Abstract

This paper addresses the controversy between “thin” (i.e. formal and procedural) and “thick” (i.e. substantive) conceptions of the rule of law. It considers the difficulty in specifying which substantive values and principles to incorporate into our understanding of the rule of law if we want a substantive conception. It considers various strategies for organizing this selection and warns against some of them.
