Abstract

本书主要通过比较分析和历史分析的方法,通过对当今世界代表大陆法系的德国和代表英美法系的美国的证据收集制度的全面研究,以及对站在美国和德国中间点的日本的证据收集制度的研究等,为中国的证据收集制度寻找有益的借鉴.同时,本书在研究中国特有的国情和文化的基础上,试图找到一个适合中国特色的证据收集制度,以保障案件事实的发现,促进司法正义的实现.
