Indigenous cultural protocols as legal obligations in filmmaking

Abstract

Indigenous cultural protocols are now being enforced as contractual requirements in Australian film funding agreements. These cultural protocols oblige filmmakers to consult with Indigenous communities and custodians, to licence the use of cultural property and to respect local Indigenous customs. By enforcement through contract, Indigenous cultural protocols can bridge gaps between the Australian legal system and laws governing use of Indigenous cultural and intellectual property (ICIP).
