Under the UDHR, all persons have the right to "seek and to enjoy . . . asylum from persecution." From this designation as fundamental followed codification of the right in the 1951 Convention relating to the Status of Refugees and the 1967 Protocol Relating (collectively 'the Convention'), the "centrepiece" of treaties and customary norms that make up international refugee law. It defines and regulates the status and rights of refugees; its purpose is to safeguard the basic rights of persons "outside (...) their country of origin," who have fled due to a legitimate fear of persecution. Fundamentally, it guarantees that asylees and refugees enjoy rights without discrimination; without penalization for illegal territorial entry; and, without expulsion or return to "territories where . . . life or freedom would be threatened on account of . . . race, religion, nationality, membership of a particular social group or political opinion," —or 'non-refoulement'. What follows is background on development of the principle of non-refoulement, evasive US Asylum Cooperative Agreements ('ACAs') and implementing legislation, and the resulting erosion to the right to asylum. An increase in global violence has forced the displacement of more than 70 million people, including 26 million refugees and 3.5 asylum seekers. Refugees and asylum seekers face serious socioeconomic and healthcare barriers and are therefore particularly vulnerable to physical and mental health risks, which are sometimes exacerbated by immigration policies and local social discriminations. Calls for a strong evidence base for humanitarian action have encouraged conducting research to address the barriers and needs of refugees and asylum seekers. Given the (...) role of epigenetics factors to mediate the effect of psychological and environmental exposures, epigenetic modifications have been used as biomarkers for life adversity and disease states. Therefore, epigenetic research can be potentially beneficial to address some of the issues associated with refugees and asylum seekers. Here, we review the value of previous and ongoing epigenetic studies with traumatized populations, explore some of the ethical challenges associated with epigenetic research with refugees and asylees and offer suggestions to address or mitigate some of these challenges. Researchers have an ethical responsibility to implement strategies to minimize the harms and maximize the short and long-term benefits to refugee and asylee participants. (shrink)

The claims of those who are compelled to migrate are, in general, taken to be more urgent and pressing than the claims of those who were not forced to do so. This article does not defend the moral relevance of voluntarism to the morality of migration, but instead seeks to demonstrate two complexities that must be included in any plausible account of that moral relevance. The first is that the decision to start the migration journey is distinct from the decision (...) to stop that journey, through resettlement; the latter may involve voluntary choice, without that voluntarism impugning the involuntary nature of the former. The second is that the migration decision of the individual might be voluntary, even while that individual's family or social network might be compelled to insist upon some particular individual member's migration. That is, the fact that any particular person might be free to refuse migration does not contradict the fact that the group in question does not have the effective freedom to avoid the migration of some group members. Once these two complexities are understood, I argue, the moral relevance of voluntarism in the ethics of migration becomes more complex and nuanced than is generally understood. (shrink)

In the following paper, Annemiek Richters of the University of Leiden in the Netherlands addresses the dilemmas faced by health professionals who are asked to evaluate and provide supporting documentation for those refugees who seek political asylum in the countries of Europe. It is in the politically charged arena of asylum applications, government regulations, and public policy where bioethics, human rights, and health converge. Despite the 1951 Convention on Refugees, a treaty signed by nations around the world to safeguard the (...) rights of those who are displaced, and other treaties that protect the rights of vulnerable populations, refugee and asylum policies have become increasingly strict in an effort to deter those who would seek safety. This tightening of borders in the countries of the West challenges physicians who find themselves caught between obligations to treat, to advocate, and to challenge policies that make treatment a potentially dangerous proposition. Unfortunately, the World Trade Center attacks have exacerbated the problem by labeling asylees and refugees as potential terrorists and subject to deportation. (shrink)

Resumen. La congregación fundada por Vicente de Paúl y Luisa de Marillac ha estado ligada al cuidado y, por su formación y método de trabajo, pueden ser consideradas como pioneras de los cuidados de enfermería, ya que su objetivo ha sido y es cubrir las necesidades básicas de la persona, teoría que postularía en 1960 Virginia Henderson. En este trabajo se pretende dar a conocer cómo las Hijas de la Caridad han estado ligadas al cuidado de la salud desde sus (...) inicios y la labor socio sanitaria que durante casi 150 años lleva prestando en Zaragoza la Casa de Amparo. Desde su inauguración el 5 de marzo de 1871, y gracias al apoyo económico del Ayuntamiento de Zaragoza, esta Institución proporciona asilo y cuidados a toda persona mayor que carece de recursos necesarios. Desde el primer momento se encargaron de ello las Hijas de la Caridad que, sin apenas recursos ni conocimientos, cuidaron de los asilados. Con el paso del tiempo, estos cuidados han ido evolucionando y profesionalizándose hasta que, en la actualidad, están siendo procurados por personal sanitario especializado; a pesar de ello, las hermanas siguen presentes en la vida de la residencia prestando su ayuda aquellos que lo necesitan. The congregation founded by Vicente de Paul and Luisa de Marillac has been linked to care and, because of their training and working method, they can be considered as pioneers of nursing care, since their objective has been and is to cover the basic needs of the person, a theory that Virginia Henderson would postulate in 1960. This paper aims to make known how the daughters of charity have been linked to health care since its inception and the social and health work that the Casa de Amparo has been providing in Zaragoza for almost 150 years. Since its inauguration on March 5, 1871, and thanks to the economic support of the City Council of Zaragoza, this Institution provides asylum and care for all older people who lack the necessary resources. From the first moment the daughters of the charity took care of it, who, without scarce resources or knowledge, took care of the asylees. With the passage of time, these cares have been evolving and professionalizing until, at present, they are being procured by specialized health personnel; In spite of this, the sisters are still present in the life of the residence, helping those who need it.
