paper investigates the relationship between reality and model, information and truth. It will argue that meaningful data need not be true in order to constitute information. Information to which truth-value cannot be ascribed, partially true information or even false information can lead to an interesting outcome such as technological innovation or scientific breakthrough. In the research process, during the transition between two theoretical frameworks, there is a dynamic mixture of old and new concepts in which truth is not well (...) defined. Instead of veridicity, correctness of a model and its appropriateness within a context are commonly required. Despite empirical models being in general only truthlike, they are nevertheless capable of producing results from which conclusions can be drawn and adequate decisions made. (shrink)

In order to judge whether a theory is empirically adequate one must have epistemic access to reliable records of past measurement results that can be compared against the predictions of the theory. Some formulations of quantum mechanics fail to satisfy this condition. The standard theory without the collapse postulate is an example. Bell's reading of Everett's relative-state formulation is another. Furthermore, there are formulations of quantum mechanics that only satisfy this condition for a special class of observers, formulations whose empirical (...) adequacy could only be judged by an observer who records her measurement results in a special way. Bohm's theory is an example. It is possible to formulate hidden-variable theories that do not suffer from such a restriction, but these encounter other problems. (shrink)

Academic publications of empirical public health research often entail recommendations for moral action that address practitioners and policy makers. These recommendations are regularly based on implicit moral judgments with the underlying reasons not explicitly stated. In this paper, we elaborate on the moral relevance of such judgments and the need to explain them in order to account for academic argumentation. We argue for an explicit reporting of bridge principles to increase the transparency of the reporting of public health research. The (...) reporting of bridge principles can inform readers, support them in understanding the relationship between empirical and normative claims in a specific paper, and may pave new ways for the rigorous reporting of empirical research that has moral implications. Most philosophers assume that ‘ought’ implies ‘can’, and most of them hold that this principle is true not only universally but also analytically or conceptually. Some skeptics deny this principle, although they often admit some related one. In this article, we show how new empirical evidence bolsters the skeptics’ arguments. We then defend the skeptical view against some objections to the empirical evidence and to its effect on the traditional principle. In light of the new evidence, we conclude that philosophers (...) should stop unconditionally assuming that ‘ought’ implies ‘can’. (shrink)

The empirical turn in bioethics has been widely discussed by philosophical medical ethicists and social scientists. The focus of this discussion has been almost exclusively on methodological issues in research, on the admissibility of empirical evidence in rational argument, and on the possible superiority of empirical methods for permitting democratic lay involvement in decision-making. In this paper I consider how the collection of qualitative and quantitative social research evidence plays its part in the construction of social order, and how this (...) creates certain paradoxes for the normative ideal of a public bioethics. The analysis in this paper is based on Foucauldian ideas, and on recent work in the history of the human sciences. Nonetheless, it may not go far enough toward explicating what is and what is not the problem. The popular understanding of increasing political polarization does not distinguish adequately between various meanings of this claim, distinctions that might have helped to advance Vallier’s theory. This study presents an empirical investigation of the ethical perceptions of the future managers - Turkish university students majoring in the Business Administration and Industrial Engineering departments of selected public and private Turkish universities - with a special emphasis on gender. The perceptions of the university students pertaining to the business world, the behaviors of employees, and the factors leading to unethical behavior are analyzed. The statistically significant differences reveal that female students have more ethical perceptions about the Turkish business (...) climate, behavior of employees, and the ethicalness of the behavior of the employees in comparison with their male counterparts. In the present inquiry, I provide a systematic exposition of empirical conceptual analysis, so understood, considering what exactly empirical conceptual analysis is, the different kinds of empirical conceptual analysis, and the main application of the method within philosophy. It can be defined (...) as a method that consists in drawing a conclusion about the semantic application conditions of a predicate on the basis of observation of the manifestations of semantic intuitions. The different kinds of empirical conceptual analysis are distinguished according to the way the manifestations of semantic intuitions are observed. The main application of the method is solving conceptual disputes – situations in which different competent speakers of a language disagree about the semantic application conditions of a predicate from that language, and their disagreement is caused by the fact that they have different semantic intuitions about that predicate. Despite the so-called ‘paradigm wars’ in many social sciences disciplines in recent decades, debate as to the appropriate philosophical basis for research in business ethics has been comparatively non-existent. Any consideration of paradigm issues in the theoretical business ethics literature is rare and only very occasional references to relevant issues have been made in the empirical journal literature. This is very much the case in the growing fields of cross-cultural business ethics and undergraduate student attitudes, and examples from these fields (...) are used in this article. No typology of the major paradigms available for, or relied upon in, business ethics has been undertaken in the wider journal literature, and this article addresses that gap. It contributes a synthesis of three models of paradigms and a tabulated comparison of ontological, epistemological and methodological assumptions in the context of empirical business ethics research. The author also suggests the likely (and usually unidentified) positivist paradigm assumptions underlying the vast majority of empirical business ethics research published in academic journals and also argues for an increased reliance on less positivist assumptions moving forward. In this article we distinguish between philosophical bioethics (PB), descriptive policy orientated bioethics (DPOB) and normative policy oriented bioethics (NPOB). We argue that finding an appropriate methodology for combining empirical data and moral theory depends on what the aims of the research endeavour are, and that, for the most part, this combination is only required for NPOB. After briefly discussing the debate around the is/ought problem, and suggesting that both sides of this debate are misunderstanding one another (i.e. one side (...) treats it as a conceptual problem, whilst the other treats it as an empirical claim), we outline and defend a methodological approach to NPOB based on work we have carried out on a project exploring the normative foundations of paternal rights and responsibilities. We suggest that given the prominent role already played by moral intuition in moral theory, one appropriate way to integrate empirical data and philosophical bioethics is to utilize empirically gathered lay intuition as the foundation for ethical reasoning in NPOB. The method we propose involves a modification of a long-established tradition on non-intervention in qualitative data gathering, combined with a form of reflective equilibrium where the demands of theory and data are given equal weight and a pragmatic compromise reached. The transition from empire to nation-state poses challenges in managing religious and ethnic pluralism. Empires, characterized by hierarchical structures and diversity, contrast with nation-states, which aim for uniformity and unity. As empires modernize administratively, they grapple with different approaches to pluralism. While Habsburgs were more in favor of a federal plurality, the Romanovs pushed for centralization and assimilation. Throughout the nineteenth century, the Ottomans vacillated between these two alternative paths. This vacillation is most evident in their approach to millet system (...) which simultaneously followed the contradictory policies of undermining millet boundaries in order to promote a sense of unity across the multi-faith society and policies of promoting and safeguarding the privileges and group-specific rights of non-Muslim communities. Ottoman nationalism eventually shifted towards a homogenizing model, akin to the Romanov approach, leading to the exclusion of religious minorities. This process of homogenization continued in the nationalist policies of modern Turkey and resulted in the secular Turkish Republic being less tolerant towards non-Muslims than the Islamic Ottoman Empire. The actual rise of empirical contributions in bioethics questions – at a fundamental level – the place bioethics will reserve for empirical approaches in its field. This article aims to discuss the relationship between empirical research and normative evaluations and to apply this to the use of the concept of dignity in end-of-life research.It describes five possible ways in which empirical research can be related to normative ethics: prescriptive applied ethics, theorist ethics, critical applied ethics, particularist ethics and integrated empirical (...) ethics. In this article, we elaborate on the critical applied ethics perspective and present it as a five stage process comprising a) the determination of the problem, b) the description of the problem, c) the study of effects and alternatives, d) normative weighing and e) the evaluation of the effects of a decision. At each stage, we explore the perspective from both the empirical and the normative poles and apply it to the case of dignity in end-of-life decisions. (shrink)

The essay is a response to the papers written by Nancy Frankenberry and Charley Hardwick in the March 1987 issue of Zygon. Questions are raised about whether Wieman's theology is functionalist in the way described by Frankenberry and whether Hardwick's proposal to establish the logical possibility of naturalism as a framework for an existential interpretation of the Christian message is satisfactory. The substantial work on cognitive moral development (CMD) by Lawrence Kohlberg and James Rest popularized the use of this construct in the literature on business ethics. This construct has been prominently used in models attempting to explain ethical/unethical behavior in management, marketing, and accounting, even though Kohlberg did not intend for the construct to be used in that manner. As a predictor of behavior, CMD has been attacked on the theoretical level, and its empirical performance has been weak. This article (...) uses another established construct, which seems to satisfy the central criticisms of CMD, as a means of testing those complaints. The comparative multidimensional ethics scale (MES) substantially outperforms CMD, operationalized using Rest’s Defining Issues Test, in every test. These results seem to suggest that other options perform better than CMD when the purpose is to model ethical/unethical behavior or even ethical judgment. (shrink)
